Hello simon I filled my wife edv as the principle and me the derivative she was selected and we haven’t filled the ds 260 yet, she has two surnames as osei tutu and Victoria as the first name, the surname is not hyphenated, I mistakenly put osei as the surname and Victoria as first name and the tutu as middle name, but on the passport it shows osei tutu as the surname and Victoria as first name..what should I do now ? Would it be a problem or can I change it before we fill the ds 260 please advice me

You cannot change the original entry, but you must fill in the DS260 with the accurate name.

Hello Mr. Simon,
I am a french citizen and my wife is a U.S citizen. We got married, and live, in France. She tried to submit a petition for me as her husband so I would get a green card but since she has not been working for the past couple of years, and has not filed taxes, it just makes this process harder (maybe impossible?). I am thinking about applying for the lottery but I am afraid than if I do not win this attempt to win the lottery will affect a future petition from my wife. Any suggestions?

I have a question. My number is eu14xxx and will be current by next January. When i was filling the dv lottery application form last year, in the highest degree of education section i marked some graduate level courses. Back then i was working and also enrolled to a master program. When i was filling out ds-260 i did not mention about my master program because i quit it and i only included my high school and university education. Do you think it will be a problem for getting an interview date, should i un-lock it and revise? Thank you.

I was attended interview on October first-2015 , all required documents were completed, but there was some mistake in my DV-260 , I filled my full name by mistake in field of my Spouse , the Embassy representative has backed our passport and he informed us that our situation refereed to ( Administrative Process) and it will take sometime to solve .
My question is : is this mistake may can effect on my visa status ? may be cancel ?

The problem with that is that the mistake meant they could not perform background checks correctly on your spouse. I have known embassies to refuse a candidate immediately in that situation. However, it sounds like they are requesting the background checks be performed – and if so, you should be OK. But – you will not know until it is over. Just be thankful you were not immediately refused!

I would like to know that when will I receive my second letter (approximate time) and when would be my interview date approximately?

1- To send documents to Ankara Embassy ,before interview date, should I send the original certified translation of documents or a copy of certified translation is Ok?

Don’t send any documents to the embassy UNLESS they ask for them. You would normally present the documents on the day of interview unless they specifically ask for documents to be sent before the interview – in which case follow their instructions exactly.

You need to have completed high school SUCCESSFULLY. That is defined by each embassy – and some of the embassies publish that. Check your embassy website and compare your qualifications…

does somebody know the minimum education requirement for the DV lottery? Is it the MITTLERER REALABSCHLUSS? If yes, can it be achieved through AUSBILDUNG? I mean 4 years GRUNDSCHULE and then 5 years HAUPTSCHULE and then 3 years AUSBILDUNG. Does this way qualify for DV lottery or does the MITTLERER REIFEABSCHLUSS have to be through REALSCHULE?

When i filled my dv lottery application i put just my first last name. (first last father name that is usual in Sudamérica.) In DS-260 application you need put your names like your passport, then i put my first and second last names. I read that this would maybe disqualifications at the interview. What do you think? It is not certain refusal, especially given how common this is in some countries (my wife was the same – as she is from Spain). So – make certain the DS260 has both names – and that means the background check will be accurate.

You might be able to keep the GC alive by entering every 6 months as a minimum – BUT sooner or later they will realize you are not residing in the USA – and they can withdraw your GC. So – it is a risk.

Firstly, thanks so much for your hard work in helping us mere mortals try and decode the bureaucracy that is the DV Lottery Program.
I have a couple of questions, firstly, what is 1NL and 2NL?
Secondly, I am from Australia so apart of the ‘Oceania’ region and my Number is 2016…925 – what do you think the likelihood is of me being safe, etc?

1NL is the letter you saw saying you are selected.
2NL is another letter (plus email) that gives you the interview details.
More info on those in the FAQ.
When people ask are they safe – they are really asking whether their case number will become current (i.e. eligible for interview). The number doesn’t mean anything more than the order in which cases are scheduled but in most recent years demand has outstripped supply, so higher numbers were not “safe” and many people missed out. However, OC is “underselected” this year and there are more OC visas available than selectees who want them. So – although your number is in the final 30 numbers, your number was safe from the beginning and in fact is already “current” for an interview in April. If you submitted your DS260 before January you will probably get your 2NL in the next week or so.

It’s hard to predict – but there are two things that need to happen.
First, they need to verify the I-134 meets the requirements. That is normally quick, and once that is done they will do the second thing.
Second, because your case was in AP past the end of your interview month, the embassy will have to request a visa slot for you from KCC. Busy embassies can sometimes do this from existing monthly allocation (denied cases), but otherwise the embassy has to wait while KCC re-allocates a visa. That can take some time.

OK – so let me check if I understand what you did. You married in December and at some point you unlocked your form (as the winner), added your husband and completed a DS260 for him, which was submitted last week – correct?
In that case his DS260 will now need some basic processing. Depending on his travel history that could be very fast (2/3 weeks) or a bit longer. Once that is done you would be ready for scheduling – so then it just depends on your case number. Are you current now?

Yes, that’s totally right, I’m also getting it unlocked again (as per advice in a previous post of yours) to change my marital status to married.
My case number is 925, I’ve checked the link on your page and it says ‘At NVC’ which I’ve then clicked on the NVC State Gov page and it lists all of these requirements I’ve never even seen before beyond what was written on the Diversity Visa pages on the KCC Travel State. Should I be preparing everything the NVC page has listed that I need?

Ahh yes – 925. Your case will say NVC until the case is scheduled. You are actually current for an April interview, but I’m not sure if they will have noticed you adding your husband. There is a chance they “grabbed” your file for interview before you asked to unlock. You might want to give KCC a call to check that they have included him on an April interview or put the case back to a May interview.
Forget everything it says on the NVC message – it is just standard info that does not apply to DV cases.

