A very common question that comes up about the DV lottery is about the requirement to prove you will not become a public charge (i.e. be in need of financial assistance from the government). Many people have a hard time accepting that is even a requirement. Well it is. For sure. Everywhere, for everyone. Got that? OK – let me explain…
For DV lottery there is a set of rules that frequently refer to the Immigration and Nationality Act. Essentially the DV lottery is operated within a framework of immigration law and there are standard aspects of the laws that apply to all immigration cases. The public charge requirement is one such example. The instructions for the DV lottery include information about this in their FAQ (Question 37 in DV2015 and DV2016 instructions). The notes say:-
37. If I receive a visa through the DV program, will the U.S. government pay for my airfare to the United States, help me find housing and employment, and/or provide healthcare or any subsidies until I am fully settled?
No. The U.S. government will not provide any of these services to you if you receive a visa through the DV program. If you are selected to apply for a DV, you will need to demonstrate that you will not become a public charge in the United States before being issued a visa. This evidence may be in the form of a combination of your personal assets, an Affidavit of Support (Form I-134) submitted by a relative or friend residing in the United States, an offer of employment from an employer in the United States, or other evidence.
OK, so it is required. OK???
So how do you prove that you will not become a public charge. The simplest way is to demonstrate that you have enough money/assets to support yourself. This can be in various ways, for example:-
- Bank/other financial statements
- Real Estate/Property
- Stocks/Bonds
- Income from business investments
The CO will be far more interested in “liquid” assets (such as savings in a bank account) than other non liquid assets.
If you intend to show the above you will need to show around $10,000 for each adult, and a bit less for children (for example $25,000 for a family of four, $10,000 for a single person). This can be from a combination of the above.
If you cannot show that level of personal finance a job offer can help, and of course someone already working in the USA on a temporary visa can show existing salary (payslips, tax records, job confirmation letters and so on).
If the selectee cannot provide the above, they may be advised obtaining an “affidavit of support” from a family member or friend already in the USA. The affidavit of support should be in the form of the I-134 which must be filled out by a US legal resident and supported by tax filing records, payslips and so on. The instructions for the I-134 are clear and helpful.
The selectee only needs to provide one I-134 to cover their case (it covers the principal and all derivatives). The income of the person filling out the I-134 should be greater than that shown on the Federal Poverty Guidelines for total number of family members for the sponsor/family AND the selectee/derivatives.
The original (or now scanned/emailed) signed I-134 plus supporting documents is presented by the selectee at the interview IF requested. Not all embassies request it as a matter of course, and some hardly ever request it. However, not providing it if requested can lead to AP/disqualification.
Supporting documents for the I-134 are the sponsors:
- 1040 (annual tax report – most recent copy)
- W2 (annual employee earnings statement if employed – most recent copy)
- Recent Payslips
- Photo ID
The I-134 should be sent to you prior to the interview by mail or scanned and the supporting documents can be photocopies or sent by email.
There are several African countries where the “host” system serves to satisfy the requirements. If the selectee is planning to stay with a host, they could be asked what is the relationship between host and selectee. If there is a good relationship (family, or close friend) the Consular Officer is allowed to use their discretion to take that as evidence that the selectee will not become a public charge.

I did my interview successfully on May 2, 2016 and I was instructed to send medical for my newly born baby. I sent it on May 6, 2016 and still I am on AP. I want to know why such a delay may happen. Does it take more time to process the case or what is the problem ?

The delay is because you did not follow instructions. If you had the medical available at the interview (as per instructions) you would not be delayed. Now you have to wait – I can’t say how long.

The problem I didn’t bring my baby’s medical at the interview was the baby’s name was not listed on 2nd NL and I asked the recommended physicians to do the medical along our medical documents but they were not okay unless it is written on the 2nd NL. That was why I didn’t take at the interview time. The Physicians need a formal letter from the embassy to do medical ; so I did as per the instruction and still I am on AP.

You should have presented the doctor with the DS260s and a CEAC printout, or approached the embassy before the interview for the letter. Now you simply have to wait. Hopefully it won’t be too long.

It’s a form. It should be filled out with answers to the questions. Just that.
It should be given to you to present at the interview, along with supporting documents.
It does NOT need to be notarized.

Hi Simon, thank you for this blog! Luckily enough I was selected into dv2016 and am about to have my interview in August. Now I have a question- do I need to bring bank statement to the interview? On the official website I didn’t see it on the list. I obtained part time h1b earlier this year and I still haven’t saved enough money yet. Is pay stubs and h1b approval letter enough for the interview? Or I should bring bank statement along with me just to be safe? Can that be in my country’s currency? ( I will be having interview in Taipei, Taiwan. So I’m wondering if I need US bank statement or I can bring my Taiwan bank statement so I don’t waste the fare transferring into my US account.)

It is “normal” to present local bank statements. Please read the article above about proof of financial support. I would recommend an I-134 for anyone interviewing in the final months of the year, because you don’t have time to risk AP for missing documents.

