I send you a greeting, we are from Venezuela and my husband participated in the Dv2022 Visa Lottery and was preselected, since 2019 he has had a lot of problems renewing his passport even at this moment it appears as if they had already given him the extension in Vzla and we are In Colombia, here we do not have a Venezuelan consulate, when applying the application, we do not take into account the passport exemption and we state that it was from a country taken by communists … we did not know that for the United States, Venezuela was not a communist country. The US government understands the difficulties in getting a Venzuelan passport renewed, and has given an automatic 5 year extension for those passports. So – complete the DS2670 with the expired passport but add 5 years onto the expiry date. At interview you will be required to explain why you chose the communist country exception, but my best guess is that they will not deny the case based on that mistake. That is not 100% certain, so you must decide whether to take the risk or not.

The DS-5540 is it required to this point or not for dv 2022 ? On Travel State Gov website it stated “ Visa applicants are otherwise not requested to take any additional steps at this time and should attend their visa interviews as scheduled. Applicants are not required to complete, nor should they present, the DS-5540, Public Charge Questionnaire.”
So can you tell me why i see a lot of people saying well you have to have the DS form when the government is saying you don’t need it if you have Affidavit of support … Lastly when i checked the DS-5540 it’s saying “ DS-5540 Public Charge Questionnaire The form is currently unavailable.”

Hi Mr Simon , i am currently in the process of filing the ds260 form and my surname has a dash (-) in it which the system does not accept and gives a red note that the name is incorrect but also it should match what is in the passport which is exactly what i wrote , so do i leave a space or join the two parts of the name together and if i did so would not that affect the validity of the information i provide and jeopardize my acceptance chances ?
my surname in the passport is ( AL-LASASSMEH) .

I have faced a question while filling the form of Lawsuit by Curtis Morrison.
In the form there is a question for those who have submitted their documents to KCC.
Here is the question: “Did you receive a confirmation from the KCC that your documents were processed?”. By the time when I sent the documents I did receive the automatic reply indicating that they received and currently processing it. So should I say yes or no for this underlined question?

If you haven’t received the ready for scheduling email yet, it means that your documents have not yet been processed by KCC. In that case, you would need to select ‘No’ for the purposes of this question.

I left my country of eligibility four years ago and never went back ever since. I do have a translated police certificate three months prior to leaving the country of eligibility.
1) May I use this police certificate? Or is it necessary to have a renew version? (Please note that I am aware that I need to have a police certificate of the country of my current residency.)
2) Is there a need to renew translations of Birth certificates or any other documents as long as there is no change of status?

Check the reciiprocity page for your country. You might not need another one if you have not returned to the country ever since. Best to check what the reciprocity page says and act accordingly.

If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview:

The police certificate was obtained more than one year ago; and
You still live in the country that issued the certificate.

In regards to completing the DS260, US visit section, where it asks about the arrival date and how long I stayed there.
I was in the United States completing my undergraduate studies from 2013 to 2018 on F-1 visa. Through this period I travelled to my home country during vacations.
should I include the whole period from 2013 to 2018 as one visit? or divide the period into several visits when I go back from vacation to the United States?

Sir I was considering joining a lawsuit which’s going to be filed by Nicoletteglazer, an imagration lawyer based in California, so sir does she have a good track record and while she was talking about her new lawsuit, she kept mentioning that mandamus action is the last resort and she asserted that she doesn’t see favourable results coming out from such lawsuits coupled with having many plantiffs will make judges uncomfortable to issue decision. So sir what’s ur thoughts on that?

Is there a way to move embassy?

On May 5th I had the interview and everything went great and my visa was approved. They said to me to come back after two working days to take my passport. But, one the next day the sent me an email and said that unfortunately your passport will not be ready tomorrow due to technical issues. We are hoping to resolve it soon and will notify you when your passport is ready for pick up. My status has been stuck on READY since then. I heard it in your video that they are having a printing issue, and we need to be practice patience. I understand that but still I’m anxious since then.
Do you think that this problem is going be solved soon, or it can last for weeks or months?
Is possible to have any effect in visa approval?

Hi Simon, I am an EU applicant based in Canada. DS260 had a question on visa location, and I confirmed that Montreal was correct. Even though I haven’t submitted the application, this question is greyed out. Now I see that Montreal is not processing DV2021 and according to a message posted in a forum they would not start anytime soon due to other urgent issues. Is it possible to change interview location to one of European cities that is good with interviews, such as Vilnius, Almaty or Tbilisi by emailing KCC?

You are not being clear. Are you talking about entering the lottery for the next entry period in October? If so, you MUST include your spouse and your step child in your application, and your spouse CAN enter also, charging to your country. If you read the FAQ that is all well explained.

