Thanks for all the great work you’re putting in!
Question: we were selected for DV2017 processing; we filed mid august ’16; on the original lottery entry, I only had space to fill in one middle name; the e-form also mentioned to provide the middle initial (even though I have 2 additional first/christian names by birth). On the DS260 I could also enter my 2nd ‘middle’ name, which is also printed in my passport, so I did as the instructions here were to file names ‘as they appear in the passport’.
I’ve lived in the US before and have always used only one middle initial (for the same reason as on the lottery entry form: no space for more initials).
You expect issues or is there anything I should change on the DS260?

The legal name in the DS260 should match the passport (which should normally match the birth cert). If it doesn’t match, change it.

If you are trying to create a history you have to put each school/stage as a new item.

Complete the DS260 with the correct date. You cannot correct the original entry.

It could possibly affect the interview – it is up to the CO.
You can delay submission of the DS260 until April or May of next year if you wish.

I was wondering if you can help me with my US visa. I won the the DV lottery 2016 and i went in for interview and now my case is on Administrative processing and i am running out of time as the program for this year closes on 31 September.

Unless the AP was because you missed some document, there is NOTHING you can do that will speed up the AP. Typically AP is for background checking, the embassy do not control the speed of that checking and they will not issue the visas until the checks have been cleared. No lawyer can help with that. You can only wait. Good luck.

That sounds like a mistake on the original entry. If you cannot correctly claim an AS region number there is absolutely no point ion continuing – as it would be certain disqualification. Why do you think you have an AS number?

Medical test first. You present the report at the interview, BUT the visa will be dated based on the medical date, not the interview date.

You don’t appear to be reading my replies. The medical should be done BEFORE the interview. So – once you are notified that your interview is scheduled, you schedule the medical to be done some time before the interview.
If approved, the visa will have an expiry date which is dated to ensure your medical is not more than 6 months old.
If you need more time you should delay your interview.

In the original form they asked what is country of birth and I answered (Morocco) which is eligible country.
Then they asked if I want to claim other country of eligibility rather than country of birth.
I think this question should be asked to whom born in countries not eligible.
But to ask this question to people born in eligible country it will be confusing and misleading question (nonsense).

Hello,
I might need to delay my interview to between Feb/Apr in order to be able to travel to the US in August 2017. In that case, though, I would like to know when it tends to be too late/around when visas tend to run out. 2017EU57xx.
Relatedly, I am not sure I understand how the date on which I sent my DS-260 (today) and my case number “work” together to decide the interview date, given how it seems to be dependent on both.
Finally, if the green card is going to be sent within 3 months from the interview (as I’ve read somewhere here) I would be unable to receive it. Can I have someone trusted in the USA get it and remail it to me in my home country? What if I can’t find anybody trusted willing to do this?

You seem to have so much incorrect in your assumptions.
If you want to delay the interview you should have held back the DS260 even further. The case will not be scheduled until the DS260 is processed, but the case must be current to be scheduled. So – late submission of the DS260 can delay the interview.
The GC is only sent 3 to 4 months after you enter the USA. You MUST have a US address to receive the GC.

Yeah, the reason I’d submitted the form this early was in part because I was, and still am, worried about green cards running out, and in part because I’d misunderstood, thinking there was a deadline this Sept 30th (instead of next year).
Still, I know that I can ask the KCC to reschedule my interview at a later date. But will this put me at risk of the green cards running out?

I can’t spend time on correcting every miss-assumption you have made. You are prolific.
I would recommend you unlock your form. They will not have started processing yet of course, and there is a chance they will not process an unlocked form. That is FAR easier than trying to reschedule (the chances of which varies greatly).
The visa expiry is based on the medical date plus 6 months. So, if you want an August entry, your medical should be March/April so an interview in April or May would be ideal (allowing a little room for delay/change in plans). Given that, I would have recommended a DS260 submission around December/January – so unlock until then.

How do I retrieve the 2NL, and how long does it usually take for the KCC to get back to people about the 2NL? I’ve seen that some DV2017 applicants already received it, so I’m wondering about mine.

95% of DV cases are not AOS cases. So – ignore the chatter about 2NL – it has little to do with your case. Your case processing is determined by your case number and the I-485 filing.

There is no “average”. Some cases take a couple of weeks, others take months. Iranian cases in particular can expect AP to last 4 to 5 months – but other cases can take that amount of time too.

I already posted a while back about my past overstay, which ended almost 15 years ago (did not go back to the US for 10 years, etc…) I came clean with it on my DS-260 but now that the 2NL have gone out, I was wondering if this could disqualify me. I haven’t received any notification and my ESC page has not been updated since May. My CN is EU67xx, so it’s pretty low (I think). Should I be worried I have not yet received my 2NL?

