The DV lottery instructions seem to confuse people about the main requirements for the DV lottery process. The first requirement is about country of eligibility which I will address in another post. The second requirement is education/work experience. So I would like to address some common misconceptions. The rules say this.
Requirement #2: In addition, to meet the education/work experience requirement of the DV program,
you must have either:
a high school education or its equivalent, defined as successful completion of a 12-year course of
elementary and secondary education;
OR
two years of work experience within the past five years in an occupation requiring at least two
years of training or experience to perform. The U.S. Department of Labor’s O*Net Online
database will be used to determine qualifying work experience.
I highlight the either/OR because that is the first misconception – You only need to qualify by one or the other, not both. If you meet the education requirement you do not have to worry about proving work experience.
The second misconception is that each adult (husband and wife) needs to meet the requirement #2. That is normally not the case (the exception being to do with cross charging which I will explain in another post). The principal selectee only needs to meet the requirement.
OK so let’s look at the two options. The first is the simplest and best way to qualify.
Education requirement
The intent of this requirement is to take in immigrants that have achieved an education equivalent to a USA High School education. Note the “USA” part. They are dealing with immigrants from all over the world and needed to establish some “level” in USA terms that can be compared to other countries. So – the level they chose is High school. This is the point at which an American child has graduated high school and is qualified to enter s US University (college).
The term High school is confusing. For instance, in the UK where I was educated, “High school” ended at 16 years old – and that would NOT be sufficient to meet the DV requirement. In UK terms a child would have to attend 2 further years of education beyond 16 years old (receiving “A levels”) to be qualified to enter a University – and that is the level required therefore. Other countries will have other standards – and each embassy is able to set the level required based on their understanding. This has led to some changes over the years that has caught people out. Some embassies publish specific and quite detailed information such as this information for DV2015 from the Kenyan US embassy or the information from the embassy in Sri Lanka. Sri Lanka by the way was a recent example of changing their standards and there are some sad stories about that on the internet.
There is a page which offers a listing for many countries here. However, be very careful with the information as it is not 100% accurate or up to date and some countries will have varied their requirements (again Sri Lanka is an example).
So – hopefully by now you have understood that there is a minimum requirement for your country. The various embassy websites are a good place to get information on the level required.
Does a higher education satisfy the education requirement???
Another common question I get asked is “I have a Bachelors degree/masters or whatever, surely I don’t have to show my High school A levels/High school diploma”. The answer is a bit of a grey area. It makes sense that someone having gained their masters or whatever must have met the requirements BUT there are some exceptions to that logic. For example, it is possible to obtain a Masters degree without having finished 12 years of elementary and secondary education and for that reason some Consular Officers will be “picky” about seeing the HIgh School level proof. There have been many reported cases where COs have insisted on this and I am sure there have been cases of denials based on this.
Vocational education
The rules specifically exclude vocational education as being used to qualify on education grounds. For example, if a selectee were to leave school at 16 and then immediately or later go into a vocational program such as teaching or nursing, the time spent in that vocational training/education could not be used to satisfy the educational requirement. In cases such as this, the selectee may need to consider whether their work experience is sufficient to meet the requirement #2.
Work Experience requirement
Ok let’s say you cannot qualify on education grounds. It is possible to base your eligibility on your work experience – although doing so is harder than education so you would only use this as a fallback method. Why is it harder, well with education you either do or you don’t meet the requirement. You present your proof and as long as you understood the standard correctly you are done. Work experience cases are “judged” by the CO based on the proof you can supply at the interview. They are subjective therefore – it is a matter of how well you can convince the CO that you meet the requirement.
So ok – what is the requirement? The instructions say it is 2 years experience, gained in the previous 5 years, in a job that meets the standard described in the O*Net database. The standard to be met is a job that is classified in job zone 4 or 5 with a SVP (Specific Vocational Preparation) rating of 7.0 or higher. Not all jobs will meet that criteria – it is generally jobs which require a higher level of education, or skills.
How do you check your job? Well you navigate to the O*Net database and enter your approximate job title in the Occupation Search field. You will get a list of similar jobs and you should find the one that is closest to your work by title. For example I typed in “teachers” and from there I chose “Kindergarten Teachers, Except Special Education“. Scroll down the page and find the section “Job Zone” as shown here:-
You can see that Kindergarten teachers is a job at the correct qualifying level. However if you look at a Teachers Assistant – then you can see that is NOT a qualifying job.
Sometimes of course your exact job title will not appear. You can choose a similar job that explains what you do and if necessary you might want to detail your job duties to show they align well with the skills, tasks and so on of the job you wish to use as proof.
How to present the case…
OK – you believe you have found the right job description in the O*Net database. You are soon to attend the interview – how do you prepare.
Well first of all, you have to understand that your credibility will come in to play. The CO has some latitude about how they approve these work experience cases, your task is to give them a good case to be able to approve you.
I would suggest preparing a well organized and professional looking file to include as much as possible of the following:-
- The print out from of the job to which you are aligning your experience.
- Employment letters such as job offers, promotion letters and so on.
- Letters (preferably notarized) from current and former managers, colleagues and so on.
- A description of your day to day duties in the roles covering a minimum of 2 years.
- Details of any vocational training or education that supports you in your job.
- Examples of work product if possible/applicable.
Make this as complete as possible. As I said your credibility counts, so look professional, have a professional demeanor and make sure what you present is well presented, free of typos etc. You generally should not need professional help in preparing this file – and if you think about it the use of a professional could cause the CO to question whether yuou are really at the level you are claiming.
It is worth spending some time on this point, if you fail to convince the CO and have not qualified on education you will be denied and there is no appeal process (if processing outside of the USA).

