I went for interview without medical report and police report. The CO gave me a white sheet that MR and PR has been ticked. I did my reports and submitted. In a week’s time, my visa status changed from Administrative Processing to Ready. It’s been three weeks and it’s still on Ready. Please what’s happening?

Hi Sir,
I am from one of the six countries in the travel ban. I received my visa on May and got admitted to US in July after ban went into effect without any problem. I stayed there for two week and came back. The question is I will go back to US soon and as you said the admission stamp in my passport is the evidence of permanent residence. They even send the green cards to the address we gave them after we left the US. My question is that Do I now considered officially a US permanent resident? If yes Does it mean that I remain exempt from the ban because I am a permanent resident and can go back to US without a problem?

In my ds260 i chose NO to the question about vaccination records, thinking i didnt have any paper documentation. 3 months later i found papers. Whats your advice on re opening the form? Shall i ask for it and change into YES or leave it as it is to avoid any delays and bring the papers to the gp? Many thanks

I had my interview in May and will activate my GC in October and start my new job the next day. It’s the first time my employer hires a GC holder and he wants to finish all the paperwork beforehand but that won’t be possible as I haven’t activated my visa yet, right? I think he also needs to fill out form I-9 and that from asks for the Alien as well as USCIS number. I have the first one on my forms, but won’t receive the USCIS number until activation, right? Will that cause problems for my employer?

By law the I-9 does not have to be completed until a few days after your start date. They can accept the visa stamp in your passport.
However, you won’t have the SSN that fast, so that is going to be a problem with such a fast start date. It will probably take 2 weeks to get the SSN.

I believe that my personal situation is a little complicated, and would appreciate some opinions on what to do next. Below, I have listed out some key information, a timeline of events, and some questions.
Key information about my situation:
– Currently living in the US on an E3 visa
– Have been approved for an H1B visa (with consular processing), so am eligible to get the H1B at a foreign embassy/consulate from Oct 1, 2017 onwards
– My number in DV lottery is likely to become current in December 2017 (give or take a month or two)
– May have violated 30 day rule (by submitting DS-260 shortly after entering US)
Timeline of key events:
– Mid-2014: Received F1 visa and entered US for a 2-year graduate degree
– Mid-2016: Converted F1 visa to F1-OPT visa
– Early May 2017: Traveled outside US to get an E3 visa at a foreign-based embassy. Returned to US – immediately afterwards on the E3 visa, so total length of stay in foreign country was ~1 week
– Mid-May 2017: Received notice of approval for H-1B Visa
– Early July 2017: Travelled to a foreign country for 2 day for work reasons. Returned to US on the E3 visa at the conclusion of the trip
– Late July 2017: Checked the DV lottery, and discovered that I was selected. I followed the instructions and submitted an AOS DS-260 immediately (~3 weeks after re-entering the US from my work trip in early July)
Questions that I have:
Q1 – It appears that I may be in violation of the “30 day rule”. How concerned should I be about this affecting my DV AOS application? (note that [1] I did not know about my lottery selection when I entered the US in July 2017, and [2] I was only outside the US for 2 days on a short work trip)
Q2+3 – With my H1B approval, I have the option of going to a foreign country to apply for a visa stamp. Is it possible that my previous submission of a DS-260 (and possible violation of the 30 day rule) will affect my chances of visa stamp approval? Would it be inadvisable for me to leave the US to apply for this visa stamp?
Q4 – When I submitted my DS-260, I listed my visa status as E3. If I was to secure an H1B visa before submitting my I-485, could it be problematic that I listed different visa classes on my DS-260 and I-485 forms?
Q5 – Given all of the information provided above, which of the following options is the best for maximizing my chances of a successful DV AOS application?
– Option 1 – Remain in the US on E3 visa until my DV AOS interview (i.e. no international travel, no action taken on H1B)
– Option 2 – Travel to foreign country after October 1 and apply for H1B visa stamp. Attempt to re-enter US on that H1B visa, and then go through DV AOS application while on the H1B
– Option 3 – Any other options that I didn’t think of?

When I was filed my ds260 I was a student and answered my current employer name because my employer paid me my salary and other expenses , now I am starting my new job when they write my work experience they deduct my two years experience ( I. e my Two years stayed in the University) because of the regulation. I am qualified by the level of education not by work experience (the minimum level of education is 12th completed mine is degree)
1. The gap between the beginning and ending of the University course on my work experience causes a problem.
2. Should I unlock and change my ds 260 form.

I am a winner of the 2018 dv play on November 6, 2016 I was waiting for the divorce judgment because it was pronounced by the judge and as was the last day of the registrations so I mentioned divorced and after 10 days j I received the divorce judgment with the date of November 16, 2016

I can’t predict the outcome. Technically it sounds like you were married – and in that case should be disqualified. But maybe the divorce process in your country means the CO will be lenient about the point of divorce. It is a big risk – it’s up to you to decide whether to gamble the fees or not.

I read the memo. So the date foe calculate is the date when visa become available meaning the date when my number shows on visa bulletin (first day of the month)

Yes – the visa becomes available on the 1st of the month – and previous cases have shown that it covers the whole of that current month. Theoretically you could argue a January or later interview would be OK also – but I would not want to have to argue that, if I were you.

please be so kind to answer my question. I am DV principal winner from Asia, and my wife and daughter are derivatives. I collected my green card and went to US to activate it. My wife and child are supposed to have interview next week, but under the pressure from her family she decided not to get green card and to stay in our homeland. The problem is that at the US embassy she was told that she and our child wouldnt be able to get US tourist visa to visit me if they miss the opportunity to collect green card. I know that taking part in lottery means immigration intent, but in this case she is abandoning immigrant visa, why would there be problems to obtain tourist visa? She has steady job and property on her name, there are no other usual obstacles except immigration intent.

