Hello Brit, congrats on your work! I am a 2018 selectee. When i filled the registration in October 2016, i misunderstood the QUESTION 6 (Country of Eligibility for the DV Program) and even though i am born in a country that is eligible (Greece), in the question :-“Are you claiming eligibility based on the country you were born?” I chose NO. And further it said: -“If not, you must enter the country from which you are claiming eligibility.” And here i have chosen the same country as the country that i am born (Greece).
Is this going to be a problem?
Can this affect my interview?
Do i disqualify for this?
Do i have to bring to my interview any additional document?

i have a question – last year i was for the first time in US to activate my green card. After 2 weeks I went back to my country to finish all businesses. Unfortunately I was in my country for almost 11 months. Now i would like to go back to US, will there be any problem if I go back after 11 months and I will fly to airport different that my port of entry (POE) which was Chicago? I have a cheaper flight now to LA and would like also to spend few days there before flying to Chicago.

Hi I won the dv 2018 BT I make some mistake during ds260 form that before I play the dv I was single and in between of that time I got married.. and after that I came to know I won the lottery… So for second letter processing I change the surname .. my first form surname was pandèý and for second processing I put the surname pandèý thapaliya because after marriage in my passport my surname was this only so sir I worried regarding this it would be a problem for my processing sir ?

Dear Simon, I did my interview and they gave me a form with 11 questions and asked me to answer and will email them. One question is about “Dates & countries of all previous travel abroad”. My question is:
Shall I mention all travels that I did with my own passport? because when I was under 18 years old, I had some travels also. But, I didn’t have my own passport that time and as a child I was in my father’s passport. Shall I mention them also? If yes, the problem is my father don’t have his passport till we know which dates and countries we visited when I was in his passport. Whats your idea, which one I have to mention?

You could submit about 11 months from now and still get an interview.
The DS260 doesn’t normally affect ESTA travel.

How do you do Mr.Simon,
As I mentioned before I am in AP (Section 221 (g) of INA) but visas issued to my family members. My wife is Principal Applicant. This is my forth month still waiting, they said my case is pending. My wife and two young kids cannot travel without me and unfortunately their visas coming to its end, expiration date on July. If they will not issue me visa till July, their visas will expire. I wonder, what the next procedure is after their visa expires?
Also they still keep my passport and following is their last reply to my e-mail;
“Thank you for your inquiry. As we informed you earlier, the additional interview will be scheduled upon completion of the administrative review. Unfortunately, we are unable to provide with information on the date of completion. As soon as we receive the results we will schedule your husband for additional interview.”
If I receive the visa after completion of the administrative review, which is after July, will they renew visas of my wife and kids? How about Medical Screening? Will they be for free?
Could you please give us detailed information as you could or direct us to the link which we could find enough information, including any extra charges?

Your wife and children must use their visas before they expire. They will not be renewed.
If your medical expires before the approval, you will have to pay for the medical again.

I won the DV lottery 2017 and got immigrant visa stamped on my passport- I am planning to travel for USA for few days to activate my visa and travel back to my old country to sale my house and resign from my job and get my pension and then travel back to US to start looking for job:

Your DS260 should match your passport/birth certificate (if your name has not changed). If that is correct – there should be no problem.

My wife’s application was selected in the lottery, but there is a problem.
On 27.11.2015 we had our second child born.
In 2016 when submitting application for 2018 DV program, we didn’t add our new born child to our application (I got to computer last days of application, had no time to take proper picture of a baby…well I do understand that it is our mistake and problem).
I do understand that according to instructions I am going to be disqualified at the interview.
But I’ve been reading about the issue and still couldn’t find 100% answer.
I would be happy to hear your opinion.
Is it worth to give it a chance and spend time and money to prepare all docs and go for interview with council and try to explain to him, that I had no intention to hide any information from US government and it was a mistake that I didn’t include newborn into application? Taking into account that child was less than one year old at the time of application.
Some legal advisers ask for money to support application and see some chances of success. Personally I don’t see what they could do extra to what I cannot do my self.
Or it is better to give up on it this time, and take our chances next time with correct filling of application?

Denial is 100% certain. There is no point in proceeding, as it would be a waste of time and money. There is certainly no point in paying anyone else to argue on your behalf, the rule is inflexible.

Today i just got the I-134 form from my cousin in USA. Everything was fine except my birthday date. Since US birthday format(mm/dd/yyyy) is different from the one in EU(dd/mm/yyyy). So for example instead of writing 07/03/1990 he wrote 03/07/1990. Everything else was fine on the form. Do you think this will be a problem during my interview? My interview is next week so they can not resend me the form because there is no time anymore.

i won the DV 2017 in France.
The interview with the CO went well and with my wife got the visa approval on May 17th.
Knowning that i did a mistake on chargeability, but it was accepted by the officer as in the same region.
i got a call 5 days later by the French embasyy warning me not to plan to leave for the USA yet. She said that because of the chargeability issue, there was need for a check by Washington and that they will decide.
I am very confused and worried because i never heard of such process.
What do you think of my case?

