Hello
I’m planning to join the new ImmPact lawsuit.
As this is my first lawsuit in my life, I’m not very familiar with how the things work inside the courtroom and with the overall process.
Can anyone give some suggestions about this request please.
“Create a declaration describing your situation and why you’re suing”
I could utter some words on:
Delays by the State Department.
Failing to work on my case.
Some personal stuff, anxiety, frustration etc.
Is that good enough?
Simon, I think you gathered some experience these two years – could you suggest something?
Thank you all, and wishing you all the best in these chaotic years.
March 27, 2021 at 20:45
Their process is designed to be used by non lawyers. Follow their instructions.
March 26, 2021 at 19:36
Do I have to provide police certificate also for county where I served military? Then it was one country, now they are separated. I provided PC for home country which is legal successor.
March 27, 2021 at 20:43
Don’t repeat questions I already answered.

Hi Brit,
The Documents I send I send to KCCdvdocuments all have English and National Language all in one page for all the required documents. Do still I need a separate translation? I requested KCC if they are satisfied with the documents and the Auto-response I got from KCC says that “The Kentucky Consular Center (KCC) has received your email; however our system could not detect any documents attached to the email.”
March 27, 2021 at 20:41
If it has English already, no need for a translation.
THe answer you got was because you sent them an email asking about status. Email the normal KCC address.

Hi Mr. Simon.
I have had a dv visa since February 3th and it expired in September 3th. Bcoz of Covid and trump ban, I could not be able to travel to USA.
– Is there any chance for me to renew my visa ?
– Can you recommend me any good lawyer to help me in order to solve this problem?
Thank you
March 27, 2021 at 20:39
You should have renewed it in September. There was a lawsuit enabling you to do so.
Now you will have to wait for the outcome of the Gomez lawsuit to see if you can renew.

