Hi Brit Simon,
My name is Fidel from Cabinda province in Angola.
I am winner DV2020 Region AF and I did not submit my Ds260 and for my family yet until now.
Reasons:
1. Passports for my family(espouse and children) have got long time to be issued it was requested since August 2018 and were issued December 2019.
2. I have married since September 2008 in family and church where the religious ceremony was held and I got church marriage certificate and has already been recognized and authenticated by the notary.
3. Recently we held the civil wedding.
Some questions
1.Won’t this delay cause my process to be disqualified?
2. What certificate can I present between the two? Church or Civil marriage certificate?
3.If it is the civil marriage certificate by the date that the wedding was held, will it not cause my process to be disqualified?

Related to form DS 5540
I find part 3 very confusing. First of all, when they say ” household in the US” do they mean all people who will be living in the same residence?. Let’s say a 21-year-old applicant who has no wife, and no children, but he is hoping to get the visa to live with his brother and other relatives in the same house in the US. Does he have to list all of those relatives on this form ???
Secondly, The question ” Was he or she on active duty,
other than training, in the U.S.
Armed Forces or Ready
Reserve while receiving a
public benefit? If you answer NO means that you were not on armed forces…. while receiving a public benefit. If you answer yes, it means that you were in the military while receiving. Either way, your answer is YES that you received public benefits.

Have you or any of the individuals applying with you covered by this form requested or received public benefits in the United States from a Federal, state, local, or tribal
government entity on or after February 24, 2020? >> Does this refer to household members ? (people listed in part 3 )

is this mean that the Healthcare proclamation deblocked or this just a templates and it still blocked?

On Form i134 the sponsor made a mistake on the date of birth,the date must be in this order mm dd yyyy (12.10 1997) but
he wrote in this order dd/mm/yyy(10.12.1997) and my birthday in fact is in decembre

Hi Brit,
I don’t have any friends in the US in order to get an I-134, but in the other hand I have my parents in my home country who are quite wealthy, and they can guarantee if something doesn’t go as planned in the US, they can finnancialy support me and my wife. Is there any way I can show this to the CO ??
I do have a Bachellors degree same as my wife, no children, both 29 years old, good jobs in well known international companies, and properies valued at about 250k us dollars in our home country in SA.
Do you think that should be enough to pass the public charge concern?

Take whatever proof you can of their financials status and willingness to support you. Generally, that is not accepted by the COs but you can try. Your education, employment and assets may be enough to satisfy the CO.

My question is on that part, can i fill the house hold names of the people i will go live with there in the states? it does not neccessary means it must be your family, relative….. and so on, it still could just be the person with which you will live with..

Your household means you are your derivatives (spouse and children). Just that. No prizes for listing everyone in the neighborhood.

First of all Sorry for my bad english
visas were issued for me and for my wife in feb 21 but not for our newborn child because his medical clearence was not ready, he was born just before the interview so my question is that medical clearence takes around 4 weeks to process and also his case status changed from addminstrative process to refused, will they still issue visa for him? if we wait we may see ristrictions on flights due to virus, in this situation what should we do? is it possible to move(me and my wife) to US to activate green card and come back before the green card within a week, will they allow entry for us leaving the infant behind? do we need our green cards in hand to travel for next time, if our visas expires can we still travel on visa if yes then for how long.

If you need to ask multiple questions, number them.
There is a technical error in the system that marked the case as refused. The baby should still get a visa. Just do what you were told to do, and be patient.

I have the interview in next week. So I saw in some comments (and even in your page explaining the probable questions in the interview) that I need a sponsor and I should answer about the where to setup.
First, I want to finance my travel alone (I have the necessary liquidity), should I put a name of a sponsor?

Please advise on form 5540 the liabilities and debts section is it advisable to first pay off the debt and have less cash asset or it’s better to declare the amount in debt and have more cash assets and once visa is guaranteed I clear off the loan ?
Or is having a debt increasing more chances of been denied the visa .

You should not take actions in anticipation of getting the visa – so behave as you normally would, and present the truthful reality on the 5540.

First, thank you for the work you are doing. My CN is 2020AF4XYZ. I had my interview on February 18 and I nailed it. I got my visa on February 19 and expires in mid August. I could not have done it without your help.
I need your opinion on the following. The Corvid-19 health emergency is now a global health problem and it is expected countries across the world will roll out interventions – popular and unpopular. Some will be hard but necessary. I am thinking travel restrictions to address the infections by travelers from “Racoon cities”.
I had wanted to travel in the month of July 2020. Do you think it is a wise idea to first travel to the US for a week and have my visa stamped then comeback to Africa to tie loose ends then travel back in the US at the end of the year?

I going through AOS for the DV2020. I have a kid that was born in the us (citizen).
In the DS 260 they ask if I have any children, but don’t provide an option to indicate that the child is already a citizen, since all prompts are trying to establish if the child will immigrate and when. what should I answer in that section? should I say I don’t have any kids if it is not relevant for the immigration process?

on Xarthsius’s ceac data embassy graphics there is some mistakes, I think. In fact, if you put in the embassy ‘s graphic a embassy as Naples or France embassy you can see there are CN of 33k (in France) and 26k (naples) that are ready, how could it be possible? In the last VB, KCC arrived to call just only up to 21200 !!

I have a real emergency question and I’m in need to your advice and instructions about my case.
I’m a dv lottery 2020, case number 2020AF15200.
Had my interview on February 17th, I’m married.
I got all the proofs for my situation.
The only issue is that I’m having a weak sponsor( low income) he made $17000 yearly.
The consulate told me to get a new sponsor with a better income.
After two days my case status went from ready to Administration processing, this made me a little bit relaxed cause I know I still have a chance to get approved with a better income sponsor.
Just a week after I found a sponsor with $47000 income yearly. (February 25th).
They told me to scan and submit the forms (I-134 +1040) on line and no need to move to the embassy which I did exactly what they instructed me.
A week after (March 2nd) my case status moved from Administration processing to Refused (Denial) for both cases.
I really dont have any explanation to what happened to me, cause I have all the proofs and all the documents that qualify me and my husband to get a visa.
Based on your experience, please instruct me and guide me with piece of advice to do the right thing to get visa.

My officer one week ago at the interview told me he needed to make further verification and he told me i am in administrative processing. But today when i checked my status at ceac it says REFUSED . Is it normal? Its the first time i entered to check my visa status as i didnt where to check it. the last updated date is only the interview date.so it is not updated again after the interview.
So is this a refusal or AP ?

There appears to have been a lot of cases updated from AP to refused. AP is a type of refusal, but one that is temporary and means there is still some decision to be made. I think there may have been a system error or perhaps this is a new way they are reporting AP cases. It is doubtful in my mind that these cases have actually all been refused.
