Dear Brit Simon,
My DV2020 interview was scheduled for May 2020 then cancelled due to COVID. Thanks to the lawsuit and the embassy opening and being proactive, I was lucky to scrap in and be issued a Visa last month. However, due to the last minute scramble for Medical etc before 30th Sept, I had to use my current passport which expires Aug 2021 although my Visa valid till March 2021.
My question: have you seen / heard of people getting a new passport after granting of VIsa and then entering US showing old passport with Visa otherwise I will have to enter by Jan 2021 due to six month validity rule – assuming Green Card ban not extended. The embassy was vague about if this was possible.
Can’t see anything on state.gov apart from visitor visas being able to use old passports which have original visa.

Regarding the DV-2022 entry, if there is a special rule for the venezuelan passports that they are considered valid for up to 5 years after expiry , in my case my passport expired May 06th 2020, should I use as the new expiration date May 6th 2025? otherwise should I select the option Passport Exemption (unable to obtain a new one). “8. Is there a minimum age to apply for the E-DV Program?

Hello, I couldnt find any information related to the questions I have. My brothers child is a special need individual and turned 18 this year and completed a high school equivalent program designed for special needs children. Since he is 18, he can enter his own application this year– I have 2 questions 1) if he (the child) wins is there a way for him to bring his parents along since he is dependent on them ? Ideally it would be best if either parent won and they can bring him as their dependent. 2) in the future when he is 21+ and either parent wins then can they still bring him as dependent?

Hello Simón, a friend is a winner of DV2021, she has 2 children, both children over 21 years old, one is already a legal resident of the United States and the other is not, when she filled out the DV2021 entry (in 2019) she did not list them because they were older than 21 years. On your DS260 you didn’t mention them and I see you say they should be mentioned. Your DS has already been sent, the documents too, and you have already received the email saying that you are ready for an interview. The question is, should you unlock the DS to mention your 2 children over 21 years of age even the one who is a legal US resident?

Allow me to make this quick point. I read here on several occasions people asking whether they can pay the $220 (for GC) once in the USA. Brit replied positively but I bet to differ. On the paper, it’s clear stated “you must pay BEFORE travelling…” . The word before is underlined. Let’s try to read on our own please. Maybe this could previously be paid once in the USA but every year information are being updated. And Brit may not know. Can anyone else confirm? Thanks!

I’ll state it again. People can pay that fee before OR AFTER entering the USA. No one is ever “challenged” for proof they have paid this fee upon entry. Paying after entry causes no problem.
I’m not sure you tried to create a controversy where there is none. Perhaps if you had done a simple google search, you might have come across this official article…

Attorneys for Gomez plaintiffs have remarkably filed a reply in opposition to Mohammed, Aker, Fonjong, and Kennedy plaintiffs’ opposition to the proposed stay.
Quick observation: Gomez attorneys suggest the DV subclass is only 20k DV selectees, which makes no sense. 100k DVs were initially selected, how did Gomez narrow that down to 20k selectees? Thank you

Dear Mr Simon,
I am DV 2021 winner, case number 19***, i am going to be a plaintiff in new suit case organized by Greg Siskind against the ban. Couldn’t get precise answer (probably there is no precise answer for now) during last zoom conference with them. If you could make something more clear:
1. As i understand, if the ban will be canceled due to Biden winning or anything else, everyone will be interviewed according their case numbers due to visa bulletin?
2. If the ban will not be canceled, probably we win the case, then:
2.1. We will have priority not depending on visa bulletin and becoming our case numbers current?
2.2. We will have priority, but will have to wait untill our numbers become current and after will have interview?
Can’t really make it clear for myself, cause yesterday was a remark from Jeff Joseph, that if your case number is not current for now you shouldn’t take a part in the suit, but Charles Cuck told that according to Aker/Gomez case big numbers were prioritised and passed the interview, but they had all current numbers for that moment… So i am deeply confused for now, should i participate having my case number not current or not..

1. No, not everyone. If Biden wins and removes the bans, there will be many people (about 18,000) that get a chance to process their cases, and that means we have too many selectees.
2. I’m sorry – I don’t understand your question.
You don’t give your region so your case number is useless. But DV2020 was different because everyone was current, so the lawyers don’t really understand how case numbers work. If your case number does not get current, no lawsuit can help.

