If his DV visa is experied he cannot now use it. The wife will have to sponsor him – which will take around 2 years.

The problem we have is that our 5-year-old son’s passport expired in November 2016. We applied for a new passport in September 2016, however, given the long delay in Venezuela, for the issuance of the passport, we have not yet been able to complete the application to send it and give us the date of the second interview. Fill out the DS260 with the expired passport, then renew it before the interview. Then take old and new to the interview.

That is exactly what I did with mine passport, i wrote by date expire 2017 and the true date is 2016. I hope there is no problem by that. I am still waiting for the new passport and my case is 2017SA000011xx., so I hope get it on time

You can and you must. The medical is a condition of the DV process. Xrays are still performed, generally with a shield to protect the fetus.

First of all I would like to say thank you to this blog and especially Mr.Simon that always offer a very good idea and solution.
I got a call from embassy yesterday to bring my passports back to them, and to day at 1 pm I arrived embassy and enter security check as normal. At the interview they did not ask any question they just told me that my visa case is approved and gave green paper, and tell me back to pick my passport on 3 feb 2017. I am very happy and I will share more about my interview experiences to th blog when I get visa on hand. And of course I will offer a small donation to Support this website. It is really useful for Dv winner. And I am really appreciate to Simon works that always answer the question to me.

At the time of filling ds260 i didnt had much knowledge and confidence regarding whole dv process so i took help from a consultancy.. so he has got my dv conf. no, case no., and birth date also.. now my interview is in next month and i have booked medical also..Thanks to your wonderfull blog, now I have confidence to further process my case myself.. and I dont want to go to consultancy again spending time and money for the thing i can do..

I finally returned to abidjan and it is in abidjan that me and my big brother verify the results and I realized that I was selected. So I think you are asking if it is OK if you try and conceal your travel or education history. It’s NEVER OK to lie, and there is always the chance they will discover you are lying. If they discover that you have lied they usually refuse the case.

I have concern about address in my case.
I am female, and i was unmarried when i applied for the dv program. I was selected for further processing in September with case number 2017EU00029XXX. I got married with my boyfriend last week , did not change our surnames and the address in our weeding certificate is same as before,actually different for both of us. Do you think it is better to change my address to make it same as my husband or i can continue with the DS-260 as it is now?

You should unlock your DS260 and update your marital status listing your husband. If your husband wants a GC he will need a DS260 of his own also (add applicant). Since married people live together normally, it would be normal that the address is the same.

Is it a crime if a person has gotten married two time already and being to the embassy the third time when he has has been divorced with the last tow already?
My friend’s uncle got married to tow wives before. The first he went to the embassy for interview and were both refused visa.He divorced and got married to the second wife. Again so luck that each of these women won dv just as they got married. For the second time he has been there again. And they have been divorced. Now he has the third wife and this wife again has won the dv 2017. And has already submitted their ds260 to KCC. If he go there the third time, will it jeopardize his chances of going to America forever? Please respond to us, because it has brought up a very huge argument between us.

These statements are a bit ridiculous.
The chance of a person winning the lottery is about 1 time in 200 years. So your uncle married two women and by complete coincidence both of them won the lottery. Then by chance your uncle ends up divorcing the two women, one after another and now has married a third wife after she was miraculously found to be a winner. That is already a childish lie that any CO is going to see through. Does your uncle think consular officers are that stupid?

After the first entry you can leave immediately for up to 1 year. Subsequent absences should be 6 months or less. You can apply for a re-entry permit with gives permission for an absence (with good reason) of up to 2 years.

I am a DV 2017 lottery winner from Zimbabwe. I am expecting to be interviewed in South Africa in April/May ( going by my late September submission date). I have read your previous posts about the US politics and the new president, especially how the DV lottery is unlikely to be affected for a few years at least.
The president has recently been signing executive orders, one of them concerning immigration from some Muslim countries. The media says the order likely includes” a multi-month ban on admitting immigrants from all countries until the State Department and Department of Homeland Security finalize an “extreme vetting” process.”
Does this have any implications on the DV? Or is it still only speculation?

Many years ago i was in trouble with the police and have a criminal record(nothing to serious it was a drunken teenage mistake), my wife does not have such issues. I traveled to america on holiday a few years ago and didn’t declare that i had a criminal record. i was completely honest when filling out the form. The crimes that cause a problem are crimes of moral turpitude. Without knowing the detail, I can’t be precise, but in general a small offence from long ago would not cause a denial.

