I was interviewed at embasy and the interviewer gave me a white paper that is written DNA test which is my father who is petitioner and i . I then came back home and i check my CEAC status before it was ready but when i came home it changed to AP.So britsimon if the embasy take my DNA Test and be approved so what will be next process of my CEAC Status plz help me!

I am already a LPR in the US. However I am homeless. Is staying in a homeless shelter in the US considered becoming a public charge ? The shelter is not affiliated to the state, it’s private. The only problem is that being homeless, I do not have a home address to give. I have a low paid job though. Would that be a problem pursuing a further citizienship application ?

Hi Britsimon, My case number became current in November (OC region), I submitted in June and unlocked and closed again end of August, we still don’t have an interview, we have requested London as we live in the UK, do you think the delay is because it it a busy embassy? If it says “at NVC” on Ceac does that mean that they have received the DS 260 forms for me and my wife and that we just need to be patient?

It is possible that your unlocking was a significant change. Also the timing of the unlocking was possibly significant. But, regardless of the reason – patience is key.

Dear Simon,
I was granted DV Immigrant Visa on Aug 2016 and entered in Sept 2016 (the visa says that this is valid for one year upon endorsement; which takes up to Sept 2017). To date I haven’t received by GC. I have called USCIS several times and spoken to level 2 officers (even though I am way over 120 days) I get the same response “It hasn’t been processed bc of back log..”
Today the officer told me that it looks like they tried to print the card on friday BUT something was wrong with fingerprints! I asked if anything I can do and they said no bc they can take up to 9 months!
I have made an info pass appointment and they told me nothing; other than everything seems fine and it is waiting for data entry.
I am struggling with banks etc to get mortgage due to not having the actual GC and frankly it is worrying. My spouse got their 5 weeks after entry and I am left with this unknown.
Do you have any advise?

It sounds like you were placed on AP pending the DNA test. Typically when the results are available they don’t need to interview you again.

You need to be honest, otherwise it will appear that you are covering up important information. If you visited Iran for a few weeks that is not “living” in Iran. If you lived there you must declare that.

I’ won with my wife and my children in 2016 i am waiting my confirmation second letter. one of my children is my biological daughter and an other one is my wife her niece, she was adopted since when she was 1 years, her father and the mother died during the war in Congo in 1998. I’ specified that I would not go with her she will follow us, because we lost her birth certificate and the process to get a other one will take a year, the only document we have for her is the passport and baptism certificate. i want to know if it will affect us to get the visa.

I am a derivative and my wife is the principal applicant. I wanted to Unlock my DS 260 to make some minor changes in the DOB of my parents. I emailed unlock request to KCC on 11/20/2016 but still the form isn’t unlocked though i received a standard email from KCC on 11/30/16.
1. Is it normal?
2. Should I send email from my wife’s mailing address (as she is the principal applicant) to unlock or sending the mail from me is OK?

It seems like Trump has lifted the ban on green card holders from entering the U.S. soil.
Does that apply to the green card holders who have just landed in the U.S. soil or green card holders from the 7 Muslim countries can return to the U.S. at any time from now?
So the 3 months ban will not affect the pmanent residents any more?
My mother is a permant resident and has a flight to Iran on Feb 23rd! She is planing to return to the U.S. In 5 months. Do you recommend that she prolongs her stay in the U.S. for now until things are more clear?

I won with my wife and children. My CN 201741xxx, ds260 sent June. In the ds260 I specified that I would not go with the children. I changed my mind, I intend to leave with them.
I wonder if I should open my ds260 and specify that I would go with them, or wait for my 2NL but I’m afraid they will not be included in the 2NL

1. I received my visa and I am entering the US around March 20th, and I haven`t received a flu vaccine because my medical was at the end of September, before the flu season. At the embassy they told me it is not necessary, but is there a chance I could face problems at the airport and be sent back home? I don`t want to receive the vaccine now if I don`t have to
2. Can I activate my visa by staying 10 days in the US, than go work in another EU country where I got offered a job recently, and than come back to US after 11 months with no problem? In other words, does the US government allow going back only to your home country and tying loose ends and getting things sorted out, or I can go somewhere else and work during that period without losing my permanent resident status? In my understanding, yes, you were covered by the initial ban. It now seems that people with Green Cards will be allowed entry, albeit through a waiver applied on a case by case basis. Wait a few days to see how things are in a few days, once procedures are more clear.

Unlock. However, I have to say that even without the ban your case is very risky. Your Iranian military service pretty much guarantees AP which has been lasting around 5 months for Iranians. So, given your case number, there will not be enough time to get AP clearance before the September 30 deadline.

