Hi Simon,
Do you think that President Trump might be blocked by the supreme court or by the lawsuits led by the AILA or other organizations straight after he extends the ban or even before? I know this situation is probably unpredictable, but you may have a different perspective based on previous years and other laws signed by Trump. Or you think it is rather possible that the current law will be prolonged ?
I guess you get a lot of such questions, but your point of view at this moment might be significant for us (concerned winners). I read all the comments and I haven’t seen such a comment before. I’m sorry if I missed something.

Hi brit.greetings once more .some few days ago you advised me to resent my documents to kcc.i sent my documents to them yesterday and received am auto reply.my question is does this autho reply indicates that the have received my documents.this is the reply.The Kentucky Consular Center (KCC) has received your email and is currently processing your documents. Hey Britsimon.
I scheduled my interview for June 4th at the Embassy in Dakar. Contacted the designated hospitals in Dakar and was told that they received directives from the embassy not to conduct any medical test until further notice. Now what will you advice us to do. Can we still go ahead and attend the interview withOut the medical report or we have to wait until the hospitals start working again conduct the test and then reschedule for another appointment.
Please advice accordingly

If your DS260 is submitted you don’t need to ask about that. You need to focus on documents.

I got married recently but I do not have the marriage certificate since the marriage certificate issuing authority is closed in my country due to covid-19 situation. Although my case is current but it shows “at NVC” in the CEAC website. My question is that
1. Can I ask my embassy to add my spouse after being scheduled for an interview?
2. Will they be able to accommodate my request?

Since your case still at NVC you can send KCC an email asking to unlock your DA-260 to add your wife, change your marital status and fill up the required details. You also need to click the Add Applicant to complete a DS-260 form for her.
Once you obtain the document, send all the required documentation at once.

2. Maybe – it is up to them.
3. Get the marriage cert. Do remember though you will need police certs and all the other documents for your spouse. So – make sure you read the instructions and anticipate what you will need.

Dear Brit, I am a selectee of 2020DV. I haven’t received a documents confirmation email from KCC yet.
I have asked KCC (3 times within 5 months) via email, whether they had received my documents and there where any problems with them.
Each time the answer was the following :
“If there are no attachments, the auto-reply explains there are no documents attached to the email. If there are attachments, the auto-reply explains we received your email and are currently processing your documents. Please allow time for the processing of your documents. Documents are processed in numerical order, based on lottery rank number. Once KCC has processed your documents, we will let you know if anything is missing or if we have received everything needed.”

1. How can I get informed whether KCC got my documents and everything is ok with them?
2. What must be my next step?

Dear Brit,I phoned KCC, so they confirmed that my DS-260 was processed.
About documents they said if you received following email (auto-reply)
“The information you provided will be forwarded to the appropriate department.”
it means we received your documents.
As they haven’t reached my case number (2020EU000333**) they haven’t processed my documents yet , and I should wait my turn to come, after it they will email mi if there are problems with my documents.
So can we conclude that auto-reply means that they received my documents?

No. That reply is NOT an auto reply. It is a standard reply. Google what “auto” means.

Whether cases get scheduled or not is nothing to do with case numbers any more (apart from Nepal and Egypt). It’s a question of whether you submitted the correct documentation and whether that has been processed or not.

Hello Simon, I am a Cuban winner of the DV 2020 lottery, I reside temporarily in Argentina, my children are still in Cuba and it will be difficult for them to attend an interview in Argentina.
I already sent email KCC explaining to change the location of the interview for guyana, I respond to change address

I’m not sure if I can advise the best idea. But – you seem to think that interviewing in Guyana would be easier – and in that case I assume the idea is to get the children there too. They normally need to attend the interview with you.

Egypt (like Nepal) is not current yet probably to slow down processing due to the high number of embassy cases. Whether they can schedule enough interviews before the end of the year or not, only time will tell. I cannot predict it.

As soon as you get your 2nl you’ll need to book an appointment to get your medical exam done by one of the panel physicians selected by the US Embassy in your country.

