We are waiting to submit DS 260 after various delays including the birth of a child and an expiring passport.
Still waiting for the return of renewed passport (come on HMPO) – should we submit the DS 260 ASAP and “unlock” later?
The window to “unlock” is getting smaller – should we be worried about rushing to submit?
Our Asian case number is in the mid 4000s.
Is there a first-come-first-served element to DS submission and interview timing?

You don’t need to worry about timing. If you submit late, it might delay your interview – but so what – that does not create a risk.

Dear Simon,
I have an unclear question even though I read your article about i-134, since english isn’t my native language. I am planning to prove that I am not gonna be public charge, So my question is
1) Do I still need the i-134
If I do,
2) Does the sponsor need to show all the proofs you mentioned in the article?
And as a back-up, I am thinking to get i-134 from a friend even if I don’t need.
So my second question is
3) Can he answer Q.8, “the following persons are dependent upon me for support”, on i-134 as, “Partially Dependent” instead of “Wholly Dependent”, since I am planning to show my saving as well.
I am sorry if I asked complicated question in complicated way.

Hi Brit. My father’s AP process has finished and We got the letter of issuance on Abu Dhabi website on 15th August 2016, Although his passport has been in embassy since 10th August 2016. After this long time, his statue didn’t chang to issued in CEAC. I emailed the embassy from contact us three times but they didn’t respond or update the case. We are really worried about this matter. Do you have any advice?

Hi Simon;
I have read through your website and again and again, I knew that your recommendation about the education part, need to listing as much as we can and make accurate.
I am a bit confusing in the section Education they said (” Highest level Education complete”) what I understand is to completed only the highest one that I had. ( my Bachelor degree). So in the ds260 I listed only my bachelor degree as highest level.
The Other thing is that I don’t have High diploma, I have bachelor because I did study Associate degree and continue to Bachelor degree. So I will qualified on job requirement as I have more than 10 years of experiences in IT & Network administrator. I will prepare everything to prove that about the job experiences.
My question is:
1. Do I need to unlock the form ds260 and listing all from secondary school till university degree even I did not have high school diploma? Follow my case number I suppose to have interview in November. Case 2017AS27##.

You should make the DS260 as accurate as possible. It is helpful (and required by the instructions) to document all the schooling.

There is no direct impact of his disability – America protects the rights of those with disabilities. However, there might be some concern over his ability to support himself financially – so he should obtain a sponsor and have an I-134 to “arm himself” (couldn’t resist) against the concern.
Regarding his education, he must meet the requirement on education grounds since his work as an artist will most likely not qualify him.

Were you denied last year because they decided your marriage was a Green Card marriage? If so, you have attempted immigration fraud, and they have decided you are banned – probably for life. In that case a waiver is unlikely, and certainly could not be processed in time for your DV win in DV2016.
It is too late for you, you cannot appeal this decision. I hope others will learn from your example and avoid the mistake you made.

I’ve received an October interview for the DV2017OC visa. Compiling all documentation/arranging medical and everything looking good. In order to prove my husband and I won’t be a public charge (I’ve read your helpful article about it but looking to clarify that the the below is fine), I’ve a few quick statements and questions.
– we were not going to fill out an Affidavit of Support
– we were going to produce the title to our property, pay slips and bank statements to prove our stability
Could you please advise:
– whether we should be safe and do both? We easily clear the minimum $ but don’t want to trip up on something small like not filling out the I-134
– is the literal printing of tax/bank documents or photocopying enough evidence or is there a robust expectation of specific documentation to suit?
– need to be signed by witness, JP, anyone specific? or is it as straightforward as I assume?

Yes, but work experience cases are generally harder to prove – so all I am saying is choose the simplest, safest option – but obviously go ready to argue work experience also.

My friend who was denied visa because of green card marriage back in 2011 ..Her husband won green card together with her two kids. My friend divorced the green card marriage she has a divorce certificate now.
At the interview the Co told her she is ineglible to go USA but approved visa for the husband and kids.
The consular told her she will join the husband and kids later after she files for a waiver….
1.she will file a waiver only?
2.she with file a way waiver from outside USA?
3.The husband will file form i130 immediately he arrive US?
4.or the husband to file the waiver for the wife and form 130 together once he reaches US?

