I just finished watching your latest video about DV-2021 on your YouTube channel. Also, the VB timeline spreadsheet. Amazing work!!
We have have an asylum case from 2017. My wife has been selected for the DV-2021 with the CN of AS…12XXX.
I want to know if we have any chance for AOS? Also, CP is not possible for us as we are in the EO ban countries.
My lawyer and people in other forums told me that we don’t have any chance, but I’ve seen some previous years similar cases on the spreadsheet created by Sm1smom that successfully got their GC through AOS.
Appreciate any advice and guidance.

I actually did and she said pending asylum is not a status. I didn’t know that. I had B2 visa and then pending asylum. No gap in between.

I noticed a small mistake in my Ds2060 form. In the high school “Course of Study” field, I did not enter “ACADEMIC” as specified. I instead merely typed “HIGH SCHOOL EDUCATION”.
Is it in your opinion something I should be worried about? I of course do have the academic high school requirement with the relevant degree (as well as a university degree).

2. I ve mentioned the passport of my birth country first (Iran) then added the second passport (Germany), but Iran is on travel ban. Is it a problem if i want to travel using the German passport?

Hi Brit. I was having trouble loading all my addresses and contacted KCC. They have advised to leave no gaps in times and also to not load more than 8. I have now managed to load all my addresses but there are more than 8. This was due to my work at the time, that involved a lot of travel and stays of more than one month but less than 2 years. Should I rationalise all these addresses to 8 or leave all of them in?

I found this paragraph on this site and it concerns me a bit, specifically the first sentence:
Vocational education
The rules specifically exclude vocational education as being used to qualify on education grounds. For example, if a selectee were to leave school at 16 and then immediately or later go into a vocational program such as teaching or nursing, the time spent in that vocational training/education could not be used to satisfy the educational requirement. In cases such as this, the selectee may need to consider whether their work experience is sufficient to meet the requirement #2.
In high education section there is help like stated below:
Help: Course of Study
For high school course of study please indicate “Academic” or “Vocational.” For all other educational levels please indicate your major or concentration.
So in “course of study” field my spouse stated “vocational”. I have to mention that she finshed music high school which is 4 years + elementary school which is 8 years in our country. So I believe that this is enough for qualificaton. In the next field “degree, diploma or certificate received” she stated “music performer pianist degree’.
My question is should we unlock hers case and change something? Is this “vocational” a problem?

Only the principal selectee needs to meet the requirement. Vocational education/training cannot be used to meet the requirement.

She is the principal selectee. Although, she never had education/training outside school activities and she finished school whith the age of 18. After all, by the time of interview she will graduate on her University of arts – Music academy. What is your opinion should we unlock the aplication DS-260 and change the field “course of study” or we can leave it “vocational”? Does that “vocatonal” metters for scheduling interview?

I am DV-2021 Oceania with a number between 600-650.
My question regards current addresses on DS-260; I am moving house here in London within the next couple of months or so. KCC has asked me to submit all police certificates etc. to them soon, which I can do as I have all of this now – they are all current.
If I was to change my current address in a couple of months however on my DS-260 – does this mean I have to pay to get all my police certificates again with the updated current address? Or am I over-thinking things? Wondering if the current address plays a part with these supporting documents or not. If so can I just update my current address at the interview?
Additionally, as they are requesting these documents now, I am presuming I have to update these all for the interview which would be later in year / beginning of 2021 or more? (where the police certs in particular would be a little outdated, according to their rules).
Sorry if this sounds silly but I noticed they said the police certificates have to cover the whole time living in one place – so obviously if they want a certificate now I’d have to produce a brand nw original doc at my interview to fulfil this requirement.

They can do whatever they want. If you lied to them before, that can make the situation much worse, because it will cause them to question your character – and that is more recent than the conviction. So its a risk, but I cannot predict the result.

There is no such thing as obliteration in American law, so regardless of what is currently stated in the Polish document “Inquiry about criminal record”, the application for an American visa should include information on all arrests and convictions. Be sure to do this as you fill in the DS-260 application for an immigrant visa. Also during the conversation with the consul, if the consul asks, please do not hide that in the old application of DS-160 you made a mistake of ignorance and did not disclose the fact of conviction for possession. Such openness will definitely have a positive impact on your visa application.

