i got selected in September 2016 (DV 2017). I’ve filled out the DS-260 form already, but i still didn’t get an appointment. My case number is 28xxx and one of my friend’s case number is 27xxx and he got already in 9th of May an appointment. Do you have any idea how long it will take? I’m so nervous, that i screwed up something by the DS-260.

HI Simon. Please I need your help and advice.
My appointment for interview will take place May,9 and my wife is pregnant and is supposed to give birth on May,20. I want to go only with my wife in september and leave the our bb with my mother’wife (the bb will have 4 or 5 month) then he will come joined us in 2 years when our situation will be good.(the person who will receive us in USA just want 2 persons, not 3 and I don’t have money to pay now for a third person).
Since several times, differents persons tell me that the embassy can refuse me the visa because American dont want to seperate families and the Embassy can tell that we want to abandon our bb.
I dont know what I must do.
1: What are the possibility if we want to go without the bb?
2: Is it an obligation to go with our bb directly?

So i had my activation trip in October 2016 (as I just mentioned in another post) so am due to return before October of this year. I’m wondering upon returning to the US, how long before I can make a short trip back home? I ask because it’s my fathers 70th and all my US family will be coming back to visit in January! I know this might look suss, but I would have a return ticket… and I also know it’s too late to apply for a re-entry permit 🙁
And it’s not just this instance, I’m just nor sure about the whole “length of stay” protocol, as im very close to my family and would want to visit frequently (at least once a year- that’s how often I currently visit my family in the states).
It’s really hard to find any information, as when I try to research I mostly just get info about re-entry permits (obviously irrelevant to me at this stage) and the initial activation trip when you can come back for 12 months.
Any info or advice would be greatly appreciated 🙂

The reason this might seem fuzzy is because there is some discretion for the immigration officers if they feel someone is abusing the LPR status.
Absences up to 6 months are legal and get very little risk of questioning. However, an IO might notice multiple absences and believe someone is not “living” in the USA.
Absences between 6 and 12 months are also fine. But the IO would have cause to question whether the LPR has established a home in the USA. This is more explainable for the “first activation”, but it does not mean that someone who has a subsequent absence of 6 to 12 months will have problems for sure.
Absences above 12 months without prior permission are very risky. There is high chance that an LPR would be paroled in tot he USA and referred to an immigration judge to explain why they should be allowed to keep the GC. So – absences of 12 to 24 months are where you need the re-entry permit.

The other thing is I recently found out I’m pregnant (very early stages) so am trying to get my things together with healthcare over there and a plan for the pregnancy.
IF my husband and I were to decide to stay here in Australia, I realise we would forfeit our LPR status and green cards, but I’m wondering if there’s a formal process for doing so? Who do we to let know? And will it affect future trips to the states as tourists?
of course this would only be an issue if there were difficulties with his pregnancy and I needed to have care here. I want to be sure on all bases.

If you need to surrender your GC you contact USCIS. If you are pregnant, just get an ACA plan from healthcare.gov.

Hi Simon,
Thank you for all your help. We received our 2NL and the interview date is 16 May 2017. I want to ask you a question about my child turning 21 years of age. I know you addressed this question with a link to follow speaking about the child status protection act that extends the age.
My question: My daughter turns 21 years of age in September 2017 (this year). Do we have to enter the USA before she turns 21 or does the extension apply where we can enter the USA a little later after she turned 21? I have googled this question with conflicting answers.

Hello simon I am a winner of Dv 2017, I played single but actually have two kids before the Dv entry with a lady am not marry to. I maintained my status as single with no kids to avoid disqualification. Last month my visa issue I intend to travel alone and subsequently in future marry my babies mama and get all three to the USA.
Questions
1.do I marry my babies now before traveling to USA?
2.do I establish birth certicate for my children before with my name as father and take along?
3.if the answer to Q1and 2 above is yes can I present these documents if searching for job in the USA.
4.when I decide to get my wife and kids to the USA ie after my green card issue will there be complication since I was issue visa as single .
5.can you please give me directive on how I can in future get my family to USA

Hi again Sir, one final question. I was able to obtain a certified and official letter of my education here in the Bahamas from the Ministry of Education. However I graduated from a private school here back in 1982 . That particular school went as far as form five which is year 11. That is when we graduated. My question is, my years in school totals 11 not 12. Would that be a problem for me? It was standard for that school and I graduated with a diploma. Please advise kindly.

