happy to be back on the forum
my ex wife(then girlfriend) applied the 2016 dv lottery , we got married in Feb and in May when everyone else was checking on their case number when she checked she won that dv. we processed ds260 as married and got our visa and green cards later. but had issues and got divorced by US courts in 2018.
I traveled outside the US in this past October 2020 in my native country I figured out this week that my new girlfriend (now fiancé) is pregnant yet we had planned the marriage just after I get my citizenship November 2021(this year) as a faster and easier for her to be able to join me in the US.
we may have our baby in September if everything goes as normal which is before I get my citizenship,
now that she got pregnant Iam confused about which best option to go to have her and my kid to join me in the US asap, and easier
1) should we stick to our initial plan not to marry her until I get my citizenship (which is after November this year). let her have a baby and sponsor them after I get my citizenship ?
2) should I marry her right now before I return in the US and immediately apply for her to sponsor
her through family reunification process which takes 2 years, and maybe adjust later by the time I get my citizenship?
3)if I choose option 2) this will not be a problem during my citizenship interview because before I was married when I immigrated to the US, I remember an immigration officer asked me this question during my interview”Will you divorce when you arrive in the US” and of course I responded ”no” because I had no intention to divorce but here we are I have divorced. will that be a problem?
4)should I marry her right now but not do anything until I get my citizenship this November 2021 then sponsor them later after I got my citizenship.

I have recently sent all documents of my husband and me to the KCC doc email address. Since we had a lot of documents (quite a few translations), I was forced to send 4 separate emails, following the instructions they gave (case number in the title, etc.). However, I’m worrying about this now.
Is this normal to them? Could our 4 emails be overlooked/ end up in their spam/ etc.

First and foremost, my condolences and thank you for being an angel in disguise to all of us.
It has now been 6 weeks since I sent my documents to the KCC document email address. You advised me to contact them within a few weeks if I didn’t hear from them, since I was worried about the fact that I was forced to send them 4 separate emails (lots of translations, etc.). Therefore, I just sent an email to the regular [email protected] email address asking them about it.
1. Is this the correct medium to ask them that question? I have no idea which other way I should get in touch with them. I didn’t send my question to the document email address because it literally said I should only send my documents there…
2. My number is 2021EU144xx. If it wasn’t for the travel bans and for Covid, would this be a good number?
3. I’m sorry I haven’t been able to fully watch each and every single video you made (i.e. you might have said this in one of your recent videos), but is there currently a court case that you advise we join? Or should we just wait and see what happens at this point?
4. Come to think of it, I have not added all my social media channels to my DS-260 form. I think I only added my LinkedIn but not my Instagram or Facebook for example. Should I ask them to unlock it to add those accounts?

I talked to two lawyers and have different responses. One says it’s going to be denied or sent back and other says it’s a risk but somethimes they accept it and you can get your GC no problem. What is your opinion?

The second lawyer is an idiot. The first was correct. This isn’t a matter of opinion, it’s a fact/understanding of the process.
There is an early filing policy. As soon as the number is announced in the VB you can submit the I-485. So once you see a VB with an EU number higher than your number you can submit. Not before that.

what someone can do if he/she has filled the dv lottery form but there is a mistake in it in the way that one person’s name has been duplicated in spouse’s field in stead of her/his spouse? Now, when we open their DS 260, there are 2 duplicated names shown in “Summary Information” page. It should be two different names; one for the principal applicant, and the other should be her/his spouse.

Sounds like that person duplicated themselves as the derivative. There is risk of denial. The only way to fix it is to submit the DS260 and submit the form, but accepting that the CO may deny the case anyway since it is such a large mistake.

Thank you for the assurance that it is more likely the JB will cancel the ban on the first days in the office. The answer to my question may depend on individual reasoning but you who is in the USA and has sources at higher level in the government may give more light. I will take your advice and wait to see what President-elect Joseph Biden will say/do. Hong Kong’s current policy is all inbound, citizens and non-citizens alike, with a few exempted individuals, are required to do a 21-day quarantine at a designated hotel(the vast majority of affordable ones have been booked up for Jan, for example). Not only that, but if you arrive from some countries like U.S, South Africa, Germany, among other countries, you need to have done and received a negative COVID-test before flying back to HK. Strict protocols, indeed. Which is another reason why I would NOT ‘casually’ book a flight to the U.S., or anywhere else for that matter. As you suggest sir, best to be patient and see what President-elect Joseph Biden does in the weeks ahead.

– Do you happen to have a loose estimate of a EU case number “cutoff” limit that you deem could possibly benefit from Curtis Morrisons lawsuit? From what I understand, if you have a high number it doesn’t really make much sense to join as you’re not current or not about to be current yet.
– Regarding the Schengen ban, I understand schengen residents would need to switch embassy interview location to get around that. Could CMs lawsuit/anunciato (or if they get consolidated) remove that need?
Also, would we need to translate documents to another language then English if we were to switch embassy location to say, Turkey or something?

1. At NVC is listed as no response – but it simply means the case is not yet sent to the embassy – and of course that is the status for all cases at this point.
2. It is based on the laws that govern the lottery. It’s in the FAQ.

Every person should make their own choice. I think Biden will remove the bans. And there is already a case that fights for every DV2021 case, but some people will still want to sign on for lawsuits. I would probably save my money and see what happens.

My consulate office is London, as this is where I currently live — however, I am looking at going back to Australia permanently ASAP.
My question is — would it be risky (or even possible) to ask KCC to change my interview location to Sydney? Would it be wise to wait until after the new administration is sworn in and base a decision on that?

I am asking this question about marriage certificate, I just wedded my wife this December and the church that issued the certificate made a mistake of my age giving me the same age as my wife, but in my documents the age is different from the marriage certificate and my wife’s age is ok only mine and I have all prove of our wedding and we have been together like four years before our wedding and have a kid.

I’m a dv2021 applicant (Very low case number in AS). I have completed ds260 on June and I have sent my documents to kcc and I have recevied the email that my documents are okey.Now my status is “At NVC” in ceac at the moment. is it where it should be? or i did something wrong?

We have not received email from kcc for supporting documents yet. we are worried of disqualification as we used previous year photo.
In CEAC website status it’s showing ‘at NVC’.
What we can assume from this status? No disqualification or disqualification.

That status is standard for every case – it does not mean anything.
The rule about not re-using a previously used photo has been in place for about 3 years. In that time I have not heard of a single case of disqualification for that reason.

Do you perhaps know if there is a way that I can view the initial 2021 DV lottery entry? The entry was made by a third party (I know that this was idiotic of us to use a third party) and I am afraid that they may have made a mistake on the entry. I just want to be prepared.
We clearly stated that we were unmarried at the time of entry to the third party but intended to get married soon and then subsequently got married in March 2020 before the results were released. We had been together for 10 years at that stage. When my husband got drawn and we opened the DS260 I was all ready listed as a derivative. I just hope there is an option on the entry like common marriage. I they did indeed mark us as married on the entry I presume we will be disqualified? We have a super high number in any case AF79000 so will have to wait and see if it will go up that high. Fingers Crossed.

No you cannot see the original entry, but the ONLY way you could be listed is if you were listed as a derivative on the original entry – i.e. yes they said you were married.
Disqualification for that is possible, but not 100% certain. Your case number is very high, so you may never get an interview, but if you decide you want to proceed your best solution is to get legally married asap.