They are correct – the crime was small, and the time since then is a long time. But you lied about it more recently – and that, frankly, is potentially a bigger problem.
But anyway – there is no amount of asking that will help you know what will happen. This is down to the discretion of the CO. All you can do is go through the process.

I have a very unique situation that I guess only you can help.
I have won the DV lottery 2021 (after almost trying 14 years), and I am already in the USA, my case number is AS_85**. As per my understanding, since I am already in the USA I may have to apply for I 485.
After being in the USA for nine years this year, my employer has filed for my GC, and two weeks ago my I 140 got approved, and now I am in a stage that I have to apply for I 485 for employment-based GC as well.
Conditions in Employer-based GC petition.
1)Since my I -140 got approved, and based on my research I have passed approximately 85% of the hurdles in process screening. But there is still a small risk of denial in the final interview since the requirements are very high.
2)I am under the EB3 category, and the visa process is not current, and it will be ” current” in Oct 2020, when the physical year starts
3)Assume if I apply the employer-based I 485 this OCT, and if everything goes smoothly, I may get my GC within 8-9 months.
pros-
can predict the interview time.
other than the interview decision everything is direct.
cons-
since the requirements are high, there is still a risk for getting a denial in the final interview.
less independence, since after getting the GC also we may have to stay with the same employer for at least 6 months(as he is getting 20% of my salary of our paycheck,So we like to get the independence ASAP)
Conditions in DV lottery process
1) Since the patterns are unpredictable, we can not guess when we will get an interview.
2)our Case number is AS_ 85XX
3)DV lottery requirements are comparatively low, and clearing the final interview is much easier.
Pros-
The biggest advantage in DV process is, that chance of denial in the final interview is very low, so it is pretty straight forward
Cons-
1)can not predict the interview time slots and cutoff numbers,
Eg-in case if they do not process our case number and stop the cutoff numbers around 8000(like in the year 2015 and 2014) we might not get a chance at all.
2) if the processing gets slow, we may have to wait until September to see the final cut off numbers,.and it may take more than a year to get the GC.
Questions-
1) Can we process two 1-485 parallelly for DV lottery and employer-based GC?
2) Can we process DV through DS 260 (to avoid I-485)and get an interview in here. And meanwhile, process employer-based I 485 parallelly.
3)If we apply DV I- 485, will we get a priority slot since we are already in the USA?
4)Can we transfer the I 485 from employer-based to Dv lottery or vise versa after submitting the document?

I had studied and worked in the States from 2003-2012. During the span, I had a minor misdemeanor charge (open container in a State park, no motor vehicle involved, just drinking in a public park) against me. Before I left USA, I filed the petition to seal this record and approved by the court.
My question is that when I file the DS260 (I won DV2021, case no. AS25,XXX), do I need to claim that I had this minor misdemeanor record even though I already sealed this record ? My follow up question is that if this matter will hurt my case?

Hi Simon, first and foremost I would like to say thank you very much for your effort in dedicating your time and energy in creating and maintaining this blog. Secondly, I have 2 questions to ask.
My first question: In my country we follow the UK Cambridge system and our primary+secondary school amounts to only 11 years. So the certification that is given to us after completing secondary school is the Cambridge GCE O levels certificate. After secondary school, I then went to college and did an advanced diploma of 3 years and then after that attended university for bachelor’s degree of 4 years. As per your blog, you mentioned that it’s a bit of a grey area as technically I didn’t complete 12 years of formal primary and secondary education even though my highest level of education is a bachelor’s degree. So my first question is, does that mean that I can only qualify with my 2 years work experience of minum zone 4 and svp 7 as per onetonline.org website? I have work experience of 7 years.
My second question is: I’ve checked the onetonline .org website but my job title that is written on my work contract is quite unique that is it not listed on the website because apparently, it is called as something else in the USA. I read through the details and work descriptions and it matches the work that I do and it meets minimum of zone 4 and svp 7 requirement. The only thing is that the job title is named differently. So my question is how do I inform/explain to them on my ds260 that my job is technically named differently is the US than in my company although the job descriptions are exactly the same.

1. I can’t assess your education. The UK system was O levels, followed by 2 years of A levels, and then University. I have no idea whether your advanced diploma was like A levels.

