Normally, by checking the FAQ you can see what I have already written or what videos I have already produced. In this case a quick look at the FAQ would have bought you to this link.

Hello Brit,
Marianela from Argentina. Thank you so much for your enormous help!
I already have my GC with me. I activated it in June 2019 and I stayed in the US only for 5 days. Immediatly after I returned home to Argentina.
1 Is it alright to remain in my country for 12 months after activating the GC? or do I have to be in the States for a week, at least, before six months are over to avoid having problems at immigration?
2 I am aware the fiscal year has ended. Am I compelled to present tax forms when I have been in the States for a week?
Thank you so much Brit,
Marianela

Dear Mr. Simon
If my wife entered the Green Card Lottery, with my details under spouse information. Can i also enter and put her details under spouse? Or will this be seen us double entry? Than you
October 9, 2019 at 03:29
Yes you can both enter.
October 8, 2019 at 17:29
Hi Simón, thanks for the info you share. I have two questions related to my application that I hope you can help me with.
1- My legal status is single, but I live with my girlfriend and we will get merried in three months, can we apply as a married couple?
2 – I heard for a coworker that married people can apply with the husband as the principal applier and viceversa, so could have doble chance, it is true? I dont think si, but I really have the doubt.
Thanks so much, sorry for my english.
October 9, 2019 at 03:30
1. No.
2. Yes it is true they can do that – but so can two single people. In both cases each person can enter.
October 8, 2019 at 18:36
Hello, Simon
I have a question regarding first names and middle names. I have checked the FAQs, but couldn’t find my particular situation.
I am Romanian and I have a first name (“Iulia”) and a middle name (“Alexandra”), but the law here in Romania requires those separate names to be hyphenated in all official documents, including my passport (where they appear as “Iulia-Alexandra”, as if they were a single name…). The form states to write your name exactly as it appears in your passport, but if I do that, they would appear as if they are a single hyphenated first name (Which they are not, they are 2 separate names. No one even calls me by my middle name, ever…).
I don’t know what to do… write them exactly as in my passport, as a single hyphenated first name, no middle name?… Or ignore that hyphen, and write them as a first name and a middle name, which they are, but risk maybe being disqualified later for providing info that is not in accordance with my passport?…
What shall I do?…
Thank you!
October 9, 2019 at 03:33
No hyphen.
October 9, 2019 at 06:44
OK, I will write them separately, as a first name and a middle name.
Thank you so much, Simon!

Hi Brit, first of all, I want to say that your guidance has made me confident enough to apply this year, so I did!! My question is that I want to migrate buy my hubby does not want to because he doesn’t want to leave his permanent job. In 10 years, he will be able to retire and hopefully join me if I am successful with winning. Will this affect my application? He has been helpful in the application process by issuing all his required information and picture. I am the primary applicant. Please help!!
October 9, 2019 at 03:34
No problem.

Thank you for taking questions. I am trying to help a friend from Nepal who would like to apply to the DV program. He is in his 50’s and grew up during the time when education was difficult to obtain in remote villages. As such he only completed the 7th grade and therefore he is not eligible to apply because of his level of education. Therefore I looked at his work experience to determine if he could be eligible under this criteria using the information on the O*NetOnline website for job classifications. I know that you must have an occupation with a SVP of 7 or higher to qualify.
My friend has been a trekking guide for the last 30 years and takes foreign visitors on treks of 2-3 weeks in the Himalaya and shares information on the cultural, history and geography of the areas they visit. In the process he has become fluent in both English and French. On the treks they visit monasteries and other locations and either camp or stay in tea houses. In order to determine if his work experience would qualify him to apply for a DV Visa I looked under “Find Occupation” and selected “Job Family” and identified two different occupations that could apply under the category of “Personal Care and Service” .
1) The first is 39-9032.00 Recreation Workers (Job Zone 4: SVP: 7 to < 8) Conduct recreation activities with groups in public, private, or volunteer agencies or recreation facilities. Organize and promote activities, such as arts and crafts, sports, games, music, dramatics, social recreation, camping, and hobbies, taking into account the needs and interests of individual members.) and
2) The second one is 39-7011.00 Tour Guides and Escorts (Job Zone 3 ; SVP 6 to <7) Escort individuals or groups on sightseeing tours or through places of interest, such as industrial establishments, public buildings, and art galleries. This one also says “Bright Outlook” even though it has a lower SVP rating (6 to <7 vs. 7 to < 8).
I know that it says that in order to qualify for a DV on the basis of your work experience, you must have, within the past five years, two years of experience in an occupation classified in a Specific Vocational Preparation (SVP) range of 7.0 or higher. My friend has 30 years of experience and if I had to choose I would say that as a sherpa trekking guide he is more of a Tour Guide/Escort than a Recreation Worker but it seems like the Recreation Worker has a higher level of SVP than the Tour Guide/Escort. Based on this do you think my friend is eligible to apply based on his work experience?
October 9, 2019 at 03:35
He should apply for the lottery and see if he is selected. IF he is – then it is worth discussing how to proceed.
October 9, 2019 at 13:35
Thank you so much!! I watched your video on the interview and I will help him to prepare a good case!
October 8, 2019 at 19:23

