Please! I need your opinion on a police clearance certificate (pcc) issue that I am a little unsettled about:
2019 DV family of 5 with our case current and an interview scheduled at the Johannesburg Consulate at the end of November 2018. 3 weeks from now!
On travel.state.gov under diversity visa it specifically says: any previous countries of residence, if you resided there for more than 12 months and you were over the age of 16, you need a police clearance certificate. (6 months if you are a citizen of that country). This is very clear cut.
My understanding of this as follows, if you previously resided in a country for more than 6 months and you are a citizen of that country you need a pcc. If you previously resided in a country for more than 12 months and you are not a citizen of that country you need a pcc. Not a citizen and less than 12 months? No need for a pcc.
However, on some of the US Consulate of Johannesburg’s documentation, they have the following wording:
(you need) Police certificate(s) for any country applicants age 16 or over have resided in for six or more months. Non-South African applicants must check the reciprocity information at travel.state.gov
This is different to the requirements on travel.state.gov! I have previously stayed in Qatar and the UK each for about 7-8 months for work so this difference is very important to me.
Two months ago I sent an email to the Johannesburg consulate and asked: if I am not a citizen of a country and I resided in that country for less than 12 months, do I need a pcc for that country? They replied to me via email with a simple answer: NO
Based on this personal feedback from the consulate I decided not to get pcc’s from Qatar and the UK.
Yesterday I received an email from the Johannesburg consulate with an attached word document stating what I need to bring to to the interview. Again, it had the following wording regarding pcc’s:
Police certificate(s) for any country applicants age 16 or over have resided in for six or more months. Non-South African applicants must check the reciprocity information at travel.state.gov
This is very unsettling and now it is far too late for me to get the two pcc’s from Qatar and UK. Interview is in three weeks!
I plan to go to the interview with printouts of the travel.state.gov table for pcc requirements as well as the email they sent me, saying no to the less than 12 months question.
Do you think I will be OK, or should I spend big money to try and get the other two pcc’s before the interview. It will cost me >$1000 and I doubt that I will get the Qatar pcc in 3 weeks time.
Do some countries’ consulates deviate from the requirements on travel.state.gov or does all questions get referred back to travel.state.gov?

JHB consulate answered you already. If the CO is not satisfied you only stayed in those countries for 7 or 8 months they may ask you for additional docs. No need for all the stress.

When I read this note about affidavit of support, it implies that if you have sufficient resources you do not need to fill in the I-134. In a previous reply you seem to have stated the contrary.

We are filling our CEAC processing for our F3 visa, my wife 10 years ago (then my girlfriend) was going in and out of my country of residence for a period of less than 2 years, she was basically a tourist for 3 months in one and 5 weeks in the other. we disclosed that information as close as possible while filling our DS-260, now we see that in the civil documents she is required to present police reports from both countries, we have police reports from all other places we have lived, but will be impossible to get the one they ask, given that my wife never was registered or has a local id number, to the best of your ability what would you suggest.

The similar mistake, on DS-260 form i put current surname of my mom(after married) but on the form said ” surname at birth “(maiden name). **At the time my understanding is surname when she born me.**
Is that a reason for disqualification?

I am a dv 2019 winner and my numbe is current.
I am holding h1visa and currently live in America.
I filed initial dv fee $330 on July and haven’t received receipt number until now. It has been almost 4 months. After my number became current I prepared all the required documents and brougt to my attorney and my attorney told me I have to have receipt number to file 485 and
Without it I can’t file 485.
My attorney is keep saying we need to wait to receive the first initial receipt.
If you have any advice, would you share with me please?

My first comment is why are you using an attorney??? They usually know VERY little about the process, and often do more to harm a DV case than help.
Now, about the receipt. Was the check sent to the correct place? Was it cashed? Did you get some informal response from KCC (even though you did not think it was a receipt). The receipt usually comes in 2 to 4 weeks, so it would be odd to not get it.
Lastly – the single most valuable piece of advice I can give you is to learn about the process by clicking the link below and studying the spreadsheet on the first post. It has EVERYTHING you need to know, and Sm1smom is THE expert on DV AOS. So – STUDY first, fire your lawyer, and follow Mom’s guidance.

I went to Dublin embassy website for required documents but there is nothing there about showing savings.
In your FAQ it says that we need to get a financial statement. Do you think embassy in Dublin will require financial proof?

Save the documents as pdf files, or make sure the email is not too large. Split the files into several emails if needed.

If you’re using Hotmail, Outlook or another cloud storage supported email platform, you might be selecting the option to upload the files to the drive (One Drive, Google Drive etc.) instead of adding them as attachments while uploading the files. Try to select attachment option or use another email client / application to send the email.

