When a case is “At NVC”, i.e. not yet scheduled, it has a number 1 – 1 case – but we don’t know the number of derivatives. When the case has been scheduled we know the derivatives number, but now the number shows as zero in the NVC column, because the case is not at NVC.

Hello Simon, I have two questions regarding the scheduling of interviews. Please clarify them.
1) If two case numbers exist and both are current and out of the two, the DS260 was processed for the high case number earlier than the low case number. In this case, who gets the interview first if the embassy doesn’t have the capacity for both in a particular month?
2) Next scenario. Let’s say that there is an AV queue in the embassy. If a lower case number gets added to the AV queue subsequently, do they get ahead of the queue due to their lower case number?

Are all the cases which were schedules for interviews up to February shown as of now in the Xarthisius’s website? I am from AS region (not an except country) and under my embassy (CLM-Colombo), cases up to 5000 are only scheduled according to Xarthisius’s data set even though the region is current up to 15550 for Feb. I was wondering whether this is due to an AV queue or some more cases are yet to be updated which are having February interviews in his website.

Now that the CEAC data is publicly available, I became a bit curious about the processing status of my DS-260.
KCC replied quickly but now I am struggling to read their answer the right way – it says:
„Records indicate you have submitted a complete and valid DS-260 application for each family member to the Kentucky Consular Center.“
Does „valid“ in that context mean it was processed with no formal errors found and now waiting to become current?

You can do AOS, but you cannot file immediately as that would show you had immigrant intention when you entered. Generally the advice is to wait at least 60 days after entry.

Thanks so much for your help. My husband won the lottery AF202316***. We are scheduled for interview on 8 Feb 2023. However while putting the documents together, he just realized that the government made an error in the passport and put the Capital city of Nairobi as the place of birth which is diffèrent from what is in the birth certificate. We will be interviewed in Cote D’Ivoire, not our country of chargeability. Is there reason to worry? Would an affidavit by a lawyer help? Should he try to get the error rectified but this may not be ready in good time. Please advise. Thanks.

The biggest risk for Iranian cases is to not have enough time to complete AP. Since your case is relatively high in Iran, you may be interviewed late, and therefore you have higher risk.

I would like to change that my interview location from the US embassy in (DJIBOUTI) to the US embassy in (Saudi Arabia) , together with my derivatives ( Spouse and three children)

If you are requesting this because you have moved, then ask KCC now. KCC expect a justification for such moves. Otherwise you can try transferring once scheduled.

I am a DV23 winner from North Africa and I just received my passport with the visa this week. I noticed that on my visa, my given name is written as follows “Jhon – Wayne” (fake name), where as on my passport it’s “Jhon-Wayne”. The spelling of my name is correct but there’s extra spaces since my first name is hyphenated. I might be overthinking this but do you think that this is something serious and would cause me problems at a port of entry? What would you advise me to do?
FYI, all other data is correct and there’s no other issues with my case.

Kiwi DV2023 lottery winner here. Currently over in the US on a 1 year J-1 visa expiring in June 2023 and looking to book a flight home to NZ for when my case number, 2023OC2***, gets called (hopefully) for the interview.
If I get an interview offer in April or May would there be the ability to move the date of the interview down track since I am still working here until June? I realise that this is probably not a possibility but just thought I’d ask anyway!

“B”, the representative at the consulate in Auckland is very friendly. Keep in mind that you also need to send a list of documents, they ask for resume, and a few other documents before they even schedule you. Why risk it, why not just go home in time to receive it.

I’m a DV 2020 winner. We went for our Visa interview in February 2020, our visas were approved. But the embassy shut down for covid before our visas were printed.
Now we’ve got two more kids. We were initially a family of 4, but now we’re a family of 6.
We want to leave the two kids so our visas processing will not be delayed after the final decision of the appeal in the Gomez case.
My question is will the embassy agree for us to leave the two younger kids (3months & 2 years)?

He worked in the French army for 5 years and I read in some websites that the military records is needed.
I would like to precise that he did not do his military service but worked as a Corporal.
1. Is the military records only needed for people who did their military service or also for people who worked in the army?
2. If yes, does the military records needed only for the principal applicant or also for the dependant?