Hello Simon,
Do you know if it is ok to have the hair in pigtail buns? I got my daughters photo like that but not sure if it will be accepted or not.
October 9, 2019 at 03:39
It’s OK
October 8, 2019 at 19:49
Hi britsimon. Sometimes photographers edit the photo to make background white and to crop some hairs on the photo. Does this cause discalification?
October 9, 2019 at 03:40
Not if done correctly.
October 8, 2019 at 19:56
I was born in a country of Asia that is eligible but i applied and have been chosen from my country of nationality which is also from Asia and eligible as well.
Is that fine? Or that might lead to disqualify my case?
October 9, 2019 at 03:43
What are the countries involved?
October 9, 2019 at 04:36
Country of born ( KSA )
Country of Nationality ( Yemen )
October 9, 2019 at 04:55
OK – so neither of those countries is limited in the draw, and both are in AS, so you should not be penalized for the error. However, as Yemen is banned, make sure you have a second passport to overcome the ban.

October 9, 2019 at 00:01
I am following your web page (and sub pages ofc 😉 ) since the very beginning of their existence (tried our luck in DVL for 8 times, now it is 9th) and my question is … DV2020 brought us around 80k selectees so do you think there is a chance for an additional selection for that fiscal year?
October 9, 2019 at 04:02
A second draw would have happened by now – so – no.
October 9, 2019 at 01:08
Hi Britt,
I have read through your FAQ and I’m sorry if I have missed this answered somewhere else. we are currently filling out our ds-260 forms, my wife is on 12 months maternity leave at the moment. for current work should we put in home maker or do we put her current employer that she is on mat leave from? I should mention by the time our case number comes up she will most likely be back at work
thank you again for your amazing resource of a website!!
October 9, 2019 at 03:56

