Actually I don’t know it but I suggest you make another one, but the interview in Kathmandu’s embassy is very easy! Even if the counselor doubt your documents he or she wouldn’t reject the visa upright, you’ll be given a chance , it happened to a guy before me. I’ll try to write about our experience soon

Way are the reasons for being at AP after
interview? Do they do cross checking wid our documents? E.g. contacting the university where we studied and contacting the offices from where we hav made our citizenship and passport?

Hi Simon,
I had my interview on 19th of Jan. Interview went well officer congratulated and kept my passports.
Then he gave us a yellow paper saying nothing pending from my side.
But he said embassy has not collected my education certificate from the education department.
In our country they have to collect that once we submit a small chit to the embassy.
My question is still the status is administrative processing. Should i ask from the embassy whether they collect my document by sending an email ?
Because i have some personal travel but currently i don’t have my passports with me.

No. People from from the 7 countries are banned for a temporary period of time. So – they will still be selected in DV2018, and if the ban is removed by then, they will be processed.

This for I-130 spouse visa do NVC goes by this way of calculations?I mean the exact amount of money someone made annually?my wife has 2jobs ,the day time job pay 10.50$ per hour and she worked for 8hrs in a day no weekend job,just Monday to Friday.and the second job pay 11.60$ per hr and worked 18hrs just on weekend ,Saturday/Sunday though the second job is a per time job.pls can you help to do the calculation to know if we are going to be okay with the AOS

Hi Brit,
I won the 2016 lottery. Me and my family visited the US for two months, received our social security numbers and green cards. We returned to our country on the 16th of November 2016.
My question is, considering the new rules and all, do we have to travel back within 6 months (may 2017)… Or can we make the move later (within one year)?
We intend to move in August/September… But with the country ban and strictness, we wanted to make sure that would be OK…
Our country of chargeability was Saudi Arabia.. And currently we reside in Pakistan… It’s just me, my husband and three year old daughter…

The ban doesn’t apply to you at all. For a normal absence, 6 months or less is wise. However, for the first absence after the activation trip, 12 months is acceptable.

You posted on ancient blog post that a derivative after an interview can be refused a visa,if we take an example a family,so a wife can be denied a visa and accorded to the other members of the family (husband and there children )…how they can separate a mother from her family?Does they take in account other factors ? Each individual gets approved or not. If the mother is refused, the family are free to decide not to move to the USA. So – “they” are not separating a mother from her family, they are simply deciding whether each person meets the requirements or not. The reasons for a denial of a derivative are because of factors like criminal history, medical ineligibilities or documentation failures.

We had our interview on Dec 5th. My wife is the main applicant and at the interview my wife and kids got their Visas and I was put on AP. Till date I am still on AP my question is we have planned our travel in April and if God for bid my Visa is still on AP would I be able to travel with my family as I have a valid B1/B2 Visa? Hi Hicham, well they asked for my CV at the interview as additional document which I provided the same day. But they put me on AP maybe for 2 things 1. My parents are US citizens and my father has filled an immigration petition on my behalf. 2. I studied in US on F1 status, but I entered US on visit visa and I changed my status over there, also after getting my Bachelor degree I did my OPT and later I got a new I-20 to do Masters just to be in status, but I never pursued the Masters and I returned back from US. I beleive the second is the main reason as within 2 weeks of interview I received calls from the embassy asking me first to provide evidence of OPT and later asking me to provide my entry and exit evidence from US at that time, which I have provided since 27th of Dec and since than I am waiting..and now I think as I am from Pakistan (live and DV chargeable to UAE) there will be more delay but it could also be faster because the Embassy of Abu Dhabi had large workload of Iranian visas…lets hope for the best.

Dear Simon,
I attended my interview this morning at London embassy. But the visa was denied. Because my husband (main applicant) chose country of chargeability Italy but he was born in Argentina. I am also was born in Argentina with Spanish nationality.
Firstly, it is possible to appeal this decision. Maybe changing region of chargeability.
Secondly. its is possible to change region of chargeability to my son (14 years old) who was born in Spain and has Italian nationality. In theory is the same region.
I would be grateful if you could give some tips in that issue.

No you cannot appeal. The instructions are clear. Unless your husbands parents were not Argentinian and were only in Argentina for some temporary reason (such as a work visa) then the denial was 100% predictable and correct. There is no way to derive benefit from your son’s place of birth.

That is the right information, I don’t know where we chose country of chargeability with this information. And they refuse the Visa under INA 212 a (5) (A) section, which does not make sense.

It is hard to generalize about what it “means” if they keep the passport or don’t. Keeping the passport “might” mean the CO expects the AP to be quick (although there are cases where the passport has been at the embassy for months while AP proceeded). The reverse is also true, meaning a CO might return the passport in the interview, but we have seen cases where the the AP has been resolved very quickly anyway.
So – don’t try and read anything into it…

Will the case number in the “Asia” region proceed faster than it should be? Or it will typically remain similar…?

