Hello, Mr Simon. I have completed my DS – 260 form in August 2020, but unfortunately, no response from KCC.
So, I have few questions to ask:
1) Should I submit the supporting documents needed to KCC, or continue waiting?
2) When should I get an affidavit support (Form I-134)? Now, or wait till after receiving an appointment letter (Interview) from KCC?

Possibly.
We don’t know for certain that embassies will reject cases that have failed to follow the new instruction. When a new photo re-use instruction was introduced about 3 years ago, it should have caused some additional refusals. It didn’t – nowhere. So – we won’t know until interviews actually start whether embassies will enforce the new rule or not.

I live with my wife soon 5 years of married life we have two children, a boy and a girl. Not being legally married yet, I played dv lottery alone (Single) while including our two children.
To date, I have already completed my ds 260 and that of the children (in short I did not add madam) I have even already sent the documents to the kcc, which subsequently notified me that everything is ok. I am currently awaiting my second letter …
I do not plan to travel with the children …

When would you want your family (including your spouse) to join you in the USA? If the answer is never or in a few years, you did it right. If the answer is in a few months, you did not do the right things.

The background checks issue is more for Iranians in particular than Muslims in general. Background checks have been particularly lengthy for Iranians for a couple of reasons.
1. Iran is uncooperative with the US for the required information and is overtly aggressive toward the USA.
2. Many males have performed national service with the Iranian military which again is aggressive toward the USA.

I was at looking at the CEAC data published by Xarthisius. With reference to status as reflected thereon, there are two terminologies used here: At NVC and NONE
1. Please, what do “At NVC and NONE imply?
2. I see that some case numbers whose bulletins have not yet being published have under status “At NVC, is this an error , since indeed their bulletins have not yet come out? Examples: some case number in the 18,000, 19,000, 20,000, 30,000, 40,000 and so forth all AF2021 Africa Region. Please some clarification

I know that muslim ban will be removed once new presidents get appointed. In that case with due to lack of time, do you still think Iran and other banded countries will be able to go through the process including strict back ground checking? I have read in your blog about holes. Holes are created when there will be some reason to disqualify them.
In our case we got selected even if we used prev year photo. Do you how kcc will work, they will check only DS260 data only or on photo validation of prev entry also.
I am tried of waiting for kcc email requesting documents. Is there any way to know the real status of our case in kcc.

1. Holes are created before the announcement of the results. So if you are a selectee, you were not disqualified during that step.
2. Previous years cases (up to now) have not been disqualified for re-using a photo from a previous entry.
3. All you can do to understand your status is ask KCC. So – best idea is exercise patience.

I was following your advices since I won the DV, there is a lawsuit for DV2020 by lawyer Nicolette glazer, this law suite will challenge the government to reissue new visa’s incase it was expired or the ban still going.

I want to maximize my chances to get the IV by the end of this fiscal year and, therefore, I am planning to join the no ban lawsuit by Curtis. My DV case number EU 38k is rather high.
If for any reason, I end up without an IV,
1) do you know / think that being a named plaintiff could adversely affect my ESTA (vacation travel) eligibility? (I am aware that the submitted DS-260 is already not helpful for that, but that is done already).
2) would joining Curtis’ case, make me ineligible to benefit from class certification from other cases, assuming this would happen? (While this would not make sense to me, I guess you know better than me)
3) Is there any risk, other than having spent the money to participate, that comes to your mind?

I am an dv2020 winner and had my visa issued in September with annotation of PP10014.
I contacted the embassy and they have responded as per below:
As per your enquiry regarding the extension of Presidential Proclamations 10014 and 10052, the proclamations do not apply to nationals of affected countries who already had valid visas issued.
To which I had questioned if I can travel as planned on 14th January and they have stated that I can travel.

I emailed the us embassy here in Fiji this morning to ask if it was ok for us to travel. Our visa was issued in September and had the PP10014 annotations on it. They responded with
The extension of Labor Market-Related Presidential Proclamations 10014 and 10052 does not apply to you. Records show your Diversity Visas will expire March 10, 2021. Please travel to the United States before your visas expire.
What does this mean? Can i travel for sure?
I went on and asked them if they were sure about their response and if it isn’t going to be a problem when we get into the airline or POE in the states- still awaiting their reply

Unless your visa was RE-issued from a pre April 23 visa, you are impacted by the ban. The embassy is incorrect.

