As we are about to go for our medical, our Intend is not to carry the children with us because of financial problems we are having now.
But on the ds260 form we were ask to whether the children are traveling with us in the USA, we said yes ,do you think it will be a problem for us during the interview.

Well it won’t cause denial for the parents, but the kids won’t get visas. It will then be expensive and take a long time to bring them to the USA.

during my interview I brought a change of new address of my sponsor & gave it to them. but now I realized that at the back of sealed envelope (@ the history) that will be present at the entry, they use the previous address. currently i’ m hundreds km far from my interview location (embassy). so do you think I should go back & inform this mistake to the embassy or I can correct it during the Port Of Entry. Passport, Birth certificate, marriage certificate if you are married, police certificate, Medical certificate, authenticated educational certificates N.B:- (10+3) certificate is not acceptable. minimum educational requirement is completion of 12th grade. Any ways if you follow this blog (www.britsimonsays.com) you will get all info & can let you prepare very well. or else if you are in Addiss you can get all info about the needed doc from the embassy. if you need some more info I can share you.

Thank you for your help. One quick question regarding keeping the Green Card active and not loosing it:
I had my stamp in Sep 2016 and I will return to the US in Aug 2017 (the first 1 year rule).
Than what is the requirement, starting from this period I need to be in the US for at least 180 days (but not consecutive), meaning I can return for 2-3 months in my country and that would not cause any troubles?

Absences less than 6 months are normally OK. But constant absences will cause questioning. The GC is not an entry visa, its permission to LIVE in the USA.

I am the selectee of the DV2017, and I am currently legally residing in the United States (Studying). Initially, I want to process my case via CP (Consular Processing), but a couple of days ago, the latest Visa Bulletin shows that my case number will be current in May (I am from Asia and am not from the banned countries under the latest executive order, the case number is 84XX).
Since I am a full-time student, I may not go back to my home country before June (I still need to attend classes and seminars till 6/20/2017).
I do have another option, which is AOS. But I need to contact the KCC first in order to request a change from CP to AOS, and after that my case will be transmitted to the USCIS.
But, my current question is: Base on my research, AOS may have a longer processing time if compared with CP. Also, it may create some further waiting time because of the current big workload at KCC if I request KCC to transmit my case to USCIS. Thus, now, I am confused how I should proceed and to successfully handle my case in a “timely manner” since a lot of stuff would be different if I change from CP to AOS (i.e. medical examination, documentation, and some documents may need further “translation” or “certification”, etc.). It will definitely be also time consuming if process via AOS…
I submitted my DS260 on the first week of Feb. And I called KCC a couple of days ago, they told me that my case is processing and could be possibly scheduled either in May or June, if not, then it should be either July or August. Now, if my case been scheduled in either May or June, I need to go back to my home country to have the interview done (also the medical examination). To be honest, it’s not impossible, but for sure, it will be a bit burden to go back twice before June (one for medical examination, and another one for the interview! This strategy may work!!).
Therefore, I am thinking about whether to proceed my case as AOS mentioned above. But the only thing I concern now is that the processing time at the USCIS cite is vary and whether the case can be processed as early as possible since the DV2017 will close on 9/30/2017.
Take away: How should I proceed my case safely and timely to avoid any potential disruption or delay (If going back to my home country twice is an option if my case been scheduled before June). Also, the President Trump’s travel ban (executive order) should somehow impact this entire procedure. Again, I am not from the banned countries, so the ban will not affect my case directly. However, whether or not the ban will go effect (it was banned yesterday) will somehow affect the processing time within the “Asia” region.

Some corrections.
The ban doesn’t impact you. Forget about it.
There is no delay to switch to AOS. KCC will be asked for a file later, but that is not a prerequisite for filing AOS. So – you could file now (just notify KCC if you decide to do that).
If you stay with COP you won’t get a May interview. I highly doubt you would get a June interview either. July or August is more likely – because your DS260 submission was very late. Once we see the next batch of 2NLs we will see how far through DS260 submissions they have reached.
Now – clear your thinking and make your mind up.

I got another related question:
If I stick to the CP option, and if, let’s say, my case been scheduled in July or even in August…
Will this kind of situation (July or August interview) impacts my interview chance or the visa availability? In other words, since the program will close on 9/30 this year, if I don’t change to the AOS due to its a bit more complicated procedures, will my chance of getting an interview or the availability on visa (if July or August is the case) be smaller?
Or I can anyway allowed an interview since my case number will be current in May, and I have submitted my DS260 form on the first week of February?
If I will still get an interview (if the July or August is the case), then it seems to me that remaining my current submitted DS260’s option (CP) would be a bit better.
Take away: I knew that if I change to the AOS, I can process directly. So that is the concern that if I remain as CP, will my chance of getting an interview or the amount of visa be not good to my current CP choice?!

I cannot tell what will happen this year, but in previous years visas have not run out until late in the year (September). Since all regions are current (with some country exceptions) it is clear that KCC thought there would be enough visas for everyone. But that when Travel ban 2.0 was about to go into effect. So – I cannot guess what will happen next. It is “possible” to put a number limit back in place instead of the “CURRENT”.
By the way, your assessment of AOS is flawed. Right now, your fastest *possible* approval is AOS.

I’m a French green card holder (DV2) through my australian wife (DV1) , we’ve been living in the US for a year now, we have an appartement lease, bank account, social security number phone number, we pay our taxes etc…
I’m planning to start a LLC company in New York (music label) but i’m also being offered an amazing job opportunity in France (Paris).
My french boss, knowing my plan to start a music label in New York would be ok to let me go to New York for a week every 2 months so i could keep my green card active and also do some ground work for my music label.
In my plans i would keep, in the US, a physical adress, bank account, social security number phone number, and pay taxes for any money income generated by my company in the US.
Meanwhile i would declare, In France, all my income generate in France by my French job.
My wife working in Fashion would also have to travel but would be based in the US most of the time.
My question is do you see anything in this plan that would be a problem for the US government ?