I’ve sent an e-mail to KCC as you advised, asking about the status of my ds260 and the documents (my case number is EU43XXX, submitted ds260 in May last year and documents in October).
Their answer was:”After sending documents to [email protected], you will receive an automatic reply to your email. If there are no attachments, the auto reply explains there are no documents attached to the email. If there are attachments, the auto reply explains we received your email and are currently processing your documents. Please allow time for processing of your documents. Documents are processed in numerical order, based on lottery rank number. Once KCC has processed your documents, we will let you know if anything is missing or if we have received everything needed.”
The auto-reply I received said “KCC has received your email and is currently processing your documents. “. So I’m guessing there were attachments, but they haven’t processed the docs yet (it’s been 7 months now!).
About the DS260, they wrote: “Your DS-260 has been processed. You should have received, or will soon receive, an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing. Please follow the instructions in the email. Interviews are scheduled numerically based on case numbers that have completed processing. ” (I haven’t received an e-mail from KCC about my ds260, maybe I will soon, as they say.)
So, my questions are:
1) Do you think I should send my documents again just in case, or will my sending them again create some sort of confusion for them? For example, they are in the middle of processing them, and if I send the documents again, they will start processing them all over again, from the beginning?
2) In one of your posts you advised sending documents to [email protected] (because of some miscommunication between KCC departments). Should I send my scanned documents there too?

Hi Brit.
I am the principal applicant and my husband is my derivative. I got my Visa on the 29th of March, all good. However, in my husband’s visa, they made an error in his name. We had informed the embassy immediately. We even went to the embassy in person. Given that it was the eve of the official lockdown in South Africa (where the embassy is), they told us to go back to our country, Mauritius, and to send the passport of my husband by DHL back to them once the lockdown in SA is over. They also kept his sealed envelopped.
We did everything we could to flag the error, made by the embassy, and to get same corrected asap. But because of the corona situation, they could not correct it. Now, we are back in Mauritius but the lockdown in South Africa has not been removed, and won’t probably be removed soon. Even if removed, flights in SA are not going to be allowed soon so we don’t know if it will be possible for us to send and receive his passport and sealed envelope via DHL.
Our visa expires in September. If by September, we are still not allowed to send his passport to SA, what other recourse can we have? Is there any other visa which he can use to come with me, the principal applicant, to the US? We really want to know our alternatives. Is there any official complaint we could make to get this corrected?
There is only an ‘i’ missing in his name. It will be so sad that he gets penalised due to a typo the embassy made and can’t correct.
Please share your views or recommendations. Thank you.

September is a long time away. You are nowhere near needing to worry about this. If you had to, you could both enter the USA and correct the name once in the USA. You need to travel by the expiry date on the visa. Extensions are possible but ONLY if the extension is arranged prior to Sept 30th. The new validity date could be after September 30th.

I see. I will try to ask the embassy whether we may go to the USA and get it corrected there. However, the issue is that they have now taken my my husband’s sealed envelopped back and it’s with them. Pfff
It would have been much easier if they had told us to get it corrected in the USA. I wish they had given us that option when we went to see them.
Can you please give me more guidance on the extension or send any link you may have on this. Are we required to perform the medical exam again if we are to get an extension?

My case is EU27XXX. I have completed the DS260 in June and later on in December requested to unlock it due to a change in my martial status. At the same time in December I have submitted all the required documents for me and my spouse correctly. I have emailed KCC in March about the documents and I received a reply that they are currently processing the documents and once they have processed the documents they will let me know if there is anything missing or if they received everything needed. I still do not have any changes and it says that my case is AT KCC. What do you think, should I contact them again?

Hello Brit, Case As7XXX from Nepal: I had requested KCC to unlock my DS260 to add my husband, reply from kcc was “Your case number is now current for interview processing. Because your case is ready to be scheduled, KCC can no longer unlock your application.”But when I visit CEAC site to view my DS260 I witnessed an option “Add Applicant” I added a DS260 form successfully for my husband with status “Completed”. My Qsns are:
1. I added a DS260 for my husband means my DS260 was unlocked?
2. I couldnt access my DS260 form to change marital status single to Married. Why?
3. In CEAC site both of us DS260 is displayed with “Completed” status means DS260 are locked?
4. My marriage certificate is not sent to anywhere, where should I send it? or I should show in the interview?

