A cautionary tale that illustrates the importance of accuracy when filling in the entry and of course the DS260. IN this DV2015 case a simple mistake costs Green Card for the selectee in Ghana.
Let’s call this gentleman John Smith. John attended his interview a few days ago and was denied his visa for a simple mistake that I believe to be nothing more sinister than a genuine error. The CO denied him because his original eDV entry (not the DS260, the online entry itself), showed him as having no first name – just a middle and lastname. In reality his firstname was in the middlename field.
The gentleman sent me some screenshots of his eDV confirmation page and his 1NL (the “you have been selected” letter).
The eDV shows his entry as Smith, John – exactly as you would expect.
The 1NL has his name (above the address and after the “Dear”) as “NFN John Smith” and “Dear NFN John Smith”.
Check out this image. There is a checkbox under each name, and the NFN is printed when someone has selected “No First Name”. These fields are process by computers, so I would be certain that the selectee made that mistake, KCC don’t retype anything. The Confirmation on the entry makes sense (i.e. not showing the firstname), and the first clue of the error was the NFN (No First Name) on the 2NL. However, it is OBVIOUS that is you provide a middle name, and say there is no first name, then the name provided as the middle name is actually your firstname.
However, all submitted cases are checked for duplicate entries, so they may believe that John Smith tried to enter with John as the firstname and John as the middlename (in a second entry). The CO could have put him on AP and put the case back for checks on John Smith, but for some reason he decided not to do that. The embassy/CO was particularly harsh, and the embassy is one (Accra, Ghana) that shows up as one with very high denial rates as shown in my league table .
What could he have done. Well if he had understood the critical nature of seeing NFN on his 1NL he could have contacted KCC and he could have possibly have got them to re-run the background checks prior to scheduling his interview. It might have delayed things but it would have diffused the issue somewhat. KCC would not have corrected the error itself, but they would have passed the case to the embassy with a file note explaining that both names had been checked. As it is, the selectee has lost his chance for the Green Card and spent money on the medicals and processing fee – not a small amount of money in Ghana.
The lesson for the rest of us is to take these issues seriously. I read time and time again stories from people such as “my brother knows someone that had that problem and he got away with it, blah blah”. Sure, some cases will be accepted with errors, and some won’t – but why take that risk on what is such a simple process if we just follow the instructions and take advice from genuine experienced people.

Hi Simion, sorry I didn’t understood the reply. Do I have to just send an email to kcc explaining and asking them to change my embassy location giving them the embassy or I have to unlock the ds260 and change it there ?
Note : I have unlocked the ds260 but couldn’t change the embassy location because it’s block. And the address which us there is my present address here with is present and previous addresses on the form. Pls can you give me a guide on how to go about it? Thanks

1. Unlock the DS260 (you have done that).
2. Change the current address to an address near where you want to be interviewed (in your case Cameroon)
3. Resubmit the DS260.
4. Email KCC asking them to make sure they schedule your interview in Cameroon.
Step 2 is because you cannot just select the embassy. KCC select the embassy based on the address they believe you are living at. You are planning ahead – and have not yet moved. I realize that – but you do not want to wait until you are actually scheduled to make this change…

I’m a 2016 dv winner and have been scheduled for interview in february this year. I have some few questions on my case
1. In my edv my I mistakenly interchanged my first name and my middle name. ie first name used in place of middle name and vice versa. On my ds260 I arranged them correctly as it is on my passport and on my High School School certificate. Can I still have a denial?
2. In entering the number of Educational institutions attended, I started from senior secondary school to my university without indicating my basic school. Can I correct it during my interview?
3. The Name arrangement on my university certificate puts my shows my first name first followed by surname and middle name. This arrangement does not match the correct arrangement of my name in my passport and high school certificate. However I’ve sworn affidavit at the high court to that effect. Can this affect me at my interview?

If I get selected I intend on using my high school diploma. But here’s the thing.
My birth name is Thi Ngoc Thao Nguyen
But my high school diploma is written out to Lyna Nguyen because for some reason I just always went by Lyna and most of my documentation was written out to Lyna.
However now I have since changed my name from Thi Ngoc Thao Nguyen to Shelly Tran.
Will this cause an issue?

1. If U correct a mistake u made in your entry concerning your name which stated as ( Smith, Andrews John) 1NL with Smith being your surname, John being your Middle name and Andrews being your first name. This name arrangement is also exactly what appears on my High School Cert.
However,
DS 260 corrected as Smith, John Andrews where smith is the surname, John, first name and Andrews middle name which is the arrangement of my name on my birth cert,passport and other supporting documents with the exception of University and Diploma certs which is also arranged as John Smith Andrews where the John (first ) Smith(Surname) Andrews(Middle ) An affidavit has been sworn to claim all the names at the high court.
Looking at league table , Accra is also the embassy with high denial rate,

There have been denials for this sort of issue – but only at embassies that deal with high levels of fraud. I HIGHLY doubt it would cause a problem in Sydney.

