Hi Brit I have a question.
Travel ban will end on March31st if Biden doesn’t cancel it by the day or doesn’t extend it right? But now so many people are waiting for interviews(not only DV case) so is there the possibility that Dv2021 winners will not have a chance for the interview after the travel ban ends? Or Dv case will be a priority case because we have a deadline (Sep31st)?

Most likely the Schengen ban would still apply. So – you would have to go to a third country from 14 days prior to entering the USA.

DV applicants whose medical exam has already been conducted but will expire prior to December 31, 2020, may opt to submit a new medical exam prior to visa issuance.

As a Dv-2021 winner how can you manage to get your green card through AOS considering that:
The process of AOS is usually taking at least 6 months to complete, and you need to get your visa by the end of the fiscal year (Sep 31) AND
you can apply for AOS once your case number becomes current while most of the case numbers are not current yet?

Well DV related AOS takes less than 6 months typically, but yes, the cases not being current is a problem for most cases.

I’m DV 2018 winner, from one Nationality that covered by Muslim ban “P.P. 9645 or 9983” my case enter AP Till the end of the year now shows Refused.
I know it’s expired by the end of September 2018.
But is there a chance for my case to be reconsidered, because it’s refused due to my Nationality covered by Muslim travel ban

A proposal to ensure that individuals whose immigrant visa applications were denied on the basis of the suspension and restriction on entry imposed by Proclamation 9645 or 9983 may have their applications reconsidered. This proposal shall consider whether to reopen immigrant visa applications that were denied due to the suspension and restriction on entry imposed by Proclamation 9645 or 9983, whether it is necessary to charge an additional fee to process those visa applications, and development of a plan for the Department of State to expedite consideration of those visa applications.

The answer is that it is probably not going to help you. The proposal was to consider family and other cases that were not time bound in the same way as DV. However, I have discussed this with lawyers and I will publish about that if there are any interesting developments or lawsuits that can help.

The US embassy told me that they can not give confirmation to airline if my visa was first issued before 23rd April 2020 and there is no annotation . Also they informed me they have no instructions to say that Im exempted from the ban. How can I prove them that I’m exempted? My visa will expire soon . Pls advice me.

Tell them firmly but politely that they are wrong. Tell them to read the link below and that they should take advice from DoS if they do not understand the terms of the proclamation. Point out the following text:
“U.S. citizens, lawful permanent residents, and those holding valid immigrant visas on the effective date of the Proclamation, are not subject to the proclamation. The Proclamation is not retroactive. ”
Also point out the order itself which states:
“Sec. 2. Scope of Suspension and Limitation on Entry. (a) The suspension and limitation on entry pursuant to section 1 of this proclamation shall apply only to aliens who:
(i) are outside the United States on the effective date of this proclamation;
(ii) do not have an immigrant visa that is valid on the effective date of this proclamation; and”
Section 2(ii) is the important part.
Also tell them that you are aware of numerous others in the same circumstances who have entered with no problem.
By the way – contact the airline to see if they understand it better than the dopey embassy staff.

First of all thank you very much for your help
I would like to have some answers to my questions below before planning our trip.
Me and my family 2020 dv winners. Our visa was originally issued on March 10, 2020 and expired in July 2020.
We have applied to reissue the visa at the US Consulate in our country. After payment of fees and submission of new medical exams, we have obtained a new visa in September 2020 which will expire March 14, 2021. In This new visa it was mentioned “Exception under PP on Risk to Labor Market”.
We want to ensure the following questions before travelling:
1- The PP is not applicable to us and we can enter the US?
2- We have to pay the USCIS Immigrant Fee to U.S. Citizenship and Immigration Services before our travel to the United States: Would it be acceptable for a friend currently in the US to pay for us ?
3- To travel from our country we found a flight with a stop over, in Turkey (is not considered as Schengen area) Normally no problem with this flight?
4- We plan to enter for activation and reside 1 week in California (we will have a year later to return) is this a problem?
5- Is there any other obligation to do before entering the US?
6- Thank you very much in advance for your precious help

2. You can pay before or after. So pay after you enter – and yes your friend can pay.
3. That’s OK based on rules today.
4. Normally that would be OK, but there may be quarantine requirements so do your own checking.
5. Again, there may be requirements such as covid testing – do your own checking.

I have been in Saudi Arabia in 2018 for 8 months on a visit visa , and i left that country without obtaining a police certificate , unfortunately it is impossible to get it now as i am in another country, and there is no way to request it remotely.
I just prepared an explanation letter for why i can not obtain the police certificate from Saudi Arabia , The question is : what should i put as a name for that letter file before i upload it to the documents e mail ?