October 9, 2019 at 02:38

October 9, 2019 at 05:26
If I have a passport that expires during 2021, meaning during the processing time of the applications, but of course the passport was valid at the time for application, could that somehow lead to a disqualification?
October 9, 2019 at 05:28
No.
October 9, 2019 at 06:49
Hi Simon!
Kazakhstan, case 400, October 8, +3 visas!
Here is some details what we had on the interview from my wife’s point of view. I just translated.
We arrived at the consulate. It is necessary to prepare in advance separately passports of all family members and a printed invitation. And since I put all this into files, I had to dig and get it out. We were not allowed to take the bag or any personal things, only docks and money. Then we were taken to the 17th floor, where we were transferred from hand to hand to the guard Pasha. He gave us a list of docs we have to prepare.
We were the sixth in line. Then they began to call people to the window #2 – there we had to hand over the documents. You can go to the window together to help with documents. A woman calls a document on a list, we have to give original, copy and translation. First, the docks of the main applicant, then the spouse and a child. They asked if we want to support with additional documents, I put two certificates from different banks about the availability of funds on 10/01/19. The accompany applicant was not asked for education documents at all, neither the school nor the university. Then they call to the window #1 – there we pay the consular fee. Just in case, we took a larger amount, because they were checking every banknote thoroughly, some may not be accepted.
After it we were invited to the consul. We got to Melissa. She asked if we knew English, the husband replied that he knew, and my daughter and I did not. To begin with, they took an oath by raising their right hand, she began to fill out something on the computer, simultaneously asking questions. To me – do you have a school education? Did you graduate? What specialty? (Here I recall that I would not say the word “engineer”, I call a specialty without the word engineer) because we had some people go on to AP because of that, just in case. Have you lived in other countries? To my daughter a question – how many full years? Husband – did you live in other countries? He replied that he lived in Canada for 8 months, Where do you work?
He replied in English, they talked about where he works now, but by education he is a coach in general, she asked what kind of sport. He replied “speedskating”. They discussed sports, training, also some famous Olympic oval in the USA, Salt Lake City, the world championship in which he participated, etc. She fills something on her computer all this time, these minutes seem to me like forever. Then some more questions – which city of the USA will you go to? We said that we go to NC, Charlotte. Melissa: “Oh yes it’s a good city”. After she finally finished printing and says, your visas are approved, on Thursday come for your passports! I tell her, thanks, Melissa! she- oooh, do you know my name? However, how many people in general know me?
We say – whole chat, we communicate with each other, and share the experience and many say that you are very nice person, who had interview with you. We also think she is nice. This is what we went through.
Sorry for my English, it is a bit rusty. I hope it will get better in the U.S.)
Thank you for your help and guidance.
October 9, 2019 at 14:55
Can you explain this part
“Did you graduate? What specialty? (Here I recall that I would not say the word “engineer”, I call a specialty without the word engineer) because we had some people go on to AP because of that, just in case. ”
May I know, why you didnt tell that you’re an engineer?
(i am asking because I am an engineer too)
October 10, 2019 at 06:11
We are not sure. We have some people who were put on AP cuz they have worked as engineers, but what kind, we don’t know. Maybe some special ones. It is i guess just a prejudice. If you don’t work on secret or specail government facilities, you shouldn’t worry about it.
October 10, 2019 at 01:39
Awesome!
October 10, 2019 at 01:54
Hi Eryx!
Can you tell me what documents in the list that they ask for? Do they list a document of financial support such as bank statement or I-134 form?
October 10, 2019 at 06:14
We just provided bank statement. We don’t have sponsorship. In our region you should show around 5k USD per person, but it can differ from others. You have to check what is enough for you in your region.
October 10, 2019 at 06:20
What other documents exist in the list you received? Thanks
October 9, 2019 at 07:45
hi Simon,
I have a friend who did not finish high school, but he is a truck driver and has been for the past 15 years. Can he participate in the 2021 Lottery?
October 10, 2019 at 01:41
There is nothing stopping him entering, but if he won, he would not meet the requirements.
October 9, 2019 at 08:34
Hey, I was born in England but moved to New Zealand when I was a couple of months old. My parents were both born and raised in New Zealand but lived in England together for a few years as an overseas experience to work and travel. They knew that when I was born that they wanted to move back to New Zealand to raise me – Am I still be eligible ?
Cheers
October 10, 2019 at 01:44
You could claim the “missionary exception” for that you need to prove your parents were in the UK only temporarily.

October 11, 2019 at 01:51
Thanks.
Do you know of any examples of how people would prove something like that though? Seems like a hard thing to prove
October 11, 2019 at 01:55
(As they weren’t there on any sort of job transfer to England or anything like that, which would be easy to prove if it were the case)
October 11, 2019 at 04:13
Every case is different. Speak ton your parents – so what they can come up with.
October 9, 2019 at 08:42

October 9, 2019 at 16:36
1) will someone ever know if I applied to the lottery when applying for a non immigrant visa?
2) if yes how can they know about it?
3) Can I be denied because of that?
4) can reapply for the lottery and if selected apply for a visa after I applied the to another immigrant visa but be denied?
5) can someone reapply after being rejected for public charge if the economic situation is different?
6) it is possible apply for a non immigrant visa after the immigrant visa was denied?
7) writing my address in the dv online form, I have to put the number too or just the street?
8) if a passport number contain letters, should I include letters while writing it?
9) to show i’m not a public charge I have to show all the things listed in your article or just one?
10) if I have my dv visa petition rejected I have some way to apply for non immigrant or immigrant visas?
October 10, 2019 at 01:45
Hi brit, sorry if there are too many questions but for me it’s very important having the knowledge of all that
October 10, 2019 at 04:49
So if it is important, read the FAQ and some of the articles here to know more.
October 10, 2019 at 02:55
1. Possibly.
2. Because of electronic systems.
3. Denied what?
4. Use some simple logic please.
5. Yes
6. Yes
7. Obviously the number. Come on. Think.
8. Yes
9. Read the article properly.
10. Repeated question.
10 questions – mainly “what if” scenarios). Please be respectful of my time.
October 11, 2019 at 16:30
2) thanks. There is an official source I can find on internet about how can they search applicants on the electronic system so I can read more accurately how it works?
3) I mean can an immigrant or non immigrant visa be denied if someone find out that I applied to the lottery?
4) I asked because on internet there are different answers to this question
Anyway thanks for the answers, of course didn’t want waist your time, It’s just that there are a lot of opinions about the dv visa and I wanted to clarify
October 11, 2019 at 21:19
2. I doubt it because some aspects of that speak to threat detection – and for those sorts of reasons they don’t want to show you everything they do…
3. Let me repeat what I said to smeone else earlier. “In interviews previously, USCIS/DHS officials have REPEATEDLY explained that simply *entering* the lottery is NOT considered immigrant intent.”
4. Answered by 3.
October 10, 2019 at 01:46
Document emails can be sent to any case number. It does NOT mean they will be interviewed out of order.
October 9, 2019 at 09:42

