A dv 2021 winner with CN AF31xxx. Will really want to know if hence forth our chance of recieving an interview letter depends only on the morison law suit now. Bcs to be honest with you I don’t even know how kcc works now neither do I even know if our case will be scheduled before the end of this fiscal year 2021.
The whole show is just scary for us right now. Have join the morison lawsuit and had already submitted docs to kcc some weeks ago.
1. do you think our case can be scheduled normally before the end of September or
2. Looking at our cn it’s just the lawsuit that will save us.

Hi Simon, hope you’re doing well.
I’m a Goh plaintiff. I also consider applying for AoS at the end of July (after learning about the final decision in Goh).
I know that there is a lawsuit against USCIS for employment-based AoS processing delays. And I know too that DV based AoS is prioritized by USCIS due to its deadline (Sep 30).
I’d like to know your opinion on this – what do you think, is it possible that those lawsuits against USCIS might decrease DV-based AoS applicants’ chances while pushing forward employment-based applicants cases?

No I don’t think that would happen. The FOs already handle DV cases with greater speed than other AOS, they are aware of the deadlines.

I submitted the ds-260 a few days ago and found out that i had messed up big time.
I forgot to include my university dorm address in previous addresses. although the “Help” text at the right mentions it as an example =).
now do you think i should ask for it to be unlocked and correct it? or can i somehow explain it at the interview? in general how serious are the consular officers about addresses?
also need to mention I’m not the actual winner; my Mom is and i filled her form correctly.

So far our embassy has not started any interviews and when we called and asked from emabssy what they say is” they have not got approval to conduct interviews so far and they are waiting for permision” can this be true? Do embassies need permission to conduct interviews? Then how about other asian countries like japan which suffer from covid bt still conducting intetviews?

I am a DV2021 winner from the North American region. I actually had my interview today and I am happy to report that I was approved!!! The CO who interviewed me returned my passport to me after the interview, and advised that the embassy will contact me to bring the passport back to print the visa in it, as they are still waiting to receive the medical package from the clinic. The medical was completed exactly 3 weeks ago btw.
Here comes my concern! Prior to receiving my 2NL, I had already booked a trip to visit the USA. I am not certain when I will get a call to bring my passport back to the Embassy and my trip is scheduled for next Friday. Are you able to advise if I would still be able to travel while my visa and immigrant package is being processed (seeing that I do have my passport in my possession)?
N.B. I will add my interview experience to your website some time this week.

Is form I-134 a mandatory document to submit for AOS? I can show bank statements and employment records that I can support myself.
I heard sometimes having extra name in your documents can cause further delays as they have to background check the support person as well.
As my number is high I am afraid that it causes more delays.

An I-134 is required in some cases, not all.
If you have extra names, list them. Honesty is important.

so if I show enough funds do I still need the I-134? how would I know if I’m one of the cases that requires I-134?

can you help to interpret this email from KCC please? We finally were able to transfer the interview to another post, but not sure if DS-260 needs to be unlocked to change the address now or once they actually schedule us? Also, we asked to transfer based on the country of chargeability but we don’t permanently live there. Is the address they are asking for purely for sending the visa? Thank you for your help again!
“Based on the information you have provided, your interview location has been changed from xxx to zzz. The new interview location will not appear on your DS-260, but will be used by KCC for scheduling purposes. When we have scheduled your interview, you will be required to log into the Entrant Status Check (ESC) to view your appointment notification. I have 2 questions, first one is that i have filled my ds260 form with starting and ending dates for my high school and university study with not very accurate dates (month and day) because it’s not available on the certificates , so i just guessed a day and month is this serious ?

A quick question on police certificates from countries I’ve ever lived in (as opposed to my country of nationality). Am I right in understanding that according to the official website (https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents/step-7-collect-civil-documents.html) I need to provide a certificate if I’ve ever lived in another country for 12 months or more and if I was 16 years or older at the time I lived there. Well, I had lived in my country of nationality prior to 2000, then spent 5 years in the UK (2000-2005, was in my twenties), after which I have been back in my country of nationality since 2005 up to this day. Do I need a police certificate from the UK for those 5 years of temporary residence over there, if it was so long ago? If so, how am I supposed to get one from such a distant past? I don’t even know how to contact the UK police for such a matter.