Paris is not quite as lenient as Sydney, but again – it should not be a problem. If you have corrected the names in the DS260, that means their background checks would have been performed on the correct name – and that is important. The only other issue comes when a mistake like that introduces doubts about the credibility of the selectee or the documents being presented. In the majority of embassies, the assumption is that people are fundamentally honest. In a small minority of embassies, that assumption is reversed. Paris is NOT in that minority.

I ama beneficiary of DV lottery which my spouse actually won, on my birth certificate my father has three names two being his name and the last one a family name but when we were filling the ds260 we omitted the last name, we did same on our marriage certifate and all other documents, in fact he stopped using the last name so we don’t add it to any documents we fill especially the DV lottery

What you should have done is corrected it on the DS260. It is now too late since you are scheduled. This may not be a problem, unless you are interviewing in Accra or a similar strict embassy.

hello brit i had my interview on the 25th february,2016 at the american embassy Freetown and i was denied on the bases of labour certification rule which i am totally against.before the start of the interview an announcement was made in krio saying -based on the eligibility rule which says for you to qualify for the visa all principal applicant must meet the educational requirement which is 5 WASCE,HND,HTC AND UNIVERSITY DEGREE or meet the work requirement which is 2 YEARS QUALIFYING WORK EXPERIENCE.with this two basic rules, i was unfairly treated as i meet both requirements as i am a degree holder from the institute of public administration and management(IPAM) and a banker for three years with client care officer as my present job title performing finance duties.
however,after the announcement we were called to window #2 for us to submit our documents i gave her my certificate in business and finance,diploma in financial services and my degree in financial services and she arranged it with my highest qualification on top together with my transcripts.i also gave her my employment letters with my promotion letter and salary increment letter.she asked me for my marriage certificate, passports,birth certificates,passport photos and police clearance and i gave her together with the photocopies.she cilped our passport photos onto our passports and i asked her whether i should include any other supporting documents to prove my marrriage and she said yes.so i submitted our wedding photos,our relationship photos before marriage and after marriage.i also gave her birth day cards,valentine cards,anniversary cards,facebook chats and facebook post before and after marriage.
applicants who were having problems with qualifications were asked not to proceed with the interview after reviewing their documents.

he walked out of the window with our passports and some originals of our documents and we both smiled but shortly he returned and gave us back our passports and original documents with the exception of my present employment letter,our birth certificates,police clearance,marriage certificate and my passport photos.he took out a white paper which says i was ineligible for the visa through the labour certification rule 212(a)(5) which i am against.
so brit i now see the reason why people forge documents just to match up with error form the initial entry.
friends don’t stress up too much about this lottery coz its a game of chance and it takes the grace of god to go through it.thanks a lot to the biggest man in the house britsimon.though i didn’t make it but i everything give thanks.

I’m sorry to hear of this denial. 212(a)(5) is used to describe any case where the education or work experience requirement has not been proven. Since you had qualifying proof I can only assume there was some concern about the date of birth and an presumption that documents were forged. It’s a shame.

The only Sch record I have now is my Sch results but the problem is my uncle who was sponsoring my education made me add his name to my name then But after Sch I stopped using the name because I had left his place, now on my school results I have 3 names and on my passport and other documents I have 2.. Pls can this cause a problem as am just a beneficiary, will the CO understand since I may not get the chance to explain to her ? Pls help

Many thanks for the good work. Just thinking about this scenario. Let’s say one’s full name as on birth certificate and passport is ABC, with A as the first name, B the middle name and C the surname. But for that person’s school certificates except masters certificate, the middle name is left out. Is that an issue? What name should be fully filled on the ds-260? Edv was filled with full name ABC as on passport and birth certoficate. What will you advise, please. Thanks

Me and my father has been using different surname. I have been using XXXX as my surname and my father had used XXXXA while he visited foreign nation and making passports. The same is mentioned in our citizenship too. My birth certificate which I recently translated in English language also mentions my surname as XXXX and my father’s surname as XXXXA and I have filled my DS-260 according to that. Will it create any problem while processing? (Though the spellings are different, both mean the same and when translated is written as same in my native language. For example both Ram and Rama are written as राम, it is just matter of preference.)