Hi Brit, thanks for your assistance my issue is, I have just completed my final exams of completion on Diploma in Banking and finance this October and I have went to the university yesterday to take my attestation so I can carry it along as part of my educational documents. But during filling my DS-260 I did not included it because I was still on it not completed. Because in the DS-260 it ask for date started and date completed for each institution attended so being I was still on it was not mentioned in my DS-260. Now my question is, it right for me to still take along this my university attestation for my completion in final exams in Banking and finance during my interview? the question is for my friend, he is a winner of DV2019 but he is in the USA illegally, meaning he went on a visa and over stayed. The question is:
1- Is it true that the new law that he has to go back to his home country and go thru the process from the US embassy there? no AOS?
2- Is there a chance that there will be a ban on him for overstaying and that he will be denied interview or during of?

I had my interview since early October last, after the interview the consul approved my visa and said that they would call me back for the withdrawal. but nothing so far yet people have left their visa after. I wrote to the embassy last week to find out more and in their response they made me understand that I am in administrative process yet the day of the interview the visa was approved.

The day you enter the USA you become an LPR. If you do that in 2018 (even on the last day) you will have to file a tax return in April 2019. If you delay to January, you have an extra year before you file a tax return.

I have recently submitted my application for DV 2020 almost 10 days ago. I am not sure but I feel that as if I had selected wrong Place of birth for my spouse (Wife).
Let me explain in detail. We both are having a Pakistani nationality. But myself(husband) was born in Saudi Arabia. I had selected Saudi as my birth place which makes me eligible to apply. However, my wife was born in Pakistan and while submitting the application, i had chosen “Pakistan” as her birth country.
I have read the guidelines for DV-2020 , mainly the section which talks about the Qualifying Country as follows: ” First, if your derivative spouse was born in an eligible country, you may claim chargeability to that country. As your eligibility is based on your spouse, you will only be issued an immigrant visa if your spouse is also eligible for and issued an immigrant visa. ”
Considering above and based on your knowledge, do you think that my application can be rejected because I should have selected Saudi as country of birth for my wife instead selecting Pakistan (which isn’t in eligible list of country).
I am confused.

You should have listed her correct PLACE of birth, but chargeability to SA.
However, your chance of selection is VERY small so there is no need to worry about it.

First of all, thaks alot for your help and guidance for my successfull visa interview.
Today my question is regarding the time period of passport and visa deliver;
well i have my visa interview on Nov 1st and thankfully visa consular approved my visa on this date then on Nov 2nd i submitted my online visa profile form without any errors. But it has been about 15 days, i donot recieve any email or sms notification to pickup my visa and passport, some people says they recieve the pickup notification in 3-4 business days. And this makes me really worried about my case.
Q: i just want to know, what is the time period of delivery visa and passport ?
(P.S. From the date of my interview, US embassy get closed for 8 days as there was some weekly holidays (like, sunday & saturday) and there also falls Nepalese great festival ‘Tihar’ vaccation. There was also Veterans day holiday on Nov 11.
IS THIS THE CASE OF DELAY)

I am a case 11xx SA (venezuela specifically), I have not sent the ds, because I have not even left the extension of my children’s passport, (an extension of the validity of the same because in Venezuela do not issue new passports by lack of material, in the embassy they accept it without problem), the one of the girl already left, the one of the man must leave at the latest in January-February 2019. Now I am living legally in Uruguay and we will do everything from here, the girl is still in Venezuela next to come. the questions are:
.- I can send the ds with the current address of the girl in venezuela, stating that the interview would be here in Montevideo, is there a problem?

Your question is pretty unclear. So I will make a couple of points.
1. The current address of the principal selectee is used to determine where the interview is scheduled. The derivatives attend the interview at the same time.
2. You can submit the documents with an expired/expiring passport, but it should be renewed in time for the interview.

Hi Brit,
South African family of five (all SA passports) going for our interview at the Joburg consulate at the end of November.
I need to travel for work on my SA passport 5 days after the interview, and I want to ask the CO to put my US visa in my (second) german passport (which I declared in my DS260), so that I can have my SA passport to travel in case they take longer than 5 days to return it to me.
Would this be acceptable? Could I run into any problems if I do this?

why did you get rejected?
is that because of No sponsor or what? DV interview it should be 99% of succeed , unless your documents were not sufficient.

This is a part of the AP process. Some that go through AP (including those that were asked for the DS5535) get cleared, some don’t. Simply knowing you were asked to complete the DS5535 doesn’t mean I can guess your outcome.

hi brit, i would like to have your opinion.in fact i went to do the medical visit and the doctor took my blood pressure and it was high.he asked me to iron the next day then he took my blood pressure again and it was always high.He told me to do a lot of sports and avoid salt.I would like your opinion if the fact that my tension was high could be a problem on the day of the interview ??

Hi Simon , my interview is on 28th of this month . and still i haven’t got my police certificate ( its on the process ) i am afraid that i wont get it before my interview although i have 2 other police certificates from other countries.do you think this would be a problem for me.should i change the interview date. the one i am missing is the country where i live write now.

I would suggest you keep the interview date. You might get the police cert in time, and if not, you will send it to the embassy as a follow up. Yes, that will mean AP – but that will be faster than trying to get rescheduled.