Exploring https://www.acro.police.uk/ at the moment, for requesting a police certificate from the UK. All in all, it looks like it’s going to take a month or so (no electronic option, they only provide hard copies via international mail). Timewise, in terms of submitting the DS-260, would you recommend waiting till I get the police certificate from the UK before I submit my DS-260? Will that not be too late? (I’m a DV-2022 selectee.)

You don’t need to wait until you have the police certs to submit the DS260. 1 month is nothing. This is not a fast process.

You need to request one from ACPO. The actual certificate is called ACRO and all you need to do is go on their website, provide the information they need, pay the fee (£55) and they will send it to your home country.

Hi Simon,
I have a question regarding the DV lottery 2022. Last October I applied for the viza. Few weeks ago I checked my status and it seems that I’m the one of the selected for the green card. However today I noticed in the DV-2022 Program Instructions that there is a new rule applied for the last 2 years with the documents that you are participating in the lottery and it requires a valid, not expired international passport. Unfortunately I have applied with my ID card because I didn’t see this rule on time 🙁 And my question is….shall I proceed with the next step filling the DS-260 or I have to write an email explanation with my case to KCC and see what the answer is? What is the best way to proceed further? Please advise!

Disqualification is quite likely. Because it is a new rule we have not seen enough cases yet to be 100% sure.

I have a question regarding the affidavit of support i134.
1-In his tax return there is the annual gross income. In the i134, he writes his annual gross income but with a slight difference of $500. Could this be an issue?
2-In his i134 form, he states that he has mortgages and gives the number. What figure is important to know whether the sponsor’s income is enough for 1 beneficiary? (Since he has mortgages now to take into account).
3-Regarding Payslip, I have received a few covering the periods from February to mid-May. Shall he also send me those of end of May and June (interview end of june)?

I can tell you that once number range is current then anyone within that range can be processed.
The guy was here yesterday, I think he sent his documents in June 2020 and KCC processed them. I dont know maybe he comes back today and confirms.
These are isolated cases, maybe 3 or 4 in EU region.
I would suggest to talk to a lawyer and file a mandamus litigation, if you are not part in any of them.
I would believe that is your only chance of being scheduled.
It seems like KCC is not willing to process more documents this fiscal year, so mandamus might be your hope.

Thank you Paulie, i saw the comments of salvino73 after you told me …and yes i think that’s weird, i mean…all respect for salvino73 and wish him good luck, but this is completly unfair because kcc clearly wrote on the ds260 confirmation page that we don’t have to send documents before they ask us, so why are they giving priority to people that has high cn and sent documents 1 year ago? Anyway i sent documents 5 weeks ago, my ds260 is sent, my cn is lower and i’m from the same country of him…so that’s completly unfair in my opinion and i think kcc is making a mess

It is not really unfair. Imagine CN 0 – 5000 are current. Within that range, anyone can be scheduled. It also depends on embassy, but mostly on how complex your case is. If it is just you and your wife and you lived only in Italy, maybe have 2 addresses since 16 years old, then this would be easier to process than someone who moved around a lot and has kids.
What you mention about KCC is their trick. If you read some of the published litigation files you will see that you are eligible for interview only when you submit DS-260 and your documents.
There is really no priority in the current range. (you may gain some priority from a legal action – litigation)
What I find unbelievable is that they do not even issue all the available visas, have not done that maybe ever. Judge Mehta in Gomez case says they processed on average something like 48000 in each fiscal year before pandemic.
Look at how many 2NLs were sent out. It is very small amount. Majority of the visas will be wasted, unless something happens.

No litigation, and yes i have been in the US 4 times with ESTA, never stayed more than the legal period (90 days), no penal or police problems in my past, just a clean young engineering student that almost finished the university hahaha trust me, i don’t think they are looking who’s easier to process…because if they do that probably i would be in first row because i’m clean in every aspect. But anyway, as i said before i’m not trying to appear stronger or smarter than other winners…just saying that kcc is acting unfairly

Frank, I am afraid your chance is in a theoretical level without a litigation.
Look at the numbers – they will waste more visas than last year.
For DV2020 in September they processed a huge amount of applications because people sued them. Guess who they processed – named plaintiffs.
Of course, do as you deem best, just my 2 cents 🙂

Caposito, very likely these rare cases were documentarily processed early on, before KCC decided to stop processing. Maybe even a clerical error as we know this is handled by some contracting company.
I am afraid praying won’t help, but legal action.

