Hi Simon, Australian here with Oceania case no. 6XX for DV2025. My questions relate to my current address for the DS260, and my interview location.
I applied for DV2025 while living in London and my selectee letter states my Post as ‘LONDON’. I lived in London for 15 years until Feb 2024, when I left to travel for several months in Central and South America (where I am now). My belongings, employer, bank accounts, recent medical history etc all remain in the UK – all now linked to my Aunt’s address. I am unsure whether I will return to reside in the UK.
At the time my interview is likely to be scheduled, e.g. early 2024, I plan to be in Australia staying with family for some months.
– Is the interview location determined by the current address I list on my DS260?
– Can you comment on the merits of me listing my mother’s address in Australia versus my Aunt’s address in the UK as my current address? Similarly, any merit to me attending an interview in London versus Sydney in this case?
– Can you foresee any issues?
I wish to be 100% honest – just in a unique situation where I am between addresses due to long term travel.

Dear Simon:
First of all I would like to thank you for all your help, as of now I have four questions
– if I have the means to support me financially (House, Wife and children): 40K – 50K. Is recommended to file an I-134 form just in case
-I have a low/mid number 2025SA17XX, my passport will expire on April 2025. Do you recommend to get a new one right now and then submit the DS260?
– in relation to this question of DS260 (Do you have documentation to establish that you have received vaccinations in accordance with U.S. law?). My wife and I were vaccinated on US (2021) with two doses of Pfizer against Covid. Should we answer yes or no on this question?
– lastly, DS260 asks if the couple have been divorcerd previously. On my country there is an alternative to marriages that is called (union de hecho-de facto union); in 2017 y dissolved this union, do you think this counts as a divorce? In my country law in not divorced.

1. Precautions are up to you.
2. No – submit now and then you can take the new one to the interview.
3. Answer no. The question is about all vaccinations, and you won’t have the US level documentation.
4. You know the laws of your country better than I do (especially since you haven’t given me the country).

1. You don’t need to file a DS260 yet as it is optional in the AOS process.

1. Your case number is quite low.
2. You said you are processing AOS, and in that method you don’t need to rush to submit a DS260 since it is optional. I already said that – so you need to pay attention.
3. I also already said to renew your passport.

So once you are scheduled for an interview, there is not possibility it gets stuck in the Ready state if you are willing to have it and do everything perfectly on your end? I mean, in a hypothetical case in which you are scheduled for September, you’ll have it if you don’t fail?

As you may know, I am currently an asylum seeker in the United States. Unfortunately, my wife mistakenly indicated on the DV Lottery application that I am a “lawfully resident.” She was unaware of the exact meaning of this term, and now we are concerned about the implications of this mistake.

In your experience, does a VB published say the 7th of the month vs the 15th of the month makes a difference in terms of the scheduling capacity and the chances of having a good scheduling month (since it’s almost a 10 day difference) ? Or does KCC start working on scheduling around the same time anyway (ie knows the next VB numbers before we do) ?

I doubt it makes any difference. The VB does not JUST concern DV, and it is not controlled by KCC. So the timing of the release has nothing to do with DV or KCC scheduling.

Hi Simon.
I’m a 2024 winner, and i attended the interview recently. It went okay, but the CO seemed to really doubt my marital status, which i think is why i was given a 221g refusal.
I am unmarried but i have 2 children with my partner, one born in 2019 and the other born in 2023. I’m from Zimbabwe, but living in South Africa with my South African partner and the children. I attended the interview, and took both kids’ birth certificates as required in the instructions. I had not done the medical at the time of the interview. I was given a pink paper that requested i do the medical, submit passport and also send through documentation to prove i’m not married, as i entered the draw as single. I told the CO i can get a Letter of no impediment( Letter of single-status) from my home country stating i’m not married, and have never been married. He said to me i must submit documents from the South African government because i’m living in South Africa. However, South Africa only issues a Letter of no Impediment for South African citizens only.(I’m not sure if CO was aware of that fact)
I’m now in possession of the Letter of no Impediment from my home country, but i’m wondering if that will be deemed as sufficient if i submit only that to the embassy. My partner has also applied for her Letter of no Impediment from the South African government, but that will take about 3-6 weeks to obtain. Do you think its better to wait for her Letter as well, despite the delay, or will mine only suffice?
We’re also planning to get married soon, but the unabridged marriage certificate ( The one required for emigration purposes) will also about 4-6 weeks to process. We’ll get a normal marriage certificate immediately, but that does not contain the comprehensive information like the abridged certificate. Do you think if we get married now and i submit the normal abridged marriage certificate i will be refused as they require the unabridged certificate??
I know created this mess and if we planned to get married we should probably have done so earlier, but we were never really sure about the move with young kids and we probably left it too late, but this is the situation at the moment.