I guess at this point in order to be safe, I will have to assume that I need to prove my work experience.
Having said that, regarding question 2, I should then just enter in my ds250 form the name of the job that is written in my work contract right and not the name of the job equivalent in the US based on the o*net website? So which means only during my interview will I then need to present all official proofs of my work contract, the details of my work description from my company and employee reference letter in order to proof the work requirement .Will it help if I apply for that particular job position listen on o*net at US companies in my industry and try to get offer letters to help build my case during interview?

Hi Simon, hope you’re doing well. I’m a winner of the DV2021 lottery with a case number 2021AS14xxx. I’m from Hong Kong and hold 2 passports – the HKSAR passport and a British National Oversea passport (BNO). I entered the lottery with the HKSAR passport and also have a B2 visa attached to it. It’ll expire by Oct 2021. I think I won’t be in the U.S. by that time as I suspect my interview won’t be scheduled till Mar-Apr. Should I input my BNO (which expires in 2028) as the primary passport on the DS-260 and add the HKSAR passport as the 2nd one? Does it matter? I will renew the HKSAR passport though. Thanks a lot!

While wining DV lottery (selected for further processing) If someone is going to receive a scholarship and the scholarship requires the student to stay for amount of two years at home country after the graduation, so should the person reject the scholarship and wait for his interview or there is another way to receive the scholarship and the visa both?
For instance, a course of study at the UK lasts for 1 year (September 2020 to September 2021) and the person can finish the course as well as get to the interview.

Hi I would like to express my gratitude for the service Britsimon offers in advance. The work you do is good. Before, I was a 2018 DVD winner when I filled out the form, but I was a 4th year university student in Accounting and Finance at the time, but I never completed it because I filled out the form. I also have over 8 years of experience. I also didn’t get married and after I was full, I got married and sent the DS260. As a result, he failed. I have questions
1. At the moment I am the winner of the 2021 DV lottery but I have not written last name 1 letter alphabet that I have seen.
2. We are currently separated by my ex-spouse and the divorce information is in my possession. How do I fill out the DS260?

Hi Simon. Re universities attended — I attended one, spent a year abroad on exchange transferred to another in Europe, from which I graduated — so in effect attended 3 universities for the one degree. 1) Do I put them all and explain in the what degree section the situation? I have addresses in these three places on my previous address list.

First I want to share with you and everyone on your blog that I just received an email, today 12 June, from KCC confirming that my documents are received and complete and are ready to be scheduled for interview numerically based on case numbers that have completed processing. This is the kind of email I have been waiting so anxiously.

3 Questions:
1. I worked as as a substitute teacher the last 10 years. And, I also had 1-year of longer contracts. The sub teaching posisitons were sometimes a day, sometimes a couple days, sometimes a few weeks. To simplify: I got paid either by the state or by the city, so two sources. So, just 2 kinds of employers. How should I display it? Capture both employers with a overall length of the 10 years?
2. Three years ago, I started as a freelancer career counselor, counseling individuals and facilitated career workshops at various universities. How should I file this? I am not self-employed but viewed as a freelancer in my country. Universities paid me for each singular workshop.
3. Internship: as a counselor where I earned a little money. = employment?

Please help me am confused, am a 2019 winner of the lottery and i have sent my documents but when i contact the kcc it seem they haven’t receive any document. This is what they sent through my email.
The Kentucky Consular Center (KCC) has received your email and is currently processing your documents. This email address, [email protected], is only used for applicants to provide the Kentucky Consular Center (KCC) with documents required to continue processing Diversity Visa applications. [email protected] does not respond to inquiries. If you have any Diversity Visa related questions, please email [email protected] with your case number, complete name, and date of birth, as entered on your original entry.
You should expect an email from KCC in the next 3-6 weeks. If you do not hear from KCC after 6 weeks, please contact [email protected] to confirm all of your documents have been received, and you are ready to be scheduled for an interview.

You have to check what you sent. Was it all the documents, were they named well, did you reference the email correctly.
Then resend all the documents. Do that fast, you are almost out of time.

Hello. I want to ask what happens if I get the host address but then that person doesn’t want to fill out I-134 form? Are they going to say no to the interview and is it worth it to try without I-134. Also what happens if I don’t have I-134 but I have a job offer instead does my chances going bigger or no? Thanks!

I wanted to ask if paid internship only for 3 months outside of my country are called as previous employment. Should I include it at my DS-260 form? Because if I do, it requires some information like the number and address of employee which I don’t possess.

