Hey Brit,
I attended your Q&A today but I was unsure about asking this.
My wife is going to have elective surgery (breast augmentation to be exact), I’m a DV 2021 winner (SA44XX) and we are concerned that doing this might hurt our chances at the medical exam. Do you think this is relevant or are we over thinking this?
I think doing something like this might be in our favour since it might show as proof that we are in a good finantial state even before leaving.

Does DV – 2022 selectees need to fill I-134 i mean should i have a sponsor in the us ? And i read the FAQ and on Travel State website they mentioned in the instructions first i need to prove that I’m not gonna be a public charge but then i see many lawyers and YouTubers they say no need for sponsor if you won through DV it’s not family based or employment based and if yes i have to do it then when exactly and where to send this document or it’s something I bring with me to the interview

Let me express my deep appreciation for your valuable advice to my questions and for ‘educating’ us through your blog with the various aspects of the DV lottery, and providing useful information, comments, advice in response to the humongous questions you receive from all over the world. A big kudo for your untiring effort to help make the DV process (for applicants and winners alike) a little easier.
As in the case of Pat, I and my husband managed to travel to the States in mid-March and activated our DV2020 immigrant visa (stayed there for two weeks). We received our SSN on 26 March and Green Card (in USA at relative’s address) on 10 May.
I have read the FAQ on “Timeline of first entry and absences from USA” but need further comment on our situatiion. Since we left for the States on short notice to avoid our visa expiring, it was necessary to return to Germany to wind up things (giving notice to employer and landlord, preparing for shipment, etc, etc.). We plan to return to the States for good in September. Will there be any problem if we return with our passport (which has the LPR stamp) and without the Green card (we do not want it to be mailed from the States)? It would be less than 7 months (from date LPR was granted) by the time we arrive back in the States.

1- for first boy I selected the option of “no, this child will not immigrant with me” is it correct?

Dear Simon,
I know you’ve got a section on marriage situations in your FAQ. But still, here’s a specific question, if I may. My long-time partner and I have been postponing our marriage due to the Covid situation. But now that I’ve got selected for further processing, we obviously need to speed things up and register our marriage prior to submitting DS-260, as we intend to leave and spend the rest of our lives together. Now, the marriage registration process in our country normally takes 10 working days. Will this 10-day delay cause any risks in terms of the DS-260 assessment, the interview or the visa (as I understand, there’s a limited number of visas)? Say, we’re finally registered as a married couple in two weeks’ time – will that be too late for submitting DS-260? (Considering that the DS-260 website recommends completing and submitting DS-260 immediately after the lottery results.) Basically, what is the safe time span for submitting DS-260? Is there a no-later-than deadline?

It depends. Generally, you share the number range, not the precise number. But the number itself is only a risky thing to give someone if that person also knows your name and date of birth.
Online you “hide” the precise number, but give a range. So – if your case number is 2022AF000012345 – you give it as 2022AF12XXX – so we can see it is the 12 Thousand range (AF, and 2022)

Apparently i heard of a case like that one, where someone used the Regional Passport number and did not have the International one, i DONOT remember which US Embassy it was in, but it was in Africa.
I understand the Selectee explained themselves Honestly and Clearly to the CO that the application instructions DID NOT CLARIFY THE KIND OF PASSPORT TO BE USED as long as it was a VALID PASSPORT. So the person went to the interview with Both Regional Passport they used to apply and the New International Passport they had gotten later and they got their DV Visa approved.
So just make sure you over-prepare yourself adequately And DONOT LIE. Get a New international Passport to continue the Process to the end. ALL THE BEST

I agree with your advice Sueshi, but I find the example somewhat suspicious. This has only been a rule for DV2021 and beyond – and as you know VERY few interviews have even happened yet. So – it is likely that people are “making up” stories, which happens often. The number of countries using these regional passports is small – right? So out of the 380 ish visa issued in AF region, only a small number could have been in countries where regional passports are even a thing, and out of those someone has given a report of success. Seems fishy – do you have first hand knowledge of any cases like that?

1. No. The new rule about passports being required at entry has not been “tested” yet because we have seen very few interviews so far in DV2021. Mostly, people who could not explain why their passports were not provided have not been scheduled for interview at all, and if any cases got to interview they are too few to get some reliable feedback in volume. So we do not know whether COs will disqualify cases for this error – even though the instructions clearly say that will result in disqualification.

