Hi brit, you have an amazing website. I know they ask for police certificate for all the countries i lived at for least 6 months. I lived in many countries in the past including kuwait, saudia arabia, and it is rather very difficult to go back to this country to ask for my police certificate.
So is it mandatory to have the police records for countries that i have never visited in the past 6 years.

I recommend you read the instructions carefully, as some of the scenarios only need a police cert for over 12 months stay. Then, for the countries you need, check the reciprocity page for those countries to make sure you really need it. If the police cert is required and available, then it is mandatory.

I’m on my E1 visa in the US now and my wife has been selected for DV-2019. We are from Europe and my wife has 2019EU18XX CN. I’d like to apply for the green card through AOS.
My question are:
1.do we still need to send DS-260 if we want to go the AOS way?
2. I heard about the 90 days rule from day of entry if you apply from non-immigrant visa for AOS. We will be coming back on our E1 from the vacation to the US in July 2018. Should I wait 90 days (so until October 2018) to make any moves regarding AOS?

Thanks for your effort on the scraping.
1. It is formula based (Poverty guidelines and Family size)
2. You can read about it at the link below, but briefly you count the people in the sponsors family (sponsor, spouse and children) and then the same in your family (principal plus derivatives). Combine the total and look that up on the poverty guidelines for the latest year. 100% should be enough, but 125% is better.

Many thanks for your yesterday (Pls See below) help. Due to Turkish law she needs to live 2 more years in Turkey to get Turkish citizenship. Therefore she can not get Turkish citizenship for now.
Btw i have reviewed past comments in your form. As far as i see some Iranians (They have only Iranian Citizenship) gets their GC even there is travel ban. How could it be possible? Travel Ban means that Iranian never gets GC in the Ban period or they have low chance to get the GC? I’m quite confused.

OK – then it’s a problem. It won’t affect your approval, but she won’t be able to get the GC.
Perhaps she can get Turkish citizenship???

There are some Iranians who can get approved. Those cases are Iranians already in the USA when the draw was announced, or those with dual citizenship. There are a few, VERY rare, waivers. Without that, your wife cannot be approved while the ban is in place.

I am worried about my situation, my number is supposed to be ready for July interview but i have received my 2NL yet for African region. from the ceac data spread sheet , i noticed that those that are ready are all having a submitted date of highest november. as for me i reviewed my DS260 in january.
1) could it had been the cause of this delay ( unlucking in january ) ?
2) do i still have hopes of receiving the 2NL for July as normal?

Hi Brit! We had our medical exam on 24 May and our interview is planned for 14 June. If the interview goes well we are planning on doing the activation trip in the first half of November. We will then travel back to the US in May/June to make further practical arrangements and pinpoint in which town we want to live. However, we will only be able to move in January/February 2020 due to a rule in our home country: if we sell our house and/or cancel our current address as our address of main residence before 28 December 2019, we will have to pay a fine of over $ 12 000. Do you think we will be fine since we won’t be absent for more than one year, since we will be back in May 2019, or do you think we better start looking into the re-entry permit?

Hello Brit, Thanks for the work you are doing and information provided. However I have a peculiar situation and wish to enquire. I am not so keen on being in the USA but the issue is my wife has won the DV Lottery 2019 which actually I entered for her. At the point of entrance we were only dating (so she was single while we prepare for marriage) though even her address used for the entry was “care of me” (My name and address). We are married now (December 2017) and she would want to take the chance. I have read the post-entry marriage before results discussions so i think im clear on that now. However, I hold a non immigrant Visa B1B2 which I use to attend Business conference with my host (Political and Educational Think Tank) every year and return back home. She ofcourse has a high school education and is currently studying a Journalism course in a Private Institution in Ghana. Should she fail to be successful at getting the Visa, obviously that will affect me but how will it affect my current Visa ( 5 Year Multiple entry)

They would normally schedule London. But you can ask KCC to schedule Dublin since that is probably more convenient. Send KCC an email to that effect, giving your name, full case number and DOB.

Thanks Simon – i contacted the Dublin embassy and they said i should be interviewed in London. As far as i can tell – if my wife (principal applicant) chooses London then we will both automatically be assigned to London does that sound right to you? Dublin would be more convenient but London isnt a big deal – the concern i had was my wife picking London and me picking Dublin as i cant change my choice on the DS-260.