I’ve texted you once more in the past and your answer was exactly what happens with my visa process.
So , I’m a dv2020 selectee and I passed my interview on December 2019 , got my visa on my passport on January 2020 with expiration date on May 11th. I was about to leave on 30 April and my flight from Greece was canceled due to travel ban from Schengen area so I wasn’t able to!
What I wanted to ask you once more is that if for some reason for example the travel ban or the EO from Trump , I will not be able to travel before the end of 2020 Dv program, do I loose my opportunity to live in US? Or I’ll be OK since I’ve already got the visa before the travel ban and the EO? Also , would it be better for me to pay the USCIS green card fee before my visa expires so it will be 100% granted ?
I keep asking the US EMBASSY here in Athens and the only answer I get is that I have to pay the visa fee again and pass the medical exam once more and that’s all, no more infos. Please advise me the best you think.

The answer is NO you cannot extend the visa after September 30th. The validity can be after September 30, but you have to have it extended before September 30.

His nationality is not a problem. I am British, my wife is Spanish – I processed through DV just fine.

I have just watched you last video and you mentioned 3/4 groups of people that we should think about in all this DV Lottery situation, but you spoke only about 2 – people who must reschedule their interviews from March, April and May, and those who supposed to get 2NL in May and didn’t. (1) What about other groups?
Moreover, what about those who are processing through AOS? To file and submit docs, we need to include the 2NL in the package, but KCC need to process ds260 plus documents first. At the same time you mentioned that AOS people don’t need to send documents that CP people send. (2) Could you please explain? (3) And, as I get current in June (2020EU50xxx) when do I suppose to get 2NL? (4) Is there still a queue, and I need to wait until the lower numbers to be processed?

Actually I covered 3. Those that were scheduled but cancelled, those that were in the second group in May, and those not yet scheduled (which is two groups really – those ready for scheduling, and those that are not).
AOS cases DO NOT need to have documents processed before submission. You need to wake up and start taking action. If you are doing AOS you should have paid your $330 fee and the receipt you get is supposed to be in your I-485. You could already have submitted the I-485 if you had that – no need to wait for KCC at all! Make sure you are studying the forum link I am sure I have given you and get on with it. It is not a good sign that you still don’t understand the process – especially as you need more time for the FTJ. Really – wake up.

Yes, I sent already $330 and i’m waiting for the receipt. Meanwhile I am working on all other things and i-485 and I’m following the Excel that Sm1smom shared. Still, it says I need to include 2nl that I suppose to get from KCC, that’s why I’m confused. You, say to ignore this step and go ahead and submit rest of my document, right?

Regarding the submission of Police Records among the various documents:
In the U.S. embassy`s web page, under “U.S. Visa: Reciprocity and Civil Documents by Country”
It states with regards to my country that “The certificate should be sent directly to the Consular Section”.
Once I ask for the certificate from the relevant Police authority, there is no option for me to receive it and send it with the rest of the documents, because it is sent directly to the Consular Section at the U.S. embassy.
How should I notify KCC about this issue? I don’t want them to consider my pack of documents as incomplete and due to that, they will not process my case.

It really helps if people would mention which country with questions like this. However, assuming you are reading the instructions correctly, you would show KCC evidence that you have followed the embassy specific instructions.

1. My case number is EU 35,xxx.
I have not yet submitted anything understandably due to my region being set at 30,000 last month, but would still like to proceed. I of course do not want to do anything without a certain level of guarantee.
Does current meant that I am eligible to start the process ASAP, even with my case number of 35,xxx?
2. What should my next steps be given that I want to proceed for the DV GC, and are there any things I should be aware of/ considered cons? (My embassy is likely Naples, Italy or London)
I really hope you understand where I’m coming from, as there is a lot happening and I would like to do everything carefully and be aware of anything.

