Late this evening Judge Mehta released an order that enjoins (blocks) the government from applying the policying of not issuing visas to selectees present within the countries affected by the regional 14 day bans. Those countries are Chine Brazil, Iran, UK, Ireland and the 26 countries in the Schengen area.
It will take a day or so for the embassies to start behaving that way since the Department of State will communicate this tomorrow.
But relief is coming!!
Big thanks to the legal team for their efforts, thanks to Judge Mehta for your wisdom and thanks to the government lawyers for realizing that when you have nothing to say, accept defeat.

Hi Simon,
do you know somebody whose visa was reissued without any annotation and they were able to enter the US?
November 10, 2020 at 18:46
That would be entirely unremarkable.
Reissuances are not subject to the ban.
September 30, 2020 at 19:54
We explained and told them. They said we do not undesrtand the PP 10014 correct. What si next? Lawyer? We paid the fees twice, paid medical twice for a visa what cannot be used?
October 1, 2020 at 04:03
Keep messages together by using reply. If you want, email Charles Kuck and he has said he will work to get these things corrected.
September 30, 2020 at 19:01
Hi brit,
Is it a problem to get married in between having a visa and obtaining the green card? I mean in the 6 months given in a visa, it’s possible to get married without causing a problem in the process? After obtaining a visa and before getting a green card.
October 1, 2020 at 03:59
It’s OK. Just a bit strange you did not do that before.
September 30, 2020 at 18:29
I am sorry, I might was not 100% clear: we previously had a visa that was valid prior to 23rd April, expired in June, and the embassy still printed on our visa today that we are subject to the PP 10014. That is not right. That is illegal.
September 30, 2020 at 19:51
OK, well tell them!
September 30, 2020 at 12:27
Hello Mr. Britsimon,
We got our reissued visas today.
It is printed on the visas illegally that we are subject to PP10014.
When we tried to explain them, they just told us that We do not understand the PP correctly. In the mean time, there is an example from Poland, where they printed not subject to PP10014 on the visa. Just like in Ukraine.
We don’t know what is this discrimination in Hungary.
Now we have a visa that illegally does not allow us to enter until PP10014 is in effect.
September 30, 2020 at 14:18
I think you misunderstand what people are being told. 10014 and 10052 remain in force. Unless your visa was reissued from a visa you had prior to April 23, then you ARE subject to the ban and must wait until January 1 to enter. Nothing different to any other country, but people are misunderstanding.
September 26, 2020 at 09:59
Dear All,
We can pick up our reissued visas on September 30th. (Last day of the fiscal year…) We appreciate all the help and support we received. Thank you.
One very important thing to point out:
They have informed us at the embassy in Budapest that they are going to print on our visas that we are subject to the Schengen ban and proclamation 10014 (We had a valid visa on April 23rd so I think we should not be subject to the proclamation.)
In Ukraine they print “Exception under PP on risk to labour market” on the visas. (Probably referring to PP 10014)
Maybe it is worth mentioning this to the judge. We are afraid that if they print it on our reissued visas that we are under PP 10014, the officer at the border protection is just going to reject our entry…
September 26, 2020 at 23:33
You need to clarify it with the embassy. They are referring to 10014, but theoretically you should not subject to the ban since you had a visa before April 23.
September 29, 2020 at 07:25
Thank you for your answer. We tried to clarify this and they said, the consul here in Budapest understood this way the text of the proclamation and there could be differences between countries, even if it is Schnegen. News: yesterday in Poland they re-issued visa with a note on it: exception of proclamation 10014. We will know more on 30th, when we pick up our visas.
September 29, 2020 at 13:57
They really don’t know what they are doing. Try and clarify what they mean by this if you can.
September 22, 2020 at 13:05
Hi brit,
I was on AP, now all my documents were ready except the medical exam. Impossible to obtain an appointement, so I emailed the embassy to ask them what to do.
Than the physician was not happy I emailed the embassy and now there is no way I’m getting the medical.
September 23, 2020 at 00:00
Keep pushing.
