My girlfriend was selected for DV2017. She got notification letter it in September 2016. In case not to make things more complicated we got married today to submit DS260 as a married couple.We added a new DS 260 through “new applicant” in her application for me, as a spouse, according to your instruction.My spouse has a child from her previous marriage.The question is should i mention her son in my application?I dont have any adoption documents.

Hi Brit!
My spouse won the DV2017 lottery. We’re currently in the US with J visas and planning on doing AOS. I may need to travel outside of the US and I’m worried about having problems upon return to the US.
I’m worried that the fact that we’ve been selected in the DV program will pose a risk to returning to the US on my current J visa due to immigrant intent. (Q1) May I be denied entry?
For context: we have not yet started the Green Card application process. We checked online that we are DV2017 selectees but haven’t submitted the DS-260 forms or anything else related to the DV program.
(Q2) Does winning the DV lottery imply “immigrant intent”?
(Q3) What should I do to minimize risk of being denied re-entry to the US on J1?

1. Not because of the DV, no.
2. No – processing is immigrant intent, not entering or winning.
3. Wait until you return from your trip to start processing. Depending on your case number and trip dates that might be needed anyway. Also – wait at least 30 days after re-entry, 60 days is better.

(Q1) What is considered the “start of processing”? Is it submitting the DS260?
(Q2) I’d appreciate to understand why we should we wait 30-60 days after re-entry to the US to start processing. What would happen if we didn’t wait?
Our CN is EU7xxx so we’d be current already. We want to do AOS which I believe can take longer. I’m worried that waiting 30-60days post returning may push things too much. We’d be submitting our DS260s in January/February 2017 if we waited 30-60d post the trip. (Q3) Is that too late to finalize the process via AOS before Sept 30?

1. Yes. But then submission of the I485 being more important for AoS cases.

Your prime concern should be avoiding immigrant intent. Submission in February is NO problem. Peop;le have processed AOS cases when they become current in September (so within the month). That is stressful but possible, so relax about the timeline and wait 60+ days after return.

In our case, my spouse is the one who’s been selected as a DV2017 winner. I’m the one who may want to travel outside of the US and I’m currently the principal applicant on our J visa (ie: I’m J1, my spouse is J2). I’m wondering how the 30/60 rule would apply in this case:
(Q1) Is it based on the date of entry of the principal DV applicant (which was a few months ago)? Or, if I travel ex-US will the clock start ticking upon MY return?
(Q2) Is the date of entry treated “individually”? I mean, each applicant (principal vs derivative) has their own 30/60 timeline. Or is it treated as a “pack”?

Hi brit i am a 2017 Dv winner my question is 1. in my marriage certificate the adress of my wife was written in english by the officiating imam but when he was about to write the same adress in Arabic language since it is a muslim marriage certificate, he made a mistake and he ended using a white correction fluid before writing the correct thing will that be a problem during interview

The Country of chargeability is what is important – and yours shows your country of birth – correct? If so – that is fine.

Have you ever been arrested or convicted for any offence or crime, even though subject of pardon, amnesty, or other similar action?
I answered: No with best of my knowledge then…. but now have doubts as not sure if thats includes speeding offence (I got some points on my driving licence for exceeding speed etc) I want to obtain police certificate and see what is there and then in case I have some recorded offences update my DS 260)- hope that make sense …

.a friend of mine is a dv winner Rwandese nationality but born in burundi,he has all document for Rwanda(passport,birth certificate,criminal record etc) as Rwandan citizen but he is eligible for burundi. he sis already schedule for interview US EMBASSY NAIROBI.
1.Would present Rwandan document be a problem caused by eligible country .
2.is it clear he can explain the consular.
Not:he mention in ds 260 that he is Rwandese born in burundi
3.is true that all foreign student in usa after completing their studies must go back in their country to work at least 2years.if your selected for dv lottery and not yet completed 2 years is it possible consular can issued you a visa.

1. I suspect he would be asked for the birth certificate from Burundi – but otherwise not a problem.

3. There are some visas like that. In those cases the DV case may not be possible if the person has not completed the 2 years.

“high school, no degree” means attended High school but don’t have a degree
“high school degree” means attended High school
“vocational degree” means attended some other education which was specific to some particular vocation (job)

2_ if i fix my sponsor in USA, and i introduce one, is that person responsible for anything for me in the future? or it’s just that form, i use his/her help to enter the U.S soil and that’s it and he’s free ?

1. It doesn’t matter where the account is. $10k is the minimum that should be shown for a single person. An I-134 is always safer.
2. No legally enforceable responsibility – it’s just a “promise”.

It takes from a few hours to a couple of weeks to unlock, depending on how busy they are. Once it is done, they send you and email.

Again, and for the last time. The I-134 is *NOT* legally enforceable. My source for that statement? The US Department of State. If you don’t ant to believe it – that’s up to you. I am 100% certain of the facts.
The I-864 was introduced *because* the I-134 was tested in court – and USCIS have switched to using the new form for the majority of cases where a legally enforceable AOS is required, the I-134 is used in cases where it is not required.

First, the sponsor cannot be sued – you are thinking about the I-864.
Bank statements are ok, like I said, the I134 is safer.

Dear Brit Simon, Our case number is not yet current but we are hoping for an interview in January or February in London. I have read that you need to provide proof of $10,000 however I have read through all the DV website step by step instructions and the London embassy info and although it lists in detail everything we need to bring nowhere does is say anything about proof of funds, should we just bring a recent bank statement? Thanks for your help.

