Hello, I won the DV 2020 and was successfully issued the visa, I never activated it due to Covid at the time and border restrictions from Aus. I am wondering if this will have an impact on my ability to travel as a tourist? Will I still be able to apply for an ESTA?

Dear Simon,
I got an email from KCC with the appointment date and I confirmed it on the website of my country embassy (Bosnia & Herzegovina). I have an issue now because my status says “In transit”, so I contacted my embassy about this and they changed the status on their website to “Attend the appointment”. However, on CEAC website, my status is still “In transit”.
I don’t know who to contact again to fix this.
Is it okay to attend the interview in my case if it still says “In transit” on CEAC but “attend the appointment” on B&H embassy’s website?

Thank you for the great info and advices you provide on your blog and videos.
I am a Dv-2022 selectees with case no. 2022AF26xxx, I submitted my DS-260 on October 8, 2021. When I check my Ds-260, it shows an expiration date 04/30/2022.
I emailed KCC many times asking about this, every time they reply:
“Your forms have been received and are currently processing. Allow several weeks for processing. Interviews are scheduled numerically based on case numbers that have completed processing. Once the Kentucky Consular Center has finished processing your DS-260, you will receive an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.”
1- My question is why my DS_260 form will expire so soon (as far as I know it should be for 1 year).
2- What will happen after 04/30/2022 for my DS-260 and my DV-2022 application.
3- Do you advice that I join the Morrison-Urena group lawsuit? (https://morrisonurena.com/dv-2022)
Appreciate if you reply ASAP, since I have to decide before 04/30/2022.

Hi sir Simon, one guy from my embassy has recieved his 2NL tonight 12 April 2022 and his DS was processed few days ago (08 April 2022). Does that mean the DQed people of my embassy have finished. What if DQed cases finish from an embassy will KCC start to process non DQ cases even if they have medium and high case numbers. My embassy is Kuala Lumpur Malaysia CN Af28k. Embassy with very few African cases.

Malaysia is one of the embassies that is doing well. They have very few local selectees and have actually scheduled more cases than the local cases needed. So – there is good chance of interview for cases there.

I am a single applicant from Somalia and 5 of my colleagues were already scheduled in Malaysia. Some of them with high CNs. What can I do shall I wait and see.

Just had a question…:my dad was refused visa because he had 2 counts of common assault cases against him about 24 years back and the co gave him a refusal but said he can still be approved if he submits an application form and said fill it in and submit it(form I-160).My question is I have searched on the internet and it says it takes about year to get that form approved and this fiscal year will end in 5 months..:.so will there be faster processing time for dvlottery applicants???

The Gomez lawsuit covers EVERYONE from DV2020 that did not get a visa. There are some visas reserved (not enough for everyone) but the government is appealing. Start paying attention and maybe you will get a chance later this year.

My question: Me and my wife (both born in Pakistan, currenlty an uneligable country fo DV Lotterry 2022) , but i have German Citizenship since 20 years, but as i understood you we cannot apply (because we are both born in Pakistan/currenlty uneligable country…). We have a 5 yr old Daughter, she is born in Germany. so now my question:
(1) is my Daughter eligable to the Greencard Visa Appliation
(2) did you ever heard of applying a child and the adding up the parent as eligable persons for the Greencard lottery? (3) is there another possibility in your mind to apply for the Greencard Lottery Programm 2022?

3. The DV program won’t work for you, unless either you ar your spouse was born to parents that were only temporarily in Pakistan from another country. Otherwise look for another route.

Dear Sir,
I am a DV2020 winner and documentary Qualified (DQ). I was about to schedule an interview as my case number is very much closer to the last interviewed case number in my country. Further, the KCC call center staff confirmed that I was ready to be scheduled but couldn’t due to the presidential proclamation.
My wife is the principal applicant and she is pregnant now and expecting a baby in mid-October 2022.
My questions are,
1. If we win the appeal and the KCC schedules interview subsequently (after October- after the baby is born), how can we add the baby, can we add the baby at the interview?
2. Will it cause unnecessary delays, If we unlock DS260 and add the baby? (since there are limited visa)
3. What if they schedule an interview before our baby is born (On or before October)? How can we add our baby?
I know this is a lot of If-type questions and everything depends on the final outcome of the appeal. I am very grateful if could answer my question as a preparation.

1. I don’t know how those cases will be handled. It will be more clear later.
2. You can’t unlock now. If you get scheduled, then negotiate with the embassy direct to add the baby.
3. That actually would be the best outcome. There is a simple process to add a baby born after issuance of the visa. Just wait and see what happens.

I had my interview on the 07th of Apr. During the interview I was verbally informed that my case is approved and that I will get the passport back in a week time which is over now.
The case status has been changed only two days back from “Ready” to “AP”
1- Do you think that there is any issue here?
2- Do I need to contact the embassy to follow up?

