***** UPDATE **** This form is no longer used. ***** UPDATE ****
This new form has been introduced as part of the government push to reduce immigration from poorer countries. I have created two videos, one that explains how the DS-5540 will be used to assess your risk of becoming a public charge, and the other to show how to complete the form.
Please take some time to learn about this new and important form. I expect it to become very widely used – so you should ASSUME you will be asked to complete it – and ideally take it already completed to the interview.

Hey brit, as always grateful for the work you are doing here
2020AF48***
1. I don’t have a current or recent employment history because i have been earning money by managing a very small family business for the past 10 years but i have a information systems degree from a recognised university. I graduated almost 12 years ago and i only have 6 months of employment history professionally. Do you think i should fill the i-134 form? My plan for when i go to the US is to go to school refresh my education and work in the IT field.
2.When i fill the DS-5540 and the I-134 form do i physically download the forms and take them with me to the interview or are they type of forms to be filled and submitted online like the DS-260?
March 10, 2020 at 19:01
1. You are mixing a couple of things up. You qualify by education OR work experience (Note the “OR”). Then you should have an I-134 – which is a separate issue.
2. Your sponsor completes the I-134 and emails it to you to present at the interview. You download the DS5540.

Hello Britsimon , I want to thank you very much for the information you are sharing . my case number 2020AF21xxx I was with my spouse. I was interviewed yesterday 9th march at the embassy in Abu Dhabi and my visa issued today. I followed your instructions to take along the filled DS-5540 form. At the end of the interview, the interviewer was handing our passport telling me an email will be sent with the DS-5540 form to be filled and for us to return another day. Thank God I had already filled the form I just told her I have already filled the form .she said oh… took it and said that’s interesting looked at it and took the passports and handed us the congratulatory white paper that says our visa has been approved. I want to urge everyone to do same by going with the filled DS-5540 form .Thank you very much once again I wish to give you a hug of thanks.i will share my interview experience in detail later. AMERICA HERE I COME
March 10, 2020 at 18:58
That’s great. You saved yourself some waiting by having the form ready. I hope others will do as you did.
March 16, 2020 at 06:17
Hi Colom,
I request you to please share the details of your interview experience at US Embassy in Abu Dhabi as I am expected to have an interview in the coming months.

My site covers dv lottery only.
March 8, 2020 at 10:59
Hi BritSimon ,
while filling the form DS-5540 do we require to collect documents like Bank statement ,Salary proof Property Valuation report and all the filled assets proof together with the form or just a Filled form at the Interview. As my interview is after 2 days i didnot have enough time to collect all of these. Thank you.
March 8, 2020 at 18:17
If tyhe CO requires theose things, you will be given time to supply them.
March 9, 2020 at 05:46
Thank you Britsimon,
Can we Include Provident Fund as a Assets or not?
March 9, 2020 at 17:14
I don’t know anything about that fund.
March 10, 2020 at 01:01
In Simple …it’s 10%of salary until you leave the job or retire and received after 1 month of leavi the job a security fund.
March 10, 2020 at 18:39
Lovely. I still don’t know.
March 8, 2020 at 09:19
Hello to you sir Simon!

1- I want to ask you if I was lucky to have an interview?
2- When filling my DS260 they advised me not to include my social networks. Can I ask to unlock my DS260 and the inclinations now or leave and during the interview I will explain them?
3- should I present myself with the DS5540 at the interveiw?
Please help me please.
Thank you
March 8, 2020 at 18:15
1. Probably. Wait and see.
2. Who advised you that??
3. Yes
March 8, 2020 at 06:34
Dear sir
Last Friday my friend have face to interview (embassy in Sri lanka) But they are not asking about DS5540 form.they asked only i 134 form.
March 8, 2020 at 07:55
I am also from sri lanka and they wont ask the ds 5540 for
March 8, 2020 at 09:49
Hi,
did you face to interview?
March 9, 2020 at 13:00
I am a Sri Lankan, but my interview was in Singapore. Singapore embassy specifically asked me to bring the DS-5540 ( informed to me via email). Never asked for the I-134 ( I never had one). Just fill it and take it with you, if they dont ask for it – dont give it. If they ask for it, you can give it there it self and save time.
