Hello Simon, how are you doing? I’m a DV2022 winner not yet current (but possibly next VB), currently I’m in the US but previously I selected CP when I filled my DS260. I wanted to know if I should contact KCC and let them know that I want to do AOS right know or if I could do that later (when I become current). I’m worried my case could be sent to the embassy and get stuck in a “limbo” (as you have called it), could this happen with AOS? Thank your for your time and help.

If you want to switch to AOS you need to get going. There is a good chance for AOS cases filed about now. The FOs will move fast.

I have an interview scheduled for the 5th of Mei. My interview got scheduled before I had a chance to send all my supporting documents to KCC. I finally got my unabridged birth certificate on the 8th of April (6 months after i applied for it)
My question is if i should still send a scanned copy of by documents to KCC (as i understand it they are done processing my case and all further questions should be directed towards the embassy) Should i email scanned copies of my documents to the embassy and explain why they were delayed? Or should i just bring the original documents with copies along to the day of the interview?

Your case number is now current for interview processing. Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov. If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.

This email comes when your case is “actively” being scheduled. It’s a special point in time. If your embassy is working, and has capacity for your case, you can expect a 2NL within the next couple of weeks. However, if your embassy is NOT working you can be in a kind of limbo. At this point you cannot make any changes, because KCC has allocated the case to your embassy, but not sent it to the embassy yet. If the embassy does not have full capacity, and there are more cases in front of you than they can interview in the month, then your interview will be pushed to a later month.

Hi Simon. I recently stumbled across your youtube video and found your content to be very helpful. I have a question. My sister won the dvs lottery and her interview is coming up this week. I currently live in the US and have been for many years. I do not have my green card yet however my employer is sponsoring me for one and has filed an I-485 (last stage in the GC process) so I am hoping to receive my green card this year. I would like to strengthen my sister’s case for getting approved when she goes for her interview at the US Consulate. She is qualifying based on work experience only. My understanding is that I cannot complete I-134 ie affidavit of support since I’m not a greencard holder (yet). Is my understanding correct? If so, what can I provide to my sister for her interview, to show that I will be able to financially support her when she is in the US? Thank you!

You are correct that normally they don’t accept I-134 from non residents, but try anyway and write a letter explaining your current I-485 process.

Good evening Brit. Thanks alot . You have been very helpful. I am AF 5*** and my interview is up coming next week. We are a family of 3.We did the medicals, though just my wife and I got sealed envelopes ( results). The physician said the medical results of the child shall be available only after the interview. They gave a third sealed envelope, and told us it contains a letter to be given to the consular officer .The letter will tell him why my child’s results are not yet available.
1. Can we be approved our visas with this situation, or it’s heading straight to AP .

I reside in Saudi Arabia but I go to uni abroad. When filling the current address section on the DS-260 I only put my house address in Saudi Arabia and didn’t include the one from abroad, because according to instructions, I haven’t stayed for more than 6 months at a time. But recently due to lockdown and Covid travelling restrictions, I’ve exceeded the 6 month period. Do you think that I should request to unlock my form in order to fix it or can I just explain everything at the time of the interview? My case number is 2022AF45xxx and is current. I’ve already obtained the police certificate from both countries.

Again, they don’t care about how long you are in the USA. That is only a factor in citizenship – which is another matter.

But, sorry to prolong this conversation, if I don’t mistake , to avoid problem with the immigration and risk losing your GC, you are supposed to live in US more than 6 months a year. Correct me if I mistake. That is why I was wondering if they start calculating it already when you are in possession of your I-555 which is pratically consider as a GC.

No you somewhat misunderstand. Yes you are supposed to live there, but you can be out of the country for up to 1 year and still be OK. However, if after 3 or 4 years you are obviously just “visiting” they can refer you to an immigration Judge for possible (but not likely) removal proceedings. But as long as you intend to move there, you should have no problem.

They lost my Green Card and now I have to pay.
I wonder how is accettable USCIS sending such an important document without a certified mail. For me this is outrageous. They told me it show up on their system as delivered and I never got it. Probably stolen by the mail man. Now I need to pay $450 of replacement, arranging Biometric for another $85 with all the burden of meeting and BS. I don’t have words for this really!

Interfering with (stealing) mail is a very serious offence here. It would be surprising if the mail man had stolen it. You might be able to start an investigation through the post office since all mail is tracked now. I actually get photos of the mail that is about to be delivered – so make enquiries.

Being current is not a guarantee of getting an interview. Many people won’t get an interview or visa despite being current. Your chance depends partly on your embassy in terms of their capacity and how many others they have ready for interviews before you.

I made the interview at the embassy and I received the passport with the visa on it. I plan to go into us on June but in the meantime I got married. Do I have to do something or can I go to the US as planned? On the visa the marital status is “single”… there will be problems at the port of entry?

You could theoretically add your spouse to your case prior to entry, but if you enter without doing that it will take you about 2+ years to sponsor your spouse. So decide what you want to do.

I’m trying to do it with the embassy, but it seems it is taking too long (the embassy asked to send via mail the marriage certificate, but so far non new updates).
What I would like to understand is if I’m the meanwhile I can go to US and activate my permanent resident card or I have to wait the response of the embassy. What do you think?