Hi Brit ,I born in Libya when my egyptian parents were working there as a teachers 40 years back but , i dont hold a Libyan nationality, I am Egyptian passport holder & I Just got my 2017 DV visa on my Egyptian passport which will be expired on June 2017, ( my wife is the principle applicant), my plan was to go for landing on June once my children get summer holiday
1- Do you think it is wise now to go for landing as soon as possible before any other hassle extend to include more countries,
2- Do you thing, as my Egyptian passport show that i born in Libya, any expected problem i may face on landing for being Egyptian born in libya.
3- since i just want to land to activate my DV visa & staying for few days, do you advise with certain international air port to land in which is not crowded & does not have a long queues as i have couple of small children. ( I will travel from UAE)

It isn’t about your record. It’s about Trump being a moron. Right now, according to the order you would not be able to re-enter the USA. I hope that gets clarified in the next few days, and better yet, I hope lawmakers will overturn the order. But for now, you are affected.

If you are interviewing in Ethiopia, that embassy typically will ask about the host you are staying with. If they are satisfied that the host is someone you know, that is all they will ask. If you want to take financial documents also, just show what you have.

You are on CP so there is no difference in the CP interview because you started on AOS. But it started on Jan 10 – that is effectively your submission date. March interviews included cases with submissions up to early September. So – that means they need to deal with most September submissions (including 2nd draw), then October, November and December. I would not expect your interview in April. The earliest would be May, but June is more likely.

My question now is this VISA eligible for Muti-entry to the USA After enter America & before I get my green card !?

i was married to a us citizen then divorced , then married again in my country Ethiopia
i noticed that on my new marriage certificate which is 10 years old now i found that there was a question if i ever married and the answer is no which is not correct as i married and divorced
my question is that
do i need to correct this error before entering the embassy for my interview (knowing that this will be a big hassle as i must file for a court hearing to explain what happened to correct it)
or this is not a big problem knowing that i have my ex marriage and divorce papers from the US

I don’t know if that will create a concern. It depends on local laws. However, I would say that as long as you have the marriage and divorce paperwork the American laws wouldn’t see a problem.

Greetings Big Brit. please i wish to find out something. i had complain of the principal’s name on the edv we wrote 3 names meanwhile original she got 4 names. however we corrected the names to four names when filling the DS260 form. But on our 2NL we still have her name there only 3.

Hi Simon! Thanks for all the good work that you are doing compiling info on DV Lottery. I am a selectee for this year, Europe. I filed my initial DS 260 back in September and my number became current in January. However, I had to switch from adjustment of status in the US to consular processing in Europe. So, my lawyer unlocked the DS 260 only on Jan. 10 2017 and changed the address. When do you think I can expect my 2NL? Will this unlocking delay the process?
Also, is it customary not to receive any notification that the DS 260 have been processed? I read most of the info on your website but got confused about the following. Why do we file DS 260 months before our no. becomes current? In my case, it’s Sept. through Dec. And how does KCC picks up DS 260, in what order? Do you know of any cases where someone whose number turned current in January actually had a January interview. Thanks and keep up excellent work.

When your DS260 is submitted, there is a period of background checking. As yours was only started in January, it will be some months before your case is ready to be scheduled.

I know of similar cases, yes. The background check is started when the switch to CP is made.

Because i have been told that someone was called after 10 days for some finger print process! Or can i go just for few days only? 2- after leaving the US territory, do i have to go back after six months maximum or one year? There is no minimum time to stay. The absences should generally be 6 months or less to avoid problems BUT they can be up to 12 months. The first absence after activation is OK up to 12 months.

Until now, i’m not entered my ds-260 form, because my Education certificate to be ready in July, this year, so i want to fill the form at that time, but i heard New US President that he will Stop taking visa to iraqian, iranian, syrian people.

You cannot wait until July to submit the DS260. If you do, there will not be time to process your form and get an interview before September 30. You cannot get your case approved after that date. So, you should plan to submit your form around April or May at the latest. It will take a few weeks to process, and then an interview could be scheduled. August interviews for August are scheduled in June, and the final interviews (September) are scheduled in mid July.

I have two questions about DV-Lottery VISA, I am Sudanese my wife is get selected in DV-Lottery 2017, but when she provide a info she did not mention my X-wife and my son under 18 age, should I mentioned this info when I fill the DS-260 from or this will effect the VISA issue ? is is there any ways to bring him to US after we get VISA and resident in US?
2nd question about President Trump’s executive order green card, visa holders already blocked by airports and Immigration stop issue visa for these people from this countries: Syria, Yemen, Sudan, Iran,…???

1. If your wife was married to you on the day she entered the lottery (in October 2015), and did not list your children (her step children), then she has broken a rule of the DV lottery process. If that is ever revealed, you could all lose your Green Cards. There is no way to ever fix that.

I did get your point. On the day your wife entered the lottery she was married to you. That means your children were her step children. Therefore those children should have been included as here derivatives. The ommision means a denial and there is no way to fix it. Ever.

Dear Simon,
We passed interview. According to Consular officer our visas are pending for additional document to be presented (verification of my daughter’s single status). I hope we will get visas next week or 2. We have another problem. The address shown in DS260 as our US address should be changed to other one. Should I do that at the point of entry, or before?
Please advise.
