Hi, we won DV2017, we “activated” our green cards August 2017 and plan to move permanently in June 2018 one a project I am working on is complete. I had a question about being out of the country when it comes to tax, I have read articles which say you owe tax to the US even if you are earning and living outside the US although you may actually pay little to zero tax. Do you have any advice on this topic?

There is a difference between having to file a tax report and having a tax liability. Even if you became an LPR on December 21 of 2017, you have to file a 2017 tax report by April of 2018. Whether you pay tax or not depends on your income, tax paid in home country and many other factors – I am not a tax accountant.

Hello Brit: Is it true DV photos for marry couple are not to have date on it. Most of our photo have date on it and we were not the one that put the date on it the photos are even older photos but that is how they were printed and we want to take it for our interview is it problem?

Photos for the visa should not have a date on it. Showing photos as proof of marriage doesn’t have the same concern.

The instructions that refer to I-864v are “generic” guidelines that work for 95% of cases. Those instructions do not correctly address DV lottery cases.

i am from nepal and my case number is 36XX from 2017 DV lottery. the visa bulletin published in Dec had 3225 for Nepal. What is the likelyhood of me receiving the 2nd letter? I know the number of visa available to a country is 3500. Also, a winner may occupy that number more if the applicant has family members. We still have long way to go for this year until sept, from my understanding. What does that mean? Does it mean that the people upto 3225 Case number received 2nd letter or does it mean people up to those number were issued visa? Is there any ways to know how many visa has been issued to nepal till now?

I have Yemeni nationality and I won the DV lottery and I did interviewed at the US Embassy in Djibouti with this nationality. My current administrative action because of travel ban. I have now acquired Sudanese nationality after did my interview , Sudan non-banned country. The question is, do you advise me to speak to the embassy to change nationality in my case from Yemeni to Sudanese?

I have a question regarding vaccination:
My wife has some medical condition that makes some vaccines required by the process not medically appropriate.
I wonder if the medical panel that we are attending next week (as a part of the process) will give us any note that it is not medically appropriate to make those vaccines, would it automatically give us a waiver from vaccination that would be enough for immigration officer to approve our case without any additional procedures? I’ve read that some people request waiver from uscis. Do they do it after their case denied or before the interview? What are chances to get our case approved without vaccines?

The panel physician may take that into account, but in the end if the physician doesn’t agree with the assessment that the vaccinations are not medically appropriate, then the medical will not be approved and the case cannot be approved.

If it is medically not appropriate , you will get an automativ waiver, we did it as well and it would show on your visas that you have a waiver. In our case it was the fact that we had recent tetanus vaccination and would need another one, but time between those would be too short hence not appropriate. Also, varicella vaccination is not available in UK that is automatic waiver as well. Not to worry about medical, as long as you healthy and have vaccinations which you shoould have at your age, you will be fine. Nurse will let you know during your medical if there is any problem.fingers crossed for the interview, that is a lot harder part.

Fundamentally doctors take an oath to do no harm. The question is whether they agree about what is medically appropriate since some people try and avoid vaccinations for reasons other than true “medical concerns”.

My interview was on the 6th December 2017 , on my denial paper it is written 221g additional processing is required, and the CO Wrote on it 90 days plus and the Co then told me that they will check at the registry and get back to me . I have checked my status and it is presently written REFUSED, Sir is it possible that after the checks they will get back to me and that my status can change from refused to other or it will never change again? For the 90 days they wrote it nearly 30 days now it remains 60 more days.

By the way – fatal means you are going to die. You are not going to die because of DV.

You should replace the passport before interview.
The USA address you give is for the GC. Make sure that is a safe place.

you say nepal above 6500 is at risk how did you know that below 7100 there are most selected from nepal only without ds 260 ready status . there is iran which has higher selecties than nepal

I posted the charts to show the sudden drop in density at about 7000 to 7100. That is when Nepal and Iran hit their draw limit. That means Nepal has it’s 4097 selectees all concentrated in the early number range – even more concentrated than last year. Last year Nepal was stopped at 7450.

Yes it is possible. Very often embassies update the case status, but don’t update the status of the derivatives. If the principal is refused, the derivatives cannot be approved. As to whether it is possible that they refused the principal – well I don’t know the specifics of the case. They should contact the embassy, but since there is no appeal process a change in status is almost unheard of.

Q1: Should I unlock my DS260 to correct it?

So I read yesterday that part of the current official Democratic “concession” to the Republican “immigration reform wish list” is re-allocation of the 50,000 DV visas to refugees/temporary status individuals who have gone to the US in times of crisis. Republicans haven’t agreed to those terms yet, of course, but given that re-allocation has apparently already been presented in the Democratic counter, it seems the DV program as it exists now is severely threatened. The Republican counter and subsequent negotiations next week are likely to make the picture worse for the DV, certainly not more favourable.
Anyway, assuming immigration reform remains tied to budget discussions this week, and an agreement is actively sought by both sides in order to stave off a Government Shutdown, what is your genuine opinion on the likelihood of any changes to the DV policies affecting DV-2018?
I know you’ve answered questions like this in posts and comments in the past, but the last couple of days in particular have really seen the DV-2018 come into the crosshairs more than ever before. Admittedly, I’m more than a little nervous as I follow this news along.

The DV process is controlled by laws. Those laws don’t get changed overnight and without notice periods. DV2018 is unaffected.
