I have one question that I can’t seem to find the answer to.
My husband won the Green Card lottery in 2020. We both live in the US and have, for respectively 9 and 14 years, always been here legally on working O1 visas. We have successfully sent in out DS-260 and paid our Adjustments of Status fee + received the receipt that shows we have paid for it.
We have both filled out the I-485, and the instructions tell us to fill out the I-944 (Instructions for Declaration of Self-Sufficiency). On that form, it asks us if we have an approved I-140 form, which we haven’t applied for because we are already here working legally. How do we go about it and let them know we are already here legally? If we answer no to the question, we have to find school papers, show that we have passed English tests, etc.

Yet another tweet to shake up a lot of people, he probably was laying awake in bed trying to find a way to blame someone else for the COVID outbreak In the US…immigrants. not quite sure how this “halt immigration and restarting the economy” come together, since a ton of company’s need immigrants to function thus keeping the economy rolling.

Brit, when state of emergency will be stopped and maybe it will happen soon, because of economical crisis which has already started in lots of countries, will Trump still be able to lockdown all the immigration? I know that during the state of emergency it is possible, but he wants to start opening everything which is connected to economy. Doesn’t he need the approval of congress? this is very hard to digest.
it is possible in the state of emergency or during a crisis stop the immigration and close the borders.
in fact the department of state had already done it. the embassy are closed and there is a ban for Europe.
but doing it by Eo can be a sort of chess move.
November is month of the election, it can be a kind of mixed strategy ,using the pandemic problems for election purpose.
i really hope something good for all us dv2020 winners. but is 21/04/2020 and there is no VB.

I am 41*** and i friend of mine from US called the KCC today and ask them about VB. The Lady on the phone explained to him that they are working there less then a half of the staff and the VB will not be performed unless the thing get better. I hope she didnt bulshiting him, but its always has a chance their Managers to give them orders to say that until see whats the Trump tweet means.

Let me share my view on this. State of emergency is related with the pandemic crisis, and considering that the US has more than 1000 deaths every day, there’s only a small likelihood that the status would be revoked in the near future, the curve has to be flattening first. Let’s just hope it’s true that summer will make the virus less infectious or virulent.
The reason to reopen the country is that they have to save the economy from tanking by lifting the lockdown (stay at home rules) and let the citizens earn money to put food on the table, provide roof over their heads or go to school, but immigration would be a low priority. It’s not black and white: if you want the economy then you have to use immigrants, I think Trump’s way of thinking is: any economy which does not involve immigrants LOL. USA used to be a generous country…give me your tired, poor, huddled masses yearning to breath free…let’s hope it will stay that way.
Ironically, by relaxing the containment measures the infection and death rate would not subside quickly, therefore reopening the economy would lengthen the state of emergency.
Of course, we can only speculate. Even scientists and experts got things wrong all the time during this crisis, and with Trump, anything can happen.

it can be everything.
for example :
he can open the embassy and doing the interview but decided to do not allow to enter in the border.
we cannot predict.

I legally reside in the US (California) as a student and became current last month (AF41XXX). I have followed the process with KCC so far, in order to have the appointment scheduled in my home country (morocco). Provided the changes, do you think it is Ok to keep it this way and hope I can still get scheduled in Morocco sometime. (depending on borders closure and consulate opening)

Would a move to USCIS doing an AOS be better?
If so is it too late to switch to USCIS provided I am already current?
In case USCIS does not issue me an interview prior to September 30th, is the procedure lost?

all cases EU14000+ basically are affected. They’ve been suspended (canceled) for a month already. After these 60 days (mid-end June) it could be suspended for another two months (mid-end August) and then suspended again.. very probable.
I’m not that strong in US laws.. but maybe a lawsuit will take place and so some federal judge may block it? Otherwise we are all doomed, almost for sure.

The different sources in finding are only talking about a pause on green cards that are “employment based” and “family of green card holders”. To my understanding the DV program is neither of those two situations. Correct me if I’m wrong? I don’t think we should lose hope yet.

