I sent my documents early March and received an email in a few days saying all documents successfully received. The ban was imposed on 23rd of April. I’m from Sri Lanka and there were 700 odd winners from my country. What are the chances of me getting an interview before September.

My case number (AS16XXX) became current in May VB. I am also an H1-B holder working in the U.S., so I believe I am eligible for the I-140 petition. I have already submitted DS260 and got confirmation from KCC in Jan 2020. So, just waiting for an interview invitation from the embassy.
Meanwhile, I found a news today that USCIS will resume premium processing for Form I-129, Petition for a Nonimmigrant Worker and Form I-140, Immigrant Petition for Alien Workers, in phases over the next month.

Special thank you again for comforting and encouraging us to be positive about our dearm during this COVID 19 outbreak and the Executive Order of His Excellency President Trump. On the Executive Order, section 4 of the Executive Order reads
“Sec. 4. Termination. This proclamation shall expire 60 days from its effective date and may be continued as necessary. Whenever appropriate, but no later than 50 days from the effective date of this proclamation, the Secretary of Homeland Security shall, in consultation with the Secretary of State and the Secretary of Labor, recommend whether I should continue or modify this proclamation.
Sec. 5. Effective Date. This proclamation is effective at 11:59 p.m. eastern daylight time on April 23, 2020.”

1- Does this means that if the Executive Order were to be extended it shall be done on the 50th day which of cause shall be June 12th 2020.
2-If by this date mention in 1 above ie 12th June 2020 the Executive Order is not extended will it be signs of hope that we are seeing light at the end of the tunnel?
3- If by that date ie 12th June 2020 the Executive Order is not extended can the President still extend it on the 23rd of June.

No. The DS260 is an application for immigrant status so you do not create a DS260 for someone who does NOT want to come. BUT do list all your children on your own DS260.

If the child was born after the entry, yes. If on the other hand, the child was already born before your entry and you simply neglected to follow the VERY CLEAR instructions, then you will be disqualified.

Brit, 2 weeks ago when I texted KCC they just replied general message without mentioning my DS form. Today they replied to my mail that my DS has been processed (without mentioning my documents) . Does it mean that they are working on my case number and I should get documents confirmation letter?

I have a same situation. Last week they replied to me that DS form is processed. I called them they said they cannot see a note from other department. And she said that document processing is going on. Sounds like a positive sign for now.

Hi Brit.
Greetings and thank you for your assistance. My interview was supposed to be in March. I visited the physician and after the medical examination, the physician told me to come collect the results a day to the interview date. The embassies became close while the report is still with the physician. Note that the medical examination was ending February which means that if the date is maintened it means that the medical results will expire in August ending.
Question
1- if the embassies reopen maybe this June or July and I am reschedule will the physician change the date and and date it to be current with the new interview appointment?
2- According to the DV prosse, do the physician always send a copy of the results to the embassy and then give the applicant another copy to take to interview.

We are in the same situation. We need to go, get it stamped and come back to mitigate the risk but there are no flights operating way back to our country. It’s only departures. We wrote to embassy and call several times but they can not give an answer upon re-issuing visa, as long as Tramup’s ban in place.
We are worrying as traveling under this situation is a risk but we have not left with many options as well.

Gen and Chamila. YOu both just need to accept the visa won’t be re-issued while the ban is in place. But there is (so far) no sign that the ban will be extended. So, if you cannot travel – be patient and wait until the ban has ended AND your visa expires.

Pre face: I live in the U.S. and would hope to adjust from here, but there may be a few issues that I’m waiting to hear from my lawyer about. I already have a pending family based i485/ i130. An NOID was issued so I’m hoping to just get done with this process via DV lottery. With all that said here are my questions:
a – are there any rights to appeal a decision under a DV lottery application if you are denied for any reason?
b – If I did consular processing and was for some reason denied for that, would I be able to re-enter the U.S. on my existing advanced parole from the family-based application?
c – Are there any effects on my existing adjustment application/ i130 that I’m not foreseeing?
d – Would I have to fly back to Australia (home country) for consular processing or could I go somewhere else (like Canada) to complete that process?

In the Approval Letter, I was reminded that “The NVC will then forward approved petition to the consulate. Which were take up to a minimum of 30 days? Then the NVC was to contact the beneficiary, with further information about immigrant visa processing steps.”. Since I received the approval notice letter, 30 days have elapsed, and I have not received any email from the NVC. I made an inquiry through their email. Hello Brit , I hope you doing great and safe with your family . Today I called the KCC as it was advices , to call them early June . The lady I talked to , told me the same answers , that they are processing documents numerically , that I need to check in a couple of weeks , even though I explain to her that we are in June and my AF region is current and I might be running out of time . She said I should receive an email once they process my documents , if not I should check again in a couple of weeks .
It’s frustrating that the KCC is the only office that we can ask about our documents , but even them don’t have clear answers to us .