You should re-read my earlier response. Entering the USA will end your possibility to simply add the spouse. Then you have a 2+ year process. So – without exceeding the expiry date of your visa, wait for the embassy and politely chase them for progress.

1. The main difference that we *know* is that documents are no longer required. There are most likely other changes, but I don’t want to speculate.

After greetings!
We have attended DV interview in 2nd week of March 2022. I am not the primary applicant. Actually, my wife is the primary applicant. I have been in Qatar from 2014 to 2017. When I fill out DS260, we didn’t disclose the information about my Qatar stay. Before the interview, I have wrote to KCC to unlock the DS260 to update the information.
Got reply from KCC that cannot unlock the DS260 at the moment due to our case was ready for interview. We took the correspondences and receipt of application for Qatar police clearance to the interview. During the interview, nothing discussed about my foreign stay. We didn’t submit any documents on it. Interview over.
When we check the status of our visa showing as “REFUSED”. Please advice on it. Is the refusal is a permanent refusal or is under process? Is there any chance to submit missing document after the interview or not?

Hi, what is the latest possible time to go to the US to proceed with an adjustment of status? I’ve heard there’s some 60 or 30 days rule, but I think you’ve said that a DV AOS case tends to go faster because the officers realize that there’s a deadline. I can’t go faster than in 3 months from now that’s why I’m a bit concerned. What do you think about hiring a lawyer as they usually know the local officers and it prolly might speed up the process? I thought about coming to Atlanta to proceed with Charles Kuck.

My question for you revolves around the DS-260. I decided to submit it pretty early back in October last year, and at the time was in between jobs partially due to the lockdowns here in New Zealand. As such, I put down unemployed on the current work section of the form. However, I’ve been working since the start of this year in my field of expertise. Would it be worth contacting KCC about updating my DS-260 to include this new information, or would that instead be something for the interview process if I’m lucky enough to have one scheduled?

Hello Brit simon, not long ago kcc asked us not to send the documents and that this will only be presented in front of the consular officer during the interview.

There is no chance that all visas will be issued. AOS cases don’t get a visa reserved for them, the visa is “drawn” when you get approved.

Question regarding DV2020…
We were DV winners from DV2020 (OC 4__) and we were granted our visas. Our first visa expired during 2020 when the first Covid round hit the world, and so we re-applied because of extraneous circumstances etc. We got granted an extension and our second visa expired Feb 2021. During this time, the Australian borders were shut and so we were unable to activate during the 6 month period. The world was shut during 2021 and we tried to follow the different lawsuits regarding DV but got lost along the way.
We have tried to email the consulate on several occasions but receive a robo email and are now thinking we should just try and enter the USA and see what the customs officer says? We still have our yellow envelopes.
However, we seem to think we might still be able to enter the USA on our expired visas and have their validity granted even though we are now in 2022. Am I correct that we might still have a chance or just stupid? Happy for you to tell me which one I am…

Judge Metha intervened in early 2021 when it was clear that the people that were issued or re-issued visas in September 2021 (thanks to his decision) would not be able to travel. So – he instructed the government to treat the expired visas as valid for another 6 months. Unfortunately it seems like you were not aware of that, and that extension has now closed of course. So – I don’t think there is anything you can do now.

Hi Brit..My DV Case 2022
After filing and submitting my DS-260 to KCC ( Kentucky Consular Center ) on 20/05/2021, I received a response Email back from the KCC requiring me to send the following documents ( Birth Certificate, Police Report, Marriage Certificate and the Biometric page of my Passport ) on 28/10/2021. I sent all the following documents to the KCC on 28/12/2021.
My inquiry is that it has been 4 months and I haven’t heard any updates or responses back from the KCC. Any update on how long wil it take?

The documents are no longer required to be sent to KCC. You are now waiting to be scheduled for interview, but that depends on the capacity of the embassy, how many people are before you and so on. So – waiting time varies, and sadly this year many will miss out.

I’m a DV2020 applicant who had an interview cancelled in April 2020 following the presidential proclamation.
I’ve seen in the news recently that the Biden Administration is appealing the August 17th 2021 ruling on the Gomez case. From what I understand the appeal (#21-5263) will be addressed by the US Court of Appeals in September 2022, and today (2022.03.31) the government has filed it’s appeal brief.
I am seeking clarification on the impact of this on my application as my local consulate is being rather ambiguous, and I’m concerned I may have misinterpreted the situation and my options. My understanding is that I will need to wait for the result of the appeal in September before I can proceed. Is this correct?

I & my family (wife & two children) are Lawful Permanent Residence from DV lottery but we are living now outside US (in Saudi Arabia ) & my questions as follow :

Then we returned to our country at September 2020 then – traveling again to USA at July 2021 and entered already at this time then returned again to our country at August 2021 to finalize all issues and personal business in my country and We are planing now to return to USA for permanent residency at July 2022 because as you know the Pandemic issue for COVID 19 So, my questions are :
1- Is there any risk to losing LPR because it will be 11 months passed since we left USA ( from August 2021 to July 2022 ) ?
2- what about taxes for me & my family to introduce it to US ?