Long time reader, first time poster. I’m an Australian DV2020 winner. I was fortunate enough to have my interview a week before the consulates closed so my expiry date of the visa in my passport is August 24. My question is regarding this temporary visa.
Do you think this visa gives proof of me being an American resident? I.e. could I use this visa when leaving Australia to prove that I am a ‘resident’ in the US, in combination with 2018 tax forms from when I was there on a J1? I’m hoping to do a quick activation trip to the US and back to Aus just to get the process started so I don’t need to redo the medical etc. later.
I know this visa is not a green card, but since all I have left to do is fly in and activate it, do you think that could be affected if this EO becomes a thing? I feel I am so close and I don’t know when is a good time to fly over and activate. I’m considering a trip sooner rather than later or hoping things die down by July/August. Obviously no one knows though.

No, the visa does NOT make you a LPR – you have to actually enter the USA to become a resident.
People with immigrant visas are not likely to be affected by the order.

Maybe the Big Baby is doing us a favor. I’m not sure I want to immigrate to the US anymore. Yes, you might get a bigger house and a nicer car, but is that really important? At times like this where helathcare, unemployment benefits and trust in the government are so important, the US fails overwhelmingly at all of these. Maybe it’s time to use my EU passport and just move to Germany.

If you really want to immigrate, there are countries with a far more relaxed immigration policy than the practically impossible USA. Certain countries in the EU, Canada, Australia for skilled workers etc. There’s always a way, you just have to find it. Winning the lottery is an opportunity that you don’t say no to, but all in all the US is really not such a good place to live, there are far superior countries.

I’ve heard of people that are literally afraid/don’t want to proceed their applications anymore.
I also truly believe that the GC should only be pursued if you’re A DREAMER and want to establish a career in the US. As of Germany, I mean, we’ve already got everything we need. Immigrating to the US with no plan or ambition/work ethic won’t get you anywhere.

What part of my comment made you think I’m not a DREAMER or have no ambition/work ethic? Do you think the US is really the only place to establish a career? And do you really think that a career is everything in life? Look around you. How has this worked out to the 22 million unemployed Americans or the 45k dead? The US can be a great place, I agree, but it’s by no means the only good place.

I was talking about the average German, in general. Like many people be hating their lives in Germany and be thinking that they’ll have it better somewhere else. Like don’t get me wrong – if you are financially stable, it’s fine. But I don’t get some (most of) people that be wanting to leave just because they don’t want to go through 9 to 5 or are annoyed by the weather? You know what I mean? Like what do you expect?
And to some the US might be the only great place. It really depends on who you want to become.

You are lucky enough to have a Eu passport and you most probably achieved you dreams, traveling to US maybe to you a new challenge or so. The US still the greatest country in the world for me and millions to achieve many dreams. A lot of opportunities are waiting there for ready and motivated people. If you already have a wonderful life as you said no need to travel to US.

Hello Sir,
My wife, who won the DV2020 Is now in USA along with two children. Unlucky me, medical report was cleared and sent to US embassy directly after 2 months then I got new interview date on March 23. But unlucky again COVID cancelled all interviews after 18 th March. Now with new immigration order by Trump will I still be given new interview opportunity or will be dismissed! (By the my spouse and children already got green card in the US)

I know you are not a lawyer but maybe you are able to answer my questions because (because you were aware of the events happening with the muslim travel ban EO)
1) If some judge or court “blocks” the EO, does it mean the EO doesn’t have any effect until eventually it gets approved (or cancelled)? (So in the meantime, if embassies open they can proceed cases??).
2) Do you think the restrictions and categories banned are broad enough in order to get the necessary attention to have a judge block it?
I ask the last questions because I’ve heard of immigration lawyers saying this is “nothingburger”. I mean, we all know the real reasons of candidate Trump doing this, but most lawyers and law professional doesn’t seem too worried, because it probably means the cases of they’re clients are delayed 2 months or more, but nothing more. However, neither the press or the lawyers have into account the DV category which is the only time-sensitive. In my opinion, this is setting a precedent on the upcoming immigration laws and lawyer, attorneys and judges should take action to stop it, but I’m worried this won’t happen… please share with us your thoughts.

Please we were supposed to have an interview on 2nd April 2020 but had been canceled.
I contacted the US embassy in Ghana and our case had been updated.
We were told they’ll contact us when they’re able to.
Right now my problem is
1. Is this suspension going to affect us?
2. Is it the possibility that they’ll contact us for a new date since they stated that “they’ll contact us when they’re able to” or we need to contact them again and choose a date for ourselves since our medicals are ready?