Hi Simon,
I’m a DV-2018 Selectee. To increase the chances for myself to the CO to grant me a visa,
I think that a Job Offer (or a Job Contract) is a plus.
What you advice me? What kind of Job Offer can I find? I work in the IT Field.
Because to have a (US) Job Contract you know that needs a SSN that I don’t have.
Copy of Green Card, residence and so on (that now I’dont have).
1. Can take in consideration the CO, a Job Offer from a US Employer, to present at the Interview day?
2. What details the CO can ask during the Interview about this fact?
3. Can be valid a Job Offer IF, the person of Affidavit of Support lives in another State,
and the Job is offered in another State (very far from the Address declared in DS-260 Form)?
I’m confuse about these details.

I just want to know that on my passport the visa expiry date is on January 1 , 2018 and my medical exam was 15 days before the interview. That means medical certificate is 15 earlier than the visa issued date . In other word I did medical checkups 25 day earlier than visa issued date.

just an observation, but the Visa Bulletin (Sept.2017) numbers for the first interviews in October 2017, especially for EU, seem to be very low at 2600 (compared to other years in the 8000-9000 realm).
Any guess on why that might be or could it just be a slow start and things will go more smoothly in subsequent months?

he has graguated in teacher training center after he has complited his high school. The teacher training was a one year course and graguated with diploma for that. The thing is in his first DV entry he has filled vocational school in eduaction level. so is it ok if he filled with diploma in his DS.

His vocational education will not count toward meeting the qualification. So – he must make sure he can prove he meets the education requirement before the vocational course.

I’ve noticed in the ‘interview experiences’ that a few people had not done their medical when they go for their interview and they just received a blue form with no issues. I have read that you shouldn’t do your medical too early due to the visa expiring 6 months from that date but what is the process of completing your medical after the interview? and what would you suggest in terms of completing it before/after the interview?

Some embassies will not allow the interview to proceed without the medical – other embassies will. In those embassies that allow it, getting the medical after the interview can lead to an extensive delay in issuing the visa and even loss of the visa (due to re-assignment of the visa to another selectee). Generally the best idea is to get the medical a week or two before the interview.

My question is about being selected in two consecutive years. I have been selected in the 2018 DV lottery but with a very high case number (OC22XX) so don’t expect to make it to interview stage at all. After extensive reading on forums and blogs, I’m seeing comments from people from the Oceania region that they were in my situation with a high case number the first time around and were fortunate enough to be selected again the following year.
Is this common for Oceania? If so, do you think KCC considers cases that just missed out in the previous year, or is this just completely random and a coincidence? It just seems strange that I have come across multiple cases that have been selected again with much lower case numbers the second time around… Either way, planning on re-entering again in October.

OC’ers have a very high chance of selection which might have been approaching 1 in 10 this year (compared to 1 in 200+ in AF region). With odds like that – it is not surprising to get winners two years running. The draw itself is random.

Hi Simon, first of all big thank you for this website. It is very helpful and many people here are successful in passing through Green Card Lottery just because of you.
I would like to ask you one question regarding criminal record check here in UK.
I lived in few another counties before so all together I have to provide 3 Criminal Record Checks.
I been told that Criminal Record Check I should start doing after I am invited for interview because nobody knows when we gonna be booked and these Criminal Records are valid in most institutions just 3 months.
Now I have been booked for Visa interview by beginning of October. I was checking official website of UK government about these criminal record checks (which are called now Disclosure and Barring Service – DBS) and there is stated that this check can request just employers and licensing bodies. And anyway this check takes about 8 weeks to get which is already late for me.
But then there is stated that I can request just something called “Basic Disclosure” where you can actually see my criminal records as well.
So I just wanted ask, is this Basic Disclosure good enough document for my interview as a proof of my criminal records?

Hi Brit . I’m sure you know my case . I really need your help . I did interview in April and my case was on AP till now . 6weeks ago the ambassy calls to ask for the explanation why we did change our names . We explained and they respond to us that the information will reflect as per passeport .

I Brit. Greatful for your help. My case is 2018AF30XX. Iam yet to receive 2nl letter. However, when enquired about my status to KCC days ago, they replied that they received my application and it pending embassy review. I submitted my application in May.
Now what does it mean by pending embassy review? I suggest that my case is done processing. But confuse on the review.

1. since one year i am leaving outside of my hometown country , when i check (Reciprocity by Country)for my
hometown country there is written (unavailable) is mean that I can’t get police certificate form my own country
but i can get police certificate from where i am know since one year.
what do you thing what should i do, is it fine to discuss with consular about this issues.
2.about the i-134 form, i download the form from official site but in some part i can’t write. although i have new
version adobe reader.

1. Unavailable = not required from that country.
2. Your sponsor should fill it in – not you. They might have to use pen.

Hello sir im sure you will understand my case and advice me.
Im case number EU17xxx and i send ds260 on 19th of june like single.
In the meantime i got engage, and im planing to get marry in November. I saw that in the previous years interview was usual in january or february,(for my case number.) also know that if i open case(location KCC) need 3 to 5 mounths to proseed my case when im adding person.
I have next option but dont know is it correct, so:
I am not able to get marry now earlier and open the case because i will have hudge weeding for 400 people and its already scheduled for november.
Im wondering if i get marry in november could i prolong with my marriage certificate and open the case when i got an mail for interview? Will they ask me why i didnt open case right after the wedding?

Unlock before the wedding, and add your spouse as soon as possible after the wedding.