OK – then there is no problem. They are obviously getting a secondopinion on the rules – but you are covered two ways
1. Forgivable mistake based on wrong country in the same region
2. Cross charging to country of spouse.
In the second option they might want to treat you as a DV1 principal – but just relax and wait for their response.

Hello Brit.
My fiance was selected for further processing for the fiscal year 2018.
At the moment of the E-DV submission we were just engaged, NOT MARRIED, so logically in the E-DV form she applied as SINGLE.
After the 2nd of May that we got the news that she was selected we realised that in order to continue the process together we must be married in order to fill me in as a SPOUSE.
Even though we had plans to get married another time, this changed our plans. We got MARRIED after the results (2nd of MAY 2017) and she is the PRINCIPAL APPLICANT.
*THE PROBLEM is that when we got married she chose to use MY SURNAME after the marriage (X) not her maiden surname (Y), in which she initially filled and applied the E-DV.
1- Is it going to be a problem that she filled the E-DV with her maiden surname and also the 1NL has her maiden surname (Y) , but now she results with a diferent surname (X) (the marriage surname)?
2- Does this by any way risks the case?
3- Is the procedure that we followed the right way, i mean that we got married after the results to fill me in as spouse and so, to continue from now and on the “further processing” together?
4- Do we get to the interview together, and if so do we have to bring any additional documents for the reasons that I mentioned above (marriage after the results and the change of the surname)?
5- Do you thing that we complicated the case with the change of the surname?

Obviously you have no choice but to replace the documents. BUT – A lot of documents get “lost” in Ghana – and consequently the COs are suspicious of this…

Aussie here and we won the DV18 lottery. Living in the states and currently working on H1B. My employer has been working on the green card for me anyway, but its such a long process, we are only at the stage where we are waiting for the DOL to come back with prevailing wage. I am approx. OC002600
1. Do you think we should continue down the path with employer green card given we are at the back of the queue for OC? I want to change jobs, so feel obligated to stay – Feel like being at back of queue means small chance we will even get an interview

Holy moly. Yours is an enormous case number. If it isn’t a typo, it’s the highest I have heard of for OC. Honestly – I think you should continue with the work based application. If the DV application comes together, you can switch later – but it won’t be for at least a year from now.

They have selected far too many people. They did the same in DV2014 and DV2015. In DV2015 they cutoff the numbers at 1490.

Hi Simon,
I’m an Australian selected for the 2018 DV lottery. My concern is that I used an old photo for my entry (idiotic, I know, but after 8 years of entering I got complacent). The same photo is in the E3 visa in my passport, issued June 2016. So if they check the date I entered the lottery against the visa issue date, the photo would be seen as six months and 1 week old. If they were to compare it against my online DS-160 application for that visa, the photo is just over seven months old.
However, the photo itself is actually several years old (I still look the same) and I cannot for the life of me remember whether I also used it to enter the 2017 lottery.
1. Is there any way for me to check which photo I uploaded for the 2017 lottery?
2. Given that their document says an old photo MAY lead to disqualification as opposed to WILL lead to disqualification, suggesting the possibility of leniency, is AOS or CP likely to be kinder?
3. In your experience, how likely are they to check? Do you know of cases of being being disqualified due to old photos?
4. If I were disqualified, would I be able to appeal?
5. If I go with CP and my application is disqualified, is this likely to affect my chances of re-entering the US (despite having a valid E3 visa)?
I have no convictions, medical issues or anything else that could potentially disqualify me.

He must be honest in the form. If he is honest, there might be some question, but similar case I have known have been approved (although they have been delayed by some months).

i had been living with man for some years,here in my culture(africa),when u live with a man for long,you are seen as husband and wife…both our families knew eachother … so i filled in “Married” in D.V including him, but later after…he got another wife and left me……we dont have a divorce papers since we were not “Legally married” before….. luckly i got a new man later and we married officially before results came back. i won the greencard 2018.. should i include my new husband..on my DS-260? how do i explain about my former relationship?

They will probably be suspicious of the previous marriage, and will want divorce papers. If you married since May 2, they may be suspicious of this new marriage.

I did my interview and before interview had started, I asked officer to correct 2 mistakes in DS-260 form. one, wrongly for my Diploma I added all 3 years of high school instead last year study(for example 1995-1998 instead 1997-1998) and the 2nd was pre-university degree which wrongly I added 2 years instead 1 year.
Officer first says she doubted can corrected the from there and it seemed it was ok from her sides. I didn’t get finally she corrected or not. Then, she gave me a form with 11 questions. One of questions was about my CV and another one asks my educational history.
Now, I do not know which dates I have to mention and will send to them? The dates I wrote in DS-260 form (which I am not sure she corrected or not) OR the dates which is correct?

I have some problems with docs and im about to sumbit the DS260, somewhere in July of 2017.

Does it make any difference if I submit it now or in July? Is there any problem could occur?

ALWAYS add the year to the case number. If this is 2018 – there is no rush to resubmit as you will be waiting about a year anyway.