The proof of how you will avoid becoming a public charge is in the FAQ when you entered the lottery.
The $10000 is per person (or at least per adult). Take a bank statement at the very least, an I-134 would be safer.

Unfortunately, I mistakenly put my nationality as the Country of Eligibility for the DV Program which is different than the country where I was born that is also eligible for the DV program.

If the two countries are in the same DV region, the mistake can sometimes be forgiven.
If this is about DV2018, your chances of selection are very low anyway…

Interview at the embassy has been scheduled for me as the principal applicant and my wife and daughter as derivatives. After the 2NL my wife definitely decided that she and our daughter would not attend the interview nor go to the USA. My question no.1 is do I have to inform the embassy by email that I will be attending the interview alone? Second question, do I have to bring 330$ just for myself, or do I have to pay 3×330$ even if they will not be there? 3. question is my visa in jeopardy in any way because the decided not to go? I am totally eligible, have finished my medical and prepared all the documents…thanx in advance!

Hi Brit I went to the interview everything went well technically our Visa was approved,but they asked for a new sponsor because my initial sponsors income is 3000 USD less than asking amount, so we are finding difficult to find a new sponsor, so its possible to drop one of our our child from the Visa Application so we can use the same old sponsor and re-apply, your advise will be great help

My husband win DV2017 but at the time of play the lottery the person that played for him mistakenly entered the wrong date of birth, now we have emailed KCC and inform them about it but the said since we have the original document with the right date of birth so we should hold on to it. You must make sure the correct date of birth is on the DS260. In most cases, if that is the only error they would forgive the mistake. Some CO’s might not forgive it – it is up to the CO.

I am very happy , i arrived in the US last week wednesday
My interview took place in Johannesburg on the 31 August 2016 in Johannesburg South Africa
I am from the Democratic Republic of Congo
My Interview:
I reached the US consulate at 1pm (was suppose to be there earlier)
After the security check, i entered.
They directed to the window, where i dropped the required document
Unfortunately the document i took from our embassy in Pretoria (Police clearance & birth certificate) were rejected.
After that step, i sat down for a while, and after some minutes , they directed me to a window to pay the fees.
And i had to wait till 5pm for the very interview:
CO: Hi, how are you doing?
ME: I am fine thanks
CO: What’your name ?
ME: ………..
CO:What’s your date of birth?
ME:………..
CO: Who is going to support you financially?
ME:………………
CO: And where are you going to stay in the US?
ME: ……………..
CO: These are two different persons, can you tell me why?
ME:………………..
CO: Ok, i will be waiting for the original of your hogh school diploma, your congolese police clearance, and your birth certificate.
NOTE:
1) I had lost the original of my high school diploma, so i had to contact the office in charge of that in Congo(Inspection generale de l’enseignement).
2) People from Congo should not bring to the consulate a police clearance(Extrait de casier judiciaire) made in provinces, it will be rejected.
The US consulate or embassy will only accept the one made in Kinshasa(Gombe)
My case was suppose to expire on the 30 September(General rule), after dropping the police clearance made at the embassy in Pretoria, which was rejected, i gave them the one made in Lubumbashi (Provincial one), which was rejected, i had to give them the one from Kinshasa(the directed me where to get it)
So my police clearance reached the US consulate on 28 September, 2 days before my case expires
Now i am in the US since last week

Please what l meant was after submitting l didn’t received confirmation mail from them so l wrote to kcc to verify ,and they didn,t respond to my mail.Until today l found a copy of the confirmation mail been forwarded to an additional email address l added to mine.So what l wanted to ask if there was going to be a problem with my case for writing to kcc for inform them Or the kcc will go ahead and offer an appointment for interview.Thanks

mr brit please tell me. I have recently edit my photo to rub it brush the dot on background and you cannot see the area using editing then i submited dvlottery 2018 and photo validator accepted it so iam disqualified or not because some of my friends said is disqualifation

The DV for 2018 doesn’t mention the nationality, I’m from Egypt but I born in Ethiopia and I live in turkey so all the questions is where I born and address which I fill it and it’s in turkey and birth place in ethiopia but there was not a quetion asking my nationality is that a problem? And 2nd question I used my mobile camera and tooked a picture from my passport picture because I couldn’t go to the photographer I might be disqualified or not? plus my picture was clearand my 3rd question is I will finish my high school on june 15 2017 and I choose high school no degree does it a problem or not? specially that choosing the winners is on 2 may and I will graduate from my high school on june 2017 and last question my last name family/last name is jezani but in mistake I wrote gezani one letter changed is it problem?

1. They want birth place (Ethiopia). Nationality is not important at all.
2. Phone photos are OK
3. No problem.

I am the winner of dv 2017.
I have following confusions .
1. I was single during the initial registration of dv but I got married before dv result (ie dec 2) . then I canged my status to married during filling ds260.will it affect or not?
2. my case id is AS2017000014# .AND I submited my ds260 form on june 16 …still I havenot received 2nd letter but my freinds having larger case id had already given interview .what may be the possible reason .?
3.Recently my sponsore of us have changed their adress on USA …I am in confussion whether I have to change their adress rigjt now or after receiving 2nd letter ? if I unlock ds form right now then I have take longer time to receive 2nd letter .so plz suggest me what is correct to do now

Does the elections have any correlations with the interviews and CNs.