I and my wife had interview at the U.S. Embassy.The American consular officer request from me to provide the following documents by mail (combined) within 4 days, before end of July :
1- My passport and my wife’s passport
2- An original, signed I-134 from a sponsor, as well as the sponsor’s 2015 and 2014 tax returns.
In the end of first week of August, I sent those passports by mail. But the I-134 and sponsor’s 2015 and 2014 tax return was mailed by sponsor, my father’s friend from my hometown, from U.S.A to visa unit American embassy also by mail. (Sponsor mailed only I-134 and Tax return as embassy requested)
They are delivered to U.S embassy at same day.
I have checked my visa status at CEAC, it is Ready. This is the message
“Your case is ready for your interview when scheduled at the U.S. Consular section”.

I had interview at u.s embassy. Every thing was ok. But CO requested I-134 which I did not have, because I had not known about it. I have been found ineligible to receive a visa under section 221(g). The CO requested I-134 as well as tax return plus my passport. My friend told my that section 221(g) is a visa killer.

I would like to know,

As I knew that US embassy in Myanmar so many DV winners went interview but there is no need to provide “affidavit of support”.

Providing Affidavit of support is not a compulsory as long as you meet the requirement of bank statement they ask you to provide. However, it is safe to have backup and nothing wrong to be over prepared. Providing it or not is your choice.

I cannot say with certainty. The properties cannot count and I don’t know whether you have enough cash. You should be able to prove account balances of at least $10,000 per adult.

Most documents are listed in their instructions. The I-134 is not listed specifically, because there are other ways to overcome public charge concerns (Savings, genuine job offer etc).

I’m an OC selectee, but have an interview coming up in London. I have a US friend who has signed an I-134 for me, but I don’t have his official tax return to prove his income. What I do have from him is several W-2’s (Wage and Tax Statements) which when put together, equate to sufficient income. Do you know if these documents will suffice as proof of his income?
Also, I’m using a very clear photo (but not scan) of his passport as proof of his US citizenship. Will a clear photo suffice?

I checked historical visa bulletin and it looks that I will be interviewed in spring 2017 or in early summer. 1) Is that correct? Is my number safe enough?
2) I have a question about i-34 letter of affidavit. How much does a person needs to receive per month in order to be qualified to be a sponsor?
I checked the link about the federal poverty guidelines that you provided (https://aspe.hhs.gov/poverty-guidelines), but still it was not clear for me. For instance, it was listed there that per one person needs to have $11,880, add $4,160 for each additional person. Does it mean that the income per month shall be like that? Or a person shall have that amount on the bank account? I know it shall not be the latter because I read that you were advising some people that they shall not ask from their sponsors bank statments, only tax records (1040/W2), payslips and photo ID.
3) So I have a friend (my best friend’s younger sister) who moved to the USA by winning a green card 5 years ago. She delivered a baby half a year ago and is on maternity leave till December 2016. She works in Netflix and still receives her salary (does Netflix considered to be a good place to work in the USA). I would like to ask her to send me i-34. There are 3 people in her family now- she, her new born baby and her husband. Do you think it will be alright? In fact, her sister is my best friend, but she got her assylum and she is divorcing with her husband now. Thats why I did not want to put my best friend’s address in DS-260 (where green card will be mailed in the USA) so I put her younger sister’s address in order to avoid questions from consul during visa interview (not sure if it will make my case week if i put a person to whom I will be arriving in the USA with assylum status, but she already got residence and legal status). So I put in the form her sister. But now I am thinking to ask both my best friend and her sister to send me i-34 forms. Do you think a person with assylum will look okey to be a sponsor? And a person with a baby and a husband be suitable to be my sponsor?
4) I have an American Host Family in the USA. Shall I may be ask them to provide me with i-34? I am just hesitant to do so because I am afraid they will not provide me with full information. I think they try not to show their full income. Last time when I intended to visit them, they sent their bank statement to me to show to the consul at the embassy. The balance was not so big, but I know that both my host mother and host father have well-paid jobs and they are considered as a family with good income in the USA.
5) I was refused in my visa to the USA 3 times. Will it influence my case in obtaining a green card?
I was in the USA twice (once as an exchange student for 9 months and second time for a summer for work and travel program). I always returned on time, I never violated visa regime.
After graduation from University I applied to the USA embassy 3 times, but got refusal each time (first time I applied in order to visit my host family, 2nd time to study in MBA program- I was already enrolled in the USA University, 3rd time I wanted to go to my friend’s wedding- the one that I have mentioned above, but got refused- each time I received

Many thanks for the enormous support. My sponsor has sent the I-134 form with the all the necessary supporting documents. We did however observe that the sponsor has in July sponsored an application which is stated on the form. The sponsor’s income is above $80,000. He has only one dependant. We are family of four applying. Our concern is will the sponsor’s recent sponsorship in July have any implication on our application?
