Hi brit ,
Thank you for your response. Sri Lanka Embassy requested to get another sponsor at the interview because insufficient income showed by current sponsor ( 27000 USD for 05 people including us ). They are asked us to send ASAS by mail.
They keep passports , originals with them. The oath and finger prints has done. They concluded with saying congratulations both of us. But request to send the another sponsor documents and gave yellow paper .
01. How much income that have to show another sponsor to embassy ?
02. Will New sponsor consider this situation as joint sponsor with My current sponsor ?
03. will it need to change any things in ds 260 form ?

I have been selected for the 2017 DV allocation. My mother’s birth surname is different from her name on my birth certificate as she was still married to her first husband when she ( illegally ) married my father. Obviously this occurred some years before `i was born and I was in no way involved. Can this affect my being granted a visa ? . The only info I can find online relates to marriages entered into by potential immigrants to gain access to the USA.

It’s hard to understand your writing. I think you are telling me you left a child under 21 off the original eDV entry – and that caused your refusal. In this case the refusal is obligatory and correct. It cannot be appealed, not matter what hardships you have gone through. The instructions about leaving family members off the original entry are very clear.

I am a winner of DV-2016. I was told that I am eligible but was subjected to AP at the interview cause I was subjected to the 2 years home residency. When I fulfilled this condition, I sent an e-mail to the embassy telling them that I fulfilled the 2 years condition.
They replied by saying “You can contact us by the end of the month and we will let you know the status of the case.”
1. What does this mean?
2. Why did they ask me to contact them in order to know the status of my case while I can check using the CEAC visa check website?

I already posted about my past overstay a little while ago… I can and will come clean with it, but I’m wondering about my criminal record since I lived in the US for well over a year. I don’t think there’s any record of me actually living anywhere or existing while I was there. I lived in the street quite a lot, never had my own place/address, was paid cash when I did work and I’m pretty sure there is no record of me except maybe on an old police report as I was the victim in a pretty bad “SUV hit pedestrian” accident… any idea or advice on what I should do?

Hey Eliza, you will need to specify which one of the forms you want them to unlock. If not, they will only unlock the main applicant’s form. It happened to me….twice 🙂

First of all thanks a lot for your kindness and support.
Simon, I have more than years in job that is qualify in O*Net Database as Computer and Network Administrator. I have prepared all the documents, such as recommendation and other support documents related to my work. in the DS260 I have put that I have graduated from University as Bachelor in information Technology, in fact yes, I did have that bachelor as proved, but I dont have high school diploma as I am fail of grade 12, but in my country even if you are fail you can still study at university as Associate and after continue to bachelor degree. and in the form I did not fill information about the High Diploma, I just fill the highest Education (Bachelor degree) put number of education (1). In this case if I am failed in High school, Do I need to show them all the documents from grade 1 -12 or just this bachelor is enough as I am qualify with working experiences?

I wish to permanently move to USA about 2 years after the first entry. As I understand if I leave US for more than a year I should obtain REP.
But if I will leave it for 11 month, then return for 2 weeks and then leave again for 11 month.. is it ok? Or I still should get REP?

I reached out a month or so ago about my country of chargeability. I am born in the UK but both my parents are born in New Zealand and are NZ citizens etc so I intend to claim NZ as my country of chargeability through them. I have been able to get more detail and understanding about the nature of their stay in the UK and what they were doing when I was born (which I didn’t have before).
My parents were both born and grew up in New Zealand (schooled etc). They moved to the UK together in their late 20s for work experience (although this wasn’t an inter-company transfer, nor were they working for the government) and to travel Europe. They returned to New Zealand and got married in 1989 before returning to the UK and their jobs etc. I was born in 1991. They both returned to New Zealand in 1993 and have lived here for past 22-23 years. All-in-all they were in the UK for about 8 years. My mother was able to stay their through a visa she could get because her grandfather was British. My Dad was on a visa where he was unable to work and would need to continuously renew it but eventually he was able to gain an Irish passport through the time they spent their and his Irish heritage.
I think this is going to be a real struggle to prove/demonstrate that my parents were in the UK temporarily (as they were there for 8 years). However I do think it is rational to suggest they were temporarily. It is very common (and always has been common) for New Zealanders to move to the UK for work experience/travel/OE and the fact that they both grew up in NZ, and returned here 22-23 years ago suggests they never intended to live in the UK permanently. Furthermore the fact that they returned to NZ to get married also suggests that they intended to be in NZ long-term (if they were going to live in the UK permanently why not get married there?). However, then the issue is around what “permanent” means and finding evidence to demonstrate their intent. Also whether or not the visas that my parents had deemed them to be “legal residents”. My feeling is that this will come down to what evidence I can present on the day, how I explain it and even what the person who I am interviewing with is like…
So, my question is do you think I will be able to build a case (a successful one) to claim chargeability to NZ through my parents (via the Missionary exception or something along those lines)? Any advice from your experience given what you know about my case would be much appreciated.