Hi Simon. Someone previously asked a question about step-children but I’m still a bit unclear. My husband has two children from a previous relationship. They live with their mother but we included them on our application. I’m just a bit unsure about the questions in relation to this. I’ve answered ‘no’ to ‘are they living with you’ and ‘no’ to ‘are they immigrating with you’ because right now they are not. But then the question ‘will they be joining you at a later date’ comes up. I’ve answered ‘no’ at the moment because I’m taking this to mean we are planning on getting them over later on. But this is something we would think about much later on when they are older. I am ok to keep this as ‘no’ in this case. Basically I’m unsure if answering ‘no’ now means it’s a ‘never’ type thing if I’m making any sense?
Also, my case number is AF3XXX. From what I have been reading this is considered a low number. I’ve also read a few comments about sending documents. I’m under the impression I am not to send any documents until I get an email from KCC? I am correct in this yes? Just because some have asked if they should go ahead and send as the case number is low?

I will answer you because maybe you are about to send your DS260 and Brit is not here yet. Will they be joining you at a later date? Answer YES. This means anytime you are ready to file for them in the future, doesn’t matter the number of years it takes.

Yes that is a low number. If you are keen to interview as soon as possible, then you should submit the DS260 now. For documents I would NORMALLY say wait for them to email you, but things are really messed up at this time, so you would be wise to wait a few weeks after the DS260 submission and then if you have not been asked to send documents, send them anyway. Again, all that assuming you want the earliest interview possible. Why wouldn’t you want an early interview – well – you need to consider when woul be a good time to move the USA.

They don’t have the right to even do that. You’re not doing anything wrong, you’re simply asking them (via your lawyers) to do their job. That is your right. Besides, how would the people interviewing you even know you signed up if the interview happens before a decision is taken? I doubt they’d find out.

I was a DV2018 selected, I was refused at the Embassy ( BUD ) because of my profession ( education ).
After the rejection, I left my job because of this and for obtain my High School diploma.
After I got my High School + Programming Schools (180 degree turn in my life ) I’m waiting with high hopes, then:

DV is a lottery. The chance of selection is very low. You should not look at this as the only plan. Make a good career and life wherever you live now, and each year you can try the lottery again, but it should not be your whole focus.

I have graduated in the US and stayed there legally longer than the date on my F1 visa under the post-graduated OPT program. Will I be denied the DV green card on this subject?
Now my wife is studying in the US with F1 visa. She has an SSN, receives checks from employers and files her income tax every year. But from last year on she has accepted the Covid-19 relief checks from the government. Will she be denied the DV green card on these subjects, too?

I did not add my son on my dv lottery entry because his mother did not want to take a picture that meets the requirements.( we were never married and my son stays with her)
I never intended for him to accompany me to the USA but do need for him to be included in my application.
I added him as my child on my ds 260 application( as a applicant) to prove that I did not want to deceive anybody.

You are 100% certain to be disqualified. You were required to add him to your entry – and they were very clear that leaving a derivative off your entry would cause disqualification. There is no doubt about the outcome, you should not proceed any further.

BritSimon Hope you are doing well, I am a DV 2021 winner with AS 25K I sent all my Required documents for my Accompanies and me almost 5 weeks ago, 2 weeks ago i sent to kcc an email asking them if they are satisfied with the documents or not. Till yesterday i also sent them again an email asking them the same thing, Today i got an email from kcc which said “Dear XXXXXXX : Congratulations on your selection for the 2021 Diversity Visa program! Please read this email and carefully follow the instructions listed in order to have your application processed as quickly as possible. You should review the list of required documents for processing below and send those to KCC to review as part of your application package, along with completing your DS-260. You will only be scheduled for interview at an overseas consular post after you have completed your DS-260 and submitted all documents required for your case and your visa rank number has become current. And so on ……. SO, 1. What do you think mr. BritSimon about this email and if you were me what are you going to do ? 2. Is there any positive signs for me from this email getting my chance to be interviewed? 3. Is it better to resend all Required Documents again ?