Since there is no US embassy in my country, my case would be processed in Turkey, Armenia or Abu Dhabi embassies; and as you know none of these centers provide DV services at the present time.
My question is, if this procedure continues in the next months, what should I do? can I change my embassy to a country other than these? Regarding my case number, do you even see a chance that I can get interview appointment?

I read FAQ about “Timeline of first entry and absences from USA”, but still have some questions concerning “tie up loose ends back in the home country”, so kindly ask for your opinion:
After (hopefully) successful interview, is it possible not to resign on you current job in home country, so after obtaining GC / LPR after entering USA (within 6 months after the medical), to return to home country to continue working in company (for less than a year, of course)?
It is not just matter of finishing obligations on current job, but also for kids to finish school year, personal obligations etc.
My spouse and kids should return to finish their obligations, while I plan to stay in US and start organizing life for them to come after one year.
I fully understand that as a LPR one has legal responsibility (to report tax on USA and foreign income, etc.)

Hi BritSimon, I am a DV-2021 winner from Guinea-Bissau. I lived in The Gambia and Egypt as a student. I got a police certificate from The Gambia and my home country, but I am unable to get a police certificate from Egypt.
I contacted the Egyptian embassy in Dakar to request one, but I didn’t get a positive response as it insists that I contact Guinea-Bissau embassy in Cairo. I informed them that Guinea-Bissau has no embassy or diplomatic representation in Egypt. The embassy insists on that.
I wrote a detailed explanation and included all my electronic correspondences with the embassy.
My question is: will lack of obtaining a police certificate from Egypt lead to disqualification?

Hi Simon! I asked a few days ago about the potential need of renewing my US police certificate (your response was that I don’t need one at all – thank you again).
I have realised that I am in a similar situation with the UK. I.e., I had lived there and obtained a police certificate after that time. Then later, after the certificate issue date, entered the UK for a brief vacation stay only. Would it need to renew the UK one?

Three questions please:
1)On the employment history section of the DS-260 form, all of my employment is related to the degree I got in college, therefore I assume that the question “Does this job require at least 2 years of training or experience?” applies to this employment correct? Since it is a requisite to have a degree to be hired for those positions specifically.
2)Since I am currently in the US I will just do the “Adjustment of Status”. I am currently under OPT, my OPT expires February 2022 but I can apply for the extension which is 2 more years. Should I do it parallelly is I continue with my adjustment of status?

According to statistics from DV 2021 Daily Statistics, SAVE THE DIVERSITY VISA, there are presently 137 embassies when it comes to the issues of the DV. Of this figure, 105 embassies are currently working while 32 are still silent meaning that they are not working.
From weeks ago, the embassy in my country was under the silent category but she was processing other immigrant visas at the same time but not DV. Today, while perusing the website, I observed that it is now under the working embassies category. With this development, I want know:
1. Does this suggest or imply that the embassy is now set to start processing DV 2021 cases?

Hi Simon,
I am DV2022 OC6XX. I have submitted my ds260 but not submitted supporting documents to KCC yet.
My husbands passport is due to expire Jan 2022, which is roughly (hopefully) around the time we might expect an interview.
Do you think it is better to:
a) renew passport now, unlock ds260 and update passport details on ds260 (prior to submitting docs)
b) renew later in the year, then unlock ds260 to update details (would this risk delay of interview?)
c) renew later in the year, don’t unlock form and run the risk of passport being expired according to ds260 form (if Feb or later interview) but bring new passport to interview? (Ie Does ds260 always need a current passport?)
On a side note, in the ds260 when entering past email addresses , I didn’t include my work/corporate email, only personal – if you think this will be an issue I might be better to renew now and go with option a) anyway and amend this?

I have a question about passports. My case number is DV2022EU5xxx. When I applied for DV2022 I sent it with my original passport where I have two UK student visas but from 2021 in my home country started giving second passport( the red passport) and it is just permit for leaving from and arriving to my home country and that is it. Will it be a problem?
