Dear Brit,
I have a question and please if anyone else can also help answer in case Brit is busy.
In the documents required it mentioned also Military Record “if you have served in the military” and the Court Record “if you have been convicted”. Do we still need to obtain and send these two records to KCCdocuments even though we have never served in the military or have never been convicted or jailed?
Maybe a Military Record that would say our names have never served in the military and the Court Record that would say we have never been convicted. I understand that in the Police Record did already say that we are cleared from any crime or conviction. I was still wondering about this for sometime now to whether or whether not sending these two documents.

Dear Simon,
Before I submit my documents and DS260 there was an alert on my country US embassy website, that all interview will reassign to other three countries, https://iq.usembassy.gov/visas/
I was not aware and I didn’t change the place of my interview in DS260. Now after five months of that decision it is still not clear that the embassy will re open or not.
1- do you think the interview will be scheduled automatically on one of three countries that mentioned on embassy website or i have to request?
2- should I ask KCC to re open my DS260 and change my interview country? Before 2NL

1 You said in your last video that all cases has the same priority since the VB is mow current.
A* How can KCC send new appointment for interview when there are still postponed appointments to be interview by the embassy?
B* Wont priority be given to postponed cases ?
2i sent an enquiry to the Embassy sometime ago and they said at the moment ,they have closed but will work to reschedule all cancelled appointment when they reopen. And now since all cases are current ,will they still reschedule me?
3 lastly how are the interview slots booked if am to reschedule my case by myself.

1a. They will do the best they can.
1b. That will be up to the embassies based on whether they are open or not.
2. It depends on whether they are scheduling or not due to the pandemic and the ban.
3. That varies by embassy.

1) When I have submitted the DS 260 is it considered as a green card application in the same time as application for immigration Visa since there is a question in the DS 260 to disclose the information to the social security administration.
2) Is the new executive order concerns just the new application for the permanent resident (Green Card).

You give the US address in the DS260. You can update it at the interview and sometimes at the POE – BUT that is where they send the GC, so if you do not update it and they send it to the address you gave them, you might have to pay $500 to get a replacement.

The result will be posted on the website on June 6, 2020. Its also a historic day. The “Deed Day”. I’m 100% part of this history making. And I also encourage all of us who are to be part of this history making to mark it as a day to remember.

I am a final year medical student, and can show a bankstatement of 10k.. having an Affidavit of Support would be a bit difficult with the current circumstances.
Q1/ Will I be safe to pass the interview?
Q2/ If CO decided negatively, will they just refuse the visa or they will put me on AP asking for an affidavit of Support?
Q3/ What are the consequences of such sponsorship on the sponser? And for how long will it be in effective? Say I became subject to public charge after 3 yrs… what will happen?

Please as i am preparing my case for interview based on work experience and along with my company letters ,pay slips ect , i have to attach internal communication memo , emails copies and now i have left with many documents more than 100 documents for some of the task i do every day , so i will not have a problem to take that much of documents and big file to the interview or i have to reduce it , considering that i am doing my job for more than 10 years and i cannot take copy of all documents and i have taken some of each year task.

I hope to get your opinion on my situation. My husband is the 2020 lottery winner and we got our 2nl for the May interview in march but the interview got cancelled due to covid 19.
I have applied and received a scholarship for my masters in a university in USA and the program is starting in August. 1. No impact on the DV case, but in reality you are likely to get the immigrant visa interview before the non immigrant process can happen. The embassies are generally closed because of the virus.

Mate my situation regards the current situation regarding Covid. I have had a greencard (through the lottery) for 3 years now. I left the country in January for work and intended to stay on after for an extended holiday in my home country of New Zealand planning to be back by the end of April. However my initial flight was canceled and although I can now re-book it I’m not in a rush to get back to the US because of what’s happening with the pandemic there. (In New Zealand last 2 days we have reported zero cases).
I have paid my taxes in the USA last 3 years, I have a car, a bank account, a US drivers license and I have resided with my girlfriend the last 2 years at her house (prior to that I had an apartment). So hopefully that shows that I have indeed and do continue to intent to make the U.S my home.
My question is if I were to come back in say September (7-8 months abroad) how do you think the immigration agents would handle my scenario?
I haven’t been able to find out any information about this online but I presume there are a number of people in my situation.

