2NL is the notification that tells you are scheduled. The visa bulletins say whether your number is current or not. 2NLs for November interviews will come out in 2 to 3 weeks.

I would suggest you send an I-134 with tax returns etc as supporting documents. You need to act fast.

Morning. Please advise we are from Namibia and our interview will be in South Africa even tough Namibia has an American Embassy they said the interviews wil only be in South Africa. Is it possible when we are issued with our visas to ask them to issue it at the Namibian embassy as we will not be able to return home without our passports? Thank you

They may be able to arrange to let you travel homne with your passport and mail it back to the SA embassy when you are home (and return to you by courier). However, that will introduce delay and risk. I wouldn’t do it unless absolutely necessary. Discuss with the embassy.

Hi BritSimon!Thank you for this blog it’s so helpful! I called the uscis department and the kcc and they couldn’t answer to my questions. I’m French and I’ve been selected for the Diversity immigrant visa program 2017. Waiting for my number to be announced. I was in France when I applied. But I’m currently in the US under a J1 visa wich will expire on December 2016. The two years restriction doesn’t apply to me. I would like to do an adjustment of status. How can I do it? Cause when I look on the website and when I called them there’s no answer for my case. One time they say yes and another time they say no. There s no details about the procedure for an adjustment of status on government and uscis website for my case. And do i still Have to fill the D260 even if I want to adjust the status through the uscis? I’m sorry it’s very long but I’m kind of lost. Thank you very much

J1 holders can adjust. But neither USCIS nor KCC are going to give you information specific to your circumstances. Whether you can adjust or not depends on when your case will become current (determined by your case number), and your status when you file/have your case accepted. Read the link below. There is a spreadsheet on post 1 of the thread. Read that and if you have questions, post them on that thread. Sm1smom is the DV AOS expert.

Because it is subjective – whether you meet the standard or not is a matter of convincing the CO that your experience is at a suitable role. Proving education is more simple, you either do or don’t meet the requirement as shown by documents.

I think your friend is incorrect. Adoption is a legal process, usually decided by a court/judge.

Hi Simon,
I am a DV2017 winner and waiting for my case to become current.
I am HIV+ and even though the ban has been lifted since 2010, I am still worried (to say the least) that this might be an issue. My case is good (I think) since I am an experienced lawyer and have a volunteer work experience in the US.
I know you are not a doctor but I guess my question is do you know of anyone with the same condition successfully receiving the GC?

Someone who has never had a job could get a visa – each case is unique.
Once you submit your DS260 it will be processed (which can take some weeks or months) and your interview will be scheduled. Higher case numbers that are current could be interviewed before yours – the whole world isn’t waiting for you!

I have a question regarding DV. I have put my highest education as Bachelors when i apply DV for the first time. i have already fulfilled the minimum education criteria for DV process. In DS 260, I have put my highest education as high school diploma. So, in such case do i get second letter?
Now i am doing my bachelor and i will graduate at the end of this year. From the past year, i can see my case will be only current in April,2017.
So, Does this create visa refusal?

Today I have received the result of my transcript evaluation ( pretty happy with the US equivalency I got) , I had required an evaluation because I will need it to get a Job in the US if I get the green card, and also because I will be having the interview in a different country than where I come from and studied
So question is , as I have re-opened my case should I modify my education informations with the education equivalency I received or should I stick to the word to word translation.

Sorry dear Brit i made a typing error,the adoption decion was signed in May 2015 not 2016 like i stated.it is quiet disturbing as i really feel for thismy little girl.she is the biological child of my cousin whom i adopted after the legal consent of her birth parents.will this date of 2015 not 2016 give her a better chance?she was adopted(may 2015) even before we played the dv(nov 2016)meaning she was in my original entry and her ds 260 has being send on june 18.any hope she could be approved?and based on this 18th june when i forwarded the forms any hope for the next interview?please use your wisdom to guess my visa outcome so i can start building new plans for my dear little girl,truly i feel so worry.Thanks Brit,your work is just so so awesome

That is a big difference – it shows the intention of the adoption was not to gain an additional visa. However, there is still a risk about the 2 year rule – but I don’t know how the CO will treat that. If you had asked me before sending the DS260 I would have suggested waiting to send that to delay the interview past May 2017. Your case number might be high enough to ensure that anyway – I don’t know the case number.
Anyway – you will only be certain of the outcome once the interview has taken place and a decision made.

But now there is a chance of geating my passport.
So once i have it could i take in the interview time to issue my visa in my passport instead of the travel document without unlocking my Ds form and change it before the interview time.

US Immigration law recognizes an adopted child on after two years have passed since the adoption. I don’t know for sure how they will treat this case. You might want to take additional paperwork to the interview to show the process was started earlier, that the child has been with you since 2013 and so on. The CO will have to make the final decision, but in your case, since the adoption was after the lottery result, there is a significant risk that the child will not be approved.

Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. Under the U.S. Immigration and Nationality Act, Immigrant Visas for “Diversity Visas” cannot be issued after September 30th of the year in which you were selected to apply for a Diversity Visa. For example, entrants into the Diversity Visa Program in Fall of 2011 were selected for Diversity Visa 2012 Program, and selectees MUST apply and receive their visa prior to September 30, 2012 otherwise they lose eligibility to receive a Diversity Immigrant Visa, regardless of additional administrative processing. In addition, please note that some immigrant visas may not be able to be issued if the annual numerical limit for that category has been reached.