On 8th May I got the news that I have been selected for DV 2022; I submitted my DS 260 on May 16 2021 not knowing that it is not good to rush. I found your useful blogs after submission of my DS 260 otherwise I would have delayed it till august or even September 2021.
I have two questions to ask and thank you in advance for your reply:
1: In my original entry form I answered the question ” Country where you live today” my permanent address at my home country in Afghanistan despite the fact that back then in October 2020 ( at the moment of filling out the entry form) I was studying in Moscow, Russia and my brother filled out the entry form for me from Belgium.
I myself don’t know why he did this but it just happened because my stay in Russia was not sure and I thought of returning to Afghanistan very soon. I had moved to Russia in September 2019.
This thing has been bothering me ever since and will keep bothering me till I get my visa approval or in worst scenario a refusal. I am a 24 years old boy and am currently studying international relations at a university in Moscow.
But on DS 260 form I wrote everything correctly, and wrote as my current address my address in Russia where I am living now.
Is this gonna be a problem or a material fact as a ground for a refusal?
2: My case number is 2022AS00007XXX; Is this a good one?

But actually if I had counted all of my elementary schools It would have become more than 7 schools. I thought they meant only educational institutions I attended after the age of sixteen.

Thank you for your dedicated support to all in need of “making sense” of such a complex convoluted system!
I have a complication that I will try to shorten and would love any assistance you can offer. I am the primary DV2021 OCxxxx candidate for myself and my husband. We completed the DS 260 that was sent to us, lots of confusion around he correct paperwork. We are Australian’s on a working visa living in the US at present.
We were told we completed the wrong form and we needed to change to the I-485. We didn’t want to change as we were anticipating being in Australia for interview and gaining DR. assessments etc in Australia. We were on the list earlier in the year, at present I cannot see our OC number on the “current” June list where numbers around us are posted. We are not sure what happened? Do you have any suggestions for “what next” please?

This question sounds like there is a lot of confusion, that could be very bad for your case. For example – you said the DS260 was “sent to you”. You complete it online – so no one will have sent it to you.
First, I wonder if you have followed the steps properly.
1. When did you submit the DS260 online?
2. When did you send documents to kccdocuments?
3. Have you received the email saying ready for scheduling?
Now, all of that involves the CP process where you would expect to interview in Sydney. Travel to and from Sydney is not easy at the moment and although SDydney is doing better than most embassies there is still significant risk you will not get an interview (especially if your answers to 1, 2 and 3 are not good.
Depending on you answers, you might want to reconsider the switch to AOS (the I-485), which is safe and unaffected by travel restrictions and so on, plus you have time to complete AOS. So – I don’t understand why you chose not to do AOS – please explain – because again, it could be some misunderstanding.

1. The DS260 was submitted and confirmed on October 26th 2020.
2. I realize now that the extra paperwork was not submitted as went down a rabbit whole trying to contact Philadelphia for an interview after being told to schedule it ourselves, unfortunately correspondence was only via pigeon mail! months past by, then it was suggested to fill out the i-485. We sadly have had advice from 3 solicitors, 1 in Australia and 2 in USA, all giving different advice, most saying go back to Australia as the system is very convoluted and may not go through at this time point.
3. No interview scheduling email was received, of course due to no. 2 not completed.
How much time do we have to complete the I-485? we still need to get Police checks from Australia.

Well you royally screwed it up. I have no idea why you were trying to get an interview in Philly for a DS260 submission.
1. You haven’t followed the CP process correctly – you should have sent documents, and it’s not for sure that you will get an interview now as you are so late. So you need to immediately decide whether to try and fix that by sending documents now, or you switch to AOS.
2. Stop talking to lawyers that have no idea how DV works. Just stop talking to lawyers, period.
3. If you want to switch to AOS, you can do so immediately – I suggest you click on the link below. The first post in that thread has a link to a document that explains the AOS process, and describes what you need to do. Do it yourself, not through lawyers. You have time, but you need to get on top of this now, and paying someone to give you bad advice is a sure strategy to lose your chance.

Hi Mr Simon I am a DV2022 winner and I am currently living in South Africa but US consulates have stopped processing immigrant visas throughout the country and we don’t know when they will resume. Do you think I should change the location where I will be interviewed to a country that is less affected by the pandemic than South Africa and where embassies are currently processing cases? cause I know when filling the DS260 there is a section where they ask you where you would want your interview to be scheduled. Regarding ds-260 form, have you ever used other names? i’m confused to answer it as my case is as follows: in my passport my full name consists of 5 names (first name, father, grandfather, grand grand father, surname), my BSc certificate for example lists only 4 names (missing grand grand father name) does this case qualify as using different name? in other words, does using shorter versions of full name qualifies as yes and should be listed as well?

Your DS260 should have the full legal name. If that means you have listed all the names – then no need to list other names used.

I guess you didn’t get what I mean. Suppose my name in passport and birth certificate is: Mody Khaled Ali Ahmed Samir. which consists of 5 names. it’s so common in Egypt to have such long name in official documents.
now suppose that my education certificate was is issued with reduced name as follows: Mody Khaled Samir, simply middle names were not mentioned.
Does this reduced name need to be listed in other names section? or Should I answer no in this case

My question
1) Do the consular officer ask you documents/certificat that in relation between your old addresses (for exemple if i was living in spain and now im living in morocco,will he ask me to bring some certificat from spain that i was living there)
Because i cant go to spain bring any document.
2) If i study in one university and i left it in the second course (year) should i put it in my ds 260 or (just ignor it) ,knowing that i dont have any diplom or certificat from that university.

i havent recieved message from kcc since i have send the documnets and my case number is af45k and ethipian embassy is only stack with 7 cases only. So what do you suggest i do shall i join a lawsuit and see if i get any chance of interview or should i wait patiently. If there is any lawsuit lmk.

