Hi Brit!
I have a question. My fiancé CS is EU44XX, unfortunately we’ve already sent the DS-260. We are getting married 10th of August. From what you’ve told us there is a huge probability that my fiancé will get invitation before ceremony. Can we unlock the DS-260 to delay the invitation? We have to change the embassy for interview either way, is it going to work out? Also question about documents, I have read that we need a notary confirmed copy of birth and marriage certificates can it be in different language than English and after that translated?

Unlocking probably won’t delay, BUt there is a chance that your number won’t go current in the first month, which would buy you some time.
Depending on your country, notarized documents are not required. Translations are required, but since you show the original and the translation you don’t have to notarize.

Thanks Brit! From your FAQ I’ve read that if we will get NCLs, we will have to contact embassy instead of KCC, is it the main difference? We are Polish citizens but we live currently in Dublin. In DS-260 we selected Dublin for interview but we want to change it to Warsaw. Do you know where I can check if they will require notarized copies?

My case number is 2018AF26XXX (current in june) but I submitted my DS-260 recently, by the end of May 2018.
My future spouse and I are both french but I was born in AF. We’ve been together for 15 years in France and have 2 kids, but we’re not married. The wedding is scheduled in July. As it will be very late, I prefered to submit my DS-260 as single with 2 kids, without my future spouse.
1) As far as you know, am I very likely to be scheduled for an interview (in France), or did I submit really late ?
2) Do you think I should add my spouse’s ds-260 after the wedding and risk to be delayed and never get scheduled ? Or would it be better not to add her (and only update from single to married) and then ask for a family reunification ?

1. Likely, not certain.
2. You have made things very difficult – you should have married earlier. It will take 2 years to complete a family reunification process. The timing of the wedding is critical – but all you can do is immediately contact the embassy prior to the interview and ask them if it is possible to add your wife (once married).

Hello!
I have heard that in the interview they ask: Have you had any problems with the police? … but do not specifically ask.
I believe most of it had to do with the police for cases of fines, violations, penalties, and so on.
What answer can you give when I do not know what the question is about? (I have been condemned for forgery before but I’m forgiven and in the testimony I find it unfulfilled + a recent accident happened and I got innocent too)
Should I declare both of these cases?

Brit my wife was DV lottery winner of 2018 she was below number 30 in south America, we submitted everything by mid November, we received in December RFE from USCIS Orlando, we answer in mid January, starting February we received EAD, and so far we have been waiting with no updates so far. Do you think we can call KCC or USCIS?

Recently I have read at official USCIS web site that starting from May applicants must present identification to sign for their documents upon delivery (https://www.uscis.gov/news/news-releases/uscis-begin-using-more-secure-mail-delivery-service).
In my case I plan to visit US and after few days go back to my country. I have mentioned my friends home address on ds260 form. He will send documents to me after delivery. Should I fill in PS Form 3801 ?(https://about.usps.com/forms/ps3801.pdf)
Unfortunately I could not find any sample “PS Form 3801” on internet and dont know how to fill in it accurately.

Hi there,
My husband and I went to the US last week to “activate” our green cards and finally got our visas stamped (Do you want me to post a feedback about it since it was a pretty stressful situation?).
Just one question; I read that some people had to go to an office and sign a paper at the aiport but the immigration officer did everything in front of us and stamped our visas but didn’t make us sign anything.
Is that normal?

Right, but I read that some people were taken to a room at the airport to see an immigrant officer and sign papers for the GC (people from France who won the lottery had this experience at JFK airport).
So I wondered why we did not sign anything.
It was stressful because the officer welcomed us saying that it is not normal that we came only to have the visa stamped and go back to our country after, and that we should stay and we could loose our PR status doing that. He said it is because of people like us that the lottery will change soon and that we did not deserve our green cards.
We explained that we need time to move and said that we would definitely move before a year but he did not seem to find this fair. I was a bit shocked hearing that but I guess it is his job putting pressure on people to make them understand that they HAVE TO live in the US.