It is not the number of years that matters, it is the level that the education means. If that level was enough to immediately enter a University for a Bachelors level degree, then the education was enough. If you would have needed further studies before University, then that education is not enough.

Hello. My wife, child and I entered USA in March and got our 551-visa validated. This months the physical green cards were already issued for my wife and child. Nothing for me (yet). I was hoping it was just delayed in the mail. However, now I got a ASC Appointment notice ‘Form I-797C Notice of action’. They ask that I come and get my biometrics taken May 4th.
Actually all 3 us us got finger printed, photographed, at the embassy and upon entry to US. Also, we all have biometric passports.
I am not in America currently, and the form states that a reschedulling can only be done by written applicatoin sent by mail i.e. this is already too late. The form also states, that failure to appear as appointed my petition (whatever they mean by that…) will be considered abandoned.
It all sounds very serious. Any experience with such form and what to do ? It seems strange that my wife and child got the actual green card very fast, whereas I (the main applicant) receive this Form instead. Any advise is apppreciated. Thanks

It simply means your prints weren’t clear. Don’t worry about it, but I would immediately write to request a reschedule if I were you (and keep evidence of the request).

I passed my interview at US consulate in Addis Ababa,Ethiopia.
During the interview they normally give a white paper informing Selectinve Service for those under the age of 26 as it says on the form. but I don’t know why they didn’t give me any paper noticing that on the interview.
I was born in Jan. 1992. i turned 25 in Jan. 2017. my visa expires in Oct. 2017 so by the time I get there I would still be 25.
should I fill the form when I get there??

Ok thanks I assume that level is correct as many students did and still do head of to University when they were done. I could not afford to go,
I did go to a vocational school in Florida and graduated with a certificate in Travel and Tourism but that school has been closed and I can’t find my diploma. I do have a reference from the school that I got when I completed. Would that suffice if asked?

Well the vocational school closed over twenty years ago. I can’t locate them for transcripts. Would the embassy then focus on my elementary and secondary education then or am I automatically disqualified?

IT’s not about being automatically disqualified. It’s about being properly prepared. Any school will be working under a certification board – so even if the school is gone you should be able to get certificates.

I told you how to find the address change. However, I think your GC will be sent to the address listed on the DS260 (you should have persisted at the airport). Anyway, change the address and see what happens.

You should NOT need to reschedule your interview. You simply have to setup an account and register the interview you have. If you are not sure – check with the embassy.

So basically unfortunately my husband filled in his tax returns for this year incorrectly by filling status as single rather than ‘married filling seperately’ using the turbo tax app (he did this beginning of April, before the deadline). As it’s his first year filling as a married man, since last year 2015 we weren’t married. Realising the mistake; he then filled in the 1040x form stating that he was advised incorrectly and wanted to change the status (again before the tax deadline, I also have a copy of this and the postal reciept as proof it was sent ).
So my question as I have my interview coming up at the end of may, is it sufficient to take what I currently have; my husband’s last year tax return (which was sent in the original affidavit of support form), all of his pay slips for the past few months, his employer contract stating employment and wage, this years w2 form that’s required to fill in his tax returns. I do have the returned tax form for this year, but it was with the incorrect status. Would I take this and explain? I dont want it to be an hindrance to our interview and im stressing like mad that they may say no to us based on the tax mistake.

Take 2015 tax returns and recent payslips/W2 etc – if they want the 2016 tax report you can follow up with that – but it most likely won’t be a problem.

I won the Dv lottery and went to the US for three weeks with my family and we got our social security nos. and the State Ids. (Michigan) and we came back to UAE to finish our things here and to go badck to US within 6 months inorder not to have a problem with the immigration. I have a problem if i want to deliver in US for sure i dont have any insurance now and am afraid it cost much to deliver in US. Do you have any idea how deliever there with no cost ( Michigan state) or if you have any emails for the health authority.. If it cost wealth i will deliver here in UAE and go there after the delivery and explain this to the US embassy here inorder to give me visa for the born baby.please advice

If you live in the USA you need health insurance.
If you give birth abroad, the baby will receive a Green Card upon your first return to the USA – but you must return before 12 months absence.