I just got my DS-260 form unlocked after I reviewed comments on your site 5 months after I submitted it. My case number is 2017AF0003xxxx.
I wish to seek your help on one miscellaneous question in the form as I have to accurately answer it. It says : ” Are you a graduate of a foreign medical school seeking to perform medical services in the United States but have not yet passed the National Board of Medical Examiners examination or its equivalent? ” Well, I am a foreign medical graduate and have not taken the Board Exam. Here is my dilemma. If I answer “Yes” to the question , will I not be implying that I am seeking to perform medical service without passing the required exam?. If so, this worries me that it might affect my application. If I answer “No” , will it not imply that I am denying that I am a foreign medical graduate? Given the above information,how would you suggest that I answer? Help please. thank you

I don’t advise on non DV cases, but I will say that typically someone sponsoring a family member has to be resident in the USA since they have to be earning enough money to support the person. They have to complete the I-864 which is more strict and has higher financial requirements.

Is it required to present cancelled passports at the interview. I was having error year of birth in my passport. After, presenting my birth certificate to the immigration office they issued me with corrected date of birth. I am really worried coz I corrected it after winning the DV. My educational documents are all in the corrected age. Although the DV is the immediate reason however I was planning to correct it when I got the time. By the way entry and DS 260 are filled with correct age.

My question is that we( me and my wife) are teachers working in different places but very close which is not more than 100kms . We meet once in a month and during break seasons. While filling the DS-260 on the address section we fill different ‘current addresses’. Does that make a problem? Because when you are responding to some one you made a remark that ‘married people live together’. How is that? Waiting for your response.

President Tump just signed the Executive order on immigration and refugees! According to that there is a 3 months suspension of immigrant and nonimmigrant entry to the U.S. from the 7 Muslim countries. According to Daily News, Trump’s order already blocks Green Card and Visa holders at airports! Based on these facts, what is your advice, in terms of travels to Iran, for Iranian Green Card holders currently residing in the U.S.? Are they at the danger of suspension from reentry if they leave U.S. right now? What are your thoughts on that?

My mother is an Iranian green card holder. She has been traveling back and forth between Iran and the U.S. for five years now. Will she be affected by this ban, if she is planing to return to the U.S. in 5 months? How will that affect her? Her flight to Iran is scheduled for Feb 23rd as of right now from the U.S.! Should she prolong her stay in the U.S. for now?

This is in connect with my previous inquiry. I was legally married, played and won the DV 2014 with my former spouse. At interview we were put on AP until 9 months before they can approve visa only for my spouse(former). She was to file a petition for me but she refused me that chance. After 5 months she asked for a divorce due to the fact that she never wanted me again and because she is now in the US. It has been done already. In 6 moths I met with a lady who was ready to marry. We got married in 8 moths after divorcing the former. Lucky two months after we got married, my present wife now has won DV 2017. She want me to immigrate with her to the US. I know want to know whether the 8 months period is too short for the embassy to guarantee me visa with this current spouse. The mathematics is; In May 2014 we went for interview with the former spouse. She traveled to the US in November 2014. In May 2015 we got divorced. End of October 2015 I met wit my present spouse and we got married in April 2016. Now that I have my divorce certificate, I want to know whether the period is too short for me to appear again at the embassy with my current spouse of DV? Because we are having mixed reactions from friend, etc.
Please help me know whether I have chances with this current wife or not. Thanks.

2) I want to change my daughter’s name in DV. She is just turned to 12 years old. I submitted Form 260 in December 30. In her passport also the old name. If i can, i want to change her name in passport also. My question is after we submitted form DS-260, can i change her name in DV process.
3) After we got the green card when can i apply for citizen?
4) After we settle in US, (6 months or more than) can i take my daughter to US?
5) Me and My hubby haven’t Birth Certificate so can i bring Census to interview?

No executive order is signed yet that affects DV. There is a draft that will pause immigration from some countries, but that order is not signed yet. And if signed it is a PAUSE.

my wife won dv lottery 2017 our case no2017********23,she was born in benin republic but her parents are from Nigeria and schooled and married to me as Nigerian too.Someone helped her to play the lootery and the person used Cotonou as a place of birth instead of Sakete when applying for the lottery.the birthcertificate with her bear Sakete as a place of birth,which place of birth is/ to be filled when filling DS260?Secondly,which international Passport are we going to use for the interview?Which US embassy is good for us to go for the interview-Benin or Nigeria?Thanks

The correct place of birth should be on the DS260.
Your country of citizenship or place of interview does not matter.

I am an Iranian who has lived in the US for 17 years continuously. I have unfortunately overstayed my visa and now my wife is one ceremony away from Citizenship. Once she is done I could file form I-485 and Adjust Status here in the States and my unlawful time would have been forgiven. I also have a US born child.
Now with the draft of Trump’s executive order out on LATimes, it states “suspension of visa and other immigration benefits”. I know it might still be too early to see through the fog, but could one conclude that people from those 7 nations are doomed if they file for I-485? Even people like me who are already in the country? Should I just give up and take my family and leave?
