So just around 24 hours ago I published a form where people could provide their details in order that the legal team from the AILA could pick some representative plaintiffs in various countries, regions and stages of the process.
The response has been overwhelming – we have over 1100 cases who have offered to be plaintiffs – covering well over 2000 selectees with family. At this point I am going to close the form, because pretty much every scenario and region has been represented, and from many countries. Some of you decided to describe your circumstances, and what the lottery has meant to you and your families. The stories are heartbreaking, and I don’t believe any decent person could remain cold-hearted when reading these stories. I won’t be publishing any specifics from these stories to respect your privacy, but you have been heard, loud and clear.
The team of lawyers at AILA and the Justice Action Center wanted me to make sure that you all know they have heard you, they aren’t ignoring you, and they will do all they can to fight for you.
So what will happen next.
Well the lawyers have had realtime access to the data collected in the form. So they have all the names, case numbers family names and so on. They need to go through the list and pick (somewhat randomly) cases that “represent” a group of people. So – that means if they had 100 cases from a region all at the same stage, they would not need to list all 100 names as plaintiffs, but they would pick one or two of those names. In that way they will build a list of cases/names that represent all selectees in the same position. This is important because if they win, they win for ALL the selectees, whether you are named or not, whether you filled in your details or not. That is what they are trying to achieve.
Now – it is NOT possible to predict the outcome. These are an excellent team of lawyers and have been successful in challenging and blocking the government multiple times before. But there are no guarantees – it will be up to a federal judge to decide.
Some have asked when the court case will be filed and heard. I can’t predict that exactly, the lawyers need time to prepare a case, it is not something they should rush, but they are aware of the time sensitivity.
Some have asked will this go to the supreme court. Well – to get to the supreme court, a case must first be heard in a lower court – in our case a federal court. But it’s important to note that a federal court has the power to issue a TRO (Temporary Restraining Order) which could immediately block the Executive order. That court would consider doing that if people are being harmed by the EO (which of course, is clear). That is one possible outcome, though not guaranteed. The court would then set a date for a later hearing, but in the meantime the EO would be blocked. So – that would be a great outcome. There are perhaps other ways it could work out, but we will see in due course.
Of course, we STILL have the problem that the embassies are closed. Challenging the ban does NOT force the embassies to reopen. So – we much continue to monitor the opening strategies by the embassies. But the legal challenge, if successful, would at least give us the most time possible before the deadline of September 30th.
Regarding the deadline of September 30th – it cannot be extended. Once we are past that date, any remaining chances are gone. All we can do is hope the legal challenge works AND that the embassies reopen.

There are multiple lawsuits proceeding. Some of them are class action lawsuits which means if they win, the proclamation will be blocked.

I am glad that universities on behalf of international students were able to block the ban that almost made many students from other countries leave USA unless their classes were not 100% online. Good for them they found a way to avoid it and very fast. I know we dv2020 selectees should be patient and when it comes to our chance to immigrate USA many would say that we “got this chance with little or no merits at all” and blah blah but honestly I do feel like we are just the “fifth wheel”. I am grateful for the efforts this AILA is doing for many of us but considering the fact that in our case the clock is ticking and we are running out of time and for many with very high numbers even if the ban will be blocked tomorrow maybe not enough time for their cases, believe me this “waiting” feels like more wasted time. These kind of actions or private lawsuits should have been taken right after the first proclamation on april I think. Why we had to wait for the second proclamation that extended the ban to say “ok, let’s try to block this thing” be this with a private lawyer paying their fees or taking other actions because due to the deadline rules of the DV program we had a reason to request blocking the ban immediately this one was set. Not my intention to blame or complain about what many people working to help us are doing and I appreciate all what they are doing but I have started to wonder “why no one suggested acting like this before?”, “why for this dv program ‘maybe’ it won’t be solved as fast as it was for the case of international students?” We have little time remaining and we still have to keep waiting for an outcome, is it because in our case we are not paying tuition to anyone like for example international students do to their universities??? I know in our case getting a green card is like a “gift” for which I am grateful or better said “I was” and I know we are not like priority to anyone and we can’t demand anything but at the same time it really makes us feel like begging until the very last minute of this process. Do all new legal immigrants abuse the system once they are settled in USA demanding welfare or stimulus checks that many Americans don’t want us anymore? If so then why don’t they stop supporting such freeloaders instead of prejudging all of us like we were like that. If they wanted to cancel this DV program they should have done it from the begging of 2020 program but don’t be so mean letting many people apply and be selected to later in the middle of the process find any lame excuse to stop the program. That’s very mean and evil 🙁

In Ukrainian embassy they have sent passports back and a cover letter to 2020 lottery winners, whose visas have been approved before, saying that these people won’t be able to receive their visas before September 30th due to the ban, therefore the visas won’t be received at all.

When the visa is approved during the interview, the embassy will keep your passport to print and stick the visa on the passport, which usually takes few working days. Most probably, embassy was closed due to COVID 19, and these approved visas passports been held in the embassy, and latter due to the ban, visas were not issued (printed) and passports were sent back with explication letter. This is the most unfair situation that could happen. The same scenario happened to a relative of mine in Baghdad on K1 visa, where his visa was approved and the embassy kept his passport to print the visa and affex it, but the embassy was closed due to the attacks on the green zone. Letter they send back his passport without the visa with explanation letter that they are unable to issue any visas ….

Now I saw TravelGov’s Tweet: beginning July 15 US Embassies and Consulates may begin phased resumption of routine visa services depending on local conditions.
My question is, if the Embassy resumes its work in my country, do I have a chance that they will reschedule me? Or is it sure that if the ban is in place, they can’t reschedule me even if they are open?
By the way, I traveled to the States on my B2 visa a couple of days ago. Do you think it’s worth trying to ask to send my case to USCIS and be interviewed from here?

I just called the Kcc for information and the lady on the phone told me that if I am winner of the year 2020, we can no longer be scheduled for the interview in relation to the suspension and that we only have to replay for the year 2020.