I was recently (15th March) denied diversity Immigrate visa based 212 (a)5 on winning with a name without a middle name and filing the visa application form (ds260) with a middle name as it appeared in my passport. I submitted documents baring both names I. E marriage certificate, secondary school cert. , employment letter all have the winning name. The CO sheet she gave me wasn’t addressed to me, date or her name. Later realised my police clearance wasn’t returned to me. I have gone ahead to make a statutory declaration on both names hence, do i stand a chance to get my visa and how do i go about it?

Last week i have taken V. interview at ADD. and the result was nice. after interview the co. gave me a yellow sheet that said “congratulations! You are approved to immigrate to US”. Co. gave me my original documents except my passport, two prevues original experience documents that i employed in different organizations and my grade 12 authenticated document. About Two months ago our visa status changed to ‘issued’ on Ceac website but have still not been called for our pp. could there be something wrong? Does it take that long to be called for your pp in Africa ? What should we do pls because we AV sent a mail already two weeks ago with no reply

I taught I could do so by email but they did not reply, and you know without appointment you can’t just go to the embassy, you will not be allowed to enter and the number on their website I understand is for only USA citizens, please do you have any idea as to how I can contact them ?

1. It is a good number? When could be our interview?
2. But what worries me most is the fact that I did a mistake filling the form about the education because I wrote degree instead of high school diploma. I immediately sent an email to KCC asking to unlock to modify this.
Do you think that can cause issues? We are both Italian but the interview will be made at Abu Dhabi embassy.

No. It is based on income. If the person presents savings alone, that number is divided by a factor of 5 (so $100k is only worth $20k)

In most embassies this would not be a problem as long as you have corrected the error on the DS260. Some embassies (Accra for instance) may still refuse you for this reason as they will suspect fraud.

the order of my names in my passport and birth certificate are not thesame. for example on my passport my surname is A and given names B while on birth certificate my surname is B andgiven names is A. And given the fact that you also have to present your birth certificate during your intwrview should i just continue and fill the DS260 form.with my passport information as it is required by the DS 260 form dispite the fact that it is different from my birth certificate in terms of order?. hi Brit Simon i have a similar problem as the one above. I wonn the 2017 lottery and my birth certificate and educational documents have my names as Acha Hope but on.my passport my order of names are Hope Acha and in apply for the dv lottery i used my passport information which is my order of names is Hope Acha and the DS 260 form it is said it should be filledwith information as it is on your passports. Please what do you advice me to do. My case number is 2017AF0027111. Do i stand a chance of geting the green card?

Since I used my passport to apply for the dv lottery and the message reads dear hope acha and the ds 260 form says you should fill as on your passport. I dont know if i should unlock because even if i unlock my names will not still be in order unless i go and do a new passport

One version is your real legal name. That should be in your DS260 along with any alias you have used.

Hi Brit. I wish to ask you if its possible to send and email to KCC in order for me to correct my order of names on the eDV form (dv first application). This is because my order of names on my passport and birth certificate are not the same. For example the order of my names on.my birth certificate is Hope Achau while on my birth certificate it is Achau Hope and because the person who played the dv lottery for me used but my passport info my order of names on the eDV form does not correspond with that on my birth certificate. So i want to ask kcc if its possible to unlock and correct the names before i proceed with filling the ds260. Because i also want to apply for a new passport with my right order of names

You cannot view, edit or even see the eDV. Just submit the DS260 with accurate info and be prepared to discuss the differences at the interview.

Hi Brit I have decided to fill the ds260 form using my legal names as the appear on my bith certificate then I fill my passport order of names where the is the other names ( alias) field then i will do an affidavit of name order change to show that the was an error in establishing my passport. If the officials made a mistake on your passport, you should get them to fix it. If you use the incorrect version as shown on your passport that will change your name as used in America, and be a nightmare to correct. You have time to sort this out to make sure your passport matches your reality as shown on other documents (birth cert and so on)

Don’t try to “do” anything that involves creating false documents. You have to understand that the risk of denial in Accra is high – ESPECIALLY when they suspect you have falsified documents. There is a risk in your case – but absolute honesty is the best solution.

Hi the DBrit I got selected for the DV 2017. I have just 2 names with my surname (christian) being my first name. Now in filling the E DV form I ticked no middle name and wrote my surname under last/family name. Now because the american system ur family name is ur last name i have a problem because my surname is my first name and not last and so after following the american system my order of names in the E DV form is Asah Christian instead of christian Asah as it is in my passport and birth certificate because Christian is my surname/family name and it is my first name where as when filling the E DV form I put christian under last/family name and Asah as first name because of the American name format. Now my winner confirmation came as congratulations dear Asah Christian because of the American format meanwhile it is suppose to be Christian Asah because Christian is surname abd first name. Please will this affrct my chances of being issued a visa during my interview?

Yes it could affect your approval. Make sure it is accurate in the DS260.