Yes you screwed up. So frustrating to read.
So send a cover letter explanation with the no impediment letter than you have explaining that you cannot obtain the SA one, and are providing the one you could obtain. Hopefully they will then accept that.
Then get off you ass and marry your partner and maybe you could add her to the case before you move – you can mention that to the embassy as being your plan. You write well – so explain that and see if they will help.

FYI at the interview the CO did ask me if i understood that if i get married to my partner i might be able to add her to my case, but i have only until September 30th to do all that.

Thanks again for all the effort you do to keep us informed. As the winner of EU2025 I follow your blog and YouTube channel with great interest. I understood the mechanism of derivatives and holes, but two things are not clear to me:
– in Europe there are many people (I know some) who participate in the Green Card almost as a joke. It happens that some winners say “but I live well in Europe…” and give up. I don’t understand if these dropouts increase the chances of other Europeans winners who fill out the DS260 and wait their round or if the freed up places benefit everyone.
– Let’s imagine that a person with a fairly low case number does not fill out the DS260. During his round he will clearly not be called for the interview. If he fills out the DS260 later, will he be eligible for the next round involving higher case numbers, or is he out?
– Around July will we only know the number of selectees per region or also the number of visas assigned to each region?

1. Yes, that happens every year (in every region). That is one of the reasons they over select, so that is already “built in” to the process.
2. He would still have a chance to process, and his low number would still give an advantage.
3. We will know the selectee numbers for each country and therefore each region. The visas available to each region is a formula, so we already know that (about 20k for EU), BUT there is some flexibility in the ratios between the regions, because unused quota from one region (usually AF) can be distributed to the other regions, again by formula. BUT don’t overthink the quota thing. You will not be able to calculate precise cutoffs, there will always be a “wait and see” element.

214b is a refusal for a non immigrant visa when the officer believes you have immigrant intent. He probably was suspicious since you have filed an application for an immigrant visa.

It’s been mentioned you don’t have strong ties to home country, while I’m a general practitioner and self sponsoring my travel, they did not let me show the documents as I did not make specific travel plan other than intended date of arrival and stay period of 2 WKs on DS-160 when submitted it , but after this I had my documents and travel plan one a paper and he did not let me explain my situation then all of a sudden refused me, that is unfair😕

Great, the July bulletin just came out and gave me hope for my AS169XX.
Does this refusal affects my DV as I did not have refusal last year when filled up the DS-260 form, but now do I need to unlock to update I have refusal today or no impact to not touching it?

You must tell the truth. State divorced and hope the CO is lenient about the mistake. Since no other person was missed or added on the entry, unmarried and divorced are essentially the same – so the CO could, and usually would, approve it.

Bit of a curly one that I’d love you opinion on…
Oceania case 6xx here. I currently reside in NYC on an E3 (non-immigrant visa) so lodging my DS260 would prohibit me from travelling in and out of North America as it demonstrates immigrant intent (which violates my current visa).
I have trips to Europe coming up for both work and pleasure until late September. Therefore, my current plan is to delay submitting my DS260 until then, after which time I will fly to Australia in November (it was already my plan to return there for 4 months) and intend on staying there until the process is complete via CP. I presume this should be okay as my case number wouldn’t be ready to interview until Jan at earliest.
Do you see any issues in me delaying the submission of my DS260 until then? Or have a better suggestion?

First you misunderstand the effect of the DS260. It is not a problem for your existing NIV, it does not violate your visa. It would be a concern for a FUTURE NIV application, not the one you are already using. Since you plan to be in Australia anyway you should submit your DS260 soon to ensure it is processed before your case number goes current (probably in December/January ish) so you can do the CP. Otherwise you could find you will be delayed being current, but not having the DS260 processed due to the big backlog of DS260s which is starting to build as we speak.

Hi Simon, thanks for all you help! I have a question.
When I submitted for the DV lottery I used a photo that was 1 year old and is also my New Zealand passport photo so very obviously more than 6 months old. I have a second current passport for the UK which is not my country of chargeability.
1. Would it be strange to try and use the UK passport in my DS-260?
2. Do you know if using a photo older than 6 months will get my application denied if they see my NZ passport and know it is an older photo?

1. No need to create drama in your own mind. Use whichever passport.
2. The CO isn’t going to be that concerned with trying to prove your photo is the same as the passport photo. Relax.

No country has a number of visas pre-allocated to it, but there is a cap that no country can receive more than 7% (3850). As for the next 2 VBs – wait and see.