Hi Brit,
about the DV 2021 mandamus lawsuit, does every applicant under the same Case number to pay the 1500$? Or it’s one payment(1500$) including the derivatives?
March 26, 2021 at 17:29
It is $1500 per case/family.
March 27, 2021 at 03:43
Congrats my home boy. I’m also just playing the waiting game. My C.N is a little bit high but let’s wait and see. I’m on 0772565365 if you need to discuss anything with me.
March 27, 2021 at 19:59
One payment per family.
March 26, 2021 at 17:15
Dear Simon, I made a mistake today. I have sent my sup documents to [email protected].
Do it will bring any negative consequence on my case
March 27, 2021 at 19:58
No. Just resend it all to the correct address.
March 26, 2021 at 16:55
Hi Brit,
Are there any news about DV2020 winners?
March 27, 2021 at 19:57
No. Just as 1000 times before we have to wait for the Gomez case.
March 26, 2021 at 15:34
No doubt the lawyers are doing excellent job for the dv winners ! But with so many lawsuits going on I fear it’ll create some sort of mess ! It’s because the named plaintiffs (whatever be the case number) will be given more priority which means people with lower case numbers might be deprived of the chance they would have in the normal years !
That’s my personal view! And I beg a pardon if its inappropriate to share it here!!
May god bless everyone!! ??
March 27, 2021 at 19:57
I don’t mind you expressing this view.
March 26, 2021 at 15:07
Hello BritSimon,
There is an update on public charge today. Is there an Impact on DV winners !?
https://travel.state.gov/content/travel/en/News/visas-news/update-on-public-charge.html#ExternalPopup
Thanks,
March 27, 2021 at 19:56
Not anything other than what I have already said. Still use the I-134, do NOT use the DS5540.
March 26, 2021 at 12:54
Hi Simon
I told you above that KCC asked me to submit further documents after I sent the documents a week ago, I don’t know why they’re asking me to submit the documents that I already submitted . However here is the email they sent to me :
Date:
Csae number : xxxxxxxx
Dear xxxxxxxx
Congratulations on your selection for dv 2021 diversity visa program!
Please read this email and carefully and carefully fallow the instructions listed in order to hqv3 your application processesd as quickly as possible.
You should review the list of required documents for processing below and send those to KCC to review as part of your application package , along with completing your d’s 260 you will only be scheduled for interview at an overseas consular post after you have completed your d’s 260 and submitted ALL documents required for your case and your visa rank number has become current.
And then they wrote the list of the documents required.
1- does this mean they are not satisfied with the documents I submitted? I’m asking for they take a wile to respond .
2- what they mean by ” you will only be scheduled for interview at an overseas consular post ” ?
3- what’s the difference between JPG and JPEG format? Or there’s no difference?
4- are the documents sent to KCC in colour or in black and white?
March 27, 2021 at 19:54
I answered you. Read that.
March 26, 2021 at 12:44
Hi Brit
Is there a difference between documentary processed and documentary qualified !!!!
March 27, 2021 at 19:53
Different words.
March 26, 2021 at 11:11
Hi Brit, I hope all is good!
My case number is AF80k and I received ready for scheduling email back in August. Does this mean that if the visa bulletin gets current, I stand a chance?
Thanks
March 27, 2021 at 19:51
Yes, maybe.
March 26, 2021 at 10:49
Hello Simon,
As a European DV lottery winner, I’m thinking about joining the new lawsuit.
My husband is a beneficiary winner. He shouldn’t join the case separately, right (i.e. we shouldn’t pay 1500×2)? Both our cases will be handled if they win?
Many thanks.
March 27, 2021 at 19:50
Just one case.
March 26, 2021 at 09:39
Hello Mr. Simon!
I have a question about the Mandamus lawsuit.
My case is EU22*** (Russia) and I would like to join this lawsuit. But I don’t know if I am eligible for this lawsuit because my case is not yet «current» and I have not even been asked for documents from KCC… And also, as you know, the Moscow Embassy is still not working. What do you think, can I join this lawsuit?
Thank you and I’m looking forward to hearing from you!
And thank you for everything you do! You have an amazing blog!
March 27, 2021 at 19:50
First you should send the documents now without being asked. I have said that MANY times on articles and videos – so I don’t know how you missed that.
Second, yes you can join the lawsuit.
March 26, 2021 at 09:35
Hello Brit,
The Khartoum embassy says on its website: “We are currently processing IR1, CR1, and IR2 visas, in addition to renewing expired immigrant visas”. This (I think) suggests that they have not reacted to the revocation of PP10014. What makes me think so is that they didn’t announce this in the news section, while other embassies (the Cairo embassy for instance) did. What should I do in this situation? Is there any way to communicate this to the lawyers in the Anunciato case? It seems so ridiculous that processing DVs puts them in risk of contracting COVID-19 while processing other visa types doesn’t!
March 27, 2021 at 19:49
I don’t agree with your assumption.
March 26, 2021 at 09:06
Dear Simon
I hope your are ok.
I sent my documents a week ago, today I got an email from KCC asking for further documents.
I’m sure I sent all the documents required . And I’m sure the police certificate is not the document that is missing; as I’ve never travelled to any country before. My case is very simple, I submitted only four documents. Please dear Simon help me.
March 27, 2021 at 19:49
