OK – I am going to be unavailable this whole weekend (three day weekend) so I am going to write up my thoughts and hopefully answer most questions. I will not be able to answer questions until Tuesday.
So what now for DV 2020 selectees.
OK – there are FIVE groups:
- People that had been issued visas but those visas expired.
- People on AP since having interviews earlier this year
- People who had interviews scheduled by KCC, but the interviews were cancelled
- People who got the ready for scheduling email.
- People that did not get the ready for scheduling email.
Group 1. You can get your visa re-issued, even if you are in the Schengen area. Contact your embassy and quote the judges order. You probably will need a new medical and will need to pay fees again. Don’t delay – you need to act fast. You should not need an interview so this should be easy for the embassy.
Group 2. If your case is now resolved (meaning whatever caused the AP delay is resolved) your case can now be approved. You will probably need a new medical to ensure the maximum visa validity. Contact the embassy asap and discuss the case with them. Do not waste time – now is the time to fight for your chance.
Group 3. Contact the embassy and see if they will schedule your case as an “emergency” or “mission critical” appointment. That is what Judge Mehta has ordered. You should make sure your medical is new.
Group 4. Having slept on this it strikes me there may be a chance for you. If you are in a country where the embassy is open and there are not that many winners there, I suggest you contact KCC and respectfully ask/demand that they forward your case to the embassy. This is outside of their normal procedure of scheduling, and they may not be able to do it – but if they will just send the case to the embassy, then it will be up to the embassy and yourself to get things arranged for the interview and the medical. It’s a chance. Quote the part of the order that I have quoted below. Judge Mehta has noted they behaved wrong and now need to do whatever they can to fix the problem in the last few weeks. Write to KCC and refer to the judges order – maybe some of you can make this happen.
Group 5. Other than cases where you are named, your chances of interview before the September 30th deadline is low. If there is an extension granted, it may only be covering the plaintiffs named on the various lawsuits. However, we will need to wait and see what Judge Mehta decides on the 25th.
In each case you should be prepared to refer to the lawsuit, and if needed provided a link to the order if an embassy does not know about it yet. The link is HERE
For those of you contacting the embassy or KCC, quote this part of the order that says they need to use “undertake good-faith efforts,” to “expeditiously process and adjudicate” your case by September 30th.
When contacting the embassies or KCC, you could use the following beginning of a letter with extracts from the court order.
Dear Sir/Madam,
As you should be aware on Friday September 4, Judge Mehta issued an order to the Department of State which directs the agencies such as DoS, KCC and the embassies to process and adjudicate DV2020 cases by the September 30th deadline. Judge Mehta has asked for a report of progress (including actions taken or not taken) for review on September 25th.
Additionally Judge Mehta found the following:
(1) the State Department’s policy of not reviewing and adjudicating non-exempt visas
is not in accordance with law, is in excess of statutory authority, and is arbitrary and capricious;
(2) the State Department’s non-processing of 2020 diversity visa applications constitutes agency
action unreasonably delayed; and (3) the State Department’s exclusion of 2020 diversity visa
applications from its guidance on mission critical services is arbitrary and capricious.He then ordered:
“Defendants shall undertake good-faith efforts, directly and through their designees, to expeditiously process and adjudicate DV-2020 diversity visa and derivative beneficiary applications and issue or reissue diversity and derivative beneficiary visas to eligible applicants by September 30, 2020”
Given this judgement from the Federal court, which has jurisdiction in these matters, I am contacting you to request your immediate cooperation so that my case can be adjudicated by the deadline and according to the order of the judge.
Suggested format for an email – add your own particular details and request according to your scenario (group) ALSO Include the link to the order.
For people named on the various lawsuits, contact your lawyers for more information – but you must realize they will be very busy so be patient. Those people should find their cases are rushed through whatever stage they are at, but again – your lawyer can advise.
About entry to the USA. The judges order explains that people will be subject to a ban on entry until January – so you could have the visa issued in September but could not travel until January. That is why you need a new medical to ensure the longest possible validity. HOWEVER, DoS might implement that differently because normally a valid visa means entry is allowed – so we will see if they choose to annotate these visas in a special way to control the entry period.
About closed embassies. For groups 1 and 2 no interview is needed. But for group 3, interviews should be possible even if the embassy is not fully open. Push the embassy for a mission critical/emergency interview as ordered by Judge Mehta.
For DV2021 cases
This MAY mean we can see some interviews scheduled in November and December. However, that is not 100% certain so wait and see. Having said that – we still have 9 months after December – so relax. Obviously DV2020 cases are the bigger concern right now because they have so little time. So please – hold your questions.

AILA chose 7 representatives from the winners to act as a class, so those 7 only will benefit from the priority from that particular lawsuit – but there are hundreds of cases on the other lawsuits.

But IOM ask for the interview appointment date to do the medical. So if embassy reschedule the interview date late September, I think we would not have enough time to do the medical. Thank you so much for everything and AILA for the great work that went through to have this judgement.
So just a quick one, am I correct in my reading of what you wrote as well after watching the video to understand that judge Mehta, did not disagree with the ban of “no entry in the USA”; which is, in my opinion, normal and kinder makes sense, specially as most countries has banned movements in and out of country due to the pandemic of Covid-19.
However, He condemns the fact that administration processing, for eg from KCC and Ambassy, shouldn’t have stopped on the reason of the ban.
Therefore that become unlawful and unfair to the DV 2020, and should be correct specially as the date limit of DV’s winners 2020 is the 30 September 2020 which is the end of fiscal year in the US!
Hence he urge the Trump administration to allow processing of the DV 2020 as soon as possible having in mind the time left.
Is my understanding correct.