September 21, 2020 at 16:12
There is a progress, anyway from the government, kind of !! ! Brit said yesterday during his YouTube Live that about 693 (or roughly 700) interviews were conducted during the last two weeks, with 90 of them at US embassy in Bogota (Colombia.) (We don’t know how many visas actually issued.)
40,000 minus 700 = 38,300 still cases to get interviewed !!! LoL !!!!
A vey long way to go !
September 21, 2020 at 13:59
Hello Brit, at what time is today’s hearing?
September 21, 2020 at 16:01
It is not a hearing as such. The government have to produce a report for the Judge to show progress. There will be no hearing to listen to.
September 21, 2020 at 16:56
Hi Britsimon. Thank you for clarification regarding today’s hearing. Do we have any insights when should we expect the decision or any updates regarding this case?
September 21, 2020 at 17:05
Only that we expect a decision by the end of the month.
September 21, 2020 at 11:30
Dear Brit!
Today our visa (Group 3) has been approved, and i would like to thank you so much, for all the support given to us in the last month.
I big thank for all the team who has work so hard and special thanks to the Judge Mehta 🙂
My god bless you all
September 21, 2020 at 15:52
Great news!
September 21, 2020 at 04:51
OK. Had our interview just couple of hours ago. The questioning CO was friendly although somewhat frustrated by our documents (but again our situation is somewhat unusual and I did provide a letter of explanation for all that). Was never asked for CV, or DS-5540.
My education (History and International Trade) was a bit puzzling for the CO at first (I’ve been working in engineering roles for the past 10+ years) – but the explanation about training both before and on the job was accepted.
Oh, and an obligatory question, it seems, about the date we married.
The interview concluded with the warning that PP10014 prevents us from entering the US and visa will have the annotation saying this.
September 21, 2020 at 05:04
Sounds good.
September 21, 2020 at 06:08
Yeah, very nice.
September 20, 2020 at 13:57
Hi BritSimon!
I am a named plaintiff in the Mohammed vs. Trump lawsuit, I had my interview last week, visas are approved according to the CO, left our passports there, but the visas appear as “refused” on the CEAC website. I didn’t get a chance to contact the embassy yet. What the hell is happening ?!?!?
September 20, 2020 at 20:35
If you hade read the FAQ you would not be worrying. That is normal while they wait for KCC to allocate the visas.
September 20, 2020 at 10:11
What time is court tomorrow? I am sorry if I have missed a post on this.
September 20, 2020 at 20:32
Checking.
September 20, 2020 at 00:56
Hii brits
my intervew day is march 17th
the plaintiff altough I joined Curtis 3.0 (but that was filed yesterday so I doubt that had any impact).
My ethiopia 2020AF00020***
I am still a little floating in the air…
Thinks I have done (besides writing KCC): I wrote my local embassy and sent both judge Mehta resolutions and asked them to cooperate and make good faith efforts.
I will keep you posted.
Thanks all for this supportive community ?
September 19, 2020 at 17:11
Let’s put some light or darkness to all the mess.
So, for the Curtis and Morrison lawsuit, there are plaintiffs that may be high hundreds, say 8 or 9 hundreds. For them, Curtis is fighting hard. Normal !
For the AILA (many thanks go to Brit for the Form), there are about thousand listed people but only 7 plaintiffs.
Basic arithmetic : 800 + 7 = 807 or 900 + 7 = 907.
So 807 or 907 people that are being prioritized by KCC and US embassies around the world since the DV Updates by the Department of State last week.
But let’s have in mind that when the Covid-19 stopped the DV-2020 processing, there were only about 12,000 visas (or interviews) issued.
55,000 – 12,000 = 43, 000.
So if all things go well, by September 30, 2020, there will be about 12,000 + 907 = 12,907 issued interviews + visas for DV-2020 selectees (or roughly 13,000 or 14,000, including those lucky interviewed in September who are not plaintiffs from Curtis nor from AILA.)
55,000 – 14, 000 = 39,000 people who were hoping to get to the United States of America would be pissed by mister Trump’s caprices.
If Monday Sept 21, courageous judge Mehta does not extend the September 30 deadline, all those 39,000 people would be left into the darkness of their hopes.
