I’m a DV winner, the US consulate in my country processes less than 70 cases every year (few winners). I will probably be current next month, can the consulate (if they want) ask KCC to send them my case? Has this ever happened?

It has happened in exceptional circumstances. It probably won’t happen for you. You must focus on whether your documents are processed and you are ready for interview.

Hi Brit,
I am one of the winners in the 2021 DV lottery, I have completed my DS-260 form and have been periodically checking the DV site for any Interview calls since July.
The last 2 times I tried checking into my DV-Lottery Confirmation, the page returns with an error, says I need to check with my Admin, and then provides some numbers. I have already emailed KCCDV but so far no response.
I did a Google search and came across this Reddit forum https://www.reddit.com/r/dvlottery/comments/dd66s6/url_rejected/
But this one speaks about someone trying to register for a DV lottery.
Could you help me out to understand if this is a rejection from getting a visa number from the DV lottery or is a problem from the consular side?

After I enter my details into the DV Lottery site.
The message I get is:
“The requested URL was rejected. Please consult with your administrator.
Your support ID is: 6398036034801015721

This issue had begun since Mid-March. Previously, after submitting the DV Details, it showed my selection confirmation. Now it just shows the above message. I have sent an email to KCCDV.

Hi Brit. About the health plan quote to show at the interview in Italy. To the interview with CO it’s ok to bring the quote printed from the Coveredca.com web site? Bronze HMO plan of $320 a month. Do they need to see anything specific about the plan? I am asking because the quote pdf is 116 pages long!

Hi Elisabetta , It is just a quote, not a contract, just to show them you have intention to have a proper insurance once in US, I remember it it was suggested on this blog somewhere , I may be wrong. Please Brit correct me if I am wrong. In that case is one less thing to do .

I have a question that already had a half answer in the FAQ but I have a different characteristic than those exposed there, so I need to ask it this way to understand.
If a person registers as married in the draw (at the beginning of everything, without having yet won) and is not actually married but plans to do so, that is why they register as married and later get married (after knowing what winner) but previously registered as married (without being):
1- What complications does this bring?
2- Can this cause my interview not to be scheduled?
3- Would the procedure be the same in my case, having registered as married and then having actually done it, as if I had registered as single and then I would have married?

Won my Green Card in the lottery in 2019 with my wife.
Had to be in USA by April 16, 2020 to activate it.
Pandemic. Wife and I flew to Hawaii to activate, came straight home. Pandemic prevented us from going back.
While stuck here, wife and I have begun divorce proceedings for which I obviously want to be in the same country.
Planning to move to USA late this year.
I’m unclear as to whether I’ll be allowed back in? Depending on where I read info, some say I’m allowed outside USA for 12 months, some 2 years – but I can’t really see whether USCIS has made allowances due to the pandemic? Could it really just boil down to the person that I get when I arrive at customs? PLEASE HELP!

Hi Brit. Thank you for all your help and patience! I have a quick question. I arrived to US on March 3rd, and already received my SSN (that is the great news). However, i am still waiting for my GC (it can take up to 90 days). At the POE I have changed my mailing address to receive the SSN and GC to my new and current location. Meanwhile my husband got a very good job offer in a different state, and we are expected to move soon, to save his spot in this company. Our concern is that we need to change the address in the uscis system once again, and we don’t know how it could mess with the GC receiving process. What do you think, shall we try and postpone our departure or we are good and shall not be concerned. Any advice would be highly appreciated. Thank you in advance!

Hi Simon. We are only sending our documents this week. Is that too late? They were never requested, however, on your advice we will send them through…although I see that advice is over a month old now. Are we sending in our documents too late and is all hope lost, or do we still stand a chance? AF48XXX South Africa. They have not started interviews yet here. When filling out the I-134, there is some fields that can’t be filled in such as ZIP Code. The I-134 file from the govs website says it’s protected, but it’s the only file available on their website unless i’m completely blind, and sometimes it won’t save the data that’s being put in. Any ideas?

I am not very familiar with the legal affairs, but I have a question with regards to the latest case that Kuck and company pursues: Is there a point in obtaining the “mandamus” if the embassy is not willing to process the cases on public health grounds. In other words, even if the case succeeds and the “mandamus” is issued, that may not be sufficient for action, would that be right?