If you check the internet you will find that everybody is covered by the order. The judge let a door open (25th september’s hearing) to see how things are developing. You better take action and start sending emails and make phone calls. It’s not over yet.

Even if you get a medical examination which is valid only for three months (due to additional check) on Sep 30 your visa will be valid until Dec 30.
So there is no chance to enter the US for those people. It is ridiculous.

you told me only those who participated in lawsuits and had made their case will make an exception and can make process their visa even after 30th of September. But judge Mehta should consider even for those who didn’t participated but were willing to enroll. However, due to their economical condition they ain’t participated.
And also judge Metha has seen that the government agencies didn’t do their job at the time being and at end when there is no time at all he gives order to resume the DV procedure with out any extension of time isn’t is unfair because people were doing and were willing to their part of job but here in the situation US agencies those which were mean to do their job fails to do their job.
Why lawyers doesn’t take this apart and sees that every body cannot afford even $500 is a fortune of money who earns $2.5 per day.

It looks like DV-2020 plaintiffs who reside in Europe (Schengen Area) may not be able to get their visas issued after all. Curtis has given his team’s interpretation of the order and, among the other things, he says the following:
“If you are in Schengen area country (Europe), it is unclear from the order whether State Department will still try to conflate “entry” and “visa issuance.” We just don’t know that yet. If they do conflate the two, that will be a problem, and then your only hope will be an extension of the deadline.”
Naturally, we need to wait and see how the State Department will interpret the order but that may take another week, so perhaps you could share your opinion about it.
Like, do you think it is very probable that the EU plaintiffs will be treated in such a different manner? And if so, do you think it may be possible to transfer one’s case to an embassy outside the Schengen area, let’s say to Russia or the UK or something, and have an interview conducted there?

Although your medical has not expired yet, it needs to be valid at the point of entry into the USA so it’s advisable for you to have a new medical done which will give you additional 6 months within which you can travel, should you receive your visa before 30th September 2020.
Email the embassy or give them a call and try and re-arrange your interview as soon as you can.

Hi Sir.
I am part of group 4 2020EU25xxx, interview in Frankfurt.
I have seen the last three 2NL (March, April, May) an between CN 15k-26k there are some kind of 15-20 cases that have interviews in Frankfurt and US Consulate in Frankfurt as I know is the biggest one on the World for Staff and operations and they are opened since 01/08.
So, I think if KCC can schedule me an interview, I can get my medical and interview in 2 weeks as I don’t need to renew any kind of document.
I am definitely going to send an email to KCC, and I think also I am going to join the new lawsuit to ask for extension.
What do you think?!

Im in group 4 regardless of the slim chance, but have my fingers crossed, received the scheduling for interview email on Jun 15, around 250 winners in my country, and on CEAC it shows they stopped at 10,000 after the EO. Many holes after 12K/15K and im at 23k.

I belong to group 1 , the embassy emailed me to prepare some documents to get a reissuance, but they also said that , the consular officer will interview me at the appointment ,
Am I going to get the visa reissued immediately?
Is it ok to be interviewed again ?
Does the order say that no interviews needed for Re-issuance?

If you are already represented by an attorney in the Mohammed v. Pompeo, Fonjong v. Trump, or Aker v. Trump lawsuits, please contact your attorney regarding next steps.
DV-2020 Selectees may now pursue their Diversity visas at their local consulates immediately. We recommend that you request an emergency visa appointment and ask to be treated as “mission critical.”
This is because on Friday, September 4, 2020, a federal court GRANTED our request for a preliminary injunction and blocked the State Department from refusing to process DV-2020 visa applications because of the April and June Presidential Proclamations. YOU DO NOT NEED TO JOIN A NEW LAWSUIT OR PAY AN ATTORNEY TOGET THE BENEFIT OF THE COURT’S ORDER. A copy of the Court’s order is available here.

Same here, got the email this morning.
We were current in March and received ready for scheduling email in March as well however, didn’t get the 2NL (we are group 4, EU22K living in UK, were living in US before and have a daughter with US passport)
1. As our case is still at KCC I am assuming we should only contact KCC?
2. Do you think it would still make sense to join the 3.0. or would a potential extension benefit us in any case?

I want to ask something, I haven’t gotten the conffirmation email, the one that says that all the required docs are the one they’ve been asking for. I also didn’t participate in any of the lawsuits. Dear Sir/ Madam,
Thank you for your email regarding the scheduling of a Diversity Immigrant Visa interview appointment.
Consistent with the court order in Gomez v. Trump, the Department of State is making a good-faith effort to adjudicate as many Diversity Visa applications as possible notwithstanding Presidential Proclamation 10014. Please note, however, the DV-2020 Program expires on September 30, 2020 and, in accordance with law, diversity visas may no longer be issued after that date. The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, we will not be able to adjudicate applications for all Diversity Visa selectees by that expiration date.
As ordered by the court, we are prioritizing individual named plaintiffs in the court case Gomez v. Trump and its companion cases who are applying for Diversity Visas. Beyond that, we have established priorities based on statutory standards and categories of cases most likely to result in timely issuances for eligible applicants. Accordingly, we are prioritizing applicants who have already been interviewed and who either have been determined eligible for a visa or may be determined eligible for a visa with additional information. We will also prioritize applicants with appointments that were cancelled in March, April, or May due to the COVID-19 pandemic and worldwide suspension of routine processing. Diversity Visa Selectees who have heard from the Kentucky Consular Center (KCC) that they are documentarily qualified, but awaiting an interview date, will be scheduled in accordance with their rank order and post’s capacity, consistent with our standard processes.