I sometimes see people that send documents without being asked receiving this email. My assumption is that sending the documents prompts the documents department to “start” the case, and the system automatically sends out this email request. Of course, I can’t be certain – but that is my assumption.
I would check the documents I have sent, and if I was sure I had sent the correct documents I would wait for at least 2 or 3 weeks to see if they then follow up.
The only thing I would say is that your case number is quite high, and so far no one near that range has been scheduled.

I am a plaintiff in one of the lawsuits and my case is still at NVC, I just checked my DS260 and realized that I need to add a bit of info about my education(I forgot to add my high school).
But I am afraid to request to unlock my ds260.

I am 2021 winner my number is AF45** Egypt, cairo embassy didn’t send any June interviews and only 7 interviews for may. The highest case number is 1208 for the interviews sent. I have a B1/B2 visa and I was thinking do I go complete the process in USA or wait my interview here in cairo because my case number is relatively low. I don’t know what is the wise decision to make and I was hoping you help me take a decision.
I was thinking maybe I’d wait till the end of may and maybe I get scheduled for June on the 2nd batch of 2nd NLs in mid may, and I know that if I go to USA I should wait 3 months to complete my DV process.

Because of that three month wait, you should make your decision and plan now. You would have to be able to support yourself and expect to be unable to work for several months. So – if you understand all that, make your decision sooner rather than later – otherwise you will not have time to complete AOS.

Hi Simon. Thanks so very much for your guidance lately. I wrote to KCC a few weeks ago asking to be scheduled as my CN is current (2021OC3xx) and I got my “ready for scheduling” email last August. They sent me a stock response:
“Your case number is now current for interview processing. Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov. If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.”
I know you mention a similar response in the FAQ, but (1) Do you think this means my case details have been sent to the consulate already? And (2), if I were to politely push and ask again for an interview, would it be the consulate I would write to, or won’t they even have heard about my case yet? (The consulate in question is Frankfurt, which seems to be taking some DV cases. On CEAC my case still shows as “At NVC”.)

Well the email normally means the case is actively being scheduled. However, there is clearly some capacity restriction being applied which means your case is in a queue to be scheduled at your consulate. Frankfurt have accepted a VERY small number of cases thus far – so all you can do is hope you will be one of those lucky enough to get an interview slot.

Your forms have been received and are currently processing. Allow several weeks for processing. Interviews are scheduled numerically based on case numbers that have completed processing. Once the Kentucky Consular Center has finished processing your DS-260, you will receive an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.
Does the “FORMS” mean for both the DS 260 and Docs or only the DS

My parents won DV lottery 2021 with the case numbers in 11k, they already got two email responses back from KCC, but nothing about the interview yet, they are in Georgia, Europe. Do you know or can you predict if they have a chance to get interviewed till the end of September? Please help.

Hello, Simon. I live in a new place since January. However, I am still registered in my old place, because we have not established all documents for the news house yet. In ds-260 I filled my new place of living. However my registered place of living is still the old one even though I know longer live there (but I still own it). My question is – Should I worry about this ?

You should also check the information posted by the Embassy or Consulate you chose for the location of your interview for operations details. The process for scheduling DV appointments has not changed from previous years. Selectees will be asked to check the Entrant Status Check (ESC) website by an email sent to the address they provided as soon as an interview is scheduled. KCC cannot predict when individual cases will be scheduled for interview, and you are not asked to take any additional steps if you have already provided all your documents and information. AOS is a different process, and there are some challenges with that approach, not least of which is that you would have to support yourself without working for several months. Could you do that? Do you understand the AOS process? If so – you might want to proceed, but you would have to act now.

Get married asap and submit DS260 as married. There is some risk of denial – but that denial is not certain. So – if you want to take the chance – that is your decision.

I am from Nepal and I got selected in DV 2022. I was in Nepal when I applied for DV but I came Germany 1 months ago in a student visa. Can I give a interview from a US embassy in Germany incase if i get the second letter ? Or should i go back to Nepal for interview ?

Hi
My partner (Nepal Citizen) got selected for dv 2022. I am from India and we both are currently living in Australia.
We have been in de fecto proven relationship since last 3 years.
No we are in dilemma that shall we first get married which will take 1.5 month in Australia and then fill ds 260 form as a married couple.
Or shall my partner fill form now as a individual and then later we send email to Kentucky councilor centre and update them our situation.
We are very stressed out and not able to move forward. Every one has suggested to fill form asap.
Please suggest on this and how to register with you as a client.