I am Medical and Clinical Laboratory Technologist (degree in Bioanalysis in my country) and have doubts how to answer these three questions of the DS-260 form:
1. Do you seek to enter the United States for the purpose of performing skilled or unskilled labor but not yet Have Been certified by the Secretary of Labor?
2. Are you a graduate of a foreign medical school seeking to perform medical services in the United States but not yet Have Passed the National Board of Medical Examiners examination or equivalent ITS?
3.Are you a health care worker seeking to perform work in the United Such States but not yet received certification unavailable from the Commission on Graduates of Foreign Nursing Schools or from an equivalent approved independent credentialing organization?
I understand that the 3rd. I answer the question with a yes but do not know how to explain my situation because obviously I’m not certified by any institution in U.S.
Moreover I work from 7am to 1pm in a clinic and I have another shift at another clinic 1pm to 4pm. But it does not allow me to add another current job, as you explain this?
In my case I have to show my level of education both as my work experience (I graduated from high school in 2007, of bioanalyst in 2014 and worked since 2011).
I hope to help me with this is the only thing missing me to send the DS-260.

Don’t overthink those three questions. They are in the form because of non DV related cases that also use the DS260. They are not important for DV cases – so answer them honestly – but don’t stress about the answers.

I answer this: Yes, I am bioanalyst and I want to do this work in the United States once I have approved some type of accreditation that allows me to do it legally.
Currently I do not have this accreditation because I did not know it was going to be selected by lottery visa.

Yes I have a brother in the u.s. if you don’t have a relative you should have a friend who will lodge you and that is what you need to tell them. The documents you need to show are your qualification documents, medicals, birth certificate, non conviction, passport, and pictures. My interview didn’t take up to 5minutes

This can be long but I need to write it. I was born in Nepal and completed my 10th by regular school from Nepal.
Now I have been living in India since 12 years. From here, I passed 12th from NIOS (http://www.nios.ac.in/) and bachelor degree from University of Delhi (http://sol.du.ac.in/) but both are distance education.
Here in India, my 12th class and Bachelor degree(3 years) are equivalent to regular 12th class and Bachelor degree which means I can sit over the government exam which required 12th and Bachelor degree.
In DV instructions, there is mentioned, “Only formal courses of study meet this requirement; correspondence programs or equivalency certificates (such as the General Equivalency Diploma G.E.D.) are not acceptable.”
As we can see the correspondence program is not eligible. So am I eligible to apply DV based on my education ?
I am working as “Software Developer” since last six year. Shall I apply to based on my work experience as my designation is available on O*Net database.
So what I should do ? Please suggest me, thanks for reading all this.

I don’t have a highschool diploma, as I left to work straight after my 10th grade (11 years of school including grade 0 which comes right before 1st grade) but that’s not sufficient.
However, I’ve been working since I was 13 as a waitress as well as many other jobs.
I know that waitressing is certainly not the same as here in Denmark, unfortunately, as I have both worked at Michelin starred restaurants etc. And the education of becoming a waiter/waitress here takes 4 years, but on the *O Net database it doesn’t count.
However, I graduated as an actress after 2 years in the US (New York), they told they would be considered as a Vocational School, now I see that, that too isn’t sufficient either.
SO, my question is (I’m sorry about the novel, I just want to make sure I got everything)
My work as an actress (which I have the required years of experience with) is not more than the required job zone 7, but writer is. I do write, but more experience with acting.
However, the entire description of writer, fits more to what I do when I prepare for a role, research for character, etc. Than the one of a writer.
I have once applied for the O-1 Visa (long story of why that didn’t go through, I’ll save that for another time 😉 ) And I still have all the letters from producers, actors, directors, casting directors and so on. As well as proof and pay stubs that I worked as an actress both in DK and in the US. I think there’s about 130 pages.
Could I bring that to the interview along with the description of the writer occupation as a description of what I do as an actress?
Also, which answer do I give on the application to the DV lottery, as there’s no “work experience” option?