Hello , I need your help. I saw online that my case is being refused , before that they requested a document to prove that I have a high school degree.
I gave them my American high school degree but they don’t believe it’s real even though my diploma is accredited by the NCA CASI, I don’t know how to prove that my diploma is genuine even though it is.
They won’t let me speak with a consul to explain my situation.
The employees have been trying to delay me on purpose for the last 3 month even though all my papers were good and I had a US visa before.
They put me on AP and didn’t tell me that they did it for a missing paper just to delay my case as much as possible and when I kept insisting that they tell me what’s going on they told me that my graduation certificate is not bonafide so I got a new one and legalized it from all the places and gave it to them, now I see they refused my case.
What should I do I am sure that I have all the right papers and I swear my diploma is a real American high school diploma I even took the SAT exams as well.
Is there a place where I can contact that can help me ? Or should I speak with a lawyer ?
I don’t mind if they refused me because I am missing something but I feel they refused because I am not a European citizen and I am applying through the American embassy in Hungary.
I am Egyptian ( the consul on my interview saw all my papers and he accepted them all , he also was very respectful, but the Hungarian employees in the embassy were trying to delay me and ignore me all the time )

There is no appeal process – you had a chance to provide proof – and failed to satisfy them. There is nothing you can do.

Eligibility Requirement #1:
• Were you born in a country whose natives are ineligible, but in which neither of your parents was born or legally resident at the time of your birth? If yes, you may claim the country of birth of one of your parents if it is a country whose natives are eligible for the DV-2019 program.
Based on the above, I entered using my mother’s country of birth and nationality.
My Questions:
1. What should I expect at the interview to prove my eligibility.
2. What should I present to prove my mother is from an eligible country? She has a state-issued national identity, passport and historical documents like her baptismal certificate.
3. What should I present to prove she’s my mother? I should be too happy for a straight DNA request.

Yes – the rules are crystal clear and I have been interpreting them accurately for years. Based on what you have said, you are NOT going to be approved, because your father was born in the ineligible country, so you cannot claim the missionary exception which is described in the quote you gave. But you are welcome to test that for yourself.

my mom got selected last year, and my dad me and her sent our ds 260 forms, which are now at kcc. if our number goes current it will be in september, but in september i will provably be in usa on h2b visa. i was under 21 when she was selected but now i am 22 so there is no way for me to get a green card with my parents as i am too old now. so what could happen if i dont show up on the interview in september, because i am i usa at the time? would it affect my parents? thanks

My case number is around 22***. And it will approximately be current next month. So, I know it is late to ask something like that, I’m sorry for that. I’m a university student right now, I had 2 obligatory internships that my university was asking me to do. They both lasted 20 work days and they did not require any experience. I did one of them in 2016 and the other one in 2017. I am realizing that I did not write them down to the “Were you previously employed?” part. Should I unlock my ds-260 and change that mistake? If I do unlock it would that cause a delay for my interview date? I’ve recently heard something like “If you unlock your ds-260 it will not cause a delay on your interview date since dv-2018”

You need to be clear what countries were are talking about. You should have entered with your country of birth – and cannot charge to your parents country of parents country of birth except in certain circumstances.

A straight answer about the countries would have helped. However, no – you cannot charge to your mother’s country. The rule to charge to your parents country is when you were born in a ineligible country which your parents were only in temporarily and NEITHER of them were born in.

I have a question for which I have already received an answer from you some time ago, but I just want to make sure I explained myself right. So, I have fully completed high school in due time and received a diploma for it. High school here lasts 4 years and I attended the first 2 years in one school and the next 2 years in another one (my family moved from one city to another). Theoretically and practically it is like completing the 4 years in the same school since the academic program is exactly the same (there is only one unique academic program for all high schools here) and only the name and location of the school changes. Furthermore the final graduation certificate, which was released by the second school, includes all the 4 academic years. In the question regarding the number of institutions I attended which is the best way to present the above?