The law is the law. Ultimately they have to let you in (under 12 months), and there would be no concerns, especially given the pandemic effects.

It’s really important that you read the instructions yourself to know what police certs to provide, and then the reciprocity page (accessed from the instructions) gives country specific info on how to apply for the police cert.

No. Unemployment is still MASSIVE. 30 million people won’t suddenly return to work in the next 4 weeks. There will be long last effects from the economic damage. I think I have said this before, but let me repeat. USCIS do NOT control the embassies. The June 5 date is about Field offices in the USA.

Hello Simon, I’m still waiting for results of this DV Lottery 2021, not selected yet.
I have just few questions, only simple curiosity at moment.
1) At what moment you could be disqualified? For example, I’m selected BUT my photo was not correct: they will automatically exclude me for further processing? In few words, I will never receive the 1NL letter? There is a sort of “pre-filter” applied to all selected cases? I’m asking you this because (I think) that could be an huge waste of time (and money) that in case of being selected, I will receive the 1NL, send DS, documents, medical and suddenly when you are at the Consulate they might say “I’m sorry, your photo was not the correct…”. Of course, I know that if you are participating to the lottery but not declaring sons or spouse, is for sure that you will be disqualified! No doubts about it… and I’m totally sure that I’ve sent everything correctly (it’s my 5th participation!)
2) I’m permanent resident in a different country respect my birth one (I born in Greece, but living in Mexico since 2010). The problem is that, the Mexican Federal Police only produce Police Records documents if they requested directly from a Consular or Embassy. What can I should to do in case of I will be selected? Asking directly to the local US Consular to contact the local Police?
3) I never served Military, so I need to send anyway a Military Records Certificate or is pretty enough to explain to KCC my situation? I need to prove it? The CO will ask to me some records about it?

But I received that mail;
After sending documents to [email protected], you will receive an automatic reply to your email. If there are no attachments, the auto reply explains there are no documents attached to the email…..
The very first day I’ve sent my documents I’ve received an auto reply from KCC and it was saying me to wait for process. But as I read the last mail now I can see there is no any attachment in that first auto-reply. Now I am a bit worried and confused. Do I have to send my documents again or it is a kind of faulty draft ?

There is a travel ban for Schengen area. My country is not part of this Schengen area, but if i want to travel to US, I must make transit in some country in Schengen area. Just on airport. Because there is no direct flight from my country.

