Dear Simon, despite the fact that VB shows numbers around 30k in 2023, embassies in naples or bucharest shows people with numbers above 30k being interviewed. how is this possible? are there exceptions or have these people changed their interview location and got interviewed? Thanks

Other regions have different number ranges. So AF region has cases being interviewed in Naples – hence the high numbers.

1.I am currently assisting my mother in running her business and I would like to use that for my work experience even though the business isn’t registered although it has been in operation for over 20years.I intend registering it in June and would like to know if that will be a problem.
2.On my birth certificate,my father’s names are 3 but on his National iD he used only two.Should I use his name on my birth cert or the iD in filling the parent’s information.
3.Also can I include voluntary experience in my application

I’m a 2024AF selectee qualifying with work experience but I have a few questions.
1. Is there data that indicates the number of people over the years who have applied with only work experience qualification and how many were given visas or denied?
2. What supporting documents would you accept as sufficient evidence of qualifying work experience if you were a C.O?
3. My case number is 2024AF16xxx with 4 derivatives, still waiting for my passport and none of my derivatives having one yet. Do you think waiting till all passports are ready before filling ds-260 is the best way to go?
4. Considering the situation at the Accra embassy, do you think submitting ds-260 in July can negatively affect our chances of getting an interview with my case number in mind?

Yes. If your embassy has more cases in the AV queue than they accept in the final months, then cases will miss out. It happened last year (about 30,000 people) and will happen again this year.

If you could stay in the USA for a longer period, you could apply for a re-entry permit. In lieu of that you can leave for absences that do not exceed 12 months each time (under 6 months is technically easier)

The only “strategy” would be to complete the DS260 early – but you are already almost 3 weeks behind others. But in reality you won’t get an interview until your number is current – which will be a long time from now.

Hi Brit, My interview is on July and I have an issue with my sponsor’s tax trasncript.Including sponsor all together we are 3 and poverty guideline shows $24 860 for 3 person.In my sponsor’s IRS(2021) , income shows as $30 000.
But for 2022 I only have W2 file which shows Income as $20 000.I am not able to present IRS for 2022(sponsor cannot get it currently) and only have w2 for 2022.will this be an issue ? Is 2021 IRS is acceptable for july interview? and if they asked me to 2022 tax file I am only able to present w2 (But it’s income is below poverty guideline)Any advice for this?

another question for another friend, this friend has the US Embassy in his country closed due to a war suddenly started in the city where the embassy in, and he couldn’t unlock the DS-260 form to change the interview location, he want to know what will happen in this case, will they schedule the interview in the nearst location to his country? or what could possibly happen to his case?

I’m a citizen of Belarus and a participant in DV 2023. My nationality is Belarusian and I hold a Belarusian passport. However, I was born in Kazakhstan. I attended an interview at the U.S. Embassy in Warsaw on May 23. Unfortunately, I was denied, with the reasoning being that my country of birth was incorrectly specified as Belarus instead of Kazakhstan. In the DS-260 form, everything was accurate and the mistake allegedly appears in the initial lottery participation form. I am certain I could not have made such a stupid error, and I distinctly remember writing Kazakhstan as my place of birth. Furthermore, in the letter dated May 8 (that I have been randomly selected), there is a line for Foreign State Chargeability, which clearly states KAZAKHSTAN.
I’ve read about instances where the embassy’s system malfunctioned and provided incorrect information. It seems to me that my situation might be a similar case related to a technical error. What can I do in this situation?

It is technically possible that you made a disqualifying mistake – but I doubt it.
There are two questions on the form. The first is country of birth You should have entered Kazakhstan, but they seem to be saying you entered Belarus. Then you might have chosen to answer Kazakhstan as the country of eligibility. So – in that case your Foreign State Chargeability would state KAZAKHSTAN.
Now – EVEN IF you had done what I just described, you gained no advantage from that entry and the countries are both within the same region, so the denial (if it is permanent) is VERY harsh.
Do these things.
1. Confirm using CEAC that you are permanently refused. There are two statuses that show as refused, one is final refusal, one is not.
2. Depending on the answer from 1, contact the embassy and either ask for an update or reconsideration, attaching a screenshot of your letter that shows Kazakhstan FSC.
3. If the embassy writes back saying their decision is final, hire a lawyer to get a legalnet review of your case. I recommend Jesse Bless.

2. When communicating with the embassy, should I emphasize that both Belarus and Kazakhstan fall within the same region and that, even if an error was made, I did not gain any advantage from it?