I think you can build a case just as you have described. Of course – the only opinion that matters is the CO on the day, but they have to make their decision on a “preponderance of evidence” – so as long as you put some effort in to whatever proof you can put together, you will have a chance.

Proof of retaining a home in NZ, Work visas, anything like that. You can make it a slam dunk with sworn statemnts from your parents explaining why they were there temporarily.

The issue is whether the CO accepts the education document is yours. That’s partly a matter of your credibility. Take whatever proof you can to establish proof.

I had a question about the timeline of the process. My case number is 2017EU00002XXX and I submitted my DS-260 in early June 2016. I’m planning on having my application later processed through the USCIS and file an adjustment of status (currently I’m J1 and the two-years rule does not apply).
1. Will I get any notice from the KCC that my application is being processed and if so how long does it take to process?
2. What’s the next step now? Do I need to file my adjustment of status form along with supporting documents once my number becomes active?
3. When I submitted the DS260 they described under “next steps” that I contact an USCIS office to schedule an appointment. Is this for fingerprinting only? And when can I schedule an appointment for?

1. Yes – they send an email saying thanks for notifying them of your intention to do AoS. That is normally fast (a few weeks).

3. That is not your next step. IGNORE their standard steps now. Allow me to introduce you to your new best friend – “Sm1smom”. Click the link below and STUDY the spreadsheet on page one of that thread. If you have remaining questions after you have read it, Mom will guide you, but lease – study first, ask later. If you do that your process will be smooth (although not all FO’s are fast). One thing. There is an “early filing policy” but given your number is so low you would be filing before the year has started so I would advise against filing early in your case. Just plan on your case taking until Jan/Feb (earlier would be a nice surpirise).

Does your husband meet the education or work experience requirement? If he finished school at 16, he probably does not meet the education requirement. So what sort of work does he do?
1. Yes he must list it.
2. Yes he will need a police cert (the reciprocity page explains)
3. Mention maternity leave

You NEED to read the instructions. You will need more police certs than you seem to understand – and I don’t know what else you might not understand, so if you want the Green Card – take the process seriously and read the link you had in your selected letter.

My number is quite early – 2017EU000001XX, however my interview will be in Sydney Australia. Can you help me estimate roughly when my interview will be. I am guessing 1st week of October since my number is so low, but not sure how quickly they get through European numbers in Australia.
Also once you get issued your interview date, are there any chances that you can postpone it by, say, a week or so?
My concern is because I am getting married on the 2nd of October, which is a Sunday, Monday is a public holiday, so I’m assuming that the interviews will commence on Tuesday 4th of October. However I am booked to go overseas on a whoneymoon on the 5th of October for 1 week and I don’t know whether to postpone it by a few weeks or what.

The order within a month is not based on case number. So it could be any time within the month (although Sydney only interview on Tuesdays).
Do not re-schedule. This isn’t a hair appointment.
Now – you are getting married. Does your future spouse not want to live in the USA with you? If he does you really should have delayed the DV process OR had the wedding earlier. Getting married days or weeks before the interview is adding complexity.

The question about moving the interview was just hypothetical, to see if there was even an opportunity to get it moved to a later date if one had a reasonable excuse or whether you get given one chance only and that’s it.
Yes my spouse does intend to move to the US with me, but there is no way of putting him on my application till after we are married, and after reading countless websites and forums that all give completely different opinions it’s really hard to know what’s the correct answer. I was told that if you have an early number and you don’t put your 260 form in as soon as possible, you can miss out on an interview entirely. Hence why I rushed to get it in.
The wedding is a huge affair and the date has been set for close to a year. We have family flying in from overseas for it, and sadly the date cannot be moved. Had I known I was going to win the green card this year after 10 years of failed attempts, I would have gotten married much sooner.
Good to know that they interview on Tuesdays in Sydney though, thank you. Here’s hoping my interview won’t come up on the 3rd of October. Either way I’ll have to apply to the KCC to amend my application as soon as humanly possible so fingers crossed…

Once your interview is scheduled KCC cannot unlock your DS260 to allow you to add your new spouse. It is then a matter of negotiating with the embassy to see how they can add the spouse, but as I said before your timing will be bad (which was avoidable). If your interview is scheduled for October, you will be informed of the date in late August. I normally advise people not to re-schedule (because there is an inherent risk with re-scheduling), but in your case I strongly advise against attending the interview without being married and without a plan to add your husband. So, a delay of your interview for even a few months is preferable.
Email KCC and ask them to unlock your DS260. In the past, unlock stopped them processing it – and that way you would avoid being scheduled. They might process and schedule anyway, but its worth a try. Then, once married you resubmit the DS260 along with your spouse (and a DS260 for him). You would be pushing the interview back to January/February – but that is MUCH better than the alternative which is a family based case (which takes 2 years).