Hi Simon, firstly thank you for everything you do, it’s very informative, I am 2021AF00034465 and have completed my DS 260 and sent all my documents but have heard nothing more, I have mailed them but get this generic reply back
“Your inquiry is about a diversity visa case number from a prior program year. Information regarding the processing of diversity visas from FY2020 in accordance with the court order in Gomez v. Biden and information regarding the processing of diversity visas from FY2021 in accordance with the court orders in Rai v. Biden, Goodluck v. Biden, and Goh v. Blinken will be published on travel.state.gov as it becomes available. ”

Were you a plaintiff in Goh or Goodluck? If not (and assuming you are not affected by Rai) then your chance is gone.

In your June VB update you mentioned odd behavior by the Consulate-General in Sydney in particular. (1) Can you expand on what you mean by that? Apparently, Sydney is closed for visas and they have moved some interviews to Perth and Melbourne but I can’t find information from these posts in CEAC data or on Xarthisius’ site about the rate that they’re issuing there (if any), so I can’t tell if they’re proceeding okay or just not doing anything.
From the frankgh.github.co data it appears that most of the OC visas are being issued in Fiji, and that very few have been issued in Australia. (2) Is that a correct interpretation from what you know?
(3) Is it worth contacting the KCC or a consular Post about this or is it just the same everywhere, as it appears across all regions, even in lower case numbers, there are still many “at KCC”?

Yes they are moving and whilst they moved some IV cases to other consulates they have not done that for DV cases.
Suva embassy are accepting cases from Sydney. If you can travel there contact Suva and KCC and push to be interviewed there.

I should be interviewed in Abu Dhabi, but they are extremely slow. They seem to have only 99 cases so far between ready and processed. I submitted my documents in November, and still waiting for 2nl.
I am wondering if I should request to be moved to another embassy (Amman, my home city for instance), or I should keep waiting for Abu Dhabi to make to contact me.

My wife is primary applicant and I am derivative.
Submitted DS-260 on 4th Nov. 2022.
First official email reply for our inquiry about our DS-260 status from KCC informed us that, “your case is current for interview processing. Once the interview date has been scheduled, you will receive notification via email…” This email reply was on 11th March 2022.
On 10th March KCC has sent 232 2nd NL for Moroccan selectee.
On 12th April KCC has sent 418 2nd NL again for Moroccan selectee.
In both lots we didnt received 2nd NL in spite of completed processing of our DS- 260, low case number and top 5 performer CSB consulate in case of DV issuance.
Now, US Consulate at Casablanca ( Morocco) looks like they have accepted enough number of DV case numbers for Morocco for this fiscal year. As of 14th April CSB DV Status is,
Issued 562
AP 4
Ready 777
Refused 26
Total 1369,
Which is more than any past fiscal year performance.
According to you,
1. What may be the reason behind this?

The embassy at Abu Dhabi which my interview should be scheduled at is working very slow as I’ve heard, and someome suggested to move the interview location. I have a visa to Australia and think my options would be :
1) Travel to Australia and move the interview location.
2) Travel to Australia and come back to Abu Dhabi once the interview is scheduled.
3) Stay in Abu Dhabi and wait.

I had previously contacted the KCC for some updates. Their regular reply would always be along the lines of “your case is being processed”. Yesterday, they replied to my latest enquiry with a completely different text. I’ll copy-paste it below. Does it mean anything specific? Perhaps, a sign of an upcoming interview at last? (considering my CN became current in January)
“Thank you for your inquiry. Your case number is now current for interview processing. Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov. If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.”

This email comes when your case is “actively” being scheduled. It’s a special point in time. If your embassy is working, and has capacity for your case, you can expect a 2NL within the next couple of weeks. However, if your embassy is NOT working you can be in a kind of limbo. At this point you cannot make any changes, because KCC has allocated the case to your embassy, but not sent it to the embassy yet. If the embassy does not have full capacity, and there are more cases in front of you than they can interview in the month, then your interview will be pushed to a later month.

I know you said yesterday, in your chat with Jesse, to not volunteer the DS5535 unless they ask for it at/after the interview. At Johannesburg we are not allowed to take the form back to the Embassy the day after; they ONLY allow it to be emailed.
Someone in our group was put on AP in January and had to send DS5535 and it took 6 weeks to process. This week another in our group was also asked for it after being told at the interview that they were approved.
If we only interview Aug/Sept, should we just hand it in with the rest of our documents before they ask for it and try avoid AP at such a late stage in the FY and potentially not be processed by September 30th? They also only let selectees know via email a day or so after the interview that they need to complete the DS5535 and email it back.

The COs know that asking for a DS5535 in September interview is basically a refusal. I honestly would not volunteer it, but its your call. You could ask the CO if they are likely to need it if you want, explaining that you are concerned about being timed out.

Hello Brit, from OC current ready for scheduling and no longer with KCC as per email I received from them. I am trying to understand if I was current in April and all processed received note from KCC to say I am now ready for scheduling should I expect that the 2nl comes after the month of April being the month I was current? I have been listening to your videos and you say they should come out over weeks after bulletin but I am not sure if you are referring to the month we find ourselves current in? I was advised I was ready a for scheduling in March. I am trying to understand why I haven’t received that 2 no. Thanks very much for your help.