1. Both refusals say “A U.S. consular officer has adjudicated and refused your visa application.” Then the temporary refusals (221g) goes on to say “Please follow any instructions provided by the consular officer. If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing…”
2. Yes You can point out this paragraph that comes from a now outdated version of their guide – the “FAM”
“(3) Errors in Choice of Country of Chargeability: If the entrant chooses the wrong country of chargeability at the time of the initial entry, the error will generally be disqualifying. However, if a DV applicant chooses a country of chargeability on the DV entry form that is within the same geographic region (one of the six) as the correct country of chargeability, and you determine that the applicant gained no benefit from his or her error, and there are no fraud concerns, you may continue processing the application using the correct country of chargeability in IVO. Post may need to obtain additional DV number(s) for the correct country of chargeability from the Immigrant Visa Control and Reporting Division (CA/VO/DO/I), as necessary, via a VISAS FROG message (see 9 FAM 604.2-1).”
3. Lawyers can use their skills and access to fight on your behalf. So – if you get turned down, then it is the last chance you have – and you should move fast.

1. You asked what qualifying work experience I have. I was transport officer for a year and half in a distribution company at one time and transport manager for a little over two years in a cable manufacturing company after that, all within the last six years. But I had no prior training what so ever before those engagements. Do I have a chance of being issued a visa at an interview with these work experiences?
2. You said any national ID can be used for ds-260. I have three kids as derivatives whose ages are 4.5 years, 2.5 years and a two months old. None of them have a national ID. Only birth certificates. Is it possible to use the birth certificates to fill ds-260 for them?

If I do that now, unlock DS260 and update my surname information, could that affect the processing time of my application or my chance of getting approved? Hi BritSimon, I am a DV2024 winner and have a question. Are there any requirements regarding how recent the issuance date of civil/supporting documents are? I want to start gathering my documents such as birth certificate to accurately complete DS-260. However, by the time I send those to KCC/the embassy at later stage, the documents will be a several months old. You have probably made a critical mistake. You are a winner in the OC region. That means you claimed eligibility to a country in that region. Unless you were married to someone from the OC region or had some reason to justify that claim, then you are certain to be disqualified. In that case you should not even waste the time and money to proceed.

She has a 19 year old daughter that she enrolled on her application correctly but the girl is expecting a child.
In your experience how does this situation impact the case…?
Will her daughter and her future grandchild be able to emigrate with her if they are approved in the interview…?

This is obviously extremely rare and I cannot be 100% certain. They may want to consult a good immigration attorney such as Jesse Bless. However, my understanding is that the grandchild would NOT be eligible as a derivative. The daughter would be. So – the daughter could sponsor the child via family based immigration, but that would be complex and slow.

I HAVE AN ISSUE, IVE BEEN BLESSED BY MY GRANDMOTHER WITH VERY LONG NAME BUT UNFORTUNATELY IT ALL CANNOT FIT INTO THE DS-260 FORM. MY LAST GIVEN NAME HAS BEEN SUBMITTED INCOMPLETE. DO YOU THINK THIS IS GOING TO BE A PROBLEM? HOW CAN I REMEDY THIS?
I HAD PREVIOUSLY DONE THIS WITH THE DS-160 FORM WHEN I VISITED THE U.S. AND HAD NO ISSUES. PLEASE ADVISE

Use your judgement to list your name as much as possible and use the “other names” section if needed.

When l look into dv2023 ceac data, I find some higher case number get 2NL very early. For exaample 2023as10k -2033as18k, ambassy TAIPEI. By that time, the selectee got 2nl on 2023/Jan. What is your opinion about this? Thank you!

That is totally normal. AS was current up to 18750 for March (and March 2NLs are sent in January)

Helo Simon, i am dv2023 winner with case number 2023AF32***. My embassy is Addis Ababa and performing very bad. I have non-immigrant US visa and wanted to move my case to the US. Do you have any advice/suggestion? Thank you for your help.

Does individual ds260 assessed separately or are dependant in case of family wanting to immigrate together.

I tried to have my cases transfered from Accra but KCC said its not a possibility because my case is ready for interview scheduling meaning I am in Av status(2023af27***).Is that a fact or they just won’t change it.Also is it possible for an embassy to send out 2Nls in September for that fiscal year since September is the last month?lastly out of the 3,300 entries selected from Ghana are they all actual people or there are some holes?

1. It is very hard to change embassies. KCC won’t do it unless another embassy asks KCC on your behalf, which is hard to make happen.
2. September 2NLs are possible but unlikely.
3. 3300 is the number of people selected in Ghana (on about 2000 cases). Holes are within the case number ranges.