My sponsor sent me his 1040 tax and W2 Forms,. it start from 1 January – 31 December 2016, he has a dependent and earns an annual income of about $58,000 .
1. i am expecting my 2nl in May/June/July, would you the form will be most recent at the time of interview?
2. Will the form help me and my wife’s case, considering his annual income and with a dependent?

I’ve a problem of not applying for my child in the initial application.
But,I’ve got an idea,my case number is not current till now around (35000 in egypt).
What if i got a tourist visa to the us alone without my family members, then went inside USA and then it will be easy to have my green card directly from a uscis office.

Hope you are well. As a DV2017 selectee I submitted DS260 on Aug 12, unlocked and resubmitted on Dec 1 (including a request to change the interview location from London to Riga). I understand that the processing takes longer if you request and interview location change. I recently contacted KCC for an update and was told that the papers have been received and are still processing. Would it be wise to contact the Riga Embassy directly to see if they have any more detailed info as it seems rather long now since I haven’t heard anything. On the Riga Embassy website they have a consular e-mail contact for case-specific visa inquiries only.

Hello,
I went to my local SSA office yesterday (manchester, NH) to follow up on my application for my SSN. They processed the application on Feb 13 and said they were still waiting for verification from DHS. I checked SAVE when I got home and it says that DHS has returned the case to the agency. The problem is that it was returned to the WRONG SSA office. It was returned to Maryland SSA office. Has you run into this problem before? I’m not sure who to contact to correct. My local SSA office, Maryland SSA office, DHS?
Note.. The problem for pending verification was long middle name to be verified online

We, a family of 5, entered our POE 14 of Dec 2016 and went home 2 weeks after. We have now received our Green cards. However we will not be able to move to the US for 2 years. Shall we travel there and file a re-entry permit and then leave or is it needed that you already live there, to be able to apply and receive a permit?

You can travel to the USA to file a re-entry permit, but you would need to be in the USA for 5 or 6 weeks while you wait for the biometric appointments.

I(principal applicant) and my wife attended dv interview on 16th March and after the interview, we were handed back our passports but the Co remained with my high school certificate and marriage certificate and told us that our case required further administrative processing and that the embassy will contact us either through email or phone before giving us a pink paper written “Administrative processing”. On 17th March, i checked the ceac and to my shock, the status shows “refused”. I have not yet received any communication from the embassy. Does it mean that my case was refused?

Unlocking at this point won’t stop the scheduling of your case. In fact, you are probably already scheduled, so they won’t unlock now. So – when the baby is born, you will contact the embassy, obtain the passport and medical for the baby and follow the embassies instructions about completing the DS260.

In the Ds-260 I’ve included my full name.
Example: John Joe Smith
I’ve checked my DS-260 again, under “Other names used:” I’ve ticked: NO.
Should I put there “John Smith” there as I’ve entered the lottery as John Smith and not John Joe Smith?

Hi Simon, thank you for all your help and information you have provided on this site. I keep getting conflicting stories but just wanted to confirm with you. I won the lottery for 2017 and submitted my DS260 in May 2016. I see the window for May is now current and I will be able to schedule in my interview (i was in the later numbers for the OC region)
When i check on the CEAC I am receiving this message: ‘Please follow the instructions you received from the National Visa Center (NVC) that list the six steps you must take before NVC can schedule your visa interview appointment. This includes submitting to NVC various fees, forms and documents. Once NVC has received all the required items, they will let you know if anything is missing or incomplete. You can also find these instructions online at http://nvc.state.gov (English) and http://nvc.state.gov/espanol (Spanish). You will find contact information for NVC at http://nvc.state.gov/ask.’
Do I ignore it? I never received such instructions and for the Sydney consulate meeting it states you bring all documents and pay fees at the meeting…
I presume I just sit and wait patiently until they email me in the coming weeks/months for an interview ?

Hello Brit,
Two questions:
1) Once you’ve ‘activated’ your status using the visa on your passport, received the green card and left the U.S., in the event that you renew your passport and want to return to the U.S. do you still need to carry your old passport with the initial visa on it along with you?
2) The rule regarding being allowed upto one year to reenter the U.S. once you’ve already activated your green card – is this a law or is it just general practice? I left the U.S.on 20/9/16 and want to return on 8/7/17. Could I face questioning?

If you have the GC you don’t need the visa.
2. The law allows entry up to 1 year – but it is common to be questioned after absences of more than 6 months.

My husband won the lottery 2017, his number is current, my question is: we are from Albania but we have macedonian nationality, so I had macedonian passport and it expired 2007, since than I don’t have another one, but I have macedonian identity card, do I have to get a new passport with my husbands surname or just to let as it is? To mention that in Albania we made the registration and I have his surname.

YOu need an unexpired passport, and it should have your correct legal name (meaning your married name if you changed your name in marriage).

It doesn’t matter where you applied from or what nationality passport you present as long as it is current and has the right name.

I should get the 2NL for an interview in may 2017 and I’ll be 4 month pregnant then.
Do I have to inform the consulate about my pregnancy before or during the interview?
Also is there a chance to deliver the baby once in the USA ( I read the article about add a new born baby, but I couldn’t find the scenario of birth after been approved and after entry to the USA).

Until you give birth, there is no baby. In the medical you will inform the physician that you are pregnant. You could deliver in the USA, or prior to the first entry. However you do it, there is a process to get the baby a Green card (or citizenship if born in the USA). For now, just relax….