1. She may not be approved for a waiver – it depends why she is ineligible. She might have a lifetime ban because of the immigration fraud.
2. No
3 & 4. I don’t know much about Family based petitions, so I don’t advise on them. Your friend will need a lawyer in the USA. I know the process will be expensive, take a long time (years), and may not be successful.

my name is Renata and I have a question regarding Green Card… My fiancé won Green Card in the Lottery and he is supposed to receive it by April 2017. He is also currently on the h1b visa, working as a doctor. We are both from the Czech Republic and I can travel to the USA on ESTA.
However, we plan to get married in April and I’ve read that I might be waiting for my boyfriend’s Green Card for at least 2 years. I’m already “ok” with the prospect of waiting for having any sort of decent working life in the States but I am concerned about not seeing my future husband during that period of waiting for the Green Card. I know there is some option for those who married US citizens and my question is: would it be possible to stay with my boyfriend (who will be a Green Card holder) while I will be waiting for the Green Card? Or would it be at least possible to come back and forth on the ESTA if nothing else? Many thanks for your response…

Simple solution. He should delay the DV lottery process until after the wedding. Then you both will get Green Cards at the same time. You could bring the wedding forward, or delay the DV interview until July or August. That will be no risk, faster, cheaper, easier.

First of all, your boyfriend is only guessing the date of interview, it might vary depending on his case number and how he processes his case (in the USA or in another country). You say April very confidently, so I wonder if there is some misunderstanding.
Second, if he plans to adjust status while in the USA, he probably should not have filed paperwork yet, other than the DS260.
Now – to answer your question. Yes, you can process how I explained. “How” to do it depends on his case number, how he plans to process and what he has done so far.

You’re right, he is just guessing… Just another question came to my mind… It is true that I would not be able to apply for adjustment of status after the marriage from ESTA (in case we do it here in the US), right… So, do you think it would be wiser for us to get married very soon so I could seek h4 visa as an equivalent to my husband’s h1b, and then could apply directly for the adjustment when he receives the Green Card (or as I understood, I would be incorporated on the application already during the interview as a wife…)? Do you think there would be any constraint (e.g. I might not receive the h4 on time (meaning before his interview, so it would make things more difficult…)? I think that to get the Green Card, I would have to travel back to my country and proceed with consular processing, thus be waiting for it there – as I would not have any other option of visa that is allowed to adjust status from ESTA, right? So my question is, do you think it is better to get married pretty soon and seek the h4 visa before the Green Card?

I have already said – my advice would be to get married earlier. You have two options, one is he adjusts and then you file an I-824 “follow to join” process, or if you want to apply for an H4 that is very simple process once you are married. You process the H4 and the I-824 at your consulate. The easiest is probably the H4 and you could enter the USA sooner than I-824. You could then enter and both adjust status once his case number is current. Do not try to adjust from an ESTA entry.

Hi Simon, thank you again for your very helpful advice! I am tempted to get back here and ask one more question, which I consider a tricky one. We are getting married in November in the US. As I understood, the city clerk will give us all the documents we need to be legally married in the US. However, as we are both not the US citizens, we need to legalise our marriage in our home country (to be legal in our country, I do not know whether it is legal already in the US) and that takes 3 months. My question is: can we both apply and pay the fee for the Green Card application right after we get married in the States, or is it wiser to wait until February after it is legalise in our home country? I know we would have it legalise by the time the interview will take place in either way. But I am just afraid there might consider it as a fraud if they would check the dates marriage in the US vs. legalisation in our country. Also, I will not have the H4 visa by the time we would be sending the application, if we decide to send it right after the marriage (would get it in February as well). However, we are concerned about waiting until February for the application, as we might lose the spots?! And as I understood, we cannot apply separately if we want both get the GC. The US marriage is legal. The only effect of the “legalization” process in your country will be to record your marriage in that country – but in reality you will already be married. So – you can submit as soon as you have married. The only other thing you need to think about is the timing and where you will both be interviewed. It sounds like you could choose to do an H4 process and then do adjustment of status in the USA, but doing H4 at the same time you are nearing an interview doesn’t make sense. So – have you decided whether to move to the USA and adjust status here?