Your DS260 application may affect the student visa application. But among other things there is a 90 day recommeded waiting period after entering the USA to adjust status, and then AOS can be a slow process. Right now you would be better served just being a little patient.

1. In your latest video u mentioned that people who did and did not fill in aila’s form were emailed. Was wondering how do I get into their contact list or get a copy of this email because I do not get any emails from anyone on urgent dv matters at the moment and I would like to know the contents of the email.
2. I think my visa is expiring on 18 March due to my medical which was done on 18 September (but results came out later). Having a diploma by itself won’t get an NIE – and I would not suggest trying to get a lawyer to achieve that at this time. You need to remain patient for a little while longer.

Simon, when we say “case number is current” does this mean I should see the word “CURRENT” instead of the cut-off number in the VB in front of my region, or it just means that the Visa Bulletin has an updated number for the next month, and I find my case number to be under/less than that number?

Those people have to wait for the outcome of the Gomez case. However, if we remain at 9095 visas, that means most visas will be quickly used for those cases were already at the embassy.

It’s not a high number, but we don’t know when interviews will start. If we have 5 months of full processing, your number would be OK. If we only got 1 or two months of interviews, your number would be at risk. So that is why I don’t predict any “safe” numbers.

The first point you make is technically a problem, but rarely causes a problem.
The second point is “yes” you can do that, but there is some risk. You have to wait 90 days after entry to avoid concern that you entered with a plan to adjust status.

The DS260 does not stop you switching to AOS. However, your case number is not current yet, so you should wait and see what happens because you could not do AOS unless your number becomes current. You would also need to factor in a waiting period after entry before switching to AOS, so you could do all that and find that a. you never get current and b. if you do, CP blockages might be faster anyway.

Thanks for sending. Its not a judges order per se. AILA are suggesting anyone who got less than 6 months of visa validity should ask for an extension up to the 6 months – just to buy a little more time. Then they also point out the motion they are filing tomorrow which would be what is discussed with the Judge on the 18th.

Hi Brit. Need to send some documents to KCC which required translation in English.
I checked some online company which ask a fortune for translating and certify even a single simple page. Would be enough to have someone fluid in English (has a diploma in foreign language English, French and Spanish to translate it? If so what they need to write to prove they can certify such translation?
-another thought…my interview will be at the American Embassy in Italy where they are more than knowledgeable in Italian….will I need to bring the rest of documentation in English as well?

Doc translation has to be done by authorised person. They will have to put seal and signature on the translated copy.

It does not need to be an official translator. DoS have in the past said anyone can translate the documents and should sign the translation with something like the following format:

It was just a comment you also made recently where some respondents on your site were complaining of the expensive fees they pay (in some cases twice etc and they felt conned and cheated) and you made a comment they were insignificant in US terms – just a couple of weeks ago

About the fees being insignificant in US terms – yes it was important to note I was drawing a contrast with US mindset about fees. In some countries the costs of paying the $330 PP for a family of 4 or 5 might be considered a HUGE amount of money, whereas it might be considered a lot less in the USA.

There is some risk to that, and you cannot do AOS until your case is current. But also if you enter the USA you have to wait 90 days before you try to adjust status otherwise you can be found to have lied on your NIV entry.

I’ve worked in multiple gulf countries for over 15years & some of these countries I’m facing really difficult to get PCC as most of the required documents can’t be summited as I left these countries long ago.
Now my main concerns is, Is it compulsory to submit PCC for all countries where I worked previously? and even have left those country more than10years ago?

First, I would say you need to read the instructions. The instructions make clear which of those countries you will need Police certs for, and gives instructions on how to obtain them for each country (plus details which countries do not require PCs).

It’s not just the ban, in fact that is pretty much a non issue now for DV2021. We are in February. The 2NLs sent in February would normally be for April interviews, meaning past the end date of the ban. The bigger problem for DV2021 is embassy opening status – but the combination of the ban and the opening status probably means we will lose February 2NLs too.
So – Anunciato and Jacob remain important to get interviews going.

So in Europe, for example in countries like France or Spain, embassies are working but they are not scheduling interviews because of the ban.

I doubt they will exclude anyone BUT I think it will give them a better idea of how many people the judge’s ruling is going to affect. The more people it affects, the more convincing the agreement is to provide some sort of relief.

I don’t think they think that way. Last year, the visa bulletin was current, although the interviews stopped for a long time…
They could have stopped the visa bulletin or it went slowly until the end of the fiscal year

I explained reasons other than that too, but your point about last year is without merit since the regions went current in early April before any of the pandemic scope was known.

Leave that to the physician to decide. They will know what vaccinations are typically given, and will administer anything else needed.