Hi Brit,
I come Kenya and I am the DV 2022 winner. I have two questions for you.My case number is AF13xx8
1) In your own opinion, is my case number a lower number?
2) In East Africa region i.e (Kenya, Uganda, Tanzania, South Sudan and Rwanda) citizens of these countries can move across each border provided they hold a temporary passport. Now I entered the 2022 DV using this temporary passport. For consistency purposes, should i fill the DS-260 form using the temporary passport and carry both (passport book+temporary passport) later to the embassy should they require an explanation for its use or should I just use the passport book to fill the DS-260?

1. Yes
2. You have a risk of denial for using that passport. We don’t know for sure whether cases such as yours will be accepted or refused at interview. You should certainly use your proper passport to proceed, although you might want to wait and see whether cases like yours are disqualified or not.

Hello Simon,
I have the following case no. 2022EU201xx and I am working on a cruise ship on a 14 weeks on/14 weeks off contract with a C1/D visa.
I want to have the interview as late as possible. I understand, my C1/D visa will be canceled once I go to the interview and I will need to enter into US with my new visa, wait for green card, and after to be able to return back to my job onboard.
Basically from July 15, 2021 until October 22, 2021 I will be onboard ship and after from January 15, 2022 until March 15, 2022 on board again and from June 1st, 2022 until August 15, 2022 one more contract onboard.
Based on your experience when will be better to fill in the DS 260 form?
I need to mention on the DS 260 form, or email KCC, that I will not be available for interview on the dates I am onboard the ship, or wait to be scheduled and after contact KCC if I will not be able to make it?

Based on your number alone, you can safely ignore the first two work periods. There is almost no chance, even in a normal year, that you would be interviewed until AFTER the March 15 date. Well after.
So the only question is about the June to August timeline. If you submitted today, and simply waited for your case to be ready (and assuming the covid crisis massively improves by then), I would guess the appointment would be in the June/August timeframe (although that is a WILD guess remembering it is FAR too soon to be making guesses).
So – if you want to make life easier, delay submission of the DS260 and documents for a while to learn more. You will then need to decide if you submit to get interviewed before June 1, or accept the risk that you only have September to interview.
So for now, just wait and see if a pre June interview is even possible.

My husband is the principal applicant 1 of dv 2021. We submitted our ds 260 application forms since August last year 2020. We won as a family and our case number is 2021 AF 31936.
My husband wrote to Kcc on march 31 2021 for case status updates and they said we should wait for their notification bcs cases are scheduled numerically based on case numbers.
We are worried bcs we haven’t received docs submission notification from Kcc up till now and it shows that our Visa number is already available on VB of may.
Reading this blog post have seen similar cases raised like my case and your reply is ” send your documents. My question is: HOW DO ONE SEND HIS DOCUMENTS WHEN WE HAVE NOT YET RECEIVED DOCUMENTS NOTIFICATION FROM KCC?
Pls help me am really worried. Thanks ! Am impatiently waiting for your reply.

If you have not submitted your documents yet (as I have been advising people to do for months) then you have created a risk for your case. You can try and submit them now, immediately, but if you don’t do that, then you really are facing missing out. Instructions to submit are below.

1. It’s good – but we have to wait to see how processing is affected by Covid.
2. Wait a few weeks to see if they ask for documents. If they don’t by mid/late June, send them anyway.

Paris hasn’t been good either, but in any case KCC is not keen to move people for no reason other than fear/impatience.
You should consider joining the lawsuit – take a look at my article about that from a few days ago.

My CN is 2022AF3xxx; if the fiscal year 2022 hopefully starts “normally” I might get an interview by the end of 2021.
I lived in Spain from 2016 to 2018 and then moved back to my home country, Morocco. I am not sure how to get a police certificate for the 2 years I lived in Spain and thought maybe since your wife is Spanish you had to provide this documet at some point.
Any clue how? The Spanish embassy in Morocco told me they do not issue such document.

Hello Brit Simon. I am a DV 2022 winner, case number 2022AF00032xxx . I just submitted my form Ds 260. When can I expect a response from KCC to submit submit supporting documents.
Secondly
I meet the minimum education requirements. I had my high school diploma in Cameroon which is an A level. I indicated my highest level of qualification as a degree. I am doing a 3yrs advanced diploma which is equivalent to a first degree. Am I going to have problems during interview? I am from Cameroon and I saw on the embassy website in Yaounde that I should come along with my A level certificate. Are they going to check my degree or just meeting he minimum requirements is okay.

I am a DV2021 winner, and I have a police certificate that will expire in August. In the case that I get my interview, do you suggest that I get a new certificate? This certificate is from my country of origin to which I have not traveled in the past 2 years. I remember reading somewhere on your blog that you don’t need to renew the certificate after 1 year if you have not traveled to the country where the certificate was issued.
