Does the CO look at the company size you work before or they just want to know that you had the experience??

Hi Simon!
I have a question, if you could help…
A friend of mine is filling in his DS 260s and we are confused about the following question:
“Is this child immigrating to the U.S. at a later date to join you? ”
Backstory: He has a previous marriage and a 15yo son from it. He married a second time and his son is noted in both DS 260 – his current wife also put him in hers, as it explicitly said “step – children”.
Anyhow, the boy wants to graduate from high school here in Bulgaria, so he will not be immigrating with them straight away, he’ll stay back with his mom, the plan is for his father to fill in a petition for him once in the US, so the child could join him after graduation.
For this reason, in the DS 260 they have replied:
Is this child immigrating to the U.S. with you? NO
Is this child immigrating to the U.S. at a later date to join you? YES
The concern is that the child is still present in the CEAC website and listed as “ACCOMPANY” in the DS 260 status.
Given the circumstances, can you advise whether this is correct? They are not planning on taking him to the interview, but they have completed the IV application for him.

Two things. The answer for that question should have been no, but the incorrect answer won’t in itself cause a problem.
They were correct to BOTH liost the child on their own DS260’s (step children should be listed), BUT they should not have created a DS260 for the child. The DS260 is an application for an immigrant visa. The boy can be sponsored later if desired (while under 21 is easiest and he must be unmarried).

Once the DS260 is created it cannot be removed. So yes, they simply attend the interview without the child and explain.

dear simon ,my question is on job part, previously I have been employed by a government university for position of Lecture in the field of social science but due to government decision our university separated into two universities so our documents were transferred to the new university. and the earlier university didn’t give us any work experience thus my work experience will be handled by the new once…they (new university )said that they will write your past and present experience by their logo…am a bit confused coz if I mention my previous experience I don’t have my past logo is simply already included within the new one…in the name of university transfer…how can I defend this during interview time…am worried sir?

Someone can show they were born in a certain country because their parents were sent there temporarily – usually by some international employer/organization. However, the stay needs to be temporary – and it sounds like your parents moved to the UK.

1. & 2 CO = Consular Officer – who will decide the outcome of the case.
3. The proof required depends on the job, but basically proof to align the job being done to a specific role on O*Net

1. Yes the passport and DS260 should match.
2. If you marry AFTER you have your visa you would have to sponsor your new spouse through family based immigration (which takes around 2 years)

2. You can sponsor a spouse as a Green Card holder – it takes about 2 years.

Hi Brit,
I have my interview scheduled in August but there is a one thing that really bother me. When I filled out the Diversity Visa Entry Form I made a mistake when using auto-fill and replace my name order ( put first name instead of last name and last name instead of first). I put everything in the right order when completed DS-260.
Is it can be a serious problem on the interview ?

I arrived in US 2 weeks ago and I paid my immigrant fee ($165) for my GC more than a week ago. I know it takes approximately 2 to 3 months to receive my GC after paying the immigrant fee. My question is, while WAITING for the GC to be received physically, am I able to work legally? Or am I only allowed to work after I receive my GC? If it is legal to work, do I just have to show my passport to my employers? Btw I already received my SSN couple of days ago. Thank you.

Yes you can work legally. When asked about your authorization to work, you explain that you are a Green Card holder (LPR). They will want proof to fill in a standard form called an I-9. The endorsed visa in your passport is sufficient proof (specifically listed on the I-9 instructions).

Hi.
Some question about the delivery address for the GC.
When we first enter US we will live in a hotel. So I give this address as a residential address.
I give an address of friend to send the GC to. My name doesnt appear on the mailbox. If we are three applicants.. each GC is sent in different envelope or all in the same? Is there an option so that the name of my friend will be on the envelope instead my name?

The education minster wont allow to change my high school certificates into my ” Yonas Hadush Hailesellasie” which exists in my passport, birth certificate, and degree certificate…i am from Ethiopia and i list “Yonas Hadsh Hailesellasie” on the section “have you used other names?” But i did not list the second name they mistaken that exists on my 9th,10th certificate
1. Should i list it(9th,10th) as the second name i used besides the original??
2. Or should i leave as it is? That is only two names, the original and the mistaken name on 11th and 12th?
3. As you see the spelling error is on the middle name not last name and given name, do you think they will make it a big deal on the interview?

It doesn’t matter where you arrive/live. Just update the address when you arrive at the POE airport so your GC is sent to that address.

1. If YOU are the principal selectee you can continue. You don’t need to divorce for that, just explain that your spouse won’t be seeking a GC for now.

Please Simon, i want to ask you about i-134 form . my aunt is married and has 3 kids and she owns the shop. my uncle-in-law is worker in company. can you tell me should my aunt fill i-134 form or should my uncle fill i-134 form ? or they both should fill the form and send to me ? thank you for your answer . good luck to you

Probably him. It’s easier to prove income as an employee, and in anycase he might file taxes jointly.

Mr simon Thanks a million, without your posts I might not be aware of my mistakes especially after reading carefully your sample d250 I clearly understood my mistake for my first question u have already about Masters add case secondly. I also made mistakes in previous experience work case
3since I have submitted ds260 more than a month ago so when I send the unlock case
does the time can have an impact on the case what if if they have already checked it so are they going to compare the correct one with the incorrect one,?Respectfully

I am from India and working on H1B visa since 2012. My employer also applied PERM for me in May 2016. I got married this year on April 2016 and my wife is a citizen of Nepal. She got selected for DV 2017 and we have submitted DS260 including myself as derivative. My question is –
1. Can i bring my wife on H4 Visa before DV 2017 interview. Will it create any complexity for Visa approval.
2. Should i wait and directly bring my wife after DV interview which is expected to be in April/May 2017 as per last few years trend.
3.If i apply for H4 Visa whether i should schedule a visa interview at Kathmandu ,Nepal or any US consulate in India.

1. You can do that.
2. Better to bring her on H4 and do adjustment of status.
3. Wherever she lives.