Hello dear Brit, thank you for making your latest video talking about “What our chances are based on our case numbers.” I have watched the video more than 2 times so that I can understand the basic concept at its core.
You majorly used xarthisius’ website to know whether a case is at risk or not. But the only problem is that xarthisius doesn’t consider the case numbers that are in the except clause in every VB.
Let’s take AF as an example coz I’m from there. Selectees from countries like Algeria, Egypt, Morocco, etc are usually in the except clause coz they have many selectees concentrated in the lower case numbers. So in order to limit those people, they are put in except after they reach a certain cn.
What xarthisius is doing is just organizing case numbers in ascending order and providing “How many cases there are before and after me” by basically subtracting stuff. But without considering case numbers that are in the except clause which is a huge thing.
And basing on the math you used, you can find a cn AF35k being in the top 30% which you said is at risk & I just can’t fathom how a cn like AF32k, AF 37k or AF 43k can be at risk.
So according to xarthisius, a cn like AF39k is in danger coz there are many cases from except countries that’s in front of it who will never be current in the FY 23 coz they will be limited by VB.
You have always been preaching to us that case numbers below AF50k technically have a chance & shouldn’t worry in a normal year if the VB is controlled well, but now you’re saying a cn like AF36k is in danger which is really bizarre.
If you go to the fundamentals, VB controls everything & Xarthius basically neglects that.
I hope you can understand what I’m talking about here and I think xarthiusius’ website is not “yet” super efficient in the “How many cases there are before and after me” part.
I would really love to get your view on this, plz comment.

1. I did not say the top 30% are at risk.
2. Risk is a sliding scale – “some” risk doesn’t mean no chance.
3. Yes the except countries could change things as could the behavior of some embassies – I addressed that, which is why the risk range at this point (****JANUARY 5****) is broad.
4. The numbers change each year. This year the highest case number is quite low – and that of course lowers the safe range.

Hello Mr BritSimon I apriciate your efforts in informig us about the DV lottery. I am Dv lottery slectee from Morocco my Case number is 2023AF00050*** I submitted the DS-260 in 18th August. I have some questions:
1) I am in the top 13% case numbers in the African region. Am I in a safe spot?
2) I was born in a village but in my ID card there is the name of nearest city. So in The DS-260 I wrote the name of this city under the city of birth. Is that correct?
3) In the DS-260 I wrote the name of the city I live in as written in my ID card in french “Tanger” instead of its English form “Tangier”. Is that somthing need to bo corrected?
4) My father was born in a village so in The DS-260 I wrote the name of his village under the city of birth is that somthing to be corrected?
5) I got a BA double from a university in Morcco and one of these degrees the awarding University is different from the teaching university. So in The DS-260 under the name of the university I worte: [the name of the awarding university] + studied at [the name of the teaching university]. and for the university adress I put in both entries adress of the teaching university. Is there somthing need to be corrected?

what happens to the holes that are in front of your case number since they have not submitted the DS260 if you check your case it says they are example 20000 cases before you. if your d260 has been processed and the majority of the cases ahead of you are holes will they move to your ds260 directly and schedule your case for an interview please explain this.

Holes are cases that were disqualified before the results were even announced. So – if Xarthisius’ site said there are 20K cases in front of yours, NONE of those are holes.

I have a question that is not related to DV visas but I wonder if you can help me?. my brother applied for a B1/B2 visa last April 2022. Until now he is under AP. he keep asking the embassy by the email but he receives only their standard reply which is your case is under AP.
DO you believe is there any steps to be taken or we can only wait until they get back to us?, Did you see a similar case before that the AP was more than 6 months?.

“There are 2854 cases before and 15602 after you in the EU region. That yields approximately 6195 people before and 33868 after you. You are in 15th percentile. Your outlook looks pretty good!”

I (Case Number : 2023AS00017xxx) initially submitted the DS260 form on 25th May 2022. Due to moving to another country for work, I had to update and submit the DS260 form again on 27th October 2022.
I sent a mail to KCC on 17th December 2022 to check whether my DS260 form has been processed, and here is the reply I received from them.
“Records indicate you have submitted a complete and valid DS-260 application for each family member to the Kentucky Consular Center…”
Based on their reply, there are few questions that I hope to get your clarifications on
1. Is my DS260 form has been processed?
2. If yes, does that mean that they have processed the DS260 form with the latest changes?
3. If the DS260 form has been processed without the latest update, will that be a cause for a rejection in the interview?

I am sending much gratitude for your expertise and resources. Two questions I’d appreciate your thoughts on:
1) The beneficiary I am sponsoring is temporarily abroad and away from their permanent home. Is it fine to list the physical address as the permanent/mailing address? Or is it safer to list it as the temporary/abroad address?
2) Should I be concerned about having a contract position as a sponsor? The application asks if my job is temporary or permanent, and I am hesitant to choose one as my company categorizes temps, contracts, and permanent staff separately.

I have been current since October 2022 with DS260 sent at the beginning of July 2022 and I have two questions regarding my case:
1. I emailed KCC for status of my case and I got this answer:
“Thank you for your inquiry.
Records indicate you have submitted a complete and valid DS-260 application for each family member to the Kentucky Consular Center. Interviews are scheduled numerically based on case numbers that have completed processing.” – what does this mean? Am I waiting for a scheduled slot or there is still some processing left to be done?
2. Besides the I-134, do I also need I-140 and W2 forms?