So if she is the principal, she should ask KCC to modify her selection of embassy and put a note on your case for Dublin. Only she will get the interview notification – you will go wherever she goes.

Secondly, I’m hoping you can help give me more of a ‘solid answer’ to a question I’m getting many mixed answers about. I have an appointment scheduled for 10th July 2018 in Sydney Australia. Sydney is not my home state so I will be traveling interstate and I am only currently scheduled to stay in Sydney for 2 additional days after my interview (before returning back to Melbourne). I am trying to find out how long the processing time/ return of passport is after the interview (basing this on a visa approval)? The online support team quotes ’10 business days minimum’ for consulate processing time. However through my research online, other people have quoted anywhere between 1 day and 1 week processing time. And in my previous experience with E3 visa’s, processing time and passport delivery method has varied every single time. On my first E3 (at the Perth Consulate) they mailed it back to me within the week, my second E3 (at the Dominican Republic Consulate) they gave me my passport and visa back on the spot after the interview, and my third (again at the Perth consulate) they asked me to come back and pick it up from the consulate in 2 days time.
The main reason I am stressing about this processing time is because I have overseas travel booked for 9 days after my interview where I will require my passport. I can push out my Sydney departure date if need be, however I can’t reschedule my overseas travel, so I need to try an get more of a solid/ realistic idea of the processing time so I can potentially try and move my interview forward if the timeline is not workable.

The visa is typically ready in less than a week – but the only way to get a really solid answer would be to ask Sydney embassy. However, be aware that printing issues can slow up that process (and have in the past).

I have some question. I had interview at 11 MAY the consulate officer told me congratulation your visa is approved after 5 or 6 came back all passport my family. When I checked my status, me with my children are Ready only my husband is administrative processing. Today I shocked when the embassy returned his passport is temporally refused under section 221(g) with one form included some documents like (medical examination , birth certificate ,family book, marriage certificate, divorce decree, police certificate , affidavit of support,…..) should be all that documents provided again?
2- His status effects my status and my children ( I am principle applicant) ?? Not issued till my husband status are changing ??

hi brit i have receive my nl2 with the interview details at the usa embassy dublin, i sent them an email asking what documents i need to bring on the day of the interview, the embassy says we must the affidavit of support too.
1.my usa sponsor made 85.000$ last year he has 4 kids and a wife, and us we are me, my wife and 3 kids, do u think based on his income his affidavit of support would be enough?
also he has a house there in usa valued at 150.000$ with 3 cars costing about 90.000$. does things like his cars and house count toward his financial ability to make us affidavit of support?

Because your first statement is incorrect. Read the DV lottery instructions and FAQ, you will see it there. Then, understand that public charge is part of EVERY immigration case, DV included.
Here is the quote from the DV instructions that many apparently don’t bother to read!
“MISCELLANEOUS
38. If I receive a visa through the DV program, will the U.S. government pay for my airfare to the
United States, help me find housing and employment, and/or provide healthcare or any subsidies
until I am fully settled?
No. The U.S. government will not provide any of these services to you if you receive a visa through the DV
program. If you are selected to apply for a DV, you must demonstrate that you will not become a public
charge in the United States before being issued a visa. This evidence may be in the form of a combination of
your personal assets, an Affidavit of Support (Form I-134) submitted by a relative or friend residing in the
United States, an offer of employment from an employer in the United States, or other evidence.”

If you submitted a fraudulent entry then give up already… you’ll be undoubtedly disqualified. If you’re married, you’re married! There is no “processing as single” because you’re NOT single… The rules are simple and straight forward: follow them and tell the truth or be disqualified. No need or point in insisting. Fraud is fraud. You don’t deserve a GC and pretty much stole an honest person’s chance. Shameful

Well i own a recording studio. Singers pay me when i produce and record their songs. Is this satifying to them? I mean please what do you suggest me to do? and maybe a little advice how can i win or convince the officers. Plus i won the 2018 dv lottery but i was disqualified because my 10+3 diploma wasn’t good enough for them. Yet again i won the 2019 dv lottery so I don’t want to lose this chance again.