A lot of ppl get the formal registration paper first and then the celebration after with everyone else. You can still do the celebration on the planned wedding day. I know a lot of ppl who has done that. An option to think about.

Yep – you just enter, you will be activated. Pay your fees before you enter. Whilst there you should apply for a SSN. Make sure you don’t leave for over 1 year – and be sure to file a tax report as required.

I have been randomly selected in the Diversity Visa lottery, and I am incredibly grateful for it! I submitted my Immigrant Visa and Alien Registration Application Form (DS-260) back in May 2015.
The last allocation cut-off number of DV in visa bulletin for the month July 2016 is 10550 for the region Asia and for the coming months August it does not show any higher number, instead it shows current. Will the DV lottery case numbers above 10550, example: 2016AS11*** have the chance of interview or DV visa availability is finished with allocation cut-off number of July?

Hi BritSimon, I have a green card but have been out of the USA for over 12 months as I had a baby and wasn’t able to return to the US in time. So I know I have lost my resident status, but if I want to travel back to the US just for a holiday do I just get a tourist Visa? Do you think they will question me on arrival? Is there also a process of losing your resident status? i.e.: Do they tell you you’ve lost it or is it just assumed after being out of the US for 12 months? Many thanks.

The immigration officer (IO) will question you at the POE. The IO cannot decide to cancel your resident status but they can refer you to an immigration judge and you have a chance to argue your case at that point. Whilst that is stressful, it might be possible to keep your resident status. I am not a lawyer, so if you plan to try that, you should rely on your own investigations or seek legal representation.

i submitted my sopuses ds260 after that i tried to submit my ds260 then the sign and submit button is not active and not accepting the click so what is wrong

Are you under 26 year old? If yes, make sure you click the selective service link which needs to be reviewed before it will allow submission.

Hello Brit,
Me, my wife and our two years old son are green card holders. We got permanent resident cards through the DV Lottery Program of the U.S. Government (my wife won before). We start living in USA for a short period ( less than two months), got all the documents in that time (green cards) and than get back to Europe, because my wife was pregnant, she decided to give birth to baby back to our old home.
Now we have new born child without green card. We need to get back to USA (after 11 months living abroad).
The question is:
1. What do we need to do for our new born child to be allowed to enter USA? Do we need embassy appointment in our home country before we get back to USA or simple to come back to USA with newborn baby with foreign passport and birth certificate?
2. How the new born baby will get his green card?
3. Do we need explanation (documents) why we were out of USA for 11 months?

There is a special process that is followed at the POE airport for residents returning with a newborn. Everything will be processed at the airport. You should check with the airline that they will allow your baby to travel without a visa, and if needed contact the US embassy for a travel authorization. You MUST return by 12 months and you MUST travel with the child.

It is best not to use someone in that circumstance. The embassy may not connect the case, but don’t add that risk if you don’t have to.

Hello Britsimon. I am a winner 2016. Me and husband were born in Congo. We are now bitish so we have dual nationalities. In my husband’s congolese passport, his names are not in the wright order. They have put surname as first name and first name as surname name but they are correct. Do you think this will cause issues? Can we ask them to put the visa in his Uk passport instead? I am the main applicant. Our kids were born in the Uk and using their Uk passports. Can we choose which passport my husband can use as the congolese one names are reversed? Both passports were mentioned on the Ds260. Looking forward to hearing from you soon. Thanks.

Sorry for asking many questions, but i collect all points which i am worry about
1) my wife attended only for 1 year in a college in another governate ( province ),she had a residence there in a private accommodation with her friends, for about 3 months in 1st term and 3 months in the 2nd term.
( the 3 months not one shot, one month there, then one week at her main address, so actual is less than 3 months per term )
is this required to be mentioned as a previous address?

I am from Egypt.
My full name in the passport is ( Ali sayed Ibrahim Ahmed Salem ), surname is (Salem)
in the DV entry filled family name is Ibrahim
middle name is Sayed
first name is Ali
in the DS-260
if i fill surname as in the passport ( Salem ) , this will be different than in the DV entry, so I tend to fill surname ( Ibrahim Ahmed Salem ), First name ( Ali sayed ).
Will it be a problem?

You need to list the name accurately in the DS260 – so however makes sense.