1. There are no guarantees until you have the visa in your hand. Yes you are eligible. , but you have left this very late. However, there is still time if you hurry up.
2. You need to learn the process (link above), submit your DS260, then your documents a few days later (don’t wait to be asked). You need to do that within the next week or two.

I hve completed the DS260 form early February, submitted all the required documents. And i received the congratulation notification which indicates that i am ready to be scheduled on March 2, 2020.
Since then i didnt get the 2NL nor any update about my case
I hve checked CEAC data many times and my case is still at NVC.
Few days back i contacted to KCC and asked about the delay of 2NL and whether they are satisfied about my documents or not then they respond as follows

Records indicate you have submitted a complete and valid DS-260 application for each family member, and you have provided all required documentation to the Kentucky Consular Center. Interviews are scheduled numerically based on case numbers that have completed processing. Interviews for the DV 2020 program will begin in October 2019 and conclude on September 30, 2020. Please refer to the visa bulletin at https://www.travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check https://www.dvlottery.state.gov.

I am a LPR I activated in June 2019 and came back to Argentina to solve problems and kept on working to save some more money to move in to the US in May 2020.
My 4th of May flight to Los Angeles was canceled. I’m just about at the one-year limit of being outside the US.
I am 48 years old and do not have already much ties in the US. Covid-19 started around 2 months ago. But I had already overstayed 6 months abroad. I’ve been reading and studying the news since March.
The Embassy only offered me the link to buy a repatriation flight – relief flight from Eastern Airlines from Buenos Aires to Miami a few weeks ago. Things got worse here in Argentina now and those relief flights are more difficult to get. No commercial flights until September at least.
1- Do you think that I could qualify for a SB1 returning resident visa (11 months abroad, no sufficient ties in the US) Ticket canceled for May 2020 to LAX.
I could try to buy the Eastern Airlines Charter relief flight to Miami IF they are available in the next 30 days in order to save the residency but I don’t know anyone in Miami and I am a bit scared of covid-19, There are not flights back to Argentina of course if I get sick, I am not in my twenties anymore but of course if it is necessary I will do it !!!
2- Do you think that flying in the relief flight is necessary in order to maintain the Green Card if it’s done before the 12 month limit?

1. You will “probably” get an SB1 approved – but of course I cannot say for certain. They are aware of the situation though, so it should not be a problem.

I am trying to do everything to keep the green card. I don’t want to lose it. There was a relief flight a few days ago but it got sold out in less than 1 hour.
1-Do you think that traveling to the US with a green card that overstayed abroad the one year limit may be also an option?
2-Or the SB1 visa is the proper thing to do?
If things continue like this I am thinking I will have 4 or 5 months of overstay until embassies reopen.
I am kind of lost on what to do.

On the new public charge rule, what if you have a host/sponsor who will support you when you get to the states, you’re 30years old with the highest level of education being highschool with no certification to prove you’re qualified in a certain skill but have been employed by various companies on jobs that don’t require certification skills but learned on the job and supported your self ever since you were of legal age but have no properties. Does that discredit you and cripples your chances of getting the green card on public charge basis?

Every case will be assessed by the CO – they make a judgement – usually generously in favor of the applicant. However, having an I-134 is a wise precaution to avoid a problem.

This is not another petition. It’s a different one.
– The earlier published petition defines the class of the lucky winners of DV lottery. Why on Earth one would ever care about those?
– This petition is about the LEGAL immigration (family ties, DV lottery, employment-based) that has been suspended by the Proclamation and that has little, if any at all, effect on the U.S. Labor Marker vs. many UNDOCUMENTED immigrants.
– This petition is to the U.S. Congress rather than to the WH administration to act.
We can sit and wait for the things to settle. Or, building a democratic society we can use the tools available to make our voice heard.

26,000 immigrant visa’s, DV lottery winners included, are issued each month. This is a drop in the ocean of the U.S. Labor Market. These legal immigrants would hardly steal the jobs from the massive of 27 million Americans that have filed for unemployment in March and April. These legal immigrants is nothing vs. 1,2-1,7 million undocumented seasonal immigrants.