March 8, 2020 at 00:19
Hi Brit,
I came across these instructions on public charge posted on the government site https://travel.state.gov/content/dam/visas/public-charge/DS-5540-instructions.pdf .
There is this section on who needs to submit the DS5540 that stipulates;
Only one form is required for a family that applies for their visas on the same petition, so long as they are interviewing as a family unit. For a family applying together, only the principal visa applicant needs to complete the form. The following immigrant visa applicants may be required to submit the DS-5540:
So if you are a couple how do u factor in contribution from spouse especially in situation where the principal applicant is not the main “bread winner”. Do you fill separately?
March 8, 2020 at 03:55
Given the form is new, and some parts of the form allow “combined” assets whilst income does not – having a second form causes no harm and may help.
March 5, 2020 at 17:51
Good day,
Thanks so much for the current update
kindly help me with the following below:
part-4 of ds 5540 form requires tax position, but if i have never been to the usa so how can i fill in such column regarding tax returns.
part-4; no:9 if i dont have no assets of the listed assets descriptions, will that affect my assessmen to ds 5540 form by CO.
Will u pls outlined the insurance company web address you said when explaining about the ds5540 so that it will help me to know which of those policies i can do my research before my interview and it has to be included in the ds5540 column provided.
Once again
Thanx.
March 5, 2020 at 18:33
Answer the questions simply, and truthfully. It’s not complicated.

March 5, 2020 at 15:48
Can someone who is a US citizen but living in Germany for the past 2 years sponsor you?
March 5, 2020 at 18:18
No.
March 5, 2020 at 18:54
Even if he’s there only temporarily and can prove US domicile?
March 5, 2020 at 19:05
Why take the risk?
March 5, 2020 at 19:16
Because I don’t know anyone else in the US…
March 5, 2020 at 19:51
Well it’s your choice whether to take the risk or not.
March 5, 2020 at 08:20
Hello Mr. Brit,
regarding the new form Ds-5540, my interview it is supposed to be on May (hopefully) but the emabassy of my country didn’t made any statement if there will be a request for additional documents. Normally should be an official notification to inform the public.
March 5, 2020 at 18:15
Well there has been an official notification, but ultimately the embassy can ask for whatever they want, whether you have been informed or not.
March 5, 2020 at 08:10
Hi sir,
I have filled ds5540 how can i submit this form
I have to bring to interview or i have to submit via online ???
March 5, 2020 at 18:14
Interview.
March 5, 2020 at 06:47
My daughter is15 and was handed a ds 5540 form. Do i need to fill than on her name or mine?
March 5, 2020 at 18:11
I don’t think a child is expected to complete the form.
March 5, 2020 at 02:52
What is the purpose of i-134? Is not a legal binding and what if the sponsor is low incomer? If the sponsor can’t match the public charge income like 60k (not exact number)per year for 4 person family is it better to not have it at all and just go with the new form? Looks bad if the sponsor is not earning enough
Any thoughts?
March 5, 2020 at 03:45
As explained in my videos, the I-134 is used in addition to the DS5540.
Your numbers are inaccurate, but having a sponsor who does not meet the income requirement is pointless, so then the applicant needs to show another sponsor.
March 5, 2020 at 04:43
Brit do you have the numbers somewhere? sponsor minimum 32,750(4 persons in family) and for us 65,500(4 persons family) in assets or income for Heavily weighed positive factors.
March 5, 2020 at 18:07
The link is in the article above….
March 5, 2020 at 04:46
Hlo Brit
Is it okay if in the place of signature on form 1-134 my sponsor wrote his name instead?? He did fill it electronically
Or should I resend the form for him to sign instead
March 5, 2020 at 18:09
Signature.
March 4, 2020 at 18:12
Hello Brit
I got me 2NL and I will have my interview on April.
There was nothing there asking me to complete DS-5540?
what should I do?
March 4, 2020 at 23:31
Complete the 5540.