They are literally above the law as far as foreign countries are concerned. So no, you can’t sue them locally, and again, the health concerns of their staff will stand.

Thanks so much for your continuous guidance and support on this journey! My Case number is 2021EU000217xx. I am currently residing in the US, but am more likely to choose consular processing as I have to leave the US for a few months over the summer. Hence, I do have a few questions:
>I have German and Turkish nationality. Hence, my understanding is that I can freely choose one of these countries for consular processing. Do you have any feeling/intuition which of these countries are already sending 2NL invites? Is there a way for me to find out more about the processing speed in these two countries?

My CN is current as of May, and I am hoping to interview in Montreal, Canada. I have submitted everything and received the ‘Ready for Scheduling’ email, so I am ready to go once Montreal begins interviewing.
Today I received a reply to my inquiry to Montreal Consulate saying the following:
“Presently, the U.S. Consulate General in Montreal is processing immigrant visas and will prioritize Immediate Relative family members of U.S. citizens including intercountry adoptions, fiancé(e)s of U.S. citizens, and certain Special Immigrant Visa applications, as well as other mission critical categories such as medical professionals. Unfortunately, we have not yet resumed processing DV-2021 visa applications at this time. . We will continue expanding our services following State Department guidance to safely return our workforce and the public to Department facilities.”
1) Considering they have confirmed they are not open, and they could potentially be closed for the rest of DV2021 processing, should I consider moving embassies?
2) If I considered moving to Mexico, is that extremely risky since it would mean putting my case back into KCC processing? I understand there is a lot of backlogged DS-260s and documents to be processed through KCC, so would it be dumb to change embassy and risk being lost in there?
3) I understand you don’t have a crystal ball, but would you recommend waiting out Montreal and hoping they reopen for DV cases in the next month or so, or looking into transferring to Mexico?

Hi Dear Brit, that’s me again :)) As you remember, I’m a DV2020, came to Boston 15 days ago. Border Officer didn’t change my address. So till now I don’t have my social security card and green card. I called the social administration, they told me to change my address with post service. I followed their recommendation.
I called the social security administration today one more time. This time the lady told me to fill out the SS-5 form, Application for a Social Security Card. She mentioned once they receive this, they will make an appointment with me for an interview. Again, she seemed not to be aware of the DV program, so I am afraid to fill out this form not to screw again… What do you recommend doing dear Brit?
I am getting crazy about this green card already. Everything has been a mess since March 2020. Thank you.

Hi Simon, I hope you and your family are doing well. I’m a dv2020 visa holder, whose vira expired on March 27th. I wish I could send you an email explaining my case. I’m still gathering my thoughts.
You may remember me, I’m the one who tried to enter the US on dec 31st and got call back as I was leaving the terminal.
Well now I’m heartbroken. We were so looking forward to this visa, it was a life changing opportunity for us.
Here’s what happened. I tried to enter the US on March 27th again through a land border crossing and they didn’t let me in because my trip was non essential 🙁 they sent me back to Mexico. The officer asked me who told me I could enter if the proclamation was still in place. So I showed him the White House web page, but he didn’t care. He said that I was looking at gossip sites and that he was a lawyer.
For context, My family and I couldn’t travel before that date because my son and I got covid (we don’t know how! We were so careful) and were quarantined one after the other. Then on the 27th as I was trying to enter the US at least by myself, my husband was rushed to the hospital due to covid. He’s still hospitalized, but improving, thank goodness. That day I didn’t care about the visa anymore, I wanted to return home to my husband.
But now, that I have more time to think about it. You know what? I think I deserved better. Has anybody gone through this? Have I lost my visa? Please help me.
Both my husband and I are skilled workers. We work in technology. I just don’t understand what happened. What did we do wrong? 🙁

Well the COVID situation is a huge risk, but for Iranians (males in particular) there is also the likely delays caused by the background checks, and of course the small amount of time before the end of the year.