1. The first one is about the skilled or unskilled labor question. I’ve read the guide, I know you had wrote that it would not create any issues, and, actually, does not matter how I answer that. Just want to clarify: if I get a job offer before the interview, the answer is definitely “yes” in this case, right? Or it still doesn’t really matter even if I have an offer?
2. All the street names (places where I lived, companies and educational institutions addresses, etc.) are Cyrillic. Same as companies names. Should I write them in Cyrillic, or should I transliterate them to Latin according to the rules, or should I ask a accredited translator to transliterate them?
3. In this one I’m not sure, but I remember something that you should get not only from the country, but also from all places you lived in the country. Was it about police certificate? Or I am even confusing something? Is one certificate from the country enough? Yes, it should be, because a database for whole country is common, right?
4. I’ve seen your answers, and I 99% sure I am able, but will ask again just to ensure: if I am in 2019 process, can I still apply for 2020?

However I can not enter some critical info about my education and business life.
DS2-260 form always says “name of (everything including city, university) is invalid”.
I have written to Kentucky Office, but they say my case is transferred to related department.
What should I do now? Keep on waiting?

My case nr. is 2019EU15XXX, I was born in Spain but lived and worked in Finland for the last 7 years, so I applied with my Spanish passport and will do the interview at the Finnish embassy.
Now I’m planning to apply to get Finnish citizenship (Finland is also a DV EU eligible country) so I would be holding dual citizenship (both countries allow to have 2 passports), and my new Finnish passport would be granted during Q4 2018 or Q1 2019.
I submitted the DS260 application claiming that I only have one passport, what could happen if I get granted a second one just before the embassy interview? What do you kindly recommend me to do?

Hey Brit,
I asked you a question few days ago and you answered ”there is no usually” times vary. So I want to make it more clear so maybe I can get more clear answer.
Me and my wife had our interview on 29th may in Almaty, Kazakhstan. The CO asked us diferrent questions about our relationship and we answered clear and he asked us even seperately but we had no problem with that, our answers were clear. So at the end of the interview the CO asked my wife to send them our photos to their email adress which were taken before marriage. ”Proof before marriage” and we did it just 2 days after that. My questions are:
• Do you think we get approve or not?
• How long does it take to get an answer? as It’s only our photos which were missing, all other documents are okay and they have translations and copies.
• the paper the CO gave us after interview, it’s written there that any missing document should be sent till the end of the month but we was a bit late, like 2 hrs. It was around 2am 1st june. Can It cause us a problem?

4. Winner who has higher number than mine, if they submit the DS-260 earlier than me, they will get the interview after me according to visa Bulletin?

AF 404##. on filling the ds260 i was asked were u employed before? i said no but was working with a company before my current employment. i said no because i didn’t had the details but now i have. i hope to go current on June vb.
1.can i unlock ds260 to add former employment?
2.if i don’t could it bring serious issues?

Hi Brit, I have my interview this week in London but unfortunately there is a 4 week backlog for medicals 🙁 I have my medical in 2 weeks and tried hard to contact the embassy – but alas no response. I also couldn’t find a way of rescheduling my interview. I’m not sure if anyone has been in such a position. Looking at previous posts I see that it is recommended that the interview is attended and you let the consular officer know. I contacted KCC but they said they don’t know- every consulate is different. Based on your years of hearing experiences – will this be a problem? 1 last thing , (working on the assumption) I will be denied “pending receipt of medical”- will they keep my passport and would I need to be on top of them to ensure it is processed. Many thanks, I’ve had a stressful year regarding this and will be so happy (assuming) I get it xx

I have known people follow up with a medical after the interview because of scheduling problems. Do that – do NOT reschedule the interview. You will be placed on AP – 221(g) refusal pending the medical.
