I have 3 children, age 33 ,27 and 29 – also have 2 grand children of which I am their legal guardian,my daughter lives with us and is a single mother. I am an Airline Captain with South African Airways and will enter the green card lottery this year – my question is should I win a green card will my whole family – my wife, children and grand children be included or excluded from immigration into America?

I answered the other question first. They won’t get GCs as you have read. In your position a DV win would be very difficult as it would not benefit your children or grandchildren quickly.

I understand the cut off for one’s children is 21 and I assume grand children are not included – they would have to make their own application for immigration to America. This even though they are under 10 years old and under my care.

Grandchildren cannot be directly sponsored by an LPR. You would need to sponsor your children and if the children are still children by that time, then they would benefit – but please understand that it will take years. You need to be aware of the options/timing – since you say they are in your care.

It’s a moving target – family immigration allocations are subject to change by the administration – so family based waiting times are likely to increase under Trump. It’s also difficult to be precise because you might qualify for citizenship and that might be a better/faster path. But it is likely to be 5 to 10 years at least.
But current waiting times for over 21 year old child (unmarried) of an LPR is about 6 years. There is no LPR option for married children. Citizenship takes 5 years of residence. As a citizen you can sponsor married children – that is around 11 years currently. These are waiting timelines, paperwork will increase that time. All these waiting timelines are published on the USCIS visa bulletin.
Your kids can enter themselves in the lottery, but the chances of selection are 1 in 200 years. The lottery is not a “plan”, it’s a lottery.

Hi Simon, just a couple of questions – I have been living in the US for the past 12 months on a J1 – do I have to provide a police check for my time here? Also, if I had a court case say 10 years ago but was not charged with anything – will this look ok or will it have an impact?

Also! Sorry! When submitting my application last year I put my current address as my AUS address as I was traveling around the states. About $200,000 to $250,000.
A sponsor that is truly committed to you would not have trouble providing his W2 etc.

Hi mate,
2017 OC selectee here, with a relatively high number (OC13XX) so not expecting an interview until July or August at the earliest. I submitted my DS-260 in September, and unlocked it once for a correction (also September).
My question is this: I may be required to travel to the US for work next month. When I return, do I need to unlock the DS-260 to update my “recent travel to the US” (which was accurate at the time I submitted the form) so that it includes this trip, or is that something that a detail that can be discussed at the interview itself?

I am one of the “smart” people who won the DV Lottery – and yet I somehow missed the part where one’s DS-260 is processed in the order in which it is submitted. Therefore, and even though my number has been current since November 2016, I am only expecting my interview to take place in April 2017. Since I have already missed something, even after reading your answers to various questions posed by other selectees, I would like to make sure of the following:

Country: South Africa
1. I received my Police Clearance Certificate in July 2016. The travel.state website indicates that it is valid for one year. Should I rather apply for a new one to be safe?
2. Public Charge: I will be living with a friend upon arrival in America and that is also the address for my CG that I have entered on the DS-260 form. I am a single female with no dependents and I thought the money that I have in the bank would be enough. Information supplied states that $10 000 would do. I have $20 000 in cash and $31 000 in a provident fund at work that I can cash out when I resign (ideally, I would rather keep that amount in a Retirement Fund). That brings the total to $51 000 dollars. 20% of that is $10 271. Is that sufficient to prove that I will not become a public charge? I do not want to inconvenience my friends in the States with an I-134 but, if necessary, I will have to organise that post haste.
3. On my DS-260, I filled out the “Foreign Name”-field because there is an é in my name. However, I now see that I have omitted to state my surname in that field. It is correctly filled in everywhere else. Should I unlock and add my surname?
4. I have mislaid my Matric Certificate years ago and only have a copy. I applied for a re-issued at the South African Department of Education in June 2016. Unfortunately, my Certificate is contained in one of the Department’s corrupted batches. After numerous phone calls, visits (1 hour’s drive), supplying the Department with a copy of the copy plus an affidavit, I still do not have an original copy and I do not have any hope of obtaining one. I do, however, have my University degree, transcript and academic record (B.Com Economics). It is impossible for one to attend University in South Africa without passing Matric with University Exemption. Would this degree suffice?
5. My mother’s place of birth on the DS-260 differs from my long form Birth Certificate. I filled in her town of birth but upon receipt of the long form Birth Certificate after a waiting period of 7 months from date of application, I noticed that the village just outside the town is indicated as her place or birth. Should I unlock and change the information, or may I supply proof that the village falls under that town’s area?
I do not want to unlock because I am already going crazy with waiting and hoping. However, as you indicated: “delay is better than denial”!.