Hi, I also called KCC today.My cn is eu32xxx. I just called kcc to find out if my documents were processed. The lady said that she is unable to see because documents are in different department. She said that I will receive an email either congratulation or something is missing or incomplete.

when they ask me about where my father and my mother were born i wrote the name of big City they were they born but my birthday certificate mention the small village which is near the city i wrote in DS-260.

I called this morning and a lady said my document has bn completely processed but that it has been directed to another department. Hi Moldir. It took a while for mine too. It never arrived even though they said it was sent. I called the KCC and they were very helpful. They emailed a copy of the receipt over night. Try that. I don’t remember the number. But I found it online pretty easily.

Dear Brit,
the unemployment rate for May is decreased, the USA market has 3 million job added,
most of the States of USA are open, the number of covid infection and deaths is decreased.
I think that this are facts that there is no need for an extension of the Immigration ban.

But once again the situation is not so bad. in 2009 the unemployment rate was 10% but no one made a ban for legal immigrants We are not hurting nobody.

If the Department of State (DoS) is responsible for reopening embassies around the world, would it be a good idea to call them or send an email and get to know what their plans for the reopening are?

I tried. We have to wait up to 5 days. There was a note: “This form is not for questions related to passports, overseas citizen services, or visas.” I asked only about the embassies’ reopening plans. I wanted to choose other section of DoS, but there was no email to contact, just the FAQ, so I decided to send my email there. It was the main DoS website. Hopefully we’ll get some info soon. I’ll let you know if I get to know something 🙂

Brit, I’ve called KCC and they still tell me that can’t see my documents, because it isn’t processed. Should I call every week or what? Some cases over 33K has received confirmations and I’ve sent them back in November. The lady was very disrespectful. She was like I can’t promise that you will receive any confirmation because of your case number. So frustrating

I have checked every detail in my email and there is not a mistake. I hope they will at least write to me if they have questions.

They are having to field questions from people over the closing months and probably get told to be clear and cautious and not over promise. They are not helping anyone by giving misleading over confident statements. The reality is we are going to see a hard landing here. The next few weeks will be hard….

Dear BritSimon, 1. does sending documents multiple times help? I have sent once and received receipt autoreply. I do not understand the logic of sending multiple times. 2. If they have some questions regarding my documents, normally they write and ask about further documents right?

1. But i did not screw, I checked many times and I followed all instructions in their email.
2. Two thing comes into my mind a. they might have question about the fact that ending of my surname changed from -ov to -nko. This is indicated in my birth certificate and it is shown their that “read as -nko”. I have mentioned in DS form that prior to 2004 I had surname with -ov. If this is the reason of delay, I do not know how can I explain them that.
b. My wife’s mother changed her surname late and in my wife’s birth certificate her mother’s surname is different than what we put in DS form.
Maybe I should have sent her parent’s marriage certificate as well? Confusing situation.
I am now thinking to send documents again. Do you think it is wise to send another attachment to explain the above a and b?
Looks like there is not much time anyways. I am EU29xx. One more try maybe.

I dont want to spark any angry response whatsoever and please dont respond in any angry tirade
But you seem to have a lot of anger and animosity and maybe that also comes across when you communicate (as it does here)
As another guy had success and said everyone’s been great
The whole world, and particularly U.S. MOST OF ALL is going through a lot of turmoil and hell
No one really knows what is happening and going to happen – everything is up in the air literally
Even the staff at KCC must be under a lot of strain and duress and colleagues not at work and unemployment and riots and protests
Things are really stressed and strained in every way in the USA and throughout the world
Looking at the US law and order, treatment of protesters and races (particularly Blacks and Hispanics) and protests – and state of economy and unemployment now, state of democracy there right now and a very peculiar President – I cant even say its a good place to be and has made me think – is this place even worth it
I would even say to Britsimon, go back to England, its a far more civilized and orderly place in the present time than what we can see – have you seen the news from the U.S.? – Its just bad to worse to worse, day by day, month by month.
Im sure the population there (incl. workers at the KCC) are feeling the heat and strain
Europe and Britain seem a far better place and has given me serious, serious, serious reservations about the USA – LIKE A COMPLETE RE-THINK – IS THIS PLACE WORTH IT?????

Interesting points and no angry tirade from me.
There is no doubt that we are in troubled times. POTUS is a damn fool. The lack of leadership has cost us more pain/damage than was necessary. The fractures in society are more evident now than before. All those things are true. But I am hopeful that November will see change – and that would mean by mid January we will see different realities, different solutions, different mindset. Of course there will still be a large percentage of the country that think like Trump, but without Trump those people will be less emboldened, less supported in their crazy ideas.
For me personally I have no plans to go back to Europe to live. I spent significant time in Spain and Switzerland as well as the UK. I am financially stable, so I could choose to live anywhere. But even knowing that I continue to choose to live here in the USA. So – that should tell you something. There are pros and cons to every place, but on balance I firmly believe I am in the best place, even though that place is suffering a lack of good leadership right now.