The ban is temporary meaning KCC must assume those cases will be delayed, not destroyed.
So – the smart move would be to advance the AS region pace faster so they process more of the cases not affected by the ban. But because in AS region the Iranian and Nepalese cases take up 80% of the selectees, It really comes down to Nepal. Nepal will go at its own pace because the majority of interviews are in KDU embassy. The rest of Asia is quite a small number. So – there is no reason to assume a much faster pace for AS as region as a whole, maybe slightly faster, but not much.

When I got my dv visa it was issued on a whole page in my passport and the opposite page(page facing the visa) was blank. Today I had to go to the neighbouring country here in Europe and the stupid customs officer saw the us visa and just to spite me put the stamp on that blank page next to the us visa. Question is, does the page next to the issued us immigrant visa has to be blank? Does the us visa endorsement stamp requires whole page next to the visa to be blank? If so, what should I do now, go to the embassy again?

Now, I have another quick question:
Since I have not yet submit my DS-260 form (because I am currently legally residing in the U.S., and I am still considering whether to proceed as CP or as AOS), shall I speed up to submit this online form as soon as possible?
Currently, I plan to submit this form by the end of this month, will this plan cause any potential issue? In other words, shall I submit this form right away based on current situation? Or I am good to keep my current plan?
PS. FYI: My Nationality is not Nepal.

=> I got another quite stupid question, but it’s really a straight forward one:
If, I say if, a person submit the DS-260 form today, and suppose his or her case number is AS-0000480X. Apparently, this number will go current in April (Since the rank number right now for March is 4700, I assume this is the case). Thus, this case number probably cannot be scheduled an interview for April or May due to the processing time for DS260.
My question is: For this scenario, is that mean this case number AS-0000480X will loss his or her right to receive an interview? Or it is just postpone to June or July…?
In other words, can that case number still receive an interview after the KCC completing the DS260 background checks process? Or this case number will typically just lost his or her opportunity to receive an scheduled interview?

I have explain my AP status bf because. Embassy has not collected my advance level certificate. But officer said u can get the passport withing one or two weeks. Now already two weeks pass still no reply from the embassy. My problem is I have to travel other country for personal thing. How can I get my passport for that travel?
Because if it is taking sometime I can keep my passport for the travel and handover to the embassy once they finish processing.

I was wondering if world class programming contests (Facebook Hacker Cup, Google Code Jam, TopCoder Open) could qualify their top performers for an EB2 visa? Below are the criteria of EB2 (quoted from USCIS official website) I believe I could satisfy:
1- Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations. Other comparable evidence of eligibility is also acceptable.
=> could the top 1% performers (200+) meet the criteria? Note that tens of thousands among the best enter initially from all around the globe.
2- Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability.
=> I do have an advanced degree, not a masters though. It’s called “Diplôme d’ingénieur” (6 years of study post high school) and it’s in the field of software engineering, which is related to the contests area, could that qualify?
3- A license to practice your profession or certification for your profession or occupation.
=>A diploma applies here?
4- Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability.
=> Tech industry jobs in the US are very rewarding already, $150k/yr for instance is not an exception at top companies (see Google software engineer wages at glassdoor.com). Would a potential sponsor be required to offer a significantly higher wage to meet the criteria?

Finally you give me the detail I needed to give you advice. If he was born in Yemen, and that is clear to KCC or the Malaysian embassy, the interview will have been cancelled. He can contact the embassy to confirm that, and that is exactly what he should do to avoid travelling to Malaysia for nothing.

Judge Birotte also ruled that validly obtained immigrant visas could not be cancelled, including those issued anyone from the seven barred countries – Syria, Iran, Iraq, Yemen, Libya, Sudan and Somalia – trying to enter the US.

Surprisingly I’ve heard according to federal judge order, visa ban is halted. Is that mean lottery interviews would continue? I know it’s a dilemma but I’d be appreciated to know your opinion.

No but seriously, I benefitted from the DV program (DV2014) and my brother did some 15 years earlier. He and I have made a good living from the USA, so we have much to be grateful for and I give back this way. You mention religion. I am very well informed about various religions, but I am not religious. I don’t care about or judge people by anyone else’s religious beliefs, so it is also pleasing to me that I can (as an atheist) be helping people of all religion – thus showing religion is not a good reason to divide us.

Hello Simon, thank you for the good work. Please help give your take on the this issue. My daughter’s passport bears 2 names which I used in the DS. However, a third name was added and she uses 3 names at school. Can I unlock and add the third name and process another passport and birthcertificate with all three? Note it’s not mentioned on the DS in other names.
You opinion means alot. Thanks.

The DS260 should match the legal name which should be in the passport and birth cert. If needed correct the DS260.