After sending documents without being asked, MANY people report then getting an email asking for documents. I believe (but cannot be certain) that sending the documents prompts them to open the case file for documents, and that the email is sent automatically based on the file being opened. So no need to send them again, just wait a few weeks and check progress.
March 26, 2021 at 07:37
You said in one of your videos that it will be kaos if all regions go current. Why,can you please elaborate a bit on that ? Thanks
March 27, 2021 at 19:43
Chaos meaning no logic or justification as to who gets visas.
March 26, 2021 at 04:01
Hello Brit Simon
I sent my Ds260 on 7th June 2020 and my case number is AF40XXX yet KCC has not email me for my support documents. What should I do?
March 27, 2021 at 19:27
Send the documents.
March 26, 2021 at 03:58
Hi Mr Simon, I’m in USA since March13, two days ago I called to the Social Security to get some information of my card, they told me that my SSN was sent on March 16, but it has not arrived. Is there any way to know if my card was returned to the SSN? is that possible? I reviewed my addres in USCIS’s page and I had to update it because the number of the apartment did not appear.
March 27, 2021 at 19:27
I don’t know.
March 26, 2021 at 01:01
Hi Brit
2021 winner. If we get visa, can my wife come late to US? Or after went together can she come and come back to US after finished our issues here in our country? Thank you for everything you do.
March 27, 2021 at 19:21
When you are issued with your visas you will have 6 months to enter the USA. You don’t have to both come at the same time, but the principal winner must go before, or with the derivative. .
March 26, 2021 at 00:15
Hi Brit!
We have emailed and phoned KCC and received no answer. Is there anything we can do other than keep trying?
#WhatsGoingOnWithTheBloodyDocuments
March 27, 2021 at 19:19
No. You just have to try again, but recognize that you have to have some patience as well as persistence.
March 25, 2021 at 23:45
Hello Mr. Simon
My question is about Mandamus lawsuit of Mr. Kuck, i watched your youtube video and due to a question asked to you and your answer about it there is one think that i dont understand i will be so happy if you help me out.
I am Eu region, not in the shengen area and my case number is current already, documents are already confirmed by kcc.
Our consulate is not closed, but not accepting inmigrant interviews.
If we win the lawsuit
A – the judge will say to government to make an exception and do the interview of mr. Blabla
B – sorry dude we do not accepting dv interviews so your win means nothing to us, in other words it is ‘moot’
A or B which one do you thing i could get?
Thank you do much for you
March 26, 2021 at 00:14
I can’t be certain of the outcome.
March 25, 2021 at 23:05
Hi Brit. Have seen Visa Bulletin. My case no is in the 16xx range so not yet current. I sent my documents to KCC in November, got the auto email but have heard nothing since. Have sent a few follow-up emails and tried to call but went to voicemail. I believe I’ve submitted all documents correctly. Do I just wait and see what happens in next few months? Will they let me know if there is an issue with my documents/application that needs fixing? Thanks again for this fantastic resource.
March 26, 2021 at 00:13
You should contact KCC to see if they are satisfied with your documents.
March 25, 2021 at 22:57
Hi simon,
When you are in the embassy and request them to unlocked your ds260
1.are you allowed to change and adjust anything you want to change or you can only change the info of your sponsor like his address ect???
March 25, 2021 at 21:30
Hi Brit
Nicole lawsuit is a bit like the new Charles Cook case, which is also filed in Washington
And it is only for the plaintiffs
Do you expect to receive a similar initial judgment as the Cook case?
March 26, 2021 at 00:11
I don’t know anything about her case.
March 25, 2021 at 17:51
Hi Brit, my name is Mahsa, I am from Iran, I am DV 2021 winner with the case number 2021AS000004xx. I have sent my DOCs to KCC in October 2020 and received their email which says my case is ready to be scheduled. Do you suggest that I take part in the Immpact team lawsuit? As you explained in your last video regarding the lawsuit, this lawsuit is most useful for those countries in schengen area and the countries in trouble with regional ban, Is Iran one of those countries too?
March 26, 2021 at 00:09
You have to decide for yourself.
March 25, 2021 at 16:58
Hello brit. I am from Ethiopia. My case number is 12k. This case number is catagorized under march visa bulletin. But I haven’t received my second notification letter. But in february 1 they sent that your case number is ready and we will schedule when appointments are available. So what can you say for my case number. I am in great tension…
March 26, 2021 at 00:08
Have you received the “ready for scheduling” email? If yes, all you can do is wait.
March 25, 2021 at 15:45
Hi Simon, I wrote an email to the embassy asking if they will process DV cases, they said however, that that matter is up to KCC to schedule interviews. Do you think if I email KCC I will be able to get them to work together? Because as far as I know, what’s stopping KCC from scheduling interviews is that the embassy is closed. Also, has anyone received a similar response in other countries’ embassies?
March 25, 2021 at 16:27
hie,i got the same email too from the embassy that KCC is the one which is supposed to schedule the interview, but they also said that as from 3 March they suspended IV and NIV visa interviews and they will resume as soon as possible but they can’t give a specific date.
March 26, 2021 at 00:06
We have to wait and see.
March 25, 2021 at 15:16
Hello, my father when he finished high school was running the school she was only 3 years old at the time and I see that the embassy says 8 + 4 can I have any problems to reject me?
March 26, 2021 at 00:05
I don’t know education requirements in specific countries.
March 25, 2021 at 14:48