March 4, 2020 at 17:20
Hi Brit thank you for the great work, I don’t have much money on my account but i have National Socials security fund savings of like 20k, which according to my country you receive it after you show proof of immigration. I have obtained a statement and forms that state and list it with and attachment stating that received upon immigration. I have an I-134 from my sponsor and i have also listed land with its value. Does this improve my chance. I am an IT professional and my wife is a also a developer.
March 4, 2020 at 23:29
Give all that information to the CO on your forms.
March 4, 2020 at 13:50
Hello Brit, thank you for all your hard work, I really appreciate your help. I have a following questions:
I’m a beneficiary of CR1 visa currently living abroad and I never worked in US. So what I should write in part 4 of the DS-5540 form, since it asks about U.S. federal tax and IRS transcript? Should I put 0 (never worked in US), or enter my income I earned in my country for the past 3 tax years?
Another question about the insurance after I enter the US: will the tourist insurance be sufficient?
Thank you in advance for answering, have a great day.
March 4, 2020 at 23:27
Answer the questions simply and honestly. The videos will answer your questions.
March 4, 2020 at 13:32
Hello sir,
I understand that my sponsor will fill the i_134 form and I’ll provide ds5540.
The first one is online and the second one is physicaly?
And is it obligatory to get those formularies?
March 4, 2020 at 23:26
Read the article.
March 4, 2020 at 08:08
Dear BritSimon!
In your article “All about public charge, affidavit of support, I-134” you said it could be enough for the family of 3 to have about 25K $, or about 10K per adult.
But now you’re suggesting one person with 50K$ in savings to get a sponsor letter, and even for my 70K$ you are saying I should be careful about getting my visa approved.
Do you suppose that the requirements went up so significantly since then or I got it incorrectly?
Thanks
March 4, 2020 at 23:17
This is all new. We don’t know exactly how they will implement the new rules.
March 3, 2020 at 23:26
Hello Brit. My interview was today, eventually the CO asked me some other documents that I can’t bring and she gave me back my passport. What do you know something like this? Your advice please.
March 3, 2020 at 23:29
Where was it? and which documents did he ask for?
March 3, 2020 at 23:40
Advice about what?
March 5, 2020 at 00:32
She asked my original baccalaureate attestation and i gave her its copy. I’m surely know that I can’t bring the original because it’s lost. Please tell me your advice?
March 5, 2020 at 02:42
I can’t give you advice unless you ask a question!!!
March 3, 2020 at 23:26
I don’t know what to do – I’m 27, just went out of med school, but I couldn’t work during my studies so I don’t have enough savings and also I don’t know anyone in the US who can fill the i-134 for me… Do you think my age and education would be enough?
March 3, 2020 at 23:40
Possibly.
March 3, 2020 at 17:15
Brit,
EU29XXX, Doing AOS. Is the D5540 only for CP applicants? For the AOS the equivalent is I-944, right?
Thanks in advance.
March 3, 2020 at 20:35
Correct.
March 3, 2020 at 12:52
Hi Simon, Should the DS5540 be filled electronically or by regular ink pen? as in electronic form there is no enough space for me to fit my long middle name!
March 3, 2020 at 20:21
Either way.
March 3, 2020 at 12:47
Hello! Thanks for your work. My situation is the following – My friend is asking me to borrow him 20K dollars, without them I woould have around 70K$ for the family of 3 (me, my wife and 3 years-old son). He is going to give me back the money as soon as I needed, but I am really worried about two things:
1) 70K of savings wouldn’t be enough for CO
2) Even if he give me the money back, CO could not to consider them “clean” even though we can have a signed agreement, because they could think I borrowed these money and lie about the agreement.
Should or shouldn’t I be worried about the insufficient funds in that case?
March 3, 2020 at 20:13
Obviously you have to be careful about getting your visa approved.
March 3, 2020 at 20:23
You once said it should be enough for the family of 3 to have about 25K $, or about 10K per adult. But now I saw you suggested one person with 50K $ in savings to get a sponsor letter, and even for my 70K $ you now are saying I should be careful.