I have 3 questions:
1)i have chosen Ankara,Turkey for my interview location,i have sent all the documents and received the confirmation email few months ago,however i still didn’t receive my 2nl and it shows my status as “at NVC” (i think because ankara embassy is not accepting interviews at the moment),i can change my interview location to Abu dhabi,emirates (which is accepting interviews now).so in your idea is it better to change the location or should i wait to receive the 2nl from ankara?
2)as for i-134 form,i have a friend who has greencard but she is housewife,her houseband is working but he doesn’t have greencard,can she send i-134 form for me?
3)Do you recommend that i participate in the new lawsuit which you said about few days ago?will i get any benefit from it?(because of my situation and case number)

First off, thank you for your great work, it’s been so helpful understanding the whole DV process through your posts and videos.
I’m 2021EU21***, in France and joined the latest DV-2021 Mandamus Litigation. So I’m pretty much waiting now.
I also have a valid O-1 until late Dec 2021, with which I can enter the US after leaving the Schengen area for 14 days. As times are uncertain, would it be a good idea to start preparing an AOS just in case at this point? Or is the preparing/filing/processing time for AOS to long to start now?

You could do that, but yoiu must be in the USA and have entered over 90 days before you start adjustment of status, and of course, you need to be current. So you are waiting for the VB as well.

It is technically possible to enter and adjust status, BUT there are some risks/challenges. You must be in status and not break any rules before filing, you have to have entered 90 days earlier, and then filing in July/August would be possible, but stressful.

Just wanted to add (for information, if someone else reads these comments) that I found out that “The 90-day rule will clearly not apply to people who enter the United States under visas that allow for dual intent.” and that ““dual intent is permissible for O-1 visa holders”. So with a good lawyer, this could do.

That’s true, I did not know O1 was a dual intent, but I did use the dual intent aspect of my H1 visa successfully during my DV case.

Dear Britsimon,
I am dv2021 winner and I am five months pregnant and delivery in late July.
1.If I get the interview before the birth of my baby, and if they issue the visa, how long do I have until I go to USA and activate GC?
2. I am planning to leave the baby in my home country after birth and visit USA as an activation trip with my husband and return back to my home country as soon as possible, because then I will be breastfeeding and due to Covid it is risky to take an infant on plane (They cannot even wear a mask). How long can I stay outside USA?
3. If I return to USA when my child is at least 1 year old (It will be his first visit, but my second visit to USA with my GC, since I visited to activate), will my baby be able to enter USA without visa?
4. If not, what is the next step of getting visa to my baby? What is the best thing to do as I am worried of this pandemic and travelling with an infant. It will be at least 20 hour travel from my home country to US.
5. Considering all this, should I delay submitting documents until early May?
Pls be kind enough to answer my question.

1. It is unlikely you will interview before the birth, but if you do you will have 6 months to activate. Read the FAQ about the baby.
2. Your first entry should be WITH the baby. There is no reason not to travel with the baby – people do it all the time.

Hi Brit and thanks for everything you are doing.
I would however wish to know your opinion on something regarding my DV2021.
My case number is pretty low (EU6xxx) and KCC already confirmed (in late January) that they have received all my documents and DS-260 and that i am ready to be scheduled for the interview. In spite of the Schengen ban, I know that Italy recently started scheduling interviews, and i was wondering what you think regarding my case because I am not sure whether or not to join the plaintiff list in the Immpact mandamus.
I know that in one of your videos on youtube, you suggested to someone else in a similar case as mine, with a low case number, that maybe it should not be the case for them to join the mandamus.

“Our visa team has developed a plan for the processing of DV applications now that we are permitted to do so, but it will take some time to implement everything fully. We certainly understand the difficulties faced by DV winners and will do everything we can to process all of the visas possible.”
This is what US Embassy in Nepal said a week before when asked about DV 2021! But only 17 cases have received 2NLs till date ! And the interviews are starting from late April !
Hope this lingering isn’t the part of their plan !

Hello Simon ,, I am a Lottery winner 2021 and the case number is approximately 5800 ,, my documents were processed and confirmed on 7/31/2020 and now I had a baby and I added it to my ds260 form without asking to open the form but I did that by clicking on Add The applicant has chosen a child and added his birthday on 3/29/2021 and you sent the form ?? Is this a correct operation that you did?

No – because the DS260 of the parents(s) would need to be unlocked to add the child. Documents would need to be sent for the whole family.

I added the child without opening my application and the system provided me with a special form for the child and I filled it out and the form was accepted by giving me (this is not a visa) and I sent an email to kccdecoument and it included the child’s passport and birth certificate and included an explanation that a new baby I had with him with The case number and all my information