Will they? No
March 25, 2021 at 14:48

Hi Brit, Asking for a friend. I’m dv2021AF20k. indicated it on application and on ds260 that I’m divorced however when I applied my passport was still valid and had my maiden surname as I had taken it before I got married .now that passport will expire in July and because my national identity card now had my former married surname .I recently applied for a new passport and it now came with the surname of my ex husband .so now I wonder will I be disqualified or as long as I have the divorce certificate and the National identity card they will accept that my new passport now has a different surname. Thank you

Good morning Sir , 2021AS11xxx
SIR , I am a plaintiff in the new litigation of dv 2021 , I submitted my documents as per request of KCC on oct 02 2020 , I am current ,
1 – do you think my chance to be interviewed is high ?
2- is it a good decision to participate ?
Thank you SIr
March 26, 2021 at 00:08
1. I don’t know
2. Your choice.
March 26, 2021 at 00:02
I don’t know for certain if that will cause problems.
March 25, 2021 at 08:50
Hi Britsimon,
I have sent my supporting documents about 5 months ago until now i didn’t received any response from KCC. The only response the sent back was documents has successfully received.
I had doubt about my passport picture due unclear images. My case number AS6000. I had asked KCC but the answer remain unclear. My consulate which take care of immigrant visa hasn’t been opened till this time. Is this can be the impact as well from KCC to delay my case?
Do you think by sending again my 2nd times of supporting documents with clear picture of my passport will impact on my case number?or shall i wait any response back from KCC if they missed or need anything further more? What shall the best action should i take? Please ?!
March 25, 2021 at 20:09
same situation
March 26, 2021 at 00:00
You need to contact them, preferably by phone. 5 months is too long, and perhaps you are missing some needed documents. Check them very carefully.
March 26, 2021 at 01:57
Is it good to sending them again second times to the KCC about the supporting documents without calling them?or shall i call them to have better answer?
Thank you

https://britsimonsays.com/what-can-you-do-if-your-documents-are-not-being-processed/
March 25, 2021 at 08:34
Hi Simon.
I really need your advise as i am kind of lost here.
My case is EU93xx. So it has been current already.
KCC came back in December and asked for ducuments which i have submitted. After that my status changed to AT NVC. Since then nothing happened. I tried calling them without luck.
They replied once to my email that my DS 260 was processed. And second time i have asked them if my documents are satisfying KCC no reply.
So i am not sure whether there is something wrong with documents or it is just simple delay related to covid? Why i am not receiving 2NL?
March 25, 2021 at 23:54
You have to ask them.
March 26, 2021 at 19:27
Hi Farid.
You have to be patience as KCC is working actively. My case number is 69XX and I have sent my docs in early semptember 2020.Today I received the “ready to be scheduled” email after 6months.So chill out, document processing is ate cn 7k range.I hope I helped you.
March 25, 2021 at 07:56
Dear Brit,
I have two questions.
1. I entered the lottery with my spouse, but she does not intend to immigrate with me. I have filed my DS-260 and on the CEAC page my application says “completed”, and since I did not open her application, hers says “start now”.
a. Should I leave her application as is?
b. Should I open her application and do something on it?
c. Do I need to inform the KCC about this?
2. My case number is 2021AS23XXX. Since my case number is high, I am planning to join the “Impact Team Lawsuit”.
I listened to your recent Q&A video and you highlighted the importance of this lawsuit in the context of schengen ban along with other things. Even the Impact Team is calling it “The Regional Ban Litigation”.
a. Considering all this, do you think it would be a good idea for me to join this law suit.
b. Would you join it if you were in my place?
c. Would you recommend any other lawsuit or joining this would suffice?
March 25, 2021 at 23:53
1.a. Yes
b. No
c. No (but you can if you want.
2. a, b and c. I already gave my opinion.
March 25, 2021 at 06:42
Helo Mr Simon I wanna ask ask you about sponsor if birth place for my sponsor is different my birth place is there any problem to me is it possible make the consulte doubt about about relative with sponsor like example,

March 25, 2021 at 08:29
Your sponsor does not have to be your relative – they can be your friend.
March 25, 2021 at 23:52
No problem.
March 25, 2021 at 06:40
Hello Brit, and thank you for your helping. My question is like out of topic but I could not figure it out who can help me.So i have a valid B1/B2 visa,i have to travel to the US next month.Do you think it will be a problem or i can travel with that visa, and if our Embassy schedule my interview i will be back for it.
March 25, 2021 at 23:51

March 25, 2021 at 05:18

Hi Brit,
Would you care to provide any details as to progress made on the case before Judge Mehta on the matter of the DV2020 visas being issued to those who would not have had the opportunity to have an interview because of the pandemic and also provide a date as to when the next court hearing would be.
March 25, 2021 at 23:48
No update. Late April or early May.
March 24, 2021 at 22:55
Hi Brit,
1. When I send documents, should I send them all from the main applicant’s email or should I send everyone’s documents from their own email?
2. If I (hopefully) get my 2NL and I then decide one of my derivatives should not be immigrating with me, can I just inform the CO at the interview?
March 25, 2021 at 11:49
Hi Mr.Simon,
I am a DV2021 winner and I am the principal applicant and my wife will immegrant with me.My wife passport which we used to fill DS260 had expired after we submitted the DS260 and now she has a new passport , now I am going to submit the documents to KCC so should I submit a photo copy of my wife’s passports (the expired one which we used in DS260 and the new one) or just submit the new valid one?
Thank you Mr.Simon in advance and wish you always the best.
March 26, 2021 at 00:03