You broke the rules of the DV program. If you admit the existence of the 2 children you will be disqualified. If you lie and get caught you will be banned from USA for life. If you lie and don’t get caught and make it to the USA, if the children are ever discovered you will be deported from the USA.
My advice is give up now, as to proceed would be either certain disqualification or breaking the law.

And i answerd no i just freaked out , the q is do i should answer yes and the health statement will provide this info or its just for annual check not drug .

I think that is something you should decide how to answer – I don’t feel comfortable in advising you on that. The physician might ask you about drug use, so think about your answer.

As part of the DV process you have a medical exam. The physician who conducts that exam may ask information about drug usage or previous physical and mental health issues.

Hi Brit, i have been selected for the dv2017, and hope to be called for interview soon enough. I was charged with an offence 13 years ago and was in court, i pleaded guilty so i got my court documents to present at the interview if needed. it was the only time i was ever in trouble with the Police. I just received my Police Certificate and it states that i have never been convicted of a crime! i now think that my conviction might be ‘spent’ as it was more than 10 years ago. Do you think i should mention the conviction in the interview or not?

Have you completed the DS260? If so, there is a question that asks were you ever arrested for a crime – if you answered that question correctly, you have already told them about the crime. So – take your court documents. Remember – honesty is the best policy.

I have a few questions regarding first entry/re-entry into the US when a diversity visa is issued & US citizenship. By the way, I have read the FAQ related to my questionS. I ask if you could please clarify my understanding of it.
Let’s say for example, my medical was 25th September, 2016 and my US consulate interview was 1st October, 2016 and my diversity visa was approved & stamped in my passport.
1. Based on my example, would 24th March, 2017 be the expiry date for the visa? That is, I must enter the US before this date to ‘activate’ my LPR status ?
2. If so, let’s suppose I arrive in the US at POE on 1st January, 2017 and the customs officer stamps my visa. Then, I stay in the USA for 1 month to explore where I would like to live. On the 1st February, 2017 I leave USA to tidy up loose ends in my home country. My understanding is that on the first visit to the US I am entitled to leave the USA for up to 12 months, that means I must return to the USA by 31st January 2018. Is this correct?
3. If I return to the USA within 12 months on my 2nd visit, and wish to leave the USA again – I can only leave up to 6 months only this time. Is this right?
4. If However, if I wish to leave for 24 months then I must apply for a re-entry permit while in the US. So, using my example in item 2, between 01 Jan 2017 & 31st Jan 2017 I should apply for a 2 year re-entry permit? Is this correct?
5. Using my example again – if I applied for US citizenship ( I believe 5 years as a PR ) does US immigration only count the time spent living in the US only & exclude the time spent away from the US? If so, the longer you spend outside the US, the longer it would take to obtain US citizenship ?

1) Does it mean I will have to make a Bank Statement which will show that I can take care of myself for sometime before going in for my interview?
2) In a case where you don’t have a Bank Statement can you take cash to the interview to prove that you will not be a public charge?

You cannot process your wifes case through DV now. Once she has had treatment you can file a family sponsored case – that will take around 2 years…

I’m currently living in the UAE working as a flight attendant. I’ve tried the DV four times and missed once. I’m planning to move to the U.S for school. can i still apply from the USA? do i still have the same chances to get it or its less?
I registered this year from Abu dhabi but didn’t get it, but always hoping for the best, maybe next year, we never know.
A friend who got it from the first time told me that if i apply from the UAE, i have more chances to win as the number of people applaying is less than in other countries? i wasn’t really convinced but i tried and still didn’t get it. To be honest, if i can stay in the US and still applying for it till i get it, then i will just move as soon as possible without hesitating.

It doesn’t matter where you apply from – you have the same chance of winning. The eligibility is based on your country of birth, not residence or citizenship.

I was told to file for waiver to join my hubby and children but my husband and children were given Dv visa .
1.do I file form i601 alone?
2.He will need to also file for me form i130? Once he arrives US?

I don’t know the detail about waivers. But I suggest you talk to a lawyer to check whether a waiver is even likely to be granted.

Your website helped me a lot. Now I know that my case number for 2017 (EU 22675) should be a ‘safe number,’ correct?
I am not sure I understood the ‘hole’ theory in practical terms.
Am I right when I say that according to the theory, factually in the EU case numbers I may actually be lower than 22675, not for interview purposes, but for a real availability of greencards, i.e. someone before may have already been discharged?

The short answer is very simple. You are safe – there are enough visas for all cases and all regions this year.
For the longer answer, I should say, the “hole theory” is like the “theory” of evolution – it is proven fact, not guesswork.
The holes are in the selectee numbers. In DV2016 the hole rate (cases that were disqualified/removed prior to the May selection) was 23% for EU. Then there was another massive drop in “density” once the two big EU countries were exhausted. I explain that at the link below. Looking at 2016 data there are probably no more than 14000 real cases in front of your number, and several thousand of those will not proceed, or will be refused. Each case number includes a selectee and their derivatives, but even so you be one of less than 15000 EU visas granted this year.