For work experience they consider employment experience that is full time and provides a living wage. If you have not had regular full time employment in either acting or writing I would say you will have a hard time meeting the work experience requirement.
The educational level question just needs to be answered – it is not identifying how you propose to qualify.

It also states that it could be writing for performance (I’m currently writing a script for performance). It doesn’t say HAS been performed, just FOR performance.

The ones I have from when I worked in NY ( I was working on an OPT, where I could only work as an actress for 1 year ) I wasn’t working every day, as it was freelance, but I think I have around 70 paystubs, the salary was low, but I was getting paid.
The hours were very long. Often 12-18 hrs pr day. I didn’t get my OPT until end of Feb. 2014 and productions slows down from around mid-end of nov. It expired in January 2015 and I had to return to Denmark. But no other work on the side, as I was only allowed to work as an actress.
The acting I’ve done here in DK, I’ve had to have jobs on the side as I had to be able to save up for my tuition to study at the acting school in NY.

After that I have obtained one Bachelor diploma (3 years / 180 ECTS) in as Manager of Business Communications, and then another one, also Bachelor (4 years / 240 ECTS) in Information Technology. As I have no work experience, is it enough to qualify?
My concern is that, if I get selected, they will disqualify me for having no (paid) work experience. Is this education enough?

Okay I am thinking to choose vocational, I dropped out of high school and then did a two years IT course. (The Netherlands here) If I win hope its enough. I work in different fields, a year here a year there. Now I teach IT but I used to work at first and second line IT support. I can get enough recommendation letters that is for sure and references. Hi Brit, someone I know got selected for dv2017, she has a high school degree but her husband has only primary school degree which is only 5 years of education. Do you think that this may become a problem during the interview?

Hello Britsimon please i won the 2017 dv lottery and on fillin my ds260 form, i mentioned my highest education to be vocational training… I have a high school certicate. The problem now is that the school i did my vocational training shut down without issueing our certificates. Please i need help

Your vocational training would not be helpful to meet the requirements anyway. So – just focus on what is needed to meet the requirements – US high school equivalent.

i and my wife were on intreview today, all of our document were ok , but i lost my bachelor degree here in hotel in yerevan befor inteview and the officer told me i have to sent them th orgin of bachelore degre, but i have lost it and i cant catch that again, im student at master degree now and i had my high school deegree too. what should i do now? please respond me .im so worry . and the other thing that i have 2 bachelore degree in two diffrent subject. but i just added one of my bachelore dgree in ds260,

Well, you will have to provide an official replacement. So – contact your education authority to do that.

Hello Simon. Please i mentioned my vocational training certificate as my highest qualification when i was feeling my ds260 form. What is making me panic now is that I didn’t collect the vocational certificate because the school shut down due to some financial reasons. But i have my high school certificate and also two transcripts of my first and second years in the university. And i equally succeeded in those transcripts. Please help tell me what to do. Please. I’m waiting. And my interview is coming up early next month.

The diploma won’t help (because it is vocational) but you haven’t mentioned your other education.
The 3 years work experience may or may not help – as described in the article above it needs to be in a certain type of job.
You clearly have not bothered to read the article. Take some responsibility for your own case. READ THE ARTICLE.

I have done diploma in pharmacy which is a part of CTEVT( Council of Technical and vocational training)
I have done vocational training ( practicals) along withit i have studied 3 years of pharmacy course so do i qualify for dv lottery?

Vocational education (such as your diploma) does not considered toward educational requirements. So – you need to consider your elementary and secondary education up to about age 18. Check the education requirements in your country (on US embassy site).

I havent done any further education.
At the age of 16 i have completed 10 and from 17 i have started DPH.

Your elementary and secondary education is most important. I don’t know whether you meet the requirements in Nepal – I don’t know your education NOR do I know the requirements in your country. So – you must decide whether to proceed or not.

I have one more question sir,
Do i have to show police clearence certificate of both the permanent address and temporary address?
I lived in permanent address about 6 years from birth and after that shifted to the temporary add. till now (14 years till now).