It happens after the interview. People from other countries, Muslim and non Muslim, can also go through that, but it is more common for Iran and takes longer for Iran because of the Iranian government. The name check against the terrorist/no travel lists is also more likely with “Muslim sounding” names (horrible characterization, but you get the point).

They will get a chance to start their cases. Some will not make it in time. While cases are on AP the other cases proceed.

Currently, I am in job, and I may need to give around 2 months of prior notice before I resign.
Previously, I had planned to travel in the last week of February
However, as you are aware that the Travel ban is extended till 31-Mar-2020.
In this regard, I have following questions:

Hello! I’m needing a little help with a DS-260 application…
I’m half way through it and realized I accidentally ticked the wrong box on the “Getting Started” page and now the boxes are greyed out and won’t let me change it.
I ticked that “I am currently in the US and want to adjust my visa status without leaving the country”, but I meant to tick the one to organize the interview in Sydney, Australia. I don’t want to submit it as is because I am in the US now working on a non-immigrant E3 visa and don’t want to do anything that might mess my current visa up.
Is there a way to change it? I haven’t submitted anything yet.

Hi Simon, if I unlock my Ds-260 to change something but I already sent supporting documents and already received the Kcc email of ready to for interview scheduling, will I have to re-send the Supporting documents? See, I used to have an old Facebook account I had deleted a long time ago because I didn’t use it. However that account no longer exists(I don’t even remember the account’s name). But is there any risk that by the interview the embassy would have access to that petition and if they are for example Republican and they that this petition is a kind of objection against Trump’s decisions and that’s why could by somehow come up with reasons to deny the case? My interview will be in Cairo and they didn’t even reissued visas fir DV2020 as many other embassies did. I hope you understand my worries.

So 6799*34%=2311cases (no response+refused ,AP ,…..).
so the remain cases will be 6799 – 2311=4488cases who will get their visas .
Actual derivative rate is 1,92 for this year ,so the number of cases 4488 * 1,92=8616 visas
The quota of ASIA for this year is 8623 visas .
1- could we consider that the cutoff for ASIA region for dv 2021 in its best scenario is AS12253 ? even in the normal year or in this year taking in consideration about 34% of cases will be subtracted.

Even in a “normal” year things wouldn’t work *exactly* like that, because Nepal (and perhaps Iran) would be slowed down giving a little more chance to ROA. Then, currently, Iran and some other countries are under the MUslim ban, so the banned cases (at this exact moment) have little/no chance of proceeding. However, the widely expected removal of the Muslim ban would re-introduce those cases (and would alter the 34% number you have, which seems low anyway). Then you have to factor in the changes in the desire of immigrants to want to come to the USA in these times and that could also change the numbers.
But then you can pretty much throw all that math/logic out the window because the embassies have closed and we are going to end up with far less processing time than a normal year, and probably anomalies in work being performed at the embassies as they re-open at different times.

Hi Brit, my husband have been refused a student visa 3 times for the US at the beginning of his administrative process in early 2017 we were not married, but on his documents he put single and we got married in December 2017,given that everything was ok in school so he went to the interview as single in early 2018 thinking it will contradict what is in the school documents and we refused the visa, he then applied again for a second interview still as single and nothing was changed at the level of the school, they said its the same fiscal year and still got refused. So giving that the school year has passed and had to do all the processing again he then mentioned married and sent the marriage certificate to the school and applied for the third time for the visa as married and still refused the visa. Staying in two different houses in different quarters in the same town. And wrote the address of one house for the school procedure and on the ds-260 wrote the second address
Questions:
1- Can the fact of applying in the interview as single while married after school processing can cause disqualification???
2- Can the difference of address cause any disqualification?.

1. I think you are asking if lying to the US government can cause a problem when asking the US government for a visa. Do you really need to ask?
2. Lies, or the lack of credibility can cause problems, yes.
The answer to these problems are to STOP LYING. Do NOT try and tell more lies to “fix” things.