1) Does the green card arrive through mail or courier? Does the winner need to be present to receive the cards?
2) I saw that there was a case that required biometric tests in-between arriving in the US and receiving the card. Why did that happen? Was it an exception or a new rule?

1. Mail. The winner doesn’t have to be present, but the address must be a real residential address – not PO box or forwarding address.

A person who is already an LPR or citizen would be a better sponsor. An I-134 is sometimes not requested – but having one ready saves time if one is requested.

Hello, I am a winner of the DV Lottery and my appointment is next week, I was wondering if you could answer these two questions please.
1. On the day of the interview, how long does it take for the Consular to make a decision ? ( Approving or denying) Is it on the spot? Do they ask us to sit in a waiting area for some time before we get the result? Or does it take days?
2. I am the main applicant. Am I allowed to have more than one sponsor to fill the I-134 Form? Like am I allowed to submit 2 forms?

1. Most cases are approved on the spot. Some cases need longer for the approval – a period called Administrative Processing (AP). AP can last days, weeks or even months.
2. No – one form is all you need. The sponsors suitability is either good enough, or it isn’t. Two sponsors judged not good enough is worthless.

The sponsor is working part-time and her salary is not good enough but she has a house and no morgage and has offered us to stay at hers untill we find a flat.
The other one has a stronger salary and a full-time job but has just sponsored her mum and dad recently.
This is why I am thinking of an additional sponsor. Will the consulate even consider looking at two I-134 forms ? I mean do I have a choice of presenting two ?

I am currently on AP since 18/01/17 due to lack of presenting enough employment docs. I sent the docs to the embassy on the 19/01/17. I recently contacted the embassy about status of my case. First I emailed them then after no reply I called them and they said they had not receive any docs from me. After hanging up I saw an email from the embassy saying we confirm we have received your docs but you are still On AP and will contact you .Am confused.

The confusing part is the fact that when calling the embassy I was told that they have not received any documents from me and I should ask DHL where they sent my documents to. But a few minutes later they replied my email saying they have received my documents and I am still on AP. So am asking whose words do I believe and what does this different communications mean.

secondly, what documents will be needed to demonstrate my working experience. Because have my High School Diploma with me.

My question is, i submitted my entry in the UAE-Dubai for DV 2018 but i’m from Kenya. Suppose i get selected, please tell me where will the interview be done? Just to get a glimpse of how it works.

Hi Simon,
The Embassy has sent an email that our interview has to be rescheduled. From Mai 1, to May 9. We confirmated that.
My question is, does the second notification letter change because of the new interview date? Ist still written May 1.

My wife is the winner of 2017 dv lottery from IRAN. We had interview on feb 01(abudhabi) but regarding the first president trump’s executive order our interview date was changed to feb 16.
My wife reached her visas in 4 days but the officer told us that more administrative processing is needed about me.
Our problem is after arround 65 days after interview and sending 2 emails as following up the problem‚ the website of us embassy says NO INFORMATION HAS BEEN FOUND .
We are very worry about it.
Would you please let me know your kind answer about our serious problem?

AP is common for Iranians, and can last around 5 months. There is nothing you can do to speed that up – the only thing to do is wait.

Dear Sir/ Madam,
I was recently selected through the Diversity Visa program and about to do my landing for the first time on April 28th, 2017. I have not received my Green Card at my mailing address as of yet, and had a couple of questions to ask:
– I understand there is to be an interview and a process for getting Biometrics done. Does this take place at the airport during the landing? If not, how long does it take to schedule and carry it out?
– If at the time of landing, the Green card was not yet received in the mail, does the foreign passport get stamped with an I-551 admission stamp to establish one-year residency?
– Is it permissible to travel outside the US using the foreign passport while waiting for the Green Card to come in the mail without jeopardizing the PR status? Is filing a travel document form I-131 required beforehand?

1. It isn’t always required. If it is required it takes place at a USCIS office.
2. Yes – check your passport!
3. Yes you can travel. The I-131 is only needed for absences 12 – 24 months.
