Hello Britsimon! First of all thank you for the informative blog, it has been very helpful to get more knowledge about the dv lottery. I am the winner of DV 2017 lottery. My case number is 2017AS000038** So, my question is When will my case number be current? And, since I recently made my passport, which would take about 30 days to get it. So, I will fill DS 260 by June 12,2016. Is there any chance my late submission of the DS 260 form will cause me getting 2NL late or will it delay my interview after my case number is current?

I’ve been selected for dv2017 with CN AF00013xxx.
Please i do have few challenges for which need your time to help clear.
1.on my university transcript, I found out that my date of birth has been altered not corresponding to my birth certificate and passport date. So I consulted the university’s director of academic affairs on this matter, he indicated that there’s nothing they can do to effect the change.
However upon feeling the initial registration form for the lottery, I stated that I’ve a degree. So what can I do to ratify this anomaly?
2.Also, didn’t i complete the degree program but yet when filling the entry form on the hindsight I stated degree program instead of some degree program. Please what effect is this mistake also going to cause my chance?

1. Just explain the mistake to the CO during interview. Your date of bith is established by your birth certificate. Your only task is to show that the education documentation is yours.
2. No. They will want to see High School level – a degree is not mandatory.
** Note: If you are interviewing in Ghana with these issues there is more risk.

Having gone through some threads which you happened to moderate, I.e forums immigration.com , I’m tempted to seek further clarification.
The issue is on the eDV, on the question of the highest education achieved I choosed university degree instead of some university courses.
I filled the form out by myself but just that I didn’t notice or more appropriately understand the question.
Please what do you perceive the situation is going to be like in Accra?
Can this error results in a possible disqualification?

The date inconsistencies on your education certificates are a high risk for Acrra. However, not presenting a degree when you said you have one is also a risk there. Realistically, you can’t avoid the risk. Just don’t be tempted to be “creative” with creating documentation to strengthen your case. Get genuine documents only that might help, and hope the CO sees you as a genuine applicant.

Yes I honestly don’t have any intention of being ‘smart’ because I know how thorough COs are in Accra.
Please when you talk about genuine documents that might help, what documents exactly for instance you’re talking about?

Hi, I won DV-2017 and currently I’m in USA, so will go through adjustment of status. I hear a lot about “If your case number is RATHER high…”. For Europe is 16000 high? And second, from the moment I found out I was selected (May 3, 2016) how much time approx. it will take to receive a green card (if there are no issues of course)? Thanks!

Your case isn’t that high, but you will probably not be able to process your Aos much before Jan/Feb or next year.

Since you are doing AoS you could apply for the EAD when you submit your AOS package., Generally it isn’t worth it – but you can if you like.

Hi Britsimon, Is it possible to disqualify a candidate for the DV on health grounds, e.g if the person is tested positive in relation to any of the medical examinations requested like HIV, Hepathisis B, Tuberculousis etc.

Paying online makes things a little faster, but even so you can expect to wait 60 to 90 days after you enter the USA to receive your GC.

6 days is not a long time. Your GC will take 60 to 90 days (maybe even more) assuming you paid the $165 prior to entering.
Your SSN typically arrives within about 2 to 3 weeks.

I am a dv2017 winner with case number 2017AF000027xxx. My passport is valid until September 2017.According to the statistics I may be scheduled for interview in April or May 2017 and I think the passport has to be valid at least for six months after visa is issued. I already have submitted ds260 form but since I have made some errors I am going to ask KCC to unlock it. It may take me long time to get a replacement passport.
My question is.
1. Is it possible to unlock and wait until the new passport is ready and submit it later?
2. Is there a possibility that I may be scheduled for interview before April 2017 so that I can use the same passport?

I don’t know what status your relative is in. It is better to have a citizen or Green Card holder.

Hi BritSimon, I have a couple of questions that I hope you might help me with. My case number is 2017EU00020xxx. I am currently in US on H1B visa and I initially filled my DS 260 indicating I’ll go with AOS (USCIS location). However, looking at the times when my number is going to be current (likely April/May 2017) and the Nebraska USCIS Visa processing times, I’m not confident that I’ll get my GC by the end of September 2017. I still haven’t filed I485 (just filled DS260) and I got an e-mail from KCC (adjustment Letter) indicating that they are aware that I’ll be applying via AOS.
1. I think it may be faster and more secure for me to go through CP. How to make the change?
2. If I go through CP and get the interview in for example May 2017, how does it work with travel and return to US? Do I get my immigrant visa right away if approved? My H1B will expire July 2017 and my employer files H1B extension for me every year before June. It’d difficult to make travel arrangements outside US after they apply for extension, and before I get approval notice for H1B, which will likely be the time when I’ll get the interview.

You are worrying about timelines unnecessarily. THere is PLENTY of time to do AOS. There are people who get current in September each year who process successfully, because the standard processing timelines are not observed for AOS cases (particularly toward the September deadline). You can also use the early filing memo and it is quite possible you will have adjusted well befor your H1 expires.
CP would be disruptive to your work. You need to be in the home country at least 1 week before the interview (for the medical) and then the passport might not arrive for a week or two after the interview.
In your situation, I would stick with AOS. In fact, I did.
Make sure you are using Moms guidance.

