Are you aware, i mean are lawyers aware that KCC schedules interviews to people within 72 hours, they appoint impossible timing in order to make them fail and pass as much processing numbers they can, so they can say to judge, we scheduled but they didnt appear?

AS887 I was jst received the call from embassy bt they formally asked about my case and all the detail and told them i did my medical on march 20 and was hold for tv check up and then the report came at june..But they called back and said i was medical hold so its not possible to resudule though report was clear.They said if extension happens might be reschudule..bad day bad luck..

Bt iom said my report was clear but remedical might get longer again to do tuberculosis check again though its clear so time is short.so that why i was medical hold case said by embassy.so,medical hold case might not be helped by extend too..is that it.it takes 8 weeks for report .so i called embassy and told them to resudule and re-medical and take the chance…OR SHOULD i wait for extension.

My case was approved back in march but not issued and last week on 15 September embassy themselves took my remedial report from the IOM without informing and Next day I submitted new police report to be delivered to the bank, as my spouse was on medical hold so we did not do medical of my spouse as she is likely to be in hold again also embassy official and medical doctor suggested us to do the same.
After that i have received several calls from Different embassy staff regarding medical and each day about my medical and also about my Passport (it is in the embassy since interview). I explained them everything and also about several calls regarding same thing and looks like my case hasn’t been move forward and I am receiving several calls .Today they even asked documents regarding my marriage which I had already presented during interview and but later told me that they will call me later but they don’t receive calls. As time is fast approaching the embassy seems to be uninformed and no coordination internally delaying my case.
what step can I take in this situation? It is quite frustrating everyday.

However, shall I also send a scanned copy of my bachelor degree certificate and copies of employment certificates of current and past work experiences? Or is that for when I go to my interview?

No. They have said that they are prioritizing and helping those cases that can be helped, because there is not enough time to help every case. That is reasonable and logical. Not against the order. So – as I have said many many times, if you are in group 5 your only hope is an extension.

Hello Brit, my wife is a DV2021 winner. I have a two questions if I may ask:
1- Regarding the criminal background. MY WIFE WAS ARRESTED IN 2012 AS A RESULT OF A MISUNDERSTANDING IN WALMART, WILLSTON, NORTH DAKOTA, USA when she was there as a student on a J1 visa. AS A RESULT, SHE WAS CHARGED WITH SHOPLIFTING, LEVEL B MISDEMEANOR IN NORTH DAKOTA. SHE PAID 250 DOLLARS IN FEES AND STAYED 10 DAYS IN JAIL. FROM OUR RESEARCH, THIS CRIME FALLS UNDER PETTY OFFENCE EXCEPTION BECAUSE IT IS THE ONLY OFFENSE AND THE MAXIMUM PENALTY POSSIBLE DID NOT EXCEED IMPRISONMENT FOR ONE YEAR AND SHE WAS NOT SENTENCED FOR MORE THAN SIX MONTHS. She has stated this information in the DS 260 form. Can you please tell us if we are eligible for DV visa?
2 – Regarding the form I-134. I am freelancing for a US company and I am in good relations with that employer who is open to fill out the i-134 for my wife and my family as the principal applicant. Is it ok to do so even if my wife is not closely acquainted with my employer with whom I have amicable relations.

I submitted my documents on September this month when lock down was lifted because the embassy was closed down as well. Not heard from the embassy since. I have a small concern.
In the DS260 there is a party to which they asked if you have already used a pseudonym, maiden name, alias, religious name or other name.
I answered no to this question, since I have no other name to which I am known outside of my names on my ID.
I had created an Instagram account with a pseudonym (Parker) is just a nickname I invented and add to my last name.
I will give you an example, in my file ds260 My name is for example John Doe but in the Instagram account is john Parker Doe.
Parker is a nickname I invented.
1- I would like to know if I have to add this nickname (Parker) in my DS 260 as other name used in the past ?
Or it’s not necessary?
Knowing that it’s not a name I’m known or I’ve been known in the past. It’s just a nickname I used in that Instagram account and another account I used (parkeur) as Twitter username identification

I am a DV2020 (2020AF16686), I have an interview scheduled on Thursday. We are 3 (I, my wife, and the child). I have required savings on the bank account ($30000). However, as you advised, to be on the safe side, I recently requested a family member who is the US to fill the Form I-134 Affidavit of Support (she sent LEAVE AND EARNINGS STATEMENT, W2-2019, 1040 of 2018, and the driving license)
Question: 1: are the supporting documents enough?
Question 2: that one who filled the I-134 is not the same as the one on the DS-260 (where I will go and send my green card). Should the one fill the I-134 be the one who will receive me or it is not required? If yes, should I mention that during the interview and ask to change? I choose the one who will receive me because he lives in a place I visited and know many people there, so likely to integrate easily, but he could not sign the I-134 Affidavit of support due to his wages.