OK – so petty crimes don’t generally cause a problem for the selectees. The crimes that do are more serious crimes (technically they are “crimes involving moral turpitude).

You cannot be approved without a cleared medical. If the doctor cannot clear you faster than October 3rd, you will not get a visa. You have to get the medical faster, or give up.

Hi Mr Brit, according to the website one is suppose to have a “technical skill” in a job. Technical skill by definition has to do with jobs like accountants, IT specialists, engineers and management. So what happens to the other qualified jobs listed on the US department of Labour website?? I ask cuz my job is a qualified one but it doesn’t fall in line with the jobs I just cited.

Filled my ds 260 on may 27th
I have some questions
1.when I was filling out my ds 260 I was rushing so instead of saying I attended 2 schooIs i filled out 1,would that be a problem?
2.and I recently got my degree on July 15
So should that be a problem because I filled a highschool with no degree on the ds 260 because I didn’t recieve my degree at the time

Hi,
My ex husband won the lottery, got his visa and is planning to leave for the US soon. We have a son and we wanted him to also have the green card, so he got it too. However, we don’t want our son to live in the US. We want him to leave here in Lebanon with me. We are planning on having him go in for the first entry, then come back home, and then take him to the US to visit his dad a few times a year. We are also hoping this will help my son eventually get his citizenship in 5 years. Do you think this is feasible?
Also, since my son is a minor, I was hoping I could travel with them (with a visitors visa) and then bring him back after maybe a week or two. Can we travel after his dad has already arrived in the US, or do we have to travel with him? What are the risks?
Additionally, on the green card documentation, it’s written that my husband and my son will be going to live in West Virginia. Since we are planning on just taking my son back home right away, does his ticket have to terminate in W Virginia? Can I just buy me and my son tickets to DC, and then spend time with my family there and go back home? We don’t see the need of him traveling there. Will the immigration officer at the airport ask to see where the ticket is terminating?
We are also hoping to get our son a social security card. At what point during the DV process does this happen? Will it be after the green card is received in the mail, or before that?

1. Citizenship requires a resident to show that they are residing mainly in the USA. With what you described, your son will not qualify for citizenship.
2. Your son can travel with you.
3. You can fly wherever you want, not just WV.
4. The SSN will be created as soon as he activates on the first trip.

Sorry can u help me I’m bampende ntumba I won in dv lottery 2016 I did submit every document to the USA Johannesburg ambassy they noticed that they was a small screech in my pourcentage and they say to me that high school diploma is not valide and I have to submit other document which must prove that high school is valide I went for to help to my embassy in south Africa they make a latter for saying that diploma is valideand I went again to Congo in department of education they did to me authentication of my high Scholl and i did bring all those documents to the USA ambassy in Johannesburg they don’t wanna give the visa

Just understand. The DV program is at risk and there are some in the USA that are anti immigration. Someone coming here and taking advantage of public assistance programs without ever having contributed to the public purse is exactly the type of thing that seems unjust to Americans. So, make a good plan and prepare to work hard and establish yourself by your own means. There are plenty of jobs, no need to move to an area without jobs and struggle.

hi simon, my wife gave birth exactly a week after we submitted the entry level and she won.the child is 10 months now and i prefer to leave him behind for 2years before i file for him to join me with the purpose of settling down well in the USA.i have filled and submitted the ds260 form and i stated in it that am not going with my child and he will join me later.i will have my interview in Ghana even tho my 2nl is not in yet.can leaving him behind cause as some problem? pls we will be grateful if you respond to us so that we can decide if we hv to unlock our ds260 and change our idea

It’s just a really bad, misinformed idea. Sponsoring the child after the DV will take 2 years, be expensive and complicated. Don’t do it.

If someone makes the draw for you and mistakely he changes your month of birth from August to October will it pls have an effect on you during the interview day and prevent you from getting access for your visa…. Otherwise your birth certificate… Passport and your school certificate all have the records as August

2.) If the answer is “Yes”, is it possible to put MBA, MSC or BSc diplomas instead of high School diploma?