Hi All
This might help those who are in New Zealand. There are flights going to USA. Air NZ is flying only on particular routes and LAX is one of them. I just did my quick activation trip (3 days) and now back in NZ in quarantine. I had to take this risk as I had sold everything in my house and was at a point where I couldn’t turn back. I just couldn’t leave this to a chance.
But like many of you I was also stressing out and continuously reading this blog to find any information which can be helpful. Simon has been on point and answered all questions precisely. But like many of us, the answers are hard to swallow as they harsh reality and the truth. Timing is very bad for the 2020 winners.
Anyway, as mentioned above I was in peculiar situation. I had the visa but could not travel due to the lockdown in my country or was it. After a lot of researching and many calls to various departments the following is what gathered:
To keep supply lines open flights are still going but are limited and only some routes are open. Further communication with Airline confirmed they are offering 3 flights per week but which days are difficult to predict. This meant if reach the Airport, I could fly. So I started to make more calls and found out there is a Ministry which is offering exemptions to travel locally if you have a valid reason. Once I explained to them my situation, they gave me all clear to fly – they didn’t allow me to drive because driving will increase the exposure which was difficult to trace should an issue occur. With this, I had permission to fly locally and internationally.
At the international Airport in NZ, they only checked my ticket. Once I reached USA, CDC did examine me and my wife but this was only because we gave them reason to believe we were sick. Once they examined us, they gave me all clear to travel to my hotel. My return flight got cancelled so instead of 2 days, I had to spend 3 days but in the end I was happy that I don’t have to worry about this anymore. Please note, I didn’t have to do a 14 day self-isolation in USA. I went prepared for this, but when they said I could leave, I was over joyed. Now I am in mandatory isolation and if no issues, I could go home with my family.
The reason I am informing you all this is because I was thinking the only option I had was to ask for extension. But I didn’t know for sure if the extension would work especially when flights are going to LA. If flights were not going to USA or if there was a BAN, I can understand this becomes an unavoidable reason but if the flight is leaving and there is no BAN and if the virus is the only issue, then does it qualify as an unavoidable reason? I didn’t want to take this chance so I went with it.
So if you are in similar situation, don’t give up. Weigh out the risks and worth making calls and talk to someone. Who knows there might be a door open which you not aware of?
And last but not the least, Thank you Simon for helping and giving those critical advice. At times not what I wanted to hear but it really gave me a kick in my bum to work harder and do a bit on my own. Well it helped and now I have 12 months to settle. Thanks once again and wish you and your family prosperity and good health.

I am in Kenya and my flight was cancelled in mid March. We now have a lockdown and no international flights are allowed in and out of the country – unless they are cargo flights. My visa expires in the next 3 months and I am a bit worried because of the mess that is there in the transportation industry. But thank you for your insights.

1. What does this reply mean: DS260 for me and my husband are okay and processed?

My CN is EU475XX . I subbmited my DS260 on November 12th and in the same day i se t my docs to KCC. These days when i was checking why KCC hasn’t sent me yet the confirmation email of received my documents , i realized that when i firstly sent the documents , I mistakenly put an error on my case number at the subject of mail , i wrote 2020EU000473XX , so number 3 instead of number 5.
Then on May 5th i resent my docs to KCC.
Is there any problem for the mistake i did?
Do you think that the fact of sending the correct mail with docs 6 months latter than my DS 260 will delay my documents processing?
When do you think I can receive my 2NL , since my number is current in June?

Yes that would have caused a delay. You need to wait and see when you will be scheduled.

I wanted to thank you kindly for your advice earlier. I went ahead and submitted my DS260 immediately on Saturday, and while it was a long process, I had no issues filling it out. I just have 2 more questions:
1. You mentioned to submit my documents a few days later, although I do not see where I can submit my documents and which I should submit.
2. Since I have filled out the DS260 and would’ve submitted my documents, what would the next step be?

Assuming I go for the interview and get the visa which expires…. let’s say September 20th 2020. I enter the USA in August 2020 and spend just 1 week to activate and go back to my country after 1 week. Meaning I don’t have the green card (because it’s not ready)as I go back to my country.
Can I travel back to the US next year February 2021 when my visa has expired and also do not have my green card with me in hand. ( as I need to go back to my US address to pick it up). Please i hope you understand me.
Is it possible to enter the US with an expired immigrant visa after activation?

Yes that is no problem.
The visa you use to activate will be endorsed upon entry to be your proof of status for up to 1 year. So you would enter using that visa still, even if it has passed the expiry date.

Hello Brit .Thanks for your help and patience to answer our questions.Please I wanted to know if the following situation might lead to a disqualification.I am married and have two sons.The first son I had him when I was still a very young man and he lives with his mom who is married also to another man.since i knew I will not travel with him to the US if I happen to win the lottery,I did not mention him when registering for the lottery.And more to that my first son lives with his mom and she will never let him go with me,so I mentioned just one son in my application because I COULD NOT get the other son to enrol with me .Will this situation bring about a disqualificatio?And how will the embassy know I have two sons?