Have you changed your mind in your previous article regarding the amount of sufficient funds or I got it incorrectly?
Thanks
March 3, 2020 at 10:57
Hi Brit, three clarifications:
1- in section 9 (available resources) can we insert the severance pay that the company where I work will give me when I move to the USA?
2- Can I also enter the value of my car?
3 – Since I am paying my car with a loan, do I have to indicate the residual debt in section 10? as you recommended, we will present two modules, one for me and one for my husband, not for my 1 year old son 🙂
thanks for everything!
March 3, 2020 at 20:07
1. No – because you don’t have it yet.
2. Cars are always a pain – they are depreciating assets, so only list it if you absolutely have to.
3. OK – you have a loan on the car – so it’s likely there is little or no value (cars depreciate faster than loans are paid off).
March 3, 2020 at 06:56
Hi Brit
My interview is in March 2nd week. As you have explained we have to submit the DS 5540 to the interview. But the problem is I and my spouse we both dont have any assets to show and our savings are very low. I am the main applicant and i am currently unemployed, will these things cause visa denial? But we have I 134 form and IRS, w2 from our sponsor
March 3, 2020 at 18:57
List your situation as it is. The I-134 will help, and perhaps your education and skills will also.
March 5, 2020 at 17:35
I can get a job offer letter from a small company in usa owned by a friend of mine. Is there anything else I shoud show with the letter? Or just a offer letter is enough?
As i mentioned i have I 134 form is there any need to fill a petition by the employer?
March 5, 2020 at 18:26
Is that a genuine offer of a job? If so you can submit it.
March 6, 2020 at 05:36
Yes it is a genuine offer. Could you please explain what do you mean by a genuine offer because other than the letter is there anything else to be done by me or the company to prove that it is a genuine offer?
March 6, 2020 at 20:47
You know it is a genuine offer, but you don’t know what that means.
What I mean is – “is it a real company, with a real job for you to do”. If they are a real company and they need someone to work – why are they not just filling that position with someone now? Why are they prepared to wait for you?
March 3, 2020 at 06:33
Hi Brit!
I just had my interview today in Singapore. It was successful and I would be getting my visas next week. Pretty much followed your page since day 1 and it had helped me alot! I will share my experience in the stories thread seperately.
Also, note that for my interview I was specifically asked to complete the DS-5540 before coming to the interview as a part of check list item. I had savings in my account and could support my case, so was not asked to submit any I-134.
Thank you very much for all the guidance that you had given to me! I wish you success in all your future endeavors!
March 3, 2020 at 17:45
Congratulations!
March 14, 2020 at 12:57
Hi Simon,
I am scheduled to have interview in early April, and I have finished my medical a few day ago. Now I am concerning about two things.
1. I am taking Psychotropic drugs once in a few days, and I told at medical check. Does it cause denial of the visa issuance? Of course, I don’t have any crime based on this or other reasons.
2. I didn’t prepare I-134 because I thought over $40,000 in my account is enough for my son and myself. Do you think I have problem at my interview?
Your answer and help is always appreciated.
Thank you.
Warm regards,
Aurora
March 14, 2020 at 15:06
1. If they believe you are dependent on the drugs, yes it could cause a problem.
2. You might be OK.
March 14, 2020 at 15:25
Thank you for your reply, Simon.
What if I am not taking the medicine by the time of the interview? Would it be ok?
It is the medicine given by doctor for Menopause as well, and it is categorize as Psychotropic drugs only used in Italy, Japan and India.
Is it still a problem?
Sorry to bother you many times.
March 14, 2020 at 16:56
The interview will take into account the physicians findings.
March 3, 2020 at 23:27
Can you please tell us how many months back was your bank statement?
March 5, 2020 at 23:32
I prepared 12 months of statements for my account and my wife’s. But they only asked for three months at the interview.
March 6, 2020 at 05:27
As you have mentioned you were asked to complete the DS 5540 as a part of the checklist before the interview, did you recieve that checklist by singapore us embassy or KCC?
March 3, 2020 at 02:17
Hi
embassy scheduled our interview this coming march 6, 2020 but we applied our visa last october 2019 Are we affected of the DS-5540 form ?