My case number was current in April and I appeared for Biometrics on April 4th since then I havent heard anything from the USCIS or the NBC. I have been waiting for the interview letter but no luck so far. Just wanted to ask if this is normal wait time or is it unusual?

In most embassies they would forgive the error as long as you enter it correctly in the DS260. Some embassies are more strict. Accra embassy for example is particularly suspicious of such mistakes.

I had my infopass appointment this morning. As told by the immigration officer, my application had been transferred to Nebraska Service Center and there was a conflict because I had also applied for Temporary Protected Status Benefit last December which USCIS had offered for Nepalese after the devastating earthquake last year. The field office of Detroit has already filed for release of my information 0n June 13th, so that they could schedule an interview for me, but the request has not been completed yet by the Nebraska Service Center. Where as my spouse application has already reached the field office and they are looking forward to schedule an interview for her. I did send an email to Nebraska Service Center to inquire about my application about 12 days ago which they havent replied to yet. Do you have any suggestions on what I should do next?

I have re-submitted my the DS260 form after reviewing some errors.
I am now worrying too much about my answer for the question “do you seek to enter to the united states for the purpose of performing skilled or unskilled labor but have not yet been certified by the secretary of labor?”. My answer was “NO”.
I was reading about visa Ineligibility laws on the department of state website and I found the following:
Any alien who seeks to enter the United States for the purpose of performing skilled or unskilled labor is inadmissible, unless the Secretary of Labor has determined and certified to the Secretary of State and the Attorney General that
(I) there are not sufficient workers who are able, willing, qualified (or equally qualified in the case of an alien described in clause (ii)) and available at the time of application for a visa and admission to the United States and at the place where the alien is to perform such skilled or unskilled labor, and
(II) the employment of such alien will not adversely affect the wages and working conditions of workers in the United States similarly employed.
Do you think my answer should be “yes” and If I say yes , where shall I apply for documentation to present in case they ask me during interview?.

I want to make you clear about my academic documents that I have S.L.C (up to class 10 )certificate from my school and than I passed 2 years proficiency certificate level with out admitting in college which is called private exam. This proficiency certificate provided me from university (T.U) and than I joined university for 3 years bachelors . I passed 3 years bachelor degree regularly attending in campus . I have same registration number in proficiency certificate and bachelor degree. Am I eligible to apply DS 260 and interview ?. I heard that somebody told me that private proficiency certificate is not eligible to apply DS260 and it will be rejected in interview. Please, make me clear about it .

The private exam is not used. However, the bachelors may be considered enough – it depends on the CO since they have some discretion when the education level achieved through a non standard path is high enough.

Brit, My husband is the PA. We have early case number. Me and my husband went for interview in February. The consul that interviewed us congratulated us that we are qualified for the visa. And as understood, we were granted but same time put on administrative processing. I understand that this process take long. Up to date we have not been called. Is there any possibility that they will still issue visa to both of us considering our circumstances? Please help us to know more.

We are Indian nationals (me. wife and a kid) living in Dubai – UAE chasing the american dream very seriously. My wife actually born in UAE but with Indian passport and nationality. I have applied DV 2016, 2017 with her country of birth as a chargeable country for my application (i.e., me as a principal applicant as she has not done high school but i am an engineering degree graduate). Am I doing okay? am I eligible for entry? I have never been selected creating a doubt that there is some thing wrong in mine or ours eligibility!

You are doing it OK. But the lottery is not a plan – you have around 1 in 100 chance of selection.

Hello Sir Britsimon, I was selected for the 2017 program but in filling out the form I indicated that I am single to the question “what is your current marital status?” I am actually divorced which the embassy don’t know about because I have been at the embassy at the time I was married.
So I am thinking if I made a mistake by I indicating Single when I am already divorced..
But also to the other question that says “previous spours” I indeed said yes and I dictated divorced.
But I am worry about the first question.

You must make sure your DS260 is accurate. Unlock and correct if needed. The CO will need your marriage and divorce certificates.

Sir i m in troublesome.
At the time of submitting ds 260, i made a plan to marry later after my 2nd NL arrived and called for interview. At that time i didnt marry my girlfriend. Now i want to add my wife(married on july 12 after 2nd NL aarived ) as i read your article about handling marital status at the various time of dv. I choose the scenario 2. As i sent email to KCC to unlock my ds 260, but i found no reply. In your many comments i found its answer to contact with embassy to include my wife to the interview.
1. How can i do that sir?
2. Does this reduce our chance to get visa?
I made all this mess because we dont have any job, if we married earlier, we would not make our living better. As i wasnot sure about my 2nd NL ( my case no is 2016AS91xx).

You made a bad plan. Leaving it until after the 2NL was unwise – there is nothing KLCC can do at that point. All you can do is ask the embassy if they will include your wife.

They cannot get visas. So – there is no point in applying for them. Now – the only issue is convincing the CO was an honest mistake, not an attempt to commit a fraud.

thanks for the reply. still have some doubt please enlighten me. i have not fill my DS260 form and my case number is 2017AF000053XX still trying to do my passport.
1) would it cause any problem with regards to the time i will be scheduled for an interview?
2) can i fill the DS260 form without having a passport?

1. Not a problem as such. but your interview will be delayed because you have been slow to submit it.
2. Yes. Use other ID then update the DS260 later.