My wife is principal applicant and was selected for the 2016. We have 2 biological children together with our niece (now 15 years of age) for whom we have obtained legal guardianship documents issued by a court of competent jurisdiction (from our home country) since 2008 when she was just 7 years of age, and we have traveled with her outside our home country on vacation sometime in late 2008. Her name is listed together with that of our two biological children on the eDV application and on the DS-260 . We are currently resident and working in another country since 2012 with all 3 children whose names have been included in our DS-260 accordingly as children. Our interview is already scheduled for 1st week September in our current country of resident. Would the legal guardianship status of our niece be an issue in us obtaining the visa? Would we be required to submit any additional supporting documents for her in this case? We are concerned

USA immigration law recognizes adoption. Guardianship is different to adoption. I suspect (but cannot say for certain) that they will not accept guardianship as adoption UNLESS laws are somehow different in your home country. Take all the paperwork regarding the guardianship to the interview. If the biological parents are deceased, you should take death certificates to the interview.
However, I suggest you think about your options if she is refused and the rest of the family is approved. They may refuse her immediately, but they might want to take a second opinion. If you would still emigrate (without your niece) then you should be prepared to ask the CO to issue visas to the rest of the family without delay, if they mention a period of AP while they check what to do about your niece.

Hi Brit,
I have a few questions maybe you can clear up.
1. When I was entering the data in my DS-260 I have entered 2 dates that could be wrong. One is my graduation day and the other is the first time I was in the USA (I was there around the year 2000, for around a month). The differences are not that big (within 30 days of the actual dates ) but will that affect my case?
2. When my friend that lives there fills out the I-134 does he need to take it to a notary?
3. I am under 26, and somewhere i read that you need to sign a military enlistment form (for emergency mobilization) if you are under 26. Do I need that form?
4. This is an idiotic question but I am expecting my number to pop up around November, December (EU10**9). When would my interview date be (around what date) in your opinion?

To deny you for applying for a visa before must have meant you lied/committed some fraud. You must know what you did – so it should not seem “very strange”.
Your husband can start the sponsorship process very soon after arriving in the USA. But he must be able to support you financially (so he will need a job or family that will take responsibility) and the process will take around 2 years – during which time you may be separated. The waiver application could increase that time. You will probably need a lawyer, so it will also be expensive. However, a waiver is not certain to be granted – again – it depends on the seriousness of what you did in 2007. You should discuss that with a lawyer now to see whether a waiver might be granted or not.

How are you Brit? I am a DV 2017 winner and on my original entry I filled my date of birth correctly as in my educational documents and birth certificate. In my DS 260 too I did the same. But my passport their was an error so now I corrected it and the one with the error is cancelled. Am I in trouble because of the cancelled passport? If I haven’t been selected I would have corrected it any way. Thank you

Hello Brit,
Finally got our visas today. It’s been a long test of patience due to a high case number and having used old photos for the initial E-DV but thankfully the interview was super smooth! Can’t thank you enough for your guidance throughout the process. I intend to post a detailed account of the interview sometime later.
Couple of questions:
1) For my daughters visa they’ve printed the wrong nationality. I checked the DS-260 and that reads the right nationality plus the passport that they’ve printed the visa on is different from the nationality they’ve mentioned on the visa. How serious/important is it that I change this before I travel on 4/9?
2) Besides the packet that was given at the embassy what else (documentation) do I need to travel with to the POE? Anything/everything that I took to the interview?
3) Is there a foreign US immigration clearance option in Doha?
4) What is the entry process like at the POE? Much like a second interview again? Should one be worried about being denied entry for any reason? I intend Miami to be my POE.

1. Talk to the embassy. It probably won’t matter, but if they can fix it in time it would be better.
2. No – just the packet and the passport.
3. I’m not sure.
4. Nothing like a second interview. No chance of denial – just a lot of waiting. Miami is a large disorganized airport and the border control people are among the worst. So – expect delays, and if it goes fast, you got lucky.

You have had 18 months notice to get married to marry your husband to avoid him being hurt, and you left it until now???? I run the blog to help people PLAN and be PREPARED to maximize their chances of getting a Green Card. You left your DS260 submission until it was FAR too late. You are incredibly lucky that you even got scheduled (I did not think they would be able to process your case in time), and now you want to complicate things by adding your husband? Wow. Just wow.

I don’t know any way to protect your case. You can email KCC to explain, which might help if someone does try and submit your case – but of course, that could complicate your own submission when you are ready to do it.

I would like to know case number 1 to 1900 has been notified.will all the case number from 1 to 1900 will get 2nd letter.

No.
Some cases are “holes” meaning there is no case with that number.
Some haven’t sent in their DS260’s and may never do that. Those are “non response cases”.
Some sent in their DS260 too late so were not processed in time.
ALL of what I just said is things I have written and explained many times before.

Hi Simon,
Regarding the public charge requirements:
1. We will go through consular processing in London. Do they usually ask for i-134 ?
2. We are a couple with EACH £20k of cash in the UK AND €20k of cash elsewhere in Europe. Does it sound sufficient ?
3. If for any reason the CO still wants to see an i-134, should we have it ready at hand or do they allow some time to produce it and send it to the embassy ?

What do I know about it?? It’s a fee. It’s $165. You pay it for the Green Card.