The light is, there are many alternatives on the table of judge Mehta. Including keeping the hopes of those 39,000 or 40,000 people alive.
September 19, 2020 at 17:31
Well you misunderstand the plaintiffs from the first cases, and possibly getting mixed up with CM 3.0 case – and in reality many people have been helped that are not plaintiffs, but anyway, yes there are a lot of people still waiting, and visas will be wasted if the deadline is not extended.
Let’s hope he does. It isn’t easy for him. People being disappointed is not a high enough standard for him to act.
September 19, 2020 at 16:03
Hi, everyone, I would like to share my experience:
I just received an email from state.gov to check status, that was linked to a letter that showed an appointment for an interview on september 25th, I was on group 5, so no doc processed email no nothing, I also weren´t on the plaintiff altough I joined Curtis 3.0 (but that was filed yesterday so I doubt that had any impact).
My CN is EU52xxx.
I am still a little floating in the air…
Thinks I have done (besides writing KCC): I wrote my local embassy and sent both judge Mehta resolutions and asked them to cooperate and make good faith efforts.
I will keep you posted.
Thanks all for this supportive community 🙂
September 19, 2020 at 16:27
Very interesting and great news for you. Which embassy is that?
September 19, 2020 at 16:33
Madrid, I am the Laura from Spain as your Laura 🙂 Told you that was a good sign.
I am not sure if this is new but in state.gov website says that point 4 in prioritization plan is: For posts that have additional capacity to process applications and are not exhausted by the three categories above, applicants whose cases are pending with the Department’s Kentucky Consular Center.
Can I have your permission to contact you by email for a quick question?
September 19, 2020 at 16:43
Thanks Laura.

Quick update, embassy emailed me today and changed the appointment for the interview, now it’s tomorrow morning! (It was supposed to be Friday morning). I managed somehow to have everything ready but the medical, so I’m still keeping my fingers crossed. Wow! Lots of yoga needed!
September 21, 2020 at 20:39
LOL – it will be fine. Best of luck!
September 21, 2020 at 20:42
Thanks, Brit, at least less days to think about itand straight into action! keep you posted!
September 22, 2020 at 19:39
Visa almost approved (waiting for medicals), CO handed me a sheet with the Welcome to the USA text :)! Two interesting facts: It was Madrid´s embassy who requested my documents to KCC when emailed them with Judge Mehta order asking to “make good faith efforts”, remeber I was a EU52xxx no plaintiff. So, at least my embassy was collaborating as much as they could with some dv selectees. Also, CO mentioned that they know that I have been keeping in touch with lawyers (that sounded a little bit scaring at first), specially because I am not a plantiff, I only joined Curtis 3.0 and that was filed after they emailed me for an interview, then I thought he said that just because I copy/pasted Mehta order text on my email. Best fo luck to everyone, keep struggling!
Special thanks to people who live on tree houses 😉
September 23, 2020 at 00:20
🙂
Not too long before we have another Spanish Laura! Come meet my wife!
September 19, 2020 at 15:41
Hi Brit, I had an interview. I was told that my visa was approved and left my passport at embassy. But when check the visa status it says adjudicated and refused. Can you advise further. Many thanks
September 19, 2020 at 16:40
The refused status often shows for a day or two until the visa is printed.
September 19, 2020 at 23:48
Thank you so much. Much appreciate it.
September 18, 2020 at 16:37

September 18, 2020 at 17:22
And could you dream about judge Mehta and extension, asap please 🙂 ?
September 18, 2020 at 14:33
Hi Simon,
We flew to Croatia and finally had our interview today BUT we weren’t approved (we were not rejected, they kept out passports) because according to the embassy, PP10014 is preventing them from doing so. Seems that the embassy in Croatia doesn’t know about orders issued on September 14, is it possible that only embassies in affected areas were informed about this? This leaves the people that took the advice and left Schengen in a terrible position. Please advise what we can do.
Thank you.
September 19, 2020 at 00:30
They will check and get it sorted out. You can also follow up by email showing them the court order or the DoS instructions.