March 3, 2020 at 05:01
Yes
March 2, 2020 at 18:17
Hi Brit,
Thank you so much for your update.
Just one question;
Are derivatives to fill the DS-5540 or it is only for the principal applicant?
March 2, 2020 at 21:11
To avoid doubt, both can fill in the form.
March 2, 2020 at 14:50
I’m EU355xx, I’ve not filled this form but I’ve sent my DS and documents already. Will they text us to fill this new form?
March 2, 2020 at 20:48
No, they will probably tell you to do so at the interview – which is why you can save some time my going to the interview prepared.
March 2, 2020 at 14:15
Hi Brit,
Thank you so much for your good time spent just to help us for the whole processing.
Just one question;
1. Are derivatives to fill the DS-5540 or it is only for the principal applicant?
March 2, 2020 at 20:45
The form has space for a listing of derivatives, However, As the form is new, I would suggest a spouse could complete a form too,if the derivative spouse earns most of the family income.
March 2, 2020 at 12:53
hi Brit,
i was issued a visa without I-134,
will i be asked by custom boarder office at US for the I-134?
will i be asked public charge form DS 5540 by the custom officer?
March 2, 2020 at 19:46
No.
March 2, 2020 at 12:38
Hello Brits,
I received 1NL (DV Program) & recently submitted my DS-260 application and mailed necessary documents to KCC. Does my sponsor need to fill both I-134 and DS-5540 if I recieve 2NL? How do I receive filled forms (i.e. I-134 or DS-5540) from sponsors? Or they need to fill it somewhere in US?
March 2, 2020 at 19:45
The sponsor completes the I-134 and emails it to the applicant along with supporting documents.
The **applicant** completes the DS5540.
March 2, 2020 at 12:03
Hello! What I don`t understand is why they require a considerable income at item no. 8 in the 5540 form (specially for those currently being and working outside US). How in earth can they demand for an applicant from Asia, Africa or Eastern Europe (my case) to earn above the federal poverty level (~30k usd for a family of 4)?
March 2, 2020 at 19:44
It is a questionnaire to establish the position. They answer to some questions might not be so rosy – but that is normal. So – you fill in the form with accurate info and rely on the assessment of skills, I-134 and so on.
March 2, 2020 at 09:16
Hello Brit
I was is Interviewed in January 2020 and was given AP, but my visa was issued on February 28.
Does the public charge affect my visa at the entry port?
Should I fill the des-5540?
March 2, 2020 at 19:40
No
March 2, 2020 at 09:15
hello brit,
thankyou for your hard work.
information you have provided for us is very crucial and helpful for us.
thankx once again.
March 2, 2020 at 08:54
It’s funny that I live in EU country that avarage monthly paycheck is $450-500.
How can I have savings or property?
I’m DV2020 winner and me and my wife just want to go in the States and work.
We are working even for this money here since 18 yrs old haha…
This form is a joke.
March 2, 2020 at 19:00
Then it will be important to have a sponsor. Just remember that the COs are living in country – they are aware of local norms.
March 2, 2020 at 07:52
Dear BritSimon,
Should I mention my alimony payment in DS-5540 or any other forms?
March 2, 2020 at 18:55
Normally yes.
March 2, 2020 at 07:39
Hello brit,
Am case nbr AF35XXX current but haven’t received 2nl at this time,we’re the 2nd of March .
I’ve received a mail from kcc announcing that my documents are ok and am ready to be schedule for an appointment.
What can I do to be sure that avery thing is okay for my case?
March 2, 2020 at 18:55
If you received that email in February you don’t need to do anything more – you will get a March 2NL for a May interview.
March 3, 2020 at 10:42
For sure am not getting you sir,
That’s mean the March 2nl is not yet available?
And those who are current now can have their appointment on may not in april?
THANKS for answering me sir.
Am very confused and afraid.
March 3, 2020 at 11:33
March 2Nls have not been sent as they send 2nl in the second half of each month (15 – 31) and they send it atleast 6weeks befor
March 3, 2020 at 19:15
2NLs are sent out in the second half of the month. April interviews are already scheduled. So 2NLs sent in March are for May interviews.