1. Are DV 2020 winners considered as exceptions if they have a profession listed in the exception list (medical nurse, doctors …)?
2. If yes, does the main applicant qualify as the exception or the dependents as well?
My wife is a registered nurse but I am the main applicant.
3. Can she qualify as an exception from the PP 10014?
4. If yes, how would we know?
We received our visas with this annotations:
– my passport: entry subject to PP 10014
– my wife passport: entry subject to PP 10014

Hi Brit, how are you brother?
I have a concern. When I filled my ds260 I answered no to the following question: have you ever visited countries or regions in the past five years?
A month after submitting my ds 260 I lost my old passport. I unlocked my ds 260 to add the number of the new passport (I had two passports, the old one I was using and the new one that I have not yet used).
A week ago, I remembered that I had visited Algeria the entry and exit visas were stamped on the last page of my old passport (lost one).
I unlocked my ds260 to correct this and add Algeria that I had visited in 2016, I had done a month there.
1- I would like to know if the fact that I added Algeria while I no longer have my old passport to prove the duration of my one month stay in Algeria could penalize me or cause my visa to be refused ?
2- or maybe the CO would request me to prove or to demonstrate the duration of my stay ? (Knowing the fact that the passport has been stolen from me and I can’t prove anything without the passport)
3- Is there a problem if I mention in my ds260 that I intend to work in the army (military) once I arrive in the United States?

3. The question is not clear – but answer honestly.
4. There is a special process for newborns. Don’t worry about it – you will sort that out later.

HI Simon.
I am not sure if you can recall so please excuse the brief summary. Having entered the US 5 Nov 2019 with my LPR Visa I then returned to South Africa 15 Nov to tie up loose ends, only to get stuck here because of borders closing down and flights cancelled owing to COVID. While there were expatriation flights they were exorbitantly expensive and so on your opinion and mine I decided to sit it out and see if the borders for international travel would re-open before 15 Nov. (that being the anniversary of my departure )
The borders have just a day ago been re-opened. I am now awaiting for commercial flights to re-start.
While my aim would be to book to leave 23 Oct would it make much difference:
a – if I left 30 th Oct ?
b – or even closer like 5 November ?
c. Is my re-entry and absence based from when I entered in 2019 ie. 5November 2019
d. – Or on my departure ie, 15 November ?

I am going to receive my green card soon. Then, I have heard that to keep the green card and be eligible for citizenship 1) we should be in US every 6 months and 2) we should be in US 3 out of 5 years.
my questions are:
1) are these correct?
2) should we do the second rule exactly in the first 5 years? I mean is it possible that, for instance, in the first 4 years we go to US every 6 months but do not stay there much. Then from year 4 to 9 we go there every 6 months and we stay in total 3 years. Then, can we apply for citizenship at the end of year 9?
3) when we go to US every 6 months, what is the minimum period that we should stay there?

Hello, Simon. I’m a DV-2021 selectee. I’m from South America. My case number according to the “letter” displayed in the Diversity Visa web site letting me know that I have been selected is 44XX. Can you tell me if this is a low, mid-field, high or very high number for South America for DV-2021? I know is complicated to know, but to the best of your knowledge, are my chances of getting scheduled for an interview good? I have no idea at this point.

Hello Brit!, Thank you for all the effort you put in this blog. I’m winner of the DV2021 lottery, I just have a simple question, concerning to the name I entered in the DV lottery form. You see, I’m from Nicaragua (South America), in our countries is usual to have two last names, our father’s and mother’s last names. There are lots of videos that state that for the DV form, only the family name is required, (father’s last name in my country), I did it that way. So, my notification of selection is addressed to “Saul Eugenio Fonseca”, but in the DS260 I entered my full name according to the instrucctions in the form, “Saul Eugenio Fonseca Flores”. My question is, is this a major concern? My visa will be refused because of this?
Plus hehe, My case number is 2021SA34XX, I’ve done some research, and I know I’m not having an interview before May 2021, but if I may ask, Do you think my number is too high for scheduling an interview?

The name should not be a problem. Use the “other names” section of the DS260 to list Saul Eugenio Fonseca and the full name as you legal name.

Well that ship already sailed. The moment you submitted the DS260 you declared immigrant intent. That can be a factor against you in non immigrant visa applications, but it is only one of several factors considered.

Dear Mr. Brit I went to the Ethiopian Embassy in person today and they asked for my case number and others too. After a while they clearly said that they are only going to help the ones who have ALREADY interviewed before. But not for the ones whose interview appointments are canceled.
What’s the solution now?

Hi Brit, i am a dv2021 winner And i am from Egypt but here is the thing , i have a job contract from a big company in hungary in my field.
My question being that if i made the interview from hungary will my odds be less , And also do i need to have a sponsor (Someone to sponsor me from usa ) if i made the interview in hungary or not ?

Since the embassy in Hungary is less experienced with documents from Egypt, there may be a little delay. But that’s about all.

Hi Brit, Just to keep you updated i just spoke to KCC one lady replied my call she was so helpful and she informed me that they are still working on plaintiff and they did not finish it. They are working on group 4 but only for plaintiff not all group 4. I dont understand its more 2 weeks and they could not finish the 1000 plaintiff where as on average KCC can schedule around 3800 case in a normal month. And is there any update regarding the status report submitted by the government lawyers as instructed by Judge Mehta ??? DoS & KCC did not do comply with the Judge Mehta order to take DV 2020 as mission critical and was done in good faith. What your take comments on that.