March 25, 2021 at 23:47
1. From 1 email is fine.
2. Yes
March 24, 2021 at 22:47
Hello Britsimon!
I hope you are doing well! I have some questions:
1- How long does it take as maximum to transfer a DV case from US embassy in Egypt to US embassy in Sweden?
2- Is there a risk that the case will be missed in the transfer?
3- Should we start to get contact with embassies now to transfer the case or should we wait? case nr 2021AF8xxx which is a low number and hopefully will get interview.
March 25, 2021 at 23:47
1. It varies.
2. Things can go wrong, yes – so you stay on top of it.
3. Depends on whether you have had the ready for scheduling interview.
March 24, 2021 at 21:50
Dear simon,
I am from arabic country AF29k, is it okay to submit document both in arabic and certified translation in english just to be more sure.?

March 24, 2021 at 20:41
Hello mr BritSimon thank you for the time and effort I’m current in march VB 17kAF Morocco i have received ready for scheduling before the last 2nls and i ask kcc about my case and after a week they replied with :
”
Thank you for your inquiry.
Records indicate you have submitted a complete and valid DS-260 application for each family member, and you have provided all required documentation to the Kentucky Consular Center. Interviews are scheduled numerically based on case numbers that have completed processing. Please refer to the visa bulletin at https://travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check dvprogram.state.gov.
In order for the Kentucky Consular Center to assist with inquiries regarding a specific Diversity Visa (DV) case, you must provide the Principal Applicant’s full name, complete case number, and date of birth in the following format (MMDDYYYY) as entered on the original entry. Please remember that the Kentucky Consular Center does not have the authority to tell you whether or not your specific case will be disqualified. Only a consular officer can do that at the time of your visa interview. Do not send any paper documents to the Kentucky Consular Center. …………..”
what do you think the reason that i have not received 2nl since the embassy in Morocco is open and processing Dv cases .
thank a lot for the help and patience
apologies if my question is already answered .

Dear Mr. Britsimon;
My Case Number is DV 2021 AF 2XXX. It has been current since last year October 2020 as per the October 2020 Visa Bulletin published for interview. The problem is that my son is now 21 years of age and I am bit concern about getting him getting a visa. He was 20 years 11 months when the Visa bulletin (October 2020) in which our CN is indicated within was published.
As per CSPA regulations put forth by USCIS, I did the mathematics and his CSPA age stands at 20 years 2 months 25 days when the visa bulletin was published.
Please see the calculation below:
DV Entry Registration Date: October 2, 2019
DV Selection Date: June 6, 2020
Pending time: 8 months 6 days
Age at time of visa availability: 20 years 11 months (Visa Bulletin for October 2020 interview)
CSPA= Age at time of visa availability – Pending time
CSPA=20 years 11 months- 8 months 6 days
CSPA= 20 years 2 months 25 days
Under this calculated CSPA age, I would you like to kindly address the following concerns for me;
1. Is he eligible to receive visa even if interview is conducted between July to September 30, 2021?
2. Is there any point in time that he ages out? If so, please show me the time or month;
3. Since indeed we are current and with this issue of child aging out, can I notify KCC and or the embassy to schedule our interview early so that he does not age out?
4. Please advise me what I should in this stead
.
Presently, the embassy in my country is handling Immigrant cases but not DV cases. We do not know when it will start to process DV cases.
Thank you so kindly for the reception and assistance and I look forward to hearing from you.
Best regards
Grace.

Mr.Britsimon
With this, what do I need to show or give to the CO during the interview concerning this issue of the age?
Thank you and best regards.

Hello! I’m doing the ds260 for dv2021.
The passport I used to enter the lottery is expired and have a new one, police took the old, and have only a copy of it.
I already read that I need to bring the copy and new at the interview but:
– do I also need to insert the old in the ds260 (I can’t find any way to put it)
– do I need to send the copy of the old when they will ask for the documents AND bring it to the interview?
Thanks man.

1. No, you scan the documents and email them to KCC. INclude old and new when you send it.
2. Yes both.