March 2, 2020 at 04:50
Hi Brit,
My wife is the winner (principal applicant), however I, as a spouse would be the one to have my position being transferred to the States and get company’s healthcare insurance.
As a summary, DS-5540 will earn more positive points I it gets filled by myself as the derivative.
Could you please let me know who should fill the form? whoever it the principal applicant or may be the derivative who might have a stronger case?
March 2, 2020 at 05:55
I don’t know how they will manage these forms yet – but you could take forms for each of you.
March 2, 2020 at 04:47
Dear sir,

Maybe – it’s a new form, so we don’t know. However, I am already seeing cases on AP waiting for the form.
March 2, 2020 at 02:57
You claimed so many times that this new rule is only for those who are already in the US. Now you telling us that we need to provide this form at the interview? I said it a while ago that this will happen by the way.
Which countries are considered “poorer”?
Half of the form is for applicants already in US. What it this mess?
March 2, 2020 at 04:40
Oh man. I explained that the public assistance part would not impact most DV selectees since they were not in the USA. However, OTHER aspects of public charge ALREADY applied to DV cases and now are formalized on this form. For your information I have been telling people about public charge since 2013.

This is downright appauling. This form seems to fit all green card categories BUT DV. This visa is not granted based on a job, special skills or anything like that. I’m personally only 28, just finished my phd. I’ve been a student for the past decade so no, I never had a high income job. I don’t have any assets (how many fresh graduates of 28 have assets??). I don’t have a US health insurance or a job offer because I’ve never lived there! Therefore, I obviously didn’t use any public benefits. So other than my age, my health and being educated I have no positive points. Is it ok, in the eyes of the CO, to be a fresh graduate who just came out to the job market? Or do I have to be a rich middle aged man with 20 years of job experience and 3 houses in order to make it? Urgh.
What are the chances of this BS to be blocked again by some court?
March 2, 2020 at 00:26
This won’t be blocked – it was already argued and the form is the result. You should get an I-134 and show a positive attitude about finding employment in the USA.

Hi,
My wife and I have 50K on our bank statment, in addiction to that, we have a sponsor, who will fill the l-134 form. He’s a millionaire .
Do you think we need to do this new form? ‘Cause we are both 24years old and actually we are still studying, we saw some questions of this form and they are also about our annual salary, and we can’t answer to that in this moment of our life because we don’t work! Thank u
March 2, 2020 at 00:24
Yes you will need the new for AND the I-134.
March 1, 2020 at 21:48
Just a quick question regarding the education and skills part – is a veterinarian considered a skilled job? And if so, do I fill in the license number etc.of my home country? Because obviously I still don’t have a US license…
March 2, 2020 at 02:05
Yes. Give whatever details make sense.
March 1, 2020 at 21:47
I’m from EU country that everyone gets approved and no one been asked for i-134.
I don’t have i-134 for interview.
I don’t need to fill this, right?
Regards
March 2, 2020 at 02:06
Yes you do, and probably an i134.
March 1, 2020 at 21:32
Hi Sir
As I told you before we have scheduled for interview on 15 of March, and do we need to fill this form or what ?
Thanks
March 1, 2020 at 21:23
Thank you for the very useful video and clarification.
My inquiry about Question No. 9 (List of Available Assets) assuming that the DS-5540 Form in the name of the wife as she is the main applicant in the DV, but the husband also has some property and bank accounts in his name, are all these assets and properties merged into one form or each of them provides a different Form
March 2, 2020 at 15:52
@Brit, i have ☝️same concern.
March 2, 2020 at 16:03
Hi Brit I have similar complain
I am the principal applicant… Still a student (have been for the past three years) as concern income statement am blank but my husband is the worker (since it’s a monogamous marraige
1)should I use his instead??….
2) even fixed assets and account statements is in his name

Everyone needs to use a little common sense to show their own case in the best light (whilst being truthful). So – if a derivative spouse is the main income earner, have him/her complete a DS5540 also.