Your website is such a wealth of knowledge, I honestly can not thank you enough for all that you’ve done on this – I sure hope you get a lot of donations!
I have emailed Kentucky to advise them, attaching my marriage certificate as well, so hopefully they’ll come back if needs be and we can push back, etc.
In your experience, if the application has all of the right information, all of the forms and relevant documents are on hand, would they find grounds for refusal? My husband and I live in London although we are Australian natives – proof that we are able to live overseas and not live off the state.
The visa process to the UK was so simple and over and done with in virtually 24 hours – what a change this has been!

I moved to the USA with a H1 visa to start with – so I did not interview in London for the DV – I did it in the USA.
London do tend to ask about finances. For a couple they would expect to see savings of at least $20k, more is better. They also take into account the qualifications/work history of the selectees to determine how the selectees will avoid becoming a “public charge”. If you can’t show that level of savings then you can show an I-134 (not I-864) from a relative or friend that lives in the USA.

Aussies seem to have around 10% chance of denial – usually for not meeting the education grounds I believe. In the UK, it was possible to leave school at 16 – the two additional years of college was optional. So – in that sort of system (similar to Australia), someone may have left school at 16 – moved on to a responsible job, but then not meet the education standard.
This might seem complicated to you at the moment – but the only complicated part is completing the forms. The waiting is horrible – but the prize is a Green Card that normally takes people years to obtain and thousands of dollars.

I would normally say around $25,000 – but it is not a finite amount. More is better. The CO may accept the foreign statement – I don’t know for sure.

I got selected for the EDV 2016 while I was here in US. I have filed for the AOS and my case number will be current this April. However I have a concern regarding my mother’s identity. I lived with my step mom since I was a child and my biological mother and my father were never legally married. So for every other legal purposes I put in my step mom’s name as my mother and so I did when I applied for F1 visa and my social security number. Since now I have to attach my birth certificates along with the application, I started putting in my biological mother’s name in all the applications. I did that in my DS 260 and I did the same for my AOS too. The Chicago Lockbox has already routed my AOS application to the USCIS NBC. Do you think this might cause a problem in the interview or is there any relevant evidence that you think I should present which could help my case?

Your parentage has almost nothing to do with your DV application. The only issue is what parents you “declare” as part of the immigration process as it relates to your possible sponsorship of your parents in the future. You could for example sponsor both your biological parents (regardless of their marital status) AND a step parent if that was through a legal marriage to one of your parents while you were young.

I would also like to share another information for people who are filing their Adjustment of Status (I-485) by themselves ( I hope I am not being an smartass.) USCIS allows US residing DV applicants to expedite their AOS application which hopefully cuts short the FBI security check process time.

USCIS will not sacrifice security but cutting short security checks – that is unrealistic. The expedite you talk of is generally ignored by the FOs – I have personal experience of that – but in any case very few applicants have significant delays on AoS cases (even though they feel like the delay is significant).

The affidavit of support is something that is requested to prove that the selectee will not become a public charge. So when they asked you “Do you know someone there? What will you do in the USA?” they were trying to see if you had anyone to help and support you in the USA and a sensible plan. Because of your answers, they obviously were satisfied and therefore did not need to ask for an affidavit of support. Someone else, with different circumstances, might well have been asked for the I-134.

Just realized that the printed information after Dv260 filled form indicates that my mother is alive but per my Passport information she is deceased.
Will that have an effect?

1. The DS260 should reflect the truth. As you have been scheduled for interview you will have to explain the difference at the interview.

İ’m a dv winner and my interview date is scheduled for 2nd, May 2016. I get the opportunity to obtain 3 affidavit of support (i-134) from different friends in USA who want to make it for me. So I want to know:
1- Is it possible to submit three different affidavit . It may not disqualify me?
2) My bank account is approximately $3,000. can I joint my bank statement to my documents. Do you advise me for that?
3) According to the affidavits is it possible to submit them after the date of my interview if my friends make a delay for sending me? It may not decrease my chance because till now they didn’t send me and I’m afraid.
3) The US address where I want my green card to be send is different from those of my 3 friends who want to make the affidavit for me. is this problem? Because when I was filling de DS-260 I didn’t get in touch with those friends because I didn’t have their address earlier. The other problem is that after coming to USA (if I get my visa) I will live at an address different from those of my friends et the one I wrote in the DS-260: is it possible for me to change the address where my green card will be sent?
4) I am a Chadian , But right now I live in Turkey where I am studying since October 2015 and my interview will be here in Turkey. But I won my DV lottery when I was in Algeria (I studied in Algeria for 7 years ago and I left it since August 2015) So about the police record must I present from both Algeria and Turkey? what about the police record from my country CHAD. Must I present also?

sir i won the dv lottery but i misspelled my name while filling the application form i filled navin instead of nabin now can i fill nabin in DS260.. will this have any chance of deselecting me or appear as a problem

A second draw is not certain. If they do select some it will be very small – 5000 to 10000 only.

i just checked by status on 4th may 2016 for DV2016 and found that i was selected for further processing with case no 2016AS00004*** .
What can i do know? Can i complete my further processing ? Is there any chance that i can get visa now???

Yes, you can process now if you hurry and submit your DS260. There is a guide to the process and completing the DS260 at the top of this page – read it, and complete your form. You must act fast.

i won 2017 as a single and got randomly selected. I was engaged may 2015. Now i am stucked with my choices. Get married and send ds260 or send ds260 and then get married and ad my wife!!! I would like u tell me what would be the best way and i will have more chances. I need to know what is ur suggestion based on ur experience Your assistance is appreciated in advanced.