I am a DV-2021 winner. I was arrested once in a country which, according to the Reciprocity by Country page, I can’t get a police certificate from. In the security questions section in the DS-260, at the top of the page, it says something along the lines of “if you answer yes to any of the questions, you may be required to provide documents supporting your answer”. I’ve answered “yes” to the question that asks whether I’ve been arrested before. The only supporting document here would be the police certificate which is not possible to get. What should I do in this case?

Diversity Visa (DV-2020) Update
Last Updated: September 17, 2020
On September 4, 2020, the U.S. District Court in the District of Columbia ruled in Gomez v. Trump that the Department must make good-faith efforts to expeditiously schedule, process and adjudicate DV-2020 diversity visa applications by September 30, 2020 notwithstanding Presidential Proclamation 10014. Therefore, DV-2020 applicants may be processed in embassies and consulates where local health conditions and post resources allow. In accordance with the requirements in the Immigration and Nationality Act and applicable regulations, applicants must be documentarily qualified, have paid all requisite application fees, be able to obtain the required medical exam by a panel physician, and demonstrate that they are eligible for a visa before visa issuance. DV-2020 applicants may be issued a visa through the end of the fiscal year, on or before September 30, 2020. Applicants are reminded that immigrant visas generally expire on the same date as the medical exam expiration, typically three or six months from the date of the exam. DV applicants whose medical exam has already been conducted but will expire prior to December 31, 2020, may opt to submit a new medical exam prior to visa issuance.
The Department of State will use the following prioritization plan for these applicants, consistent with the court order and applicable law:
Individuals who were named plaintiffs in Gomez v. Trump and its companion cases;
Applicants who had already been interviewed who seek reissuance or to overcome a prior refusal;
Applicants who were scheduled for appointments in March, April, or May and whose appointments were cancelled due to the COVID-19 pandemic and worldwide suspension of routine visa processing;
For posts that have additional capacity to process applications and are not exhausted by the three categories above, applicants whose cases are pending with the Department’s Kentucky Consular Center.
Although DV-2020 applicants may be issued an immigrant visa under this court order, Presidential Proclamation 10014, which suspends entry into the United States of certain immigrants (including Diversity Visa applicants), remains in effect until December 31, 2020, and can be extended by the President. Therefore, unless a DV visa recipient also meets an exception to the Proclamation, that DV visa holder will be unable to travel to the United States on the issued visa while the Proclamation is in effect.
Please note that prior versions of this guidance addressed travel restrictions imposed in Presidential Proclamations 9984, 9992, 9993, 9996, and 10041, which suspend entry of individuals who within the last 14 days have been physically present in China, Iran, UK, Ireland, the 26 countries of the Schengen area, or Brazil. On September 14, the U.S. District Court in the District of Columbia ruled in Gomez v. Trump amended its order to enjoin the State Department from applying or enforcing State’s implementation guidance for these proclamations when it comes to DV-2020 applicants. Consistent with the Court’ order, no DV-2020 applicants will be prevented from applying for or receiving a visa due to these regional COVID proclamations if otherwise eligible.
Please note that Presidential Proclamations 9645 and 9983 restrict the issuance of diversity visas to nationals of the following countries unless they qualify for a waiver or an exception: Burma, Eritrea, Iran, Kyrgyzstan, Libya, Nigeria, North Korea, Somalia, Sudan, Syria, Tanzania, and Yemen. DV-2020 applicants may be subject to restrictions under additional Presidential Proclamations as well. The Court’s order does not extend to these and other Presidential Proclamations; it only pertains to those proclamations already discussed above.
DV-2020 applicants whose visas will expire before December 31, 2020 when Proclamation 10014 is currently due to expire, will be unable to immigrate on that visa, unless they are exempt from the Proclamation, and cannot be issued a new visa after September 30, 2020. DV applicants are reminded that if they were either in the United States, or held a valid immigrant visa on April 23, when Presidential Proclamation 10014 went into effect, they are exempt from the Proclamation. DV applicants who held valid DV visas on April 23 but were unable to travel and whose visas have since expired, may pay applicable visa fees to have the DV re-issued visa before September 30, 2020.
DV-2020 applicants whose cases were previously scheduled for an interview appointment (even if cancelled) at a U.S. embassy or consulate overseas should reach out directly to that embassy or consulate for further information on their specific case. If a post is unable to process cases due to local health conditions and resource constraints, an applicant may request a transfer to another post. DV applicants can request a transfer by contacting the desired post directly; not all transfer requests will be able to be accommodated. DV applicants who have responded to requests for documents from the Kentucky Consular Center (KCC) and have been notified that their cases are documentarily qualified, but awaiting a visa interview date, will be scheduled in accordance with their rank order and post’s scheduling capacity. The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, it will be unable to accommodate all DV applicants before September 30, 2020.
Please note that embassies and consulates may need to reschedule visa applicants in other visa categories to prioritize DV applicants, in adherence with the court order, through September