2. Your savings will probably be enough. An I-134 removes the word “probably”.
3. I would, yes. Identifying information is important.
4. Some COs have accepted degrees in place of High School results. Others have insisted on HS results.
5. That in itself doesn’t warrant an unlock, but correct it if you unlock for point 3.

I have gone for DV interview once in 2014 with my spouse. We were on admin processing. My spouse was later granted the visa and leaving me. She was to file petition for, but decided to ignore that. Now i have divorced her since 2015. in 2016 i got married to another woman. Fortunately months after we got married, she won the DV. I already have my divorce certificate.Will you advice me to go with my present spouse for interview at the embassy without any eye-brawl by the embassy? I am afraid that it will affect me. We have already submitted our DS260. Please help me to know whether it is not a crime to do so.
I hear people say that the embassy will take me to be a fraudster and will not accept me neither. Please advice me what to do Brits.

My wife, principal applicant (CN:AF35***), who is Kenyan went and studied Form 5 and 6 (A-level) in Uganda (neighboring country) over 10 years ago. She has been in Kenya since completion of Form 6. Will she require to get Police clearance from Uganda for the Kenyan Embassy interview? Our contact, XX, in the USA, the one we named in DS260 and who is an LPR of over 8 years, invited her relative, YY, to visit her in the US for three weeks. YY traveled in mid Dec 2016. YY was granted 5 year visa but she is yet to return after the 3-week visit. Can these jeopardize our interview given YY, who is XX’s relative is overstaying now? If so do we need to change XX in DS260 (we mentioned XX is our relative in DS260)? Thanks for your continued help. We are really anxious.

1. Applying for a re-entry permit normally means 5 or 6 weeks in the USA
2. Each person applying must be in the USA for the biometrics.
3. No, it is a RESIDENT card. You are supposed to be living in the USA.

The first absence is OK. What is not OK is the frequent absences, returning every 6 months just to keep the GC active.

1. Ideally not. Rescheduling can lead to delays before your interview can be reassigned.
2. Depending on the embassy involved that may or may not affect your interview. Some embassies are stricter about the I-134 than others.

Yes for sure !
The CO asked me about my sponsor and how did he get to US i answered and it was fine
Then he asked me about why i stopped studying after i got my baccalaureate, i told him that i was working without contract or insurance, thus i have no documented proof about what i was doing during that 2 years span time He told me that my case isn’t clear and that it needs further Administrative Procedure and explain me to wait 60 days at least before taking contact them at the e-mail they gave me !

I can’t predict the chances in your case or any individual case other than when a case is obviously going to be denied. Your case is not “obviously” going to be denied, but I cannot say how likely it is to be approved.

It really about what they do during that AP time that worries me, cause if i’m going to be denied they won’t tell the reason, and frankly i don’t know what to think about it neither, so i find myself worrying about nothing specific.
The reason i think is that i had to justify what i was doing during that 2 years time, while not studying and not working under contact too, so if they’ve to investigate about this then everything’s fine by my side, but still the CO answer wasn’t a “Yes”, and from what i read about AP on other forums it takes very long time, finger crossed i hope for the best

The CO asked me first if i had a cousin in Usa i told him yes, then asked me how did he get to the usa, i answered him.
Then asked me why i stopped studying and what i was doing during that time, i told him i was working during that time, and then told me my case needs more Administrative procedure