My second question was, that if ban will not be removed, the lawyers win the lawsuit. What will probably happen with the plaintiffs. We will wait till our case number becomes current and will be able to get an interview even the ban exists? Or because our number wasn’t current on the date of lawsuit we will no get our interview?

I can’t predict every scenario. If you are not current, you don’t get an interview. As to whether the date of the lawsuit affects anything, I don’t know – we have to wait and see.

I would like to hear your thoughts on whether or not I should focus my energy in perusing all three “Public Charge” venues.
Meaning, it is within my grasp to come with solid bank statements, to a lesser extent a job offer, and to a lesser extent a sponsor.
So in your opinion, would you think that “less is more” and I should pursue one of 2 paths – either get a bank statement and a job offer or get a sponsor.. or would you say that “the more the merrier” and if I’d get all three of them it will only help my chances and no hamper them?
And if having all three is an absolute good thing, can the sponsor be from another state as the job offer?

I have a few questions as I have won the DV-2021 lottery.
I’m Japanese and I live in Tokyo.
1) I am currently preparing supporting documents including the Police Certificates of locations I’ve lived for more than 6 months since turning 16 years old.
I attended middle school and high school in Shanghai, China so I will need a Police Certificate issued from Shanghai, China.
However, I am struggling to obtain this because the Chinese Embassy in Japan has been closed since April due to Covid. There is no information on when they will reopen.
I was wondering if it will hinder my application if I do not have a Police Report that covers 16 years old ~ 18 1/2 years old.
Of course if I cannot obtain it, I will submit a written explanation when I submit my other documents.
2) If I lived in Shanghai, China from 2004 (when I was 12 years old) to 2011 (when I was 18 years old), do I need a Police Certificate from Shanghai that covers my whole time there (from 2004 to 2011) or do I need one that covers my time there since turning 16 years old (my birthday in 2008 to when I left in 2011)?
3) I have won the lottery of DV-2021. Can I register for the lottery of of DV-2022 in case I am unable to obtain a visa through DV-2021?
4) Will I be disqualified if I use the same photo for DV-2022 that I used for DV-2021?

And after 12 days they replied me like this .

Regarding the passport exemption. Would someone qualify for that if they have fled their country of birth, are applying for asylum in a new country, and cannot renew their passport from country of birth because revealing their current location could place their life in danger? If yes, does the applicant just write the explanation on the app? Also, do they have to apply to DHS for the waiver mentioned on the application? Thanks!!

Helo Mr Simon I am dv2021 u know period high school is 3 years, my first in high school was between (2010 to 2011 )
And Second year in high school (2011 to 2012) and third year in high school (2012 to 2013) All these years in one school
After completed this I took the certificate high school (successful)
But my average not allowed to joining to the medical collages which I want it so I sat to exam for final year in high school twice after first time (2013 to 2014) this year studied in other school and (2014 to 2015) this year studied in other school
(To increase my average so now I have 3 high school certificate)
In ds260 there question about number of educational institutions attended?

In the DS260 you have to list all your children (of any age), but you will not be able to get visas for the children over 21.

My question is what do we need to select in the option for immigration as there is also option for either the child is immigrating with you or not but as being above 21 my child won’t be eligible but i need to list them and while listing there is selection option for immigration.

However, there was one answer that you gave to a particular question that has made me confused and I want to seek further clarification. And it was about listing your children above 21 years on ds-260.
I’m dv2021 selectee and I have 3 children. At the time that I was entering for the lottery, my eldest child was above 21 years so I didn’t include her as my derivative. And also when I was completing my ds-260, I didn’t list her because I thought she does not qualify to migrate to US with us. Please I want to find out whether I should have indicated on the ds-260 that I have 3 children and listed her as well. Thank you once again for being so resourceful.

For children, you need to look carefully at the question being asked. In the DS260 the first question is “Do you have any children?. It does not say “Do you have any children over 21?” – so you should not assume a part of the question that is not there. If you did this wrong, as KCC to unlock the form.

HOWEVER – admitting the person was a “happy mistake”. The person should not have been admitted, the ban is still in force (unless someone already had a visa prior to April 23). So you should not rely on getting lucky in the same way, you need to realize you are risking your own time and money. I am not recommending you try entering the USA –