I’m a DV2020 winner, I’ve submitted my DS260 and received that it was processed. I’ve submitted my documents as well I received a confirmation of delivery, but actually never received a confirmation that they are processed, or the email that says I’m ready for scheduling, although I sent them multiple email, and there response was that the processing is based on case number.
as you know all regions are current for a while, do I still have a possibility to get the green card?
PS the embassy in my country is working now?

Embassies are not taking interviews. So – that is one problem and your documents is another problem. Wait another week or two, then contact KCC about your documents.

Thank you so much for all your help and sharing your knowledge.
I am currently in the process of my E2 visa. I had my Visa interview in February but got denied and being asked to send additional documents via email however due to covid 19, the company who is supporting me this Visa is not able to give me this document now. They said they are still willing to sponsor me this Visa but do not know when it will be. And now I got selected for further process with DV2021. Should I cancel this E2 visa process or could process DV2021 without canceling E2 Visa process? My passport is still at the embassy which I’ll need to get police certificate which will be the next step after submitting DV260.

You should consider your case number then decide whether to have two processes running at the same time (which is possible). You will need to make that decision yourself.

Thank you very much for your response. My case number is AS29xxx. Which looks like pretty high? I don’t know what to decide as E2 visa probably wont be able to process at any time soon I would like to process with DV2021. I feel so lost

Right – well that makes it much easier. That’s a high number which may or may not even get current. If it does it will be a year ofr so from now, so you certainly can’t doing anything with DV for a long time if at all. No need to be lost – just realistic.

First of all Id like to thank you for your website, it is really helpful. My situation is the following:
I have been selected for the 2021 DV loterry, with the number EU24XXX.
Right now I am waiting for the interview in order to get an F1 to study an MBA in the USA.
I have heard that I should not complete DS-260 until I have my F1 because they could deny me the visa. Is this true?
Also, can I choose whether to process my petition for visa through consular process or I have to do an AOS? In case I could choose, which is better for my situation?
My studies last two years, and I should have an OPT period that allow me to work for 1 year after the completion.

Yes don’t submit the DS260 yet. You can do CP later, which might be safer since there might be concerns that you entered the USA with intent to adjust status.

Do you think it is worth me writing unemployed as my current status of work so I can get the application in ASAP?
Or wait till I am employed so it looks better on the application. Or does that not matter anymore.

Actually I’m a BSc degree holder (BSc in Geography) . I have been teaching elementary English language for the past five years and currently doing same job.
I have completed my primary secondary/high school and undergraduate studies. Filling in the educational qualifications isn’t a problem. I’m actually confused with the question -Does your job require a minimum of 2 years training / experience?
Actually the job requires 2 years of experience according to the system of the country l’m currently teaching in.
So would it pose any issue if I answer with a yes???
I read the article you provided but still not clear on what to do.

That might work, although they could point out that you are not living up to the terms of the GC. It is not a visitors visa. It is permission to live and work there.

I’m just wondering past which point of the process I can decide to cancel my application and just not go on with it, so it doesn’t jeopardize my potential future chances of getting my ESTA applications approved.
I’m just asking as sometimes there are unexpected events in your life when you have to stay in your home country, whatever reason that may be.
1. Once I’ve submitted my DS-260 application.
2. Once KCC has reviewed my application and sent me an email asking to upload civil documents
3. Once my interview has been scheduled
4. Post-interview when my visa (green card) has been approved

Once you submit the DS260 application, that will affect future NIV requests if you decide not to continue the DV process.

No, because it says in the email from kcc,,, in english language or in original language, and it’s like a document that proof i didn’t serve in the military,,, so i only send it just in case if they needed me to send it. the document only has my name and nationa ID number, biirth date and lots of signatures.
This is it’s definition from US Amman embassy.

*writing this comment again, because I think the other one did not arrived* Brit, I have already sent me documents twice. I‘m going to get in touch with KCC in two weeks.
Well my concern now is -since I‘m reading that your advising people to overlook their docs promptly- that I ONLY sent them my original UNMIK birth certificate.
But I became a German citizen in 2014 and got issued a birth certificate afterwards. Am I allowed to send them both in a mail or should I just send the German one included? Kinda going crazy since they have not processed them. Thank you so much in advance.