I stayed Germany far time back for six months for a environmental course which was offered by my government office.
There I entered Germany on 15 th january 2010 and came back to my home country on 19 th July 2010.
These were exact my dates and do you think I need to get the police certificate from Germany for my stay.
There I followed the post graduate environmental course for six months only.

The capacity of the embassy seems to influence the cases that get processed, so a quieter embassy may mean a faster DS processing.

I think (but I am not sure) that the daughter could still get the DV visa and then later bring the baby upon the activation entry, but timing would be critical.

I had a mistake on my date of birth on my passport I palyed DV with but fortunately for me I won. I use the same information to fill out the DS-260 because it was very difficult to replace my passport, but now my interview has be schedule in this month and I’ve replaced my passport with the correct information on it.
My question is
If I inform the consular during my interview about the mistake can it be rectify in my DS260 at the US embassy?
Does this mistake have a great negative impact on my case.

Until they finish processing you cannot be scheduled, and any case that is ready before you will be scheduled before you.

Good morning simon.courage for your good work. I had my interview, this April and my derivatives son’s medicals report was not yet available.Aftet the interview. The CO said once we bring the pending medical report, he will issue us visas. He kept the passports. I was later informed by the panel physician that my son tested positive for TB. Though he has no symptoms. It suggested latent tb.So he prescribed an x ray, which will through more light on the case. we are presently waiting for the results. I will wish to know;
1.If we stand a risk of being denied our visas because of the child’s condition?
2. If no(1) above, can we start the treatment and then complete it while in USA?
3. Can the embassy withhold only the child’s visa until he is clear?
4. Can we travel and leave the child behind on treatment, for him to join when clear?

Those things are troubling. With a passport number and month of birth you may have been assumed to have tried to “hide” your identity. There is some risk that the CO considers that either a fraud or terrorism suspicion. In normal times I would advise you to unlock and correct, because you don’t want those inaccuracies to invalidate your background search – BUT you will have to decide for yourself what is least risky – leave it as is (correcting at the interview) OR unlocking (and perhaps delaying an interview).

Accra are doing a poor job, but transfer is not always easy. Since you are “current for interview processing” you cannot transfer. All you can do is hope that Accra wake up.

My question: when should I expect the 2NL email?! in April or May ?!
Do you advise me to move my case to Beirut embassy since it is processing much faster ?!
Or no nedd and I might get the 2NL in April ?!

Many people are waiting for interviews, and many have tried to move embassies but KCC or the embassies have refused.
I can’t predict when or if you will get your 2NL, you just have to wait and see.

The reason to renew is because it’s harder to renew it from the US.

I have received my 2NL interview has been scheduled for june. When I checked my ceac status I is in “Ready ‘ status.
After that there us a step which I need to register in the embassy web site OR
I have to just attend the interview on my scheduling date..
Because some are comment here something register the Embassy after getting 2NL.

Hi Sir, thanks for all the help! I am a 2022 DV winner. My derivative applicants(children) will follow-to-join me or accompany me at a later date in the US after the fiscal year 2022. I don’t want to take them alone with me at this moment because of personal circumstances. I want to know during my interview, will I present medical examination results for my derivative applicants that are not accompanying me in the US?. Or I am only presenting medical examination and supporting documents for me alone since I’m the only one travelling at this moment.

Do you understand that not including your derivatives in the DV process means you will have to use the I-130 process which is more complex, more expensive and will take at least 2 years.

I hope you are staying safe and healthy. I am DV selectee with case number 2022EU19xxx. I submitted my DS-260 on May 25 2021. Request from KCC for documents submission was on November 11 2021, documents submission date – November 11 2021. My embassy is ATA (Almaty, Kazakhstan). I emailed to KCC on March 12, 2022 and their reply says that my case number is current for interview processing. My questions:
1. I am wondering whether ATA (Almaty, Kazakhstan) embassy doing good or not?
2. Is it worth it to wait embassy for an interview for a month? Or not to waste time and return back to US, since I have a permission (F1 OPT) for reentry and do AOS?
3. I have finished my master degree in US and I had government scholarship(Kazakhstan). Since I had funding from my home country government (Kazakhstan), I have an obligation to work in the country. So I am wondering whether it can affect my green card case, even it is my personal agreement with the government?
4. According to OPT rules, I need to find a job within 90 days from start date of EAD. My 90 days unemployment expires on 23 June 2022. If I apply for AOS before unemployment expiration date(23June), will I avoid violating my status?
5. Is it ok If I apply for AOS at the beginning of June? Is it enough time to process my case?

I understand that having the minimum 12th grade high school diploma would be enough but im still unsure in my case. I have UK GCSE plus BTEC First Certificate in business with grade D. Is it enough?

There are many delays this year, and I believe a lot of people will lose their chance. The visas cannot normally be issued after the end of the fiscal year (September 30, 2022).

The I-134 is not filed anywhere, it is simply presented by the applicant at the interview. Just so you are aware there is no legal ability to force a sponsor to pay the expenses because of an I-134.
