Simon, you are correct in your videos about how cases are ordered. But I believe KCC’s scheduling interviews based on DQ date instead of case number is unlawful. The law says diversity visas “shall be issued to eligible qualified immigrants strictly in a random order…” [8 U.S.C § 1153(e)(2)]. The time to become DQ is not strictly random, but based on arbitrary factors like complexity of application, number of derivatives, and country of origin. Only case number ordering is strictly random. Therefore, legally, of those plaintiffs who are already documentarily qualified, the 6,914 reserved visas in DV2021 should go to those with the lowest case numbers, not those who became qualified first. DQ date must be disregarded completely, or KCC is acting unlawfully and low CNs will have grounds for appeal.

You are only taking one part of the regs into consideration. The very next line says “(3)Waiting lists of applicants for visas under this section shall be maintained in accordance with regulations prescribed by the Secretary of State.”. And that refers to procedures about cases on waiting lists being treated in an order of DQ. This is standard among other visa types. So – I don’t think your point has any legs. But feel free to consult a lawyer.

The lawsuits have to be filed and visas reserved BEFORE the year expires. As to whether non plaintiffs will get reserved visas – we have to wait and see.

Hello Simon,
My SO was selected for further processing in DV2021. Initially we prepared to get married so that we could go together to the US. Unfortunately, the DV2021 situation unfolded in such a manner that we, with a high case number, thought it exceedingly unlikely to get processed in time. Hence we cancelled the wedding for now since it’s financially very unfavorable in our country, and there is no real direct need other than immigration. However, my SO was then suddenly made DQ and invited for an interview on the same day (in late August). There is now no time to get married and process everything with the embassy before the 30th of September.
Question: do you think it makes sense to try and get a reserved visa if the judge decides he will also reserve visas in DV2021? After all, the whole ban is the reason we are in this situation now. Is there anything we can still try within the scope of the DV program this year? Or just try to get a F2A? It’s a bit of an unfortunate situation as that will take years and years. Maybe for us there is no other option to abandon the green card and wish someone else luck on it 🙂

A lot of times o sent inquiry emails to KCC, if my docs were ok or something missing. The only response that i had is….”Your DS-260 has been processed. I think KCC process DQ according to ds 260 submissions and not case number. For DV 2022 I found that those who submit their ds 260 before May 13 have been asked to send their documents regardless to CN. Some people their CN is 35k have been asked to doc, and other CN less that 1000 has not been asked to send doc. Reasons behind..

I have explained this many times. In the early days after the winners announcement there is no backlog so an early submission could easily be processed, but once there is a backlog, case number order is what drives the processing.

We’re in the range 2021AS18K, we submitted our DS-260 on June 11,2020 and we didn’t receive an email to send our documents(we were looking at the inbox and junk everyday). However, we sent them in March based on your recommendation.
I recently knew that people in my country with higher case numbers received the “submit your documents” email before December 2020! I think there is something else missing/blurry in their processing.
Note that we submitted our DS-260 after our marriage. Do you think they wanted the marriage certificate to be directly sent after completing the DS260 so they start processing it?

Your number is fairly high, so they may not have got to your documents. Your best hope is a preservation order in the lawsuits.

I’m from DV 2021. I sent an email to KCC asking if they had received my documents a month ago and they just with this today.
“Thank you for your inquiry.
The Kentucky Consular Center has not received your documents. In order to continue processing your case, all documents should be submitted as attachments to your email to ensure they are properly received. We ask that you use the following method to name and attach your files: • Your DV case number; • The full name of the applicant whose document you scanned; and • The document name or form number. For example: 2021AF00938653_John_Doe_Passport.pdf 2021AF00938653_Jane_Doe_Birth_Certificate.pdf Use your case number as the subject of the email. The maximum email size is 30MB. If the total size of your attachments is larger than 30MB, send multiple emails using your case number as the subject of each email. Please send your documents for KCC review only after you have collected all of the required documents for yourself and all accompanying family members. Send documents only to the [email protected] email address. Documents photographed or scanned with a mobile phone are acceptable, but every document must be fully legible. Illegible or incomplete documents must be re-submitted and will delay processing of your case.”
I have followed the tips in this article and all the documents are legible. The only issue I can think of is that I used this format 2021AF00938653_John_Doe_Passport.pdf instead of 2021AF00938653_John_Adams_Bary_Doe_Passport.pdf because there are four words in my full name. Should I resend the documents by including all the four names in my full name?

That would not be the problem. Look very carefully how you are sending them and make sure the subject is your full case number with leading zeros

Dear Simon, EU2021 derivative here, also a Goh derivative. We wrote an e mail to our local embassy, asking for help regarding interview scheduling and contacting KCC on our behalf – which they did expressly. Not only that, they called my wife (principal applicant) on the phone, saying they have a capacity and we’re welcome. After providing all the data, an e-mail was sent from the embassy directly to the KCC, a day after KCC responded ….” the case listed below is not documentary qualified. If Post has available capacity, please provide it to KCC so that we can schedule documentary complete cases accordingly…” That was a shocker ! no explanation, why we are not DQ, resending files or correction request ? There are 3,4 e-mails exchanged with our IV department, and they didn’t explain anything. Can you explain it ? If I could somehow send you the docs, so that you can maybe find something we missed or did so wrong that this just happened.

I was never dealing with US immigration before and have been always coming in / out US on a regular visa basis. Now, with this whole DV thing, and thanks to you I got hooked. I’d never knew for Charles, Greg, Jeff, Curtis, Raphael or Aaron, and most of all I’d never be able to join the lawsuit if it wasn’t for this blog and videos.
I can tell you this – if my case is going to be among the preserved ones from upcoming JM’s order, and if I get my visa – then I’m taking the Cali Bar once I get there.

I’m 2021AF9k, DQ since December 2020: I live in country A, but country A has adjudicated only seven (7) DV2021. I wrote country B to accept my DV case for interview and they agreed, they told me to ask country A to transfer my case to them (country B).
But I’m confused, I have not been scheduled yet, the embassy in my country A is not prioritizing DVs. What can I do?

Why won’t someone from the KCC come forward and explain the whole situation with DV2021 in a normal and transparent way? I mean if it’s game over then it is game over, right? Why is it so hard for them to say that? Why are we fortunetelling the whole thing? Or forcing them to say something with all the legal mumbo-jumbo for that matter. You know, shouldn’t be so hard to say: “no more interviews for September, end of story. go home.”