1. That means your DS260 has been processed, which makes sense as we are now seeing more July submissions processed and rumors of some early August ones. Now you are waiting for capacity and scheduling at your embassy. Hopefully you will get scheduled in the next batch (after the VB)
2. I-134 should be supported by 1040/W2, recent payslips and photo ID.

I’m a DV 2020 winner. When we went for interview in February 2020 were a family of four. Our interview went on well, but embassy shut down for Covid before our visas were printed. Now we’ve gotten two other kids (2years and 3months old).
1. If we win the Gomez appeal and they ask us to continue our Visa processing, will the embassy force us to process for the two younger kids even though we may choose to leave them?
2. In case we leave them, how long will it take us to re-unite?
Note: The reason why we want to leave the two younger kids behind is because we are financially constraint right now.

I wanted to thank you for mentioning the FAM (Foreign Affair Manual) in one of your videos. It’s a fantastic resource for information.
I came across 9 FAM 504.4-8(E)(2) regarding the location of homeless applicants and it mentions that homeless applicants physically present in a third country are to be processed at the same IV processing post as nationals of that country, as long as they have permission from the host government to remain there legally for a sufficient period to complete processing of the application.
My question is:
does this include individuals who have come to another country and are allowed to stay there visa-free for a certain period of time, such as 90 days? Have you heard or seen any discussion around this matter?
It seems to me that this would qualify as being physically present in the country and having permission from the host government to stay there.
In addition, it would reasonably be enough time to complete the necessary medical examination and consular interview.
The permission from the host government to stay in the country would be demonstrated through a stamp in their passport at border control and possibly an act issued by the government listing the nationalities that are allowed to stay visa-free for 90 days.

Just a quick question. I am a Kiwi DV2023 winner and am currently waiting on my 2NL.
I have gathered all my documents ready for the interview but in looking over the police certificate section (of which I have already attained my home certificate from New Zealand), the DoS mentions that lottery winners need to attain police certificates from
“the country of current residence (if different from nationality) if they resided there for more than 6 months.”
I am currently living in the U.S. on a 1 year J-1 working visa since June and wonder if the prior quote applies to me, despite not being a permanent resident of the USA.
I also spent a year abroad on exchange at a university in the U.S. four years ago and wonder if the other category requiring police certificates from “any previous country or countries of residence if residing there for more than 12 months” applies to me.
I have presumed that I therefore require U.S. police certificates as well, however when clicking on the prompted ‘Reciprocity and Civil Documents by Country’ link (https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html) to find the U.S. tab, I find that the option of selecting the USA as a country does not exist!
I can only therefore presume that police forms from my time residing in the U.S. are not required?

No police certs are needed for the USA. I’m pretty sure that is mentioned in the main instructions.

I am DV2023 AS4xxx winner and I logged the DS260 very late in early November 2022.
I watched the video on understanding the risks of the case number and as per the xarthisius website I have 2305 cases before me and 10K after me. 19th percentile. I know this seems good. But how does the DS260 logged date (or rather the processed status) come into play here?
Since I logged the DS 260 very late, is there a risk of not getting my 2NL? I am current from Jan2023 as per VB but not received 2NL yet.

Your late submission will have delayed things of course, but once your DS260 is processed you will be scheduled.

1/ Do we need to provide financial statement during interview.
2/ If yes, of how many months?
3/ What is the minimum amount expected to have in our account.

So I am a 2023Dv winner and I have received my immigrant visa a month ago. I have decided to go to the US for a few days in February in order to activate my visa. My question is : is that allowed ? Can I just stay a week and then go back to my country to prepare for my big move ?
Do they give us a document stating that we have entered the country and that we can come back no problem ?
..I am a bit confused on that Since the green card takes a few weeks to get processed and sent to the address we put so when i am there I won’t be able to take it with me…

Hello Simon quick question, I live and work in Dubai for the last 7yrs and I inquired when kcc had put my interview location to be Nairobi as I come from Uganda, I requested for the change of my case from Nairobi to Abudhabi and in the email I attached my residence card, to my surprise KCC declined my request and told me that non citizens are allocated interviews jurisdiction consular district at the place of application. I still failed to understand why my case is refused from moving from Nairobi to Abudhabi yet am not yet current and not yet ready for vacation as I would want to attend interviews while still keeping my job. What is your advice on the matter? Should I scan them visa, ID again, Google map location, current address and job offer letter they might accept?
Please kindly answer me accordingly

Yes that is allowed. Upon entry your one time visa will be endorsed, and then that serves as your temporary “greencard” for up to 1 year.

Our Case number 2023EU63xx.
DS forms submitted last June 16, unlocked resubmited on July 7.
Still didnt get 2 NL, although our case number matches January-February VB, which is the same number up to -15000 cases.
KCC replied with “Your records indicate that u submitted complete and valid DS forms…”
Is it normal timing? Do u think we wil get interview at least in Februrary?