Hi Simon, Does common law marriage with an affidavit qualify as marriage in the case of DV Lottery?

Hello Brit
Please a have question and is
If you marry transitionally without any legal document attached but got separated. How is that one?

October 10, 2019 at 01:49
It depends on the laws of your country.
October 9, 2019 at 11:36
Hi Simon,
I have dual citizenship, Hong Kong and British. I was born in Hong Kong. I wonder if I should use my Hong Kong passport (not the British passport) to apply since Hong Kong is eligible area not UK. THANK YOU.

The passport does not matter.

Hi Simon, Thank you for your help I am writing to you since I have a question and I need to clarify myself, I was a winner of the dv2020 and when filling out the form DS260 an error was made with the year of my marriage because of what I then had to call KCC to unlock me and to correct the error and I did so I write to you because some people say that this is why they can deny me my visa since they have access to see my old ds corrected my question is that if This is true that if for that reason they can deny me my visa because it was actually a mistake and I had to fix it. Greetings and I hope your answer thanks for your immense work
October 10, 2019 at 02:16
It is not a problem to correct a mistake.

Hi Mr Simon,
I wanted to ask you in case I end up winning the lottery, could I be able to provide permanent residence to my fiance once I move there? He is currently living there under DACA. I know because of age limitations he can’t apply to the lottery but I wanted to see if this was a posibility?

Hi,
I know embassies offer translation or they let a spose to translate for the other during an interview, but is English language proficiency a problem for approving the visa?
October 10, 2019 at 02:45
No
October 9, 2019 at 16:09
Hello Simon,
I just joined your YouTube channel. Thanks for the interesting videos.
I have two questions. Looked at the FAQ but couldn’t find the answers.
1. In the The Netherlands there are two ways of living together. Marriage and/ or a contract with your spouse through a notary. In lack of a better word it’s called a “ living together contract”. It’s the same as a marriage but without the wedding party.
My husband and I were married before ( to each other) but divorced in 2012.
We always lived and stayed together and are “ formally “ being reunited October 22 – 2019 ( during the entry period for the lottery ) through a contract by the notary.
Could you give me advice as how to enter our status: married, single ?
2. My partner has a daughter from a previous relationship but he has not seen or heard from her in 14 years. There is no contact with her or his ex partner.
a. Does he need to mention his daughter on the entry form?
b. Does he need to send a picture of the daughter wich is impossible because we have no idea were they live?
I’m so sorry to bother you with my questions but I reallllllly want to enter my/ our DV lottery applications truthfully.
Honesty is always the key but I don’t want to make any mistakes on the entry form!!!
I have been visiting The States for almost 30 years ( all my friends love there ) and entered the DV lottery sooo many times so hopefully with your kind guidance and honest advice I will finally be going home and stay there.
Hope to hear back from you and thanks so much in advance.
Have wonderful day Simon,

1. I don’t know enough about laws in yourcountry to say whether the notary process will regain married status. Currently you are “divorced”
2a. Yes – assuming the child is under 21. And if you enter as married you also need to include that child.
2b. If he or you cannot comply with the rules, it would be better not to enter.

There is a forum for Dutch people that want to move to the US called AllesAmerika (check the emigration section). There might be people there who know the answer to 1.

Hi Simon,
I am wondering when I check CECA I see every year almost 16k winner for Asia but the approved visa not more than 6K does that mean they only accept 35% from Asia every year?
October 10, 2019 at 03:00
Some don’t apply, many are affected by the travel ban. It’s not “every year”.
